With the issues in the Niger Delta, it is better to invest in Hydro or coal plants. This will eventually be built and will be useless just like 70 others which are currently giving Fashola headache because of the dependency on peace in the Niger Delta. |

If NLC embarks on this strike they will be the most insensitive and foolish leadership of the congress so far. How much can a government worker who earns N36000 a month (twice the minimum wage) gather to stockpile food items on the 16th of May. When most workers are already looking up for the next wage. Considering the current prices of food prices this is a DOA protest. All the people who could have sponsered it are hiding from the long arms of the law. Well some will call it witch-hunting. |
Nigerians! Nigerians!! Nigerians!!! These are the problem of this country. The land is blessed but majority of the people are still suffering from the curse of worshipping Idols and so are pulling the country back. Let us make efforts to love this nation for atleast a year and see what difference this will make. It will be nice if some of the analysis that were made in 2012 are played back so that people with objective minds can see that this decision though difficult could be a destiny changer for Nigeria if the right questions are asked and the right laws and institutions put in place. |

Most Nigerians do not have a full of deep understanding of things they try to criticize in governance. All that one needs to do most times to understand what is being suggested is to ask few questions; 1. Who made the statement? Minister for Information, CULTURE AND TOURISM. 2. What was he trying to project? CULTURE and TOURISM has the potential to create employment. Employment is not necessarily a white collar job. He has not said the job will be for everyone. Most Nigerians celebrate the Calabar festival as a feat but are failing to understand the subtle idea in what was being projected by the minister. Let us learn to debate issues without resulting to abusing each other. This is the way to change our society. |
Nigeria's major problem is that she has only a few true lovers. Notwithstanding the present challenges, 1 year down the line this Government is one of the best Nigeria has had in recent times. The major strength of this administration is its doggedness willing to stick to their chosen path despite the initial rough patches. People compare eggs and carrots in a bid to discredit this government but then for the discerning and objective mind the mischief is clearly spotted. People say OBJ managed the economy better at $38 per barrel but did he inherit a wage bill similar to what the current administration inherited. The inheritance left by GEJ: 1. less than 3000MW of Electricity. 2. less than $30BN in Foreign reserve. 3. Over 2 Trillion in various debts. 4. A weak military force. Among other things. This government will succeed to the joy of her supporter and to the shame of the enemies of the Nigerian state. The APC template in Lagos is mostly viewed as not perfect but a fair deal. Most times at least 53% of the people are happy with the APC Led government and this 53% they will still get come 2019. So safe to say Buhari might still be your president till 2023. |

I was doing a personal research into Land Titles and discovered this beautiful piece written in Jun 13, 2014 by : Pastor Olatayo Beckley LLB, BL, ACIS, ACIARB, MIOD Lawyer, Chartered Secretary, Tax Expert, & Arbitrator based in Lagos Nigeria. I decided to post it to educate the forum and have our legal minds buttress and explain further the points that have been made. Our amiable Omonile Lawyer of the forum has been quiet recently though. Seems he is getting tired of omonile cases and looking at the more juicy cases from politician. ![]() @Lawyer over to you. About a month ago, I stumbled upon a discussion by some people (who are not legal minds) on the issue of legal title over land and they all concluded that the highest and safest form of legal title over landed properties in Nigeria is the one conferred by the Certificate of Occupancy issued by the government. They safely gave this conclusion on the fact that the Land Use Act of 1978 (the main legislation on real estate in Nigeria) has transferred the ownership of all lands to the government and it is the government that can pass such ownership title in respect of land to individuals and corporate entities via the certificate of occupancy. I then intruded into their discussion and informed them that this is not the position of the law. The law actually recognizes five types of legal land ownership in Nigeria and the certificate of occupancy is just one of them. In fact, there are many instances where the court has nullified a certificate of occupancy where the root of title is not found in one of the types of legal ownership recognized by the law. Thankfully on Wednesday the 9 of June 2014, the Honorable High Court sitting at Ota Ogun State awarded judgment in favour of my clients in respect of a vast expanse of land in Ogun State where the information I passed to the discussants above was further highlighted and reiterated. I will therefore highlight these five types of legal ownership for the purpose of informing Nigerians and non Nigerians on this position of the law because I believe that information is power. The Supreme Court in the case of ELEGUSHI V OSENI (2005) 14 NWLR (PT 945) AT 348 aptly stated the five types of legal land ownership in Nigeria and they are as follows 1, By traditional evidence. 2. By acts of Ownership extending over a sufficient length of time which acts are numerous and positive enough to warrant the inference that they are owners 3. By acts of long possession and enjoyment of the land in dispute 4. By the production of the documents of title which must be authenticated 5 By proof of possession of connected or adjacent land in circumstances rendering it probable that the owners of such connected or adjacent land would in addition be the owners of the land in dispute. I will try and explain each of these types of ownership: 1, BY TRADITIONAL EVIDENCE. The Nigerian law first and foremost gives recognition to traditional or customary land ownership notwithstanding the Land Use Act. This means in effect that people who have “founded” and “settled” on land over the years in the olden days are deemed to be the owners of such land. Consequently the title of traditional land owners is legal, proper and genuine. They need not have certificate of occupancy to prove their land ownership 2 BY ACTS OF OWNERSHIP EXTENDING OVER A SUFFICIENT LENGTH OF TIME WHICH ACTS ARE NUMEROUS AND POSITIVE ENOUGH TO WARRANT THE INFERENCE THAT THEY ARE OWNERS. The Nigerian law also gives legal ownership over land to people who cannot by positive traditional evidence show how they “founded” or “settled” on the said land if they can show that they and their ancestors have lived on the land for years without being challenged. 3, BY ACTS OF LONG POSSESSION AND ENJOYMENT OF THE LAND IN DISPUTE. Where the land owner cannot prove their land ownership by positive traditional evidence or show that their enjoyment of the land is not challenged or controverted , but if they can show that their adversaries in respect of the land have failed to take positive legal steps to “wrestle” the ownership land in dispute from them over a long period of time, they will then be deemed to have legal ownership of the said land BY THE PRODUCTION OF THE DOCUMENTS OF TITLE WHICH MUST BE AUTHENTICATED: This cover all instances of formal land documents which will include the certificate of occupancy and other documents issued by the government It is very important that such documents of title must be premised and authenticated upon the earlier mentioned roots of title. Consequently, a mere certificate of occupancy will not confer legal ownership if it can be shown that the root of title is defective. A certificate of occupancy procured through fraud and misrepresentation will be set aside and considered to be of no legal effect whatsoever. It is therefore very important that all prospective purchasers, investors or dealers in respect of real estate or landed properties must conduct investigation and ensure that the root of title of such documents of title is good, proper and founded on other evidences of title ownership before any reliance can be placed on them BY PROOF OF POSSESSION OF CONNECTED OR ADJACENT LAND IN CIRCUMSTANCES RENDERING IT PROBABLE THAT THE OWNERS OF SUCH CONNECTED OR ADJACENT LAND WOULD IN ADDITION BE THE OWNERS OF THE LAND IN DISPUTE.: This would probably occur where there is no dispute that a particular vast expanse belongs to a particular persons or persons. Such persons would also be deemed to be owners of smaller surrounding parcels of land if there is no other evidence to the contrary It is therefore very important that all investors and dealers of real estate in Nigeria should arm themselves with this piece of information in order to protect their investment. He expects us to show some understanding but communication is very important if that will happen. I think his advisers around media need to improve and encourage him to speak more to Nigerians. The truth is the Federal Government should even be more adamant because of the threat. Submitting to Iran will weaken our the government of the day and will embolden any militant group that has international affiliates. If Iran is so concerned about the Shites in Nigeria they should invest massively in educating them, so that they know how to respect constituted authority where ever they find themselves. Iran has not been of great help to the Shites in Nigeria else I expected that most of their followers would have been empowered with sound education, Zaria should have been honoured with one of the best hospitals built by the Iran sponsored Shites for their followers in the state. They would have helped them to such a level that their schools would be listed as one of the best in the country. But what is people who have become a burden on the Nigerian state and yet choose not to respect constituted authorities. Let Iran relax as they have not contributed anything massively meaningful to Nigeria and by Nigeria I refer to the benefit of their Nigerian followers. |
@gists I don't know what you are driving at but just a few points. 1. The NA have a standing mandate to deal decisively with anyone perceived to be an enemy of the state both internally and externally especially people who take up arms. It would be fool hardy for soldiers to run into an armed robbery scene and claim that it is the job of policemen to deal with that leaving the citizens at the mercy of the robbers until policemen arrive. Ofcourse, this will be termed an internal aggression and dealt with decisively. 2. The NA stretched out the olive branch twice by choosing to dialogue with the sect members first at the roadblock and later when then went to effect some arrests at the sect leader's home. 3. What would have happened to ordinary citizens at the road block mounted by the sect members? The would have been denied access to that road because some people stronger than them were on a religious procession and were not willing to allow any other person access. In all let's not forget the foundation of freedom - "Your right to stretch your hand freely ends where my right to defend my nose starts " |
