If you report immediately, there is ample chance that forensics will identify the DNA, (hair strands, semen, juice, e.t.c) of the rapist and use it to prosecute him or her. DONSMITH123:Buhari contested and won the 2015 election, based ON THE PROMISE OF SECURITY FOR ALL, including fighting corruption. Today, hardly do you go by in 24hrs, without hearing that Fulani herdsmen have again, KILLED CITIZENS of the middle belt, especially in a particular one or two local Govt area of benue! These herdsmen have focused on this Fertile Benue valley and want to genocidally drive away the people (Tivs, Junkuns, ..) from their ancestral home. Buhari has ordered the I.G to relocate to that state, which he refused to comply with and the killings have also continued unabated. We have the Police, the Army, Airforce, naval Force, DSS, Nigerian Self Defence, e.t.c. Is it that all these security forces, (headed mostly by the same Muslim Fulanis/Northerners), being paid from the sweat of Nigerians and their tax, CANT DO THEIR DUTY OF PROTECTING Nigerians in those places ...or is it that a section of them get INSTRUCTIONS FROM THEIR BOSS, who in-turn is acting on 'body language' INSTRUCTION from Mr. President, to allow these citizens to continue to be lsaughtered? Even as of today, the Governor of Benue state Ortom, has just ENDORSED BUAHRi for a second term! What good did this Gov. Ortom see in Buhari, on behalf of his people, for such endorsement? One must also wonder what still remains for IMPEACHMENT PROCEEDINGS to be instituted against the President, who obviously have FAILED IN ONE OF HIS CORE RESPONSIBILITIES of PROTECTING the lives of all Nigerians? WHat are they waiting for? One can also ask: Why is it that the Nigeria Police and the Nigerian Army have been able to succesfully disarm the people being attacked (taking away their protection while they, the security forces, still refuse or fail to protect them) BUT HAVE FALED to DISARM THE ATTACKERS? Does all these not point to one thing: CONSPITACY AT THE HIGHEST LEVEL, to drive away the People of Benue from their fertile lands and the people of Taraba and Nasarawa (all states that have passed the Anti-open grazing Bill into law) so as to create a grazing root and fertile land/hub in the beneue valley, for the same 'terrorist' FULANI Herdsmen? As someone who supported Buhari and voted for him in 2015 (while canvassing for him as well even though l expect nothing in return other than Good Governance), l am utterly disappointed in him and will, with the same energy used in 2015, canvass for other person to be President of Nigeria in 2019. Now, this is not me advocating for the same rogues that we drove out in 2015 (PDP) to come back. it is me seeking for an "alternative" tot he "mistake and menace" called Buhari, while ensuring that the PDP wolves are kept at bay at the same time. Can any of the other remaining sixty-something parties put forward a CREDIBLE CANDIDATE, so Nigerians can have a choice? Cutting-off electricity or any other utility for that matter or such similar action, in order to forcefully eject a tenant is unlawful.... it is stated in black and white in section 44 of the tenancy Act 2013 (amended) so l wont advice that at all. That 'initial receipt and agreement' is enough evidence that they rented the place from him. FYI, Rent agreement can even be 'verbal', where no written documentation is made! And please, stop making all these 'assumptions and generalisations' on behalf of the Op, he knows best what transpired between them, all you need to do is just advice, based on what is lawful. |

I read every one of the comments here and it saddens me that these are the kind of response one would get from the "average Nigerian"! Nothing cerebral at all, just a couple of time-wasting suggestions that have no bearing on the issue in discuss. There is a Tenancy Act 2013 (as amended), in operation in the state. I want you to download it AND READ IT. There is a particular section that deals with 'sub-letting' I would have just written the applicable areas here for you (I have done that in the past, on similar Tenancy issues) but l think l want to encourage you and others to at least know the laws that guide all of us (Tenants and Landlords) so that when we act, we do so within the ambits of the law. I am also worried that you say you have rented a place for almost five years, without tenancy agreement! Please, even if you are renting from your parents (as long as money is exchanging hands), it a 'contractual arrangement' and should be documented...... for 'unforseen' situations like this. As a form of heads-up for you, read section 14, 15 and 44 -Sub 3b properly. There are two ways to go about this: 1- Go to the nearest magistrate court to you and ask to be given form TL4 (Seven (7) days notice of intention to recover possesion) and post it on their doors,if they refuse to collect it (take proper pictures/vidoe on your phone, that will prove beyond any reasonable doubt, that the Notices were duely pasted or tip a baillif to do so for you). This is what your 'Lawyer' should have done for you. After the expiry of the 7-days Notice, you go back to court to ask for an order of court to give you a Bailiff to forcefully open the door and remove the contents, while being issued with a Warrant for possession Certificate TL10. It should not take more than one month, if your Lawyer is not working against you, since you dont seem to have the time to do it yourself. (Be 'nice' to the court registrar as well )2.) if there was no written agreement between You and these occupants or any proof of tenancy, in law, they are called "Licenses" and they are simply living there ar your pleasure (note that l said "if" ). Since you are on good terms with the Landlord's agent, let him write you that they notice that there are "unknown people SQUATTING in your flat" and that those people should leave the place. You then write him back that they do not live there but just asked that they "squat there for a few weeks" and you have asked them to leave. Since they are Licenses, they are not protected under the law, like "legal tenants". Change the entrance and inside door locks immediately. (If they attempt to break it, just ensure you film them doing so, dont even fight them! Evidence is very important at this stage) You simply tip some security force (military preferable), open their door and throw their things out, then Report them at the nearest Police station for TRESSPASSING into your Flat (never agree that they are renting from you....always maintain they are just squatting with you). It is now left for them to prove that they have a "legally enforceable tencancy" with you or in that Flat. They can go to court but you will eventaully win, Since it appears that they are "troublesome and capable of violence", you will need the protection of a secuirty agent to deal with any violence they may want ot perpetuate, once they notice that their load has been thrown outside .... but you come across as a soft person and l am not sure yo u have the liver for this. .My two cents |
