A Federal High Court in Ikoyi, Lagos, has delivered a landmark judgement that Nigerians who live in a residential estate cannot be compelled to be a member of the Community Development Association (CDA) popularly known as residents’ association of estate.
This decision of the Court has put an end to any future arbitrariness of resident associations in Nigeria. By this decision, payment of dues is now voluntary and forcing residents to be members has now been declared unconstitutional.
Residents in Lagos State will no longer be subjected and compelled to pay outrageous membership dues and other levies. The judgement was delivered on Friday, 25th of September, 2020, by Honorable Justice Oweibo, sitting at the Federal High Court, Ikoyi, Lagos.
This suit *(FHC/L/CS/982/2020)* was filed by Megawatts Nigeria Ltd (Applicant) through its counsel Mr. Kayode Adeniji of Lawracles LP, against the Registered Trustees of Gbagada Phase II Residents’ Association and others as respondents.
Facts deposed to on court processes show that Gbagada Phase II Residents Association had been sending notices: requesting the payment of estate dues from 2017 to 2020 for sums ranging from 300 hundred thousand to 200 thousand naira annually, to Megawatts Nigeria Limited.
The position of the Residents Association is that since Megawatts Nig. Ltd is a company resident within the estate, it is bound to pay demanded dues and levies.
The position of megawatts on the other hand is that since it provides for its own security, waste management and other services the estate claims to be providing, it is not bound to pay dues. This is in addition to the fact that Megawatts is not a member of the association.
Megawatts further claimed that the estate security prevented its trucks from accessing the estate in order to compel and coerce the applicant to pay requested fees.
‘The primary issue before the court was whether a person; resident in an estate can be compelled and coerced into membership of a resident association?
The court ruled in favour of Megawatts Nig. Ltd and awarded cost against Gbagada Phase II Residents Association. The court further declared that no one can be forced to be a member of a residential association, be it a company operating within the space of the residential estate or a person who is a resident in that estate.
The court considered section 40 of the 1999 CFRN as Amended which states that: “Every person shall be entitled to assemble freely and associate with other persons, and in particular he may form or belong to any political party, trade union or any other association for the protection of his interest ....’’ Enforcement of the law on estate developers will be difficult because most residents sign to pay service charge in their agreement after land purchase. Infact, haven't you noticed that most estate developers issue deed of sub-lease rather than the usual deed of assignment to their residents. It is deliberate. It means they still have control over the ownership of the land in perpetuity their supposed estate residents thought they have purchased. Buying land from private estate in Nigeria is a scam. |

I've done extremely cheap builds on nairaland platform but as at today "Things are no longer at ease"
I've done a 3 floor project about the same time you did yours for N10m (carcass only) and I did a 4 unit 4 bedroom terrace duplex for N16m (carcass and fence only). Both project had 1.2m raft and we use marine boards for the project.
I've built a duplex in the worst of lekki land with N22m but it's shocking to tell you that I've spent almost N43 million on the same duplex between 2019 and this year and we are not done.
So I understand 16m can work in 2014, 2015 and maybe 2016. I am very sure it wont go that far in 2020. 16mm iron rod is sold 4,200 per length ma What do you refer as extremely cheap builds? If a client decide to build his house based on simplicity and functionality rather than luxury and flamboyance? does that mean his house is extremely cheap? Bro, you are mistaken. As far as the structure of the house is sound, habitable and comfortable, you have no right to call it extremely cheap build. |

He has apologized severally this morning but I'm done. He is emotionally abusive on a good day. I can't count the no of times in a day he insults me. He threatens to Kill me and kill himself. My dad doesn't talk to him any more. Let me tell you why.
He didn't have a car at the time, and would go with mine. He was meant to pick the kids up, while I was also waiting for him to pick me up from work. At about 7:30 pm, I called him again asking for when he would get to the kids school and he told me he was busy(Busy here means busy drinking). The school kept calling me, the teachers need to go home. 8 pm, I picked an uber and went to pick them. My phone died and I couldn't charge it till I got home. As I turned my phone on, his call came in and I apologized, that I had picked them up but my phone went off. He said he was in the school and was looking for the kids. I kept on apologizing. He promised to deal with me on getting home. He then called my mum and was shouting at her on phone(he does this regularly). My dad stepped in. He tried to understand the issue. He told my dad, that I disrespected him and that if it was his subordinate in the office( He's in the para military) that disrespected him, they would kill the person and nobody would find the dead body. My dad then said, but she's your wife and not your subordinate. He shouted at my dad and dropped the call.
I go through a lot of emotional stress on a daily basis. I need to leave for my sanity. He's a great father.What do I do about my kids? Matured responses please. When he is beating you in your home, can't you scream so that your landlord or other tenants in the compound bail you out? |

Like how many trucks of 20 tonnes filling sand would I use to fill it up to a reasonable depth.? this is a swamp and not a land at all. Is it safe to build a house on such swamp? Even if you sand fill the swamp, what about the water beneath the soil? Think again about it to avoid sinking house in the future. |

Don't mind that nairaland builders like n3xt etc. Imagine 19 million naira can't complete 4 bedroom duplex indeed? My university friend who is a civil engineer just built three bedroom ensuit bungalow for his mother. He spent 4 million naira only. I was amazed at the quality of the house during the house warming for his mother. But nairaland builders will be quoting 13 million naira for bungalow. |

To get to a carcass like this won't cost you less than 13m naira. It is very simple. What is the cost of foundation plus German floor? Oga, to have a good German floor that will carry your house you would not spend less that 1.8m. To have a good decking you can't spend less that 2.5 or 3m. Iron alone 16mm is now 225k. Do you know the qty of 16mm, 12mm, 10mm you would use for decking and German floor. Roofing. Wood work plus logging and workmanship will take 800k while China gerrard will cost you about 1.5m plus workmanship. China roofing sheet in the market is about 2k to 2700 per sqm. Abeg my brother listen to professional oh. That was how someone said on property section that with 9m ony few things it will remain and I started thinking with my 12m I will almost finish. Hmmmm I spent 29m to complete the house. You will spend 100% of what brought your house to carcass to finish and that is if your taste is controlled. Enough for the wise You exaggerated your cost of finishing 4 bedroom duplex with 29 million. I believe 19 million should complete 4 bedroom duplex under close supervision. |

1plot of land would be enough. For a 2storey building or 3storey building. The building size(length & width) determines the size of land required.
I would advise you build a mixed use development , your own personal apartment in front and tenants at the back.
You can do 4bedroom duplex in front and 2bedroom flats (upstairs)at the back for rent.
