The apex court said the appeal was dismissed for want of diligent prosecution.
The seven-member panel of justices led by Justice Bode Rhodes-Vivour therefore unanimously held that the appeal lacked merit and dismissed same.
On April 18, a Court of Appeal sitting in Kaduna upheld the appeal Mr Yusuf, challenging a Federal High Court’s order that sacked him as the party’s candidate.
Delivering the judgement, Justice Tanko Hussaini said the Federal High Court judge in Kano erred in law by assuming jurisdiction without the plaintiff, Ibrahim Little, joining the necessary party, Abba Yusuf.
The judge also said Mr Little lacked locus standi to institute action challenging the process that he did not participate in.

As an aside,i personally think that the apex court were here.ibrahim little was denied of his political rights when after buying forms,kwankwaso took the venue of the primaries to his house and prevented others from participating in it making yusuf a sole contestant.that is an infringement of his fundamental human rights,the apex court should have cancelled that primaries.perhaps little didnt argue it well in court

APC Court of Nigeria despite admitting that INEC went beyond their powers and constitutional mandate in certain dealings at the Osun election erroneously granted the appeal of APC on one of the grounds that the the justice that read the lead judgment was absently during the course of the proceedings.

The APC justices forgot that the Tribunal is a superior court of records. I wonder what court of records means to them.

Then there is the biggest hurdle, the current law does not support electronic results. That was one of the provisions the amended law had. But Mr President declined.

The question you should ask is, of what relevance is server to tribunal?
Why is it so difficult for Atiku to present the signed result sheets signed by party agents and electoral officers of which all his agents had a copy given to them?

Why is Atiku finding it difficult to prove electoral irregularities with available evidence in his hand?
Why the need to rely on something you have to prove its existence, prove the figures are the correct figures and prove its admissibility before electoral act and tribunal when you have result sheets with you?

I don't know why you are giving Atiku false hope.

The only results recognized by law is the result sheets signed by party agents and electoral officers.

That's what Atiku should use to prove his case not one server that many voters don't even know exist.

the data for accredited number of voters are available both manually n electronically.
But what Atiku was actually asking for is electronically transmitted results which is not recognized by the electoral procedures
