Did he forge any certificate? Thought it's a case of misspelling.
Oluchukwu and Oluchi is same thing but in legal terms..?
Chukwudi and Chidi is same thing.
Nkiruka and Nkiru
OluwaSeyi and Seyi
Chukwuma and Chima
Anayo & Anayochukwu.
I have also heard of Muhammad and Muhammed and Muhammadu
Etc etc etc.. the list and names are endless.
So if Supreme accepted Buhari names as it is, why did they then reject the other.
Well, they may have their reasons.
Look, we shouldn't copy paste white man's constitution without looking at our culture and traditions first.
This copy and paste constitution is the biggest problem we have as a diverse nation.
Granted that he changed his names, did he have a court affidavit to back it up?

The Law is not a Paradigm of Perfection, so in most cases I am above laws because laws are designed by people and if the people are imperfect, the laws they promulgate will be imperfect.

So your rationale about Law is not tenable to characters like me. I am about what should be, and not about the paper tigers you call laws in your Nigeria.

Are you surprise about the decadence in the society when you are suspending the cerebral faculties and engaging in sentimental brouhaha?

Please dont sound dumb, cos I don't think you are.
Ok oo Mrs I am above the law... Whatever makes you feel good.

Guy,electoral laws are meant to better our elections and enthrone a true winner.morally the right thing to have done is to punish the forger alone or allow the party bring another candidate since the party was voted for.if you are punishing the party, why not punish inec along
Morally that’s the right thing to do but constitutionally, that’s not the right thing to do. We can’t sacrifice the constitutional legality on the alter of morality. If we must do that, let’s throw away the constitution entirely.

First of all, it is NOT sentiment. And if Justice is blind, then it is not justice because Justice is not supposed to be blind, but Justice is supposed to be about Truth.

Truth that it is the Responsibility of INEC to vet and verify Certificates, and not the Governorship Candidate, in fact an individual needs legal permit to verify another person's credentials in Educational Institution and must show cause before court or police grants you a warrant to initiate such case.

So you can see it is the prerogative of INEC to vet, verify and approve a Candidate, but if INEC failed to do their job, a Justice system is supposed to revert back to INEC with their observation and then INEC will launch an investigation and take blame for their inactions and then we can begin to either plan a new election or assign the winner a new person to deputize. That is a legally tenable negotiation process in a system that Governance is for the people.

Because majority of the 'People' in Democracy voted for a particular party and a particular candidate based on their salesmanship, their manifesto and the content of Character.

Now Supreme Court has become a Cash and Carry Cabal, very silly people think they are.
What are you even talking about? Which legally tenable how? Quote the section of the constitution that supports your interpretation? .... The law is what it is whether you like it not. When you have a deputy that doesn’t meet requirements, it means you don’t have a deputy and the constitution states that you must have a deputy. So next time don’t forge result and make sure your mate doesn’t too so that the law won’t bite you in the ass later.

I agree with you.though the letter of the law was followed in isolation,it wasn't followed in spirit.they was no community or compound reading.judgments should be given in tandem with who the masses voted
Judgment should be universal not selective. When you start given judgment based on what the masses like, then it’s no more judgment but compensation.

It appears here that the deputy governorship candidate derives his legitimacy leaning more on the governorship candidate. The governorship candidate among other qualifications only gets legitimacy when he nominates a running mate. In my own opinion, in essence, should the deputy governorship candidate fall short of the qualification for the office, he should solely pay the price.
Well, its just a mere opinion of mine.
When the deputy governorship candidate falls short of the qualification for the office, it means the governorship candidate does not have a running mate which makes him fall short of the qualification for the office too.

The Court has no right to sack him due to negligence of INEC.

It is INEC's job to vet and verify all Creddentials before approving Candidates and their Running Mates. So is the purpose of INEC if they can not actually have a mechanism of credentials verification?

What is the basis of approval of candidature without credibility evaluation process?

I think the recent events from Supreme Court will lead the country to more chaos as it is. The truth is that the mass of the people voted for a particular candidate who had a manifesto they loved, now Supreme Court is by their actions enthroning unpopular manifestos.

Election was designed to be the Peoples' Choice. Now is it the peoples' Choice? Hell no!

This is Cash and Carry Politics and we all know it but keep supporting it. What you find, you get and Nigeria is getting closer to what she deserves - chaos.
I understand your sentiment but Justice is blind, objective and factual. That INEC failed in her duty or that Lyon wasn’t aware the deputy forged result is not an excuse because in law, ignorance is not an excuse so, suck it up because it’s what it is... LAW.

It is not legally admissible to fault the Governor on fake credentials of the Deputy, it is solely the responsibility of INEC to vet and verify those Certificates before approving any nominated Candidate prior to election after verifying and confirming the credentials.

INEC can not specify the Certificate Requirement of an Office, but refuses to Verify those same documents BEFORE approving the Candidate for Position.

My personal submission is that even as it is, it is only the Deputy that is supposed to be disqualified and not the Governor if his own documents are good.

Besides, how come Supreme Court Judges are focused on Governors and not the President who is clearly very uneducated?

This country is not a home for sane minds, I think Nnamdi Kanu is right. These things can only happen in zoos, and I must apologize for the animals to even naming this a zoo. Animals are more clever than the Supreme Court judges in this case.
The law is very clear on this. You cannot contest for a governor without a running mate. In this, APC candidate does not have a running mate, that’s why the court sacked him.

The judgement is flawed because the deputy governor wasn't standing election on a standalone basis and so his qualification shouldn't affect that of the main candidate. If in the case of the running mate to the late governor-elect of Kogi State was not allowed to take over the mandate because he wasn't a sworn-in yet before the death occured, then I see no reason why this should hold. Buh .....this is Nigeria, the result of this wahala will have a lot of input to the Imo State wahala at the Supreme court.....abeg na dem wahala cheesy
The Governor-elect was sacked because he doesn’t have a running mate.

Yes,but that doesn't say if your deputy committed an offence, they should sacked his principal. It doesn't make sense at all and bad precedent for our justice system.
When you have a deputy/running mate that doesn’t meet the requirements to contest, it means you don’t have a deputy.

I don't understand the judgement.

Was David Lyon disqualified because his deputy presented a false information INEC on his behalf? Or on behalf of the deputy himself.

Cuz the law cannot punish David Lyon on the travails of his Deputy.

Some thing is not panning out.
Go and study the constitution very well. They are on a joint ticket so, whatever affects one, affects the other. The law states that you must have a deputy before you can contest for governorship election. So when you have a deputy with fake result, it makes him unqualified which in turn means that you don’t have a deputy. What is hard for you to understand?

The reason for the disqualification seems lame. If it is a genuine reason, I am sure many present-day governors will lose their seat if background checks were carried out on their deputies.
Result forgery is not lame. Our politicians are very unserious because I see no reason why they can’t get a simple genuine o’level result. Always trying to cut corners, that’s why the whole country is a shithole.

Wrong judgment.
Even though i'm more aligned with the PDP this judgment is wrong. Same as that of Imo state.

The supreme court should have allowed Lyon to be sworn in and disqualified his deputy. Lyon would then pick another deputy. The people of Bayelsa voted for Lyon, not his deputy.
The law is very clear on that, no sentiments. You must have a deputy for you to contest. And when you presented an unqualified deputy, it’s as good as you don’t have any.. very simple and clear.

If deputy and governors actually have the same ticket, why then was Faleke not sworn in as Governor in Kogi State after the death of abdulsalam?
Why was Bello brought into the fold?
Because Faleke didn’t participate in the primaries. The law is very clear on that, no sentiments.

Sultan5:
Lol most people here are ignorant about the going ons in Syria. In case you didn't know Turkish forces have been in Syria since 2016. Both countries have no love for one another. This isn't about fair or who has the right to dictate any thing. This is bad blood. The only reason Turkey is showing some level of restraints against Syria forces is because of Russia. They don't want wahala with Russia. If not Turkey would have Syrian forces on the run in their own country.

The Turkish president even said this some months back that, Turkish forces are there to remove the Syrian president from power. Although he later retracted his statements. Turkey have supported the free Syria army from day 1 of this conflict.

For the Idlib situation, as bullshit an excuse you may think it is. Doesn't change the facts that Turkey don't want anymore refugees in their country. Infact recent polls have shown that Turkish citizen want the current refugees in their country to return to Syria dispite the war there. Turkey has created a safe zone in Syria. Something the US refused to support because they don't want to be in open conflict with Syria forces. But as I have stated earlier, the Turks aren't afraid of open conflict with Syria forces.

But they did this so Syrians will have a safe place where they can stay within their own country. Since their own government could care less about their safety. And with the mounting flow of refugees into Turkey. This wasn't a bad idea even the Germans supported it. But the Turks have their own craze for head too.

So the point is, this isn't about fair or whatever. These are two countries who are ready to have a go at each other. Russia and Iran are the countries trying to avoid escalation. The US self don tire for Turkey matter since they started attacking US backed Kurdish fighters.
Listen to your own words, does that sound good to you? Turkey with US (Obama Administration) started war in Syria by arming Free Syria Army (which later metamorphosed to ISIS)to fight Syrian government and the resultant effect is what they are experiencing today. Turkey helped in creating the Syria refugees situation so, they should deal with it. My take is that Turkey shouldn’t be in Syria territory except they want to help Syria army in fighting the rebel’s/ISIS. Let the Syria army with Russia’s support continue pushing them till they leave the country.

That’s some bulshit excuse. If they don’t want refugees in their country, they should be at the the border within their own territory and not in Syria’s territory while dictating where Syria’s army should be.

What is Turkish military doing in Syria? Why are they fighting the Syrian army in Syria’s territory? Same way French military are supporting and arming rebels in Libya.
