Updates: Atiku, PDP open trial, as tribunal overrules call for suspension of proceedings The Peoples Democratic Party and its presidential candidate, Alhaji Atiku Abubakar, have opened trial at the Presidential Election Petition Tribunal in Abuja in respect of their petition challenging the victory of President Muhammadu Buhari, at the February 23, 2019 poll. The petitioners’ legal team led by Dr. Livy Uzoukwu (SAN), on Thursday, opened the trial by tendering electoral document, Form EC8C for Agaie Local Government Area of Niger State. The tendering was opposed by the respondents’ lawyers, but as earlier agreed among the parties, the lawyers said they would give the reasons for their objection to the document at the final address stage. The trial finally opened after the five-man tribunal’s dismissal of the respondents’ earlier request for the suspension of the trial on Thursday. The respondents comprising the Independent National Electoral Commission, Buhari and his party, the All Progressives Congress, had earlier called for the suspension of the proceedings on the grounds of alleged late filing and serving of the petitioners’ schedule of documents on them shortly before sitting began on Thursday. But ruling, the five-man bench led by Justice Mohammed Garba, dismissed the respondents’ request, saying that the agreements reached between the parties at the pre-hearing session concluded earlier on Wednesday, had stipulated that trial would commence on Thursday. Justice Garba, who delivered the ruling of the tribunal added that the agreement reached which was adopted at the tribunal’s directive on Wednesday did also not make the service of the schedule of documents a condition-precedent for the commencement of trial. Election petition: INEC, Buhari, APC seek suspension of tribunal’s proceedings, complain of ambush by Atiku Ade Adesomoju, Abuja Respondents to the petition filed by the Peoples Democratic Party and its presidential candidate, Alhaji Atiku Abubakar, have called for the “suspension” of proceedings of the Presidential Election Petition Tribunal, on Thursday (today). Thursday was scheduled for the commencement of trial, when the petitioners challenging President Muhammadu Buhari’s victory at the February 23 election, were to begin calling their witnesses. But shortly after the petitioners’ lawyer, Dr. Livy Uzoukwu (SAN), indicated to the tribunal that he was starting the petitioners’ case with Niger State, Buhari’s counsel, Mike Igbokwe (SAN), rose to call for a halt of the proceedings. He complained that he was only served with the petitioners’ schedule of documents shortly before the commencement of sitting. This, he said, was contrary to the agreement that the schedule would be filed and served far ahead of proceedings. Counsel for the Independent National Electoral Commission, Yunus Usman (SAN), and the All Progressives Congress’ Yakubu Maikyau (SAN), also expressed the same misgivings. They said the alleged late filing and serving of the same schedule was an ambush and called for the suspension of the trial to enable them to go through the schedule. But Uzoukwu expressed surprise over the observation made by the respondents’ lawyers. He said his team “should be commended and not condemned”, as he could not have served the schedule earlier than Thursday morning, because the registry of the court only completed the processing earlier on Thursday. He alleged that the time within which the petitioners had to present their case “is being compromised by the respondents”. He said the schedule to be used for Niger and Jigawa States was already with the respondents. The Justice Mohammed Garba-led tribunal of five judges has stood down the matter for 30 minutes to rule. Tiday is fixed for Atiku to begin their Petition by calling all their 400 witnesses. Though 14 is slated for this purpose, but the legal team decided to reduce it to 10 days. Ibanga Akpabio, under cross examination by Counsel to the PDP, Solomon Umoh, SAN, was asked as Senatorial Agent, to mentioned the Local Government Areas that his party won in the election. "Ikot Ekpene and some others that I do not know", Akpabio, who is also a lawyer answered. "I put it to you that you lost in all Local Government Areas," Umoh added. Counsel to Independent National Electoral Commission (INEC), Robert Emukpoeruo told the tribunal that APC members unleashed violence on INEC adhoc staff, abducted and coerced them into writing results in favour of APC. Ibanga Akpabio who denied this statement was however drawn to paragraph 11 of his witness statement, where he noted that "…an INEC staff escaped with a phone call and never came back." The INEC Counsel told the tribunal that; "To confirm in paragraph 11 of your witness statement that INEC officials were abducted, you said that at final point of collation, he received a phone call and escaped. I put it to you that one can only escape from abduction," Emukpoeruo submitted The witness agreed with INEC, that accreditation in an election can only be done with voters’ registers and/or card readers. INEC Counsel: On the result sheet, column for accreditation has to be collated from card readers and voters’ registers. Do you agree? Akpabio: Yes INEC Counsel: Is there any other source where this information can be obtained? JUST IN: 12 witnesses testify against El-rufai at elections Tribunal Twelve witnesses, on Wednesday, testified against the Kaduna State Governor of All Progressives Congress, APC, Nasir El-Rufai at the Governorship Election Petition Tribunal, sitting in Kaduna. The witnesses told the tribunal that the March 9 governorship elections in which the governor was declared winner by independent National Electoral Commission, INEC, did not hold in many polling units of Kaduna North Local Government Area of the state. All the 12 witnesses testified on behalf of the petitioners, the Peoples Democratic Party, PDP, and its candidate, Alhaji Isa Ashiru. They also said phantom votes were added to the APC candidate to declared him winner of the governorship elections by INEC in Polling units where elections was held. The witnesses said INEC officials did not show up at many polling units in the local government on March 9th. A witness identified as Dan-Auta Mohammed, told the tribunal that elections did not take place at his polling Unit 003. “I was surprised that INEC announced the result of an election that never took place,” he said. Another witness Simon Kester, also said election did not hold in polling unit 018, but INEC released a result from that same polling unit which had no stamp or signature on it. Sani Musa Danburan of polling unit 009 said, as an agent of his party, he could confirm elections did not hold in his polling Unit on March 9. “Even the result from INEC didn’t have stamp of the presiding officer,” he said. Mr. Benjamin Augustine, a witness who served as an agent of the PDP at Hayin Banki Ward collation centre, equally said phantom votes were added for the APC on the purported INEC certified result sheet which was different from the pink copy given to him at the end of the collation exercise. He tendered the pink copy given to him by collation officer to the court which it was adopted by the court as an exhibit. Aliyu Mohammad, another witness who served as a PDP agent in polling units 006, said election did not take place in his polling unit, but surprisingly, “I was later shown the result of the election purported to have emanated from INEC without the official stamp.” All the witnesses, who served as agents of the petitioners in Kaduna North, told the tribunal that INEC officials never showed up at their polling units on the March 9th 2019 governorship elections. Ibrahim Bako-led Tribunal adjourned to June 20th for continuation of hearing after taking 12 witnesses. Daily Trust gathered that about 30 witnesses from Zaria and Kaduna North Local Government Areas had testified against the Independent National Electoral Commission.
