Saraki won because he was born abroad. Hamzat went there to Naturalise as an adult....

2 different scenarios, hamzat is entitled to the privileges and rights as any normal Nigerian except the right to vie for public elective office in Nigeria and the right to contest for President in the USA.

Trust me, GRV lawyers have Sanwo Olu and Hamzat in a very difficult place, it is GRV's case to lose......

The Hamzat naturalization argument is mere distraction and empty noise. That a Nigerian whose citizenship is by birth cannot lose the rights of a citizen is a settled case. Funny enough, the precedent was even in a case involving LP.

“… when a Nigerian by Naturalisation or Registration acquires the citizenship of another country he loses his right as a naturalized Nigeria. Such a person would not be able to contest any election into any elative office in Nigeria. However, a Nigerian by birth who thereafter acquires the citizenship of another country i.e. America as in the instant case does not lose his right to vie for any elective office in Nigeria being a citizen by birth and not by naturalization or registration.” Per, MUDASHIRU NASIRU ONIYANGI ,J.C.A ( Pp. 18-23, paras. F-A )

Section 66(1)(a) of the Constitution of the Federal Republic,1999,(As Amended ), is clear and unambiguous that a person who voluntarily acquires the Citizenship of another Country, who is a Citizen of Nigeria by birth is not eligible for elections.

It is my submission that the operative word here is “voluntarily acquire the Citizenship of another Country”.

So you can be a dual Citizen of Nigeria by birth. That is to say you are born in another country and at the same time , one of your parents or grand parents is indigenous to a Community in Nigeria. This is the category of dual citizens that can not be caught by Section 66(1) of the Constitution.

Section 66(1) is clear and unambiguous and should interpreted literally as expected by the literal cannon of interpretation.
Section 28 only says you will not forfeit your Citizenship,but by the provisions of Section 66(1) of the Constitution you can not contest.

In the United States ,if you are not born in the United States you cannot contest for the Presidency.

It does not detract from your Citizenship.

So,the argument that Section 28 of gives you leverage to contest is not tenable as the being a Citizen simpli cita, does not qualify you to contest, except you meet other pre-requisites and one of the pre-requisites is as stated in Section 66 (1) of the Constitution.

The Provisions of the Constitution finds expression in Section 66 (1) which prohibits a person who voluntarily acquires the Citizenship of another Country from elective Office.

The cases of Ogbeide v. Osula and Labour Party v. Ishola, referred to by some analysts are Court of Appeal decisions.

The Supreme Court had decided in Ucha v. Onwe (2011) that voluntary acquisition of citizenship of another Country, prohibits you from elective Office in tandem with Section 66(1)(a) of the Constitution of the Federal Republic 1999,(As Amended ). This remains the Law according to the legal principle and tradition of following Staris Decisis (Judicial Precedence).

The law is clear, but also the law is Amoral (meaning it views things only in terms of what the laws stipulates and not in terms of right and wrong).

If a true, certified document can get to the tribunal or any court house after the gubernatorial elections tribunal is over, that Hamzat Naturalised and renounced his Nigerian citizenship......and there is no supporting document showing that he subsequently Naturalised back to being a Nigerian Citizen......he is automatically ineligible to run for public office in Nigeria.

That means his party ticket is null and void and that will in effect, affect both him and Sanwo Olu since its a joint ticket.....

The runner up for the elections will be sworn in, if it isn't Labour Party, too bad!!

N.B:- Before you people start quoting Ishola vs Labour party (2014), remember, that is citing a case law from the appeal court. Ucha Vs Onwe (2011) is tort/case law from the supreme Court that clearly settles the issue.

If you have parents or grandparents from Nigeria and you are born in the USA and become a citizen, wahala no dey!!

If as a Nigerian adult you acquire citizenship of another country by Naturalisation or Registration, you have lost the right to contest for public office.

Meaning Dual citizenship as an individual is allowed, your rights are intact, but you lose the right to vie for public office.

N.B: the right section that deal with disqualification grounds is Section 182(1) for governorship elections

Am sorry for my writing pattern; I am in a serious dilemma since January.

I live in a face me I slap you house with just four co-tenants and the landlord.

There is this neighbour of mine that parked in on December 2021, a married man with three kids; two daughters and a son,the eldest daughter should be around 14 years old while the son and the last daughter should be about 4 & 2 years respectively.

We where living in peace although one has to make tolerance a friend for there to be peace.
These my neighbour's eldest daughter to be honest is morally bankrupted, she steals and lies without remorse.

My neighbour's wife always try to cover up her daughter bad behaviours. During christmas time 2022, I noticed a sudden suspicious behaviours from my neighbours wife towards me in particular; she does as if am a diabolic person, as a cool headed guy I focused on my life until on January 21 2023 when I heard the worst words towards my dignity and reputation as a common person;

Fellow nairalanders guess what? My neighbours wife accused me of poisoning his two little kids.

As a cool guy and from what i learnt never to take action when angry, I maintained like its nothing but told our landlord.

My neighbour who is a driver usually travels and can stay there for weeks, so I have to wait for the man of the house to return and hear from him before taking action, so on 29 January he returned, a general yard meeting processed; he was asked to explain more on the accusation from his wife towards me and this was what he said;

"Someone in our yard premises poisoned his children using mirinda and biscuit" that we all are lucky nothing happened to his kids otherwise he will call the police to arrest everybody in our yard.

When asked how he found out that it was someone from our yard and what sickness his children suffered; he said that his children were vomiting blood in the middle of the night, and he went to a spiritual doctor who told him that it was someone from the yard he lives in.

Please Nairalanders what will I do cause I have tried to let go of this heavy accusation but it havent been easy and to make matters worse the once loved innocent easy going guy have become a depressed soul due to the crack on my previous solid reputation.

Please anyone with a good pragmatic solution should help a brother.

Go to the police station and make an entry. It is important so that in the near future he doesn't use a mob to have you lynched in case something unfortunate happens to his kids and they want to pin it on you.

Remember you are going to make an entry for harassment, because this is harassment.

Also please, did he mention your name specifically? If he didn't ignore, if he did report. Also please take your personal prayer life seriously, to avoid spiritual attack that will turn your life to a "townhall" life
