While Breach of contract is different from Fraud, Fraud in any part of the world (including Nigeria) is "deceit, trickery, sharp practice, or breach of confidence, perpetrated for profit or to gain some unfair or dishonest advantage." This is a simple definition of fraud; check your dictionary.

This is what the OP, gaylord, posted. I responded with his post (and Timothy’s post) in mind:
More than 20 times during this period  I have been told by Mr German that this car has sailed with different  dates given to me as the time of arrival but nothing has surfaced.

At this present period, (maybe later but  lets see how this thread goes ) I don’t want to go into nitty gritty of what has been happening over the last five months but I wish  to appeal to Nairalanders especially  people in the pre order biz to help persuade Mr German to come out clean and explain what is going on with this transaction

The last information I heard was that this ride left American waters on the 31st of Dec but up till this time no BOL has been issued by the so called  shipper in States …, haba I think BOL should be a thing issued within three days once the vessel sails ??

Now, I'm not calling anyone a criminal however if what Gaylord posted is true, then that’s pure deceit and that’s fraudulent. If a dealer knows he cannot deliver a vehicle in 3wks and proposes to his client that he can, he is fraudulent. If a dealer knows that there is (going) to be an issue with delivery and refuses to disclose it in a timely manner, then he is fraudulent. If a dealer knows a car is rebuilt and passes it on as a non-accidented car to the end-user without disclosing it, he/she is fraudulent. All these are also breaches of contract.

Inspired, I quite agree with most of what you posted. It's usually not a good thing when a client comes online to a public forum to express his displeasure. There are several transactions I have refused to go ahead with by just “googling” a company’s name or checking their ratings on the BBB. Does that mean they do not run a legit business? No. It only means they do not stand by their word. Flip this the other way; A buyer deposits N2mil for a vehicle to pay a balance of N3mil upon delivery. You the seller delivers the vehicle on time and the buyer does not meet his obligation to pay on time; let’s say he pays you the remaining N3mil in 4mths time meanwhile, you could not sell the vehicle within that 4mth period and your close to N3mil is tied up, what would you do? Now assume you gave the buyer the vehicle the day you cleared it from the port and he told you he’d deposit the money the next day; then the next week and tells you that for 3mths, will you have the patience? Will you be willing to do business again with the buyer? Be honest. What if the situation was beyond the buyer’s control, will that make a difference to you?

Like I posted earlier, German seems like a decent chap. I do not think his initial intention was to have these transactions go this way. And I am in no way trying to castigate him. I just think when things start going south, as a dealer you need to control it. I think he (and other dealers) should be straight and open about the process and impending delays; this way, you avoid situations like these. Here, he dropped the ball. I’m glad he seems to have picked it up and I hope he continues to hold onto it because he seems to be doing a lot of things right; perhaps, I may patronize him down the road, who knows.

I find it odd that some of you (just like you have done, Inspired) are quick to dismiss a complaint simply because a seller has shown a receipt and BOL. So, what is a fraudulent case to you? Just curious? Is it only when that the seller absconds with the buyer's money or does it include a seller not meeting his commitments (timeline, specs, etc)? The fact that good customer service is non-existent in Nigeria, does not mean it is right.

In my case (as posted above), if the seller had informed me about the port situation, I'd have made a more informed decision. It was after I paid him in full and enquired a couple weeks later when the vehicle ought to have sailed, that he told me he had another vehicle that had been stuck in the port for three months; so my case is unusual and I should relax. WTH?  This was money I could have used to do other business; God knows I would have probably doubled the money I gave to the seller in 3mths; that's opportunity cost right there and I was the loser. Economic profits-wise, I was a bigger loser. To me, that's fraud. So, in the pre-order business, what risks does the seller assume? In your world, none, I guess since he/she can show a receipt and BOL. I ended up purchasing another vehicle from Cosharis in Lagos so as to meet my "suprise" commitment to my mother. I'm sure buyers who go the pre-order route know what to do with their money; they are definitely not looking for a pseudo-bank to keep it for 4-5mths. This is no different from a seller telling the buyer he can provide a 2010 Acura and he brings a 2007 Beemer and expects the buyer to be content. I know some of you mean well, and this German chap seems like a decent chap however, measure your customer's expectations and keep them happy. It's obviously better to exceed your client's expectation; in business, screwups happen all the time, sometimes they are beyond your control. When they happen, be ready to go out of your way and cut deals that will keep your client happy and at ease; sometimes, you'd lose (the margins are pretty tight, I know), but that's the risk you have to take on as a dealer who asks for money upfront. Sometimes, simple phonecalls, emails and being straightforward does wonders. It's funny both seller (German) and buyer (gaylord) seem to be based in Nigeria; long before this happens, if I were in German's shoes, I'd have flown/driven to meet gaylord and had a chat with him over some drinks/meal just to make him feel at ease that I'm not posting him. I'm not telling anyone how to run their business but in the service industry, customer intimacy is prime. This epistle is to all dealers, not necessarily German007.

In Most cases, they were mostly caused by miscommunication / Logistics issues from Seller to Buyer and the issues were/are being resolved amicably.

There has so Far been No Fraudulent Case reported till date.

I Would Implore you to Keep your Customers Abreast about True Situation of their Consignments at all times, Date Changes, Port Back Logs, Vessel Delays, etc,  are circumstances Beyond your Control.

As Suggested earlier, if the Problem Lies with your Shippers or Freight Forwarders, We can recommend Up to Par Freight Forwarders/Shippers That knows their Onions.

Life is a Learning Process.

Going by the email from the Shipper, The Vessel departs American Waters today and the Issuance of the BOL Should Put this matter to rest.

Since the commencement of this thread, I have been in touch with Gaylord Via emails as regards this matter and I have assured him everything would be fine.

If there are any other issues as regards the vessel or this Vehicle in General, you may either send an email to Monitor_1 or my Humble Self.

I'm not pointing fingers but this is just my advice. I was in the auto business before Nairaland was established. I have since moved on to other bigger things; however, it's obvious that in this business of importation/exportation, there are some delays which you cannot control as a dealer. This is the reason why you have to keep your customer informed from day one. It's true that if you tell customers that they'd get their vehicles after 5mths, you'd likely not get their patronage. So it's common to see auto dealers or Nigerian importers give optimistic (or less realistic) dates. On the average, these dates are likely not met. Regardless, you cannot keep your customer in the dark.

My experience on NL in 2008 made me abandon this auto section for a while. I closed my US Adesa Auction account in 2006 to concentrate on other businesses. However, in 2008, I wanted to suprise my mum for her birthday who had just relocated to Nigeria with a vehicle. I was/am familiar the whole process and I contacted a dealer on NL. I spoke with him a few times and he guaranteed a 30day delivery (I did not force him). He gave me a fair price for an '07 Murano and I went to Baltimore to give him a money order (paid in full). This occured in mid March '08 and the vehicle did not sail till June. My mum's bday was in May. Most times (if not all), I initiated the call and I remember telling the dude why he did not keep me updated. His response was "if you did not hear anything from me, nothing has changed". How the hell do you think I'd feel? You didnt deliver on your promise and then you cannot even spare 2mins every week to make me feel aight? I mean, I paid in full. Funny enough, he yelled at me on the phone and hung up on me. I just ignored him and started contacting the freightforwarder directly and when the vehicle sailed, I was the one who informed him to go pick up the BOL and DHL it to my agent in Lagos asap. My money could have been chilling in the bank collecting some interest, no matter how small. Yeah, that period, the ports in the East Coast were facing challenges and I was not expecting him to be a miracle worker but I expected him to be a sales man; someone that I can recommend. Yeah, I eventually got the vehicle but never recommended him to anyone. I remember calling Jenju after the episode to ask if that's how he operated his business. To keep my sanity, I reopened my account and I now purchase directly from the auctions or any dealer whenever I (or a sibling/relative/friend) want a vehicle. I was ready to pay someone to do the logistics for me cos I did not have the time but with all the headache of the first order, I did not see any point paying someone else to make phonecalls for me. Since 2008, I have purchased and shipped over 60 vehicles and trucks from the US; now, that's business that the dude would have had if he played his cards right.

I read Timothy's thread few mins ago (the other Honda Accord delay); I sympathise with him and from my understanding, you did not keep him abreast. One thing some of you dealers need to come to terms with is that there is a time value of money. If I wanted to preorder a vehicle in Sept and you give me some sort of assurance that you can deliver before Christmas when I'd be in Nigeria, then you missing that date (no matter the logistics screwup) is a breach of contract. No two way about it. The onus is on you to pacify the client. Different folks react differently. Some may keep quiet while others may come to NL to vent their anger and frustration. Yeah, when they get the vehicle they'd be happy but the happiness may just be relief.

So to German, I've seen a few of your threads and you seem like a decent chap. Brush up a little and build a reputation of competency. Goodluck and I hope you make this client (and others) happy.

Some colleges are good. All pple have to do is look for reputable courses that have been approved, accreditted, tested and proven to be qualitative and sought after. For example, Lambton College as a whole is not all that but the ITP programs has a lot of job prospects and its respected by even Microsoft and Google these are major players in the IT industry. Seneca college is good too likewise some institutes of technology. I know you love quality likewise me but when u dont get into the best, you improvise & get into the best program in a better inst so stop disliking colleges.

I never said colleges were not good. They are for a different market segment. If an individual residing in Canada (a PR or Citizen - perhaps a new immigrant or high school grad), paying minimal fees, then it only makes sense to go do a program that can get him/her into the workforce and a college will do just that. It's advantageous as the individual does not rack up unnecessary debt/costs. However, an individual coming from Nigeria, paying higher international fees, higher cost of living, etc; assuming the person is not able to establish him/herself in Canada and has to relocate to Nigeria after the program, of what use is such a program in the Nigerian context?

Hmmmm 7 days return ticket but you plan to stay more than 7 days. I'm sure you realise that you cannot get these drugs off the shelf in the US and you'd need a doctor's prescription to get them in the US. So, if you are just carrying drugs for 7days, make sure you budget for more in the US. Healthcare in the US na real empire, not cheap at all. Goodluck and I hope everything works out well for you.

I'm guessing you are talking about an M.ASc in Pet. Engineering. These M.ASc positions are very competitive. Have you tried the M.Eng route? The M.Eng programs are usually one year and they are less competitive. Go to www.aucc.ca and go thru the list. The application window is closing really fast.

I do not think it's a biggie. Infact, they may not even ask unless they search you. And even if they do, you do not have to go into details. They are drugs prescribed by your doctor. They usually have their doctor at the port, so he/she may be called upon if the issue escalates. However, I think it's a "no biggie".
If so, I'd be more concerned about the pregnancy. I'm guessing you are on a Visitor's visa? If the pregnancy is already showing, you may not be allowed in to give birth.

- I also read your other post in the health section. I doubt you will be able to hide you HIV status from your parents. They would likely pick up on it in the hospital. Infact, you are obliged to declare such knowledge to the physician.
- Also, I believe this is a trying period for you. You actually need to pray and encourage your husband just as he is encouraging you (I'm probably stating the obvious) cos no matter how good and supportive he is, he is scratching his head somewhere.
- Lastly, I know this is the travel section but I'm a little curious as to how and when you likely contracted this. You do not need to answer. I'm just curious!

Like I told you on the other thread, I doubt you'd get a job from Nigeria. Your best bet is to migrate as a student. Why not try applying for a Masters program first? Some post grad programs have funding and you never know, you may get the required funding for your education. Secondly, I think there's the commonwealth scholarship; I dunno much about it but maybe you can look into it. You may want to broaden your scope to include the US as well. Just my thoughts.

P.S. The bots Seun installed are full of bugs. I have been banned a number of times and I have never spammed this forum. So, do not take it personal. It's unfortunate that Seun does not seem be interested in fixing this problem.

Wrt my qualification, I’m a Physics graduate (BSc. Industrial Physics-2nd class upper division), NIIT trained Network Administrator (via MCITP program), and Microsoft Certified Technology Specialist, MCTS (I am also planning to write one or more Microsoft Certification Exam before the end of January).

I understand that with my qualifications, I can work as Systems Administrator/Network Administrator/HelpDest support Technician/Computer operator etc - NOC 2281-B and NOC 2282

I had been self-employed for nearly 2years in IT, repairing computers, laptops, and other IT works for both individuals, companies and Banks on small scale contract level.
Traveling through education stuff would have been a better option but it requires high funds which is not readily available to me now.

It's a fairly straightforward process and I'd advice you to apply inland. I know alot of people advice for outland because of the appeal process option but frankly, I think your best shot is inland especially for Africans. Trust me, you do not want to go thru the appeal process; it's draining and time-consuming. Your spouse may not be able to come visit till the issue is resolved, etc. And unless your fiance does not mind going to Accra for an interview (if they ask him to come down), I would not worry too much about an appeal, if you have a strong application. Most times, inland applications are only denied after they have conducted an interview, done some extensive research about your relationship or there are some contradictions in your application.

As you have mentioned, include a work permit application in the inland sponsorship application. This means you have to pay $550 (for the sponsorship and $150 for the WP).  I understand he has a 5mth left on his visitors stay; so you have approx 5mths to put in the application. Make sure he is always in status otherwise the application may become complicated. So, if you cannot go thru with your wedding and application within 5mths, you have to apply for a visitors visa extension. There's no guarantee he will get it.

Note that the WP included in the sponsorship application only helps to get him an implied status. You may not hear anything from CIC for almost 6-7mths from when you put in the application. This means he cannot work for at least a yr (5mths + 7mths). Make sure you folks are aware about the implications. When the 1st stage is approved (approval in principle), he may be granted the WP. The PR usually comes within a month or thereabouts after the 1st stage approval, depending on the Immigration office.

Just a few things.
- Dont call your wedding a "mini-marriage" anywhere (even online) as you have done here, no matter your intentions.
- Regardless of where you put in your application (inland or outland), you need evidence of your relationship, prior to your marriage.
- I hope you are familiar with other conditions for sponsorship and you meet the criteria. If not, make sure you familiarize yourself so that you do not waste your resources.

It all depends on what you are looking for.

The only advantage going to the UK is the 1-year post graduate programs. Apart from that, UK na real sufferhead; believe me.

Still, depending on the program, some N.American universities offer 12-15mths post grad programs.

If I were in your shoes, at 26, I'd pick US or Canada. Infact, at 30/31, you could be a Canadian citizen with some good work experience which you can take back to Nigeria with you. I know you are not bent on settling afterwards but I believe in keeping all options open. You never know the future. You do not lose anything if you do not exercise all your options. Also, I do not know where you get your money from but I work hard for mine and stretch its value; hence, if I pay $20k for a post grad degree, for instance, in any country, I must make sure I make triple that money before I leave that country. At the minimum, my $20k, my time and my effort gets me the education, experience, money and more importantly, good contacts and network. That's just my philosophy. Goodluck with your decision!

A few things; CC made a couple of good points however, I would not bother with point #2. Trust me, most men that cheat on their spouses, do not cheat because the woman outside is more beautiful or appeal to them better than their spouses. There's usually an intrigue, a spark, something that causes them to look out. It's just like eating some nice home cooked meal you appreciate and then going out to a few times to eat junk; sometimes the junk taste good, most times, it's just junk. Hence, my advice.

If this dude was not like this initially, then it's obvious the spark in your home is gone. Sometimes, it may be an attitude that is repelling him, not sex. "A do me I do you" attitude is a shot in the dark at solving the problem. Most times, you are officially giving the guy license to roam and if you really want your home back, then you have to work hard at it. You need to re-generate that spark. What got you folks going in the first place? One major issue in most marriages is lack of communication. You folks need to re-start doing things together. If you are serious, this is a task that you have to go 100% regardless of his initial response. Take the initiative and come up with social activities that will get things going again for you and your family. You need to also make him realise that he is disrespecting his family, not just you and at a point, stand your ground and let him know you would no longer be taking crap from him.

1. You can use your Nigerian license to rent a car. You'd need a credit card in your name and depending on the rental period and company, they'd hold some money on your card. It could range between $200 and up. Most car rentals will charge extra if you take the vehicle into the US. Make sure you insure the vehicle, unless you have some 3rd party insurance that covers the rental.
2. You can use a rental into the US.
3. Depends on the border agent. You could be given up to 6mths. Also, note that the agents can also turn you back at the border; you visa does not guarantee you entry.
