I think INEC has nothing to lose by not putting a robust defense, if they rely on PDP witnesse , i smell trouble for APC except they make a good case.

They will do that by writing submission. That's not require witness. They will rely on Atiku witnesses that election was manually collated and server is alien to our laws. The other aspect raised by petitioner didn't concern INEC.

in Nigeria what governs admissibility of evidence is relevance. So if it is relevant, it is admissible. ..

Any document not authenticated by electoral authority is not admissible as legitimate record.

Is the record in Atiku's possession authentic?

I never went to law school but is obvious to see that that Atiku's case can be punctured using technicalities to test its validity.

Many testify to transmitting the result not just one witness and the particular witness said the code was in his phone if needed.

The issue of server and transmission of results have been materially proved.

Inec/apc said they will argue on the side of law during their defense. That simply tells you they know server existence is done and sealed.

The good thing is, inec doesn't need any law expressly to transmit result to its server. It is an administrative procedure.

We are having an interesting case at hand.

Dont mind the kids typing rubbish.The case is a simple one.Atiku said there is a server INEC said there is none.Atiku applies to inspect servers and govt organization INEC refused.Issues were joined and so based on law if issues are joined application will not be granted.Under the irrebutable presumption section of the evidence act,if you withhold or refuse to release evidence the law deems it that the evidence is not favorable to you particularly in a civil case where the court looks at preponderance of evidence.Olanipekun wanted to cross examine the server expert on information within a server that is outside his custody which he smartly declined.This is what will be covered in the final address after the defense open and close their case.Dont mind all these fake and APC sponsored journalism meant for ignorant and lazy youths and people who had never to the courtroom

can be a combination of both.
