The Nigerian Communications Commission, NCC, yesterday distanced itself from claims by MTN Nigeria that it persuaded the phone company to withdraw its lawsuit for both sides to reach an out-of-court settlement over a N780 billion fine imposed by the regulator. The commission also denied knowledge of MTN’s claim that it made a part payment of the fine. MTN had announced Wednesday that it was dropping its legal challenge, and making a “good faith” payment of N50 billion to enable the two sides reach an amicable solution on the matter. “This is a most encouraging development. It demonstrates a willingness and sincerity by both parties to work together towards a positive outcome,” MTN Nigeria’s Chief Executive Officer, Ferdi Moolman, had said. But the Director of Public Affairs, NCC, Tony Ojobo, said yesterday the commission was neither aware of MTN’s decision to withdraw its court case, nor pay $250 million (about (N50 billion) to the Nigerian government. “We, NCC, are not privy to it (agreement to withdraw a case from court and pay $250 million by MTN). We do not have anything to do with it. We do not have any evidence of payment of any money to the Nigerian government. ‘’There is no invoice to that effect. We have also not gotten any official information or confirmation that they have withdrawn their case in court. “That information is not from us, NCC. It is MTN that released it from South Africa. We have not got into any discussion on the modalities of payment of the fine. ‘’Whatever MTN is doing does not affect the fact that a regulatory fine was imposed and payment is expected,” Ojobo said. Mr. Ojobo, however, assured that the NCC management would meet later to review the report and take a decision that would be communicated to the public through an official statement. “We have not even met to take a decision like that. There was no discussion whatsoever with NCC on the matter. MTN has not even met with the committee that was set to discuss these issues. “On what basis was the agreement made? We do not know the basis on which they arrived at the $250 million they claim to have paid. ‘’For now, no official position on this. We are just hearing it in the news like every other person,” he explained. The NCC had in October 2015, sanctioned MTN, Nigeria’s largest mobile operator, for failing to disconnect 5.1 million improperly registered lines within the prescribed deadline in compliance with its regulatory directive to telecom operators in the country. The penalty was based on N200,000 fine imposed for every unregistered SIM card in use on any telecom operator’s network. Although the fine was subsequently reduced by 25 per cent to N780 billion, MTN Nigeria failed to pay the penalty. The company later filed a suit at the Federal High Court, Lagos to challenge the Nigerian government’s action. The court gave both parties until March 18, 2016 to reach an amicable out-of-court settlement over the matter. When contacted, spokesperson for MTN, Funso Aina, said he should be given some time to respond.

The All Progressives Congress has congratulated a former President of the Senate, David Mark, for his victory in the Benue South Senatorial rerun election held Saturday.

Mr. Mark was declared winner early Sunday morning amid protest by his main challenger, Daniel Onjeh, who demanded that the election be declared inconclusive.
The former senate president scored 84,192 votes, leaving a margin of 12,571 votes between him and Mr. Onjeh, who garnered 71,621 votes.
A total of 29,273 votes were cancelled.

After Mr. Mark was declared winner by INEC, Mr. Onjeh’s agent protested, saying the number of cancelled votes (29,273) was higher than the margin of win (12,571).
He therefore contended that the election should have been declared inconclusive.

He also accused INEC of cancelling votes in APC’s strongholds, and indicated that his party and its candidate would challenge Mr. Mark’s victory.


But despite the protest by its own candidate, the APC congratulated Mr. Mark, in what appears an endorsement of the result declared by INEC.
“Congratulations to Senator David Mark, who has just been declared winner, Benue South Senatorial rerun election,” the party said via its twitter handle, @APCNigeria. The APC is known to have used that twitter handle to disseminate official messages since 2013.

The message was posted at 8:46 A.M, about four hours after INEC declared Mr. Mark winner of the election.
When contacted, the Assistant Director of Publicity at the APC headquarters, Edegbe Odemwingie, asked for time to revert with an official statement from the party on the matter.

He is yet to do so at the time of this report.
But the campaign of the APC candidate, told PREMIUM TIMES it is not aware that the ruling party had congratulated Mr. Mark.

Okpokwu Ogenyi, the spokesperson for the campaign, said the result declared did not reflect the wishes of the Idoma/Igede nation.

“The people came out enmasse to vote for change but Mark colluded with INEC and security agencies to manipulate results,” Mr. Ogenyi said. “We won’t accept that. We are calling for the cancellation of results in Opoku, Agatu and otukpo".

The Presidency on Monday said the foreign trips by President Muhammadu Buhari were necessitated by his desire to block and recover funds looted from Nigeria.

The Senior Special Assistant to the President on Media and Publicity, Mallam Garba Shehu, said this in an interview with State House correspondents.

Buhari will on Tuesday travel to France and Britain. He had visited Kenya and Ethiopia last week.

But Shehu said it would be wrong to describe the President’s foreign trips as jamboree.

He said so far, Buhari had during his trips secured agreements with various countries on recovery and repatriation of stolen funds.

He also disclosed that some top security officials in the country would, in the next one week, travel to the United Arab Emirates to further actualise an agreement on recovery and repatriation of stolen funds.

Shehu said, “You also see gradually the strategic efforts to go after the stolen funds abroad. The UAE is very important to the country.

“Don’t be surprised that in the coming week or two, you will see high level security officials leaving Nigeria for the UAE to begin to give expression to our wish to enjoy this new cooperation between the two countries with a view to recovering stolen assets.

“There are numerous agreements we have also signed with them; drugs, human trafficking and stolen assets that have been stolen abroad.

“So, the President want to make it difficult for people, even when then steal from Nigeria, there would probably be no hiding place for stolen assets

Former President of Nigeria, Chief Olusegun Obasanjo, on Monday lambasted some state governors in Nigeria for living like emperors while demanding sacrifice from the citizens for Nigeria to survive the hard times.

Obasanjo chided the governors while speaking as the chairman at the inaugural conference of the Ibadan School of Government and Public Policy, held at the University of Ibadan.

Obasanjo said when he became Nigerian president in 1999; he recognised corruption as a major impediment to the Nigerian state, setting up structures like the Economic and Financial Crimes Commission and the Independent Corrupt Practices and Other Related Offences Commission to fight the rot. However, he said that after he left, corruption returned to Nigeria with a vengeance, draining billions of dollars from the nation’s economy that could hardly afford to lose even a million dollars.



He said, “Leaders who call for sacrifice from the citizenry cannot be living in obscene opulence. We must address these foundational issues to make the economy work, to strengthen our institutions, build public confidence in government and deal with our peace and security challenges.

“We must address the issue of employment for our teeming population particularly for our youths. Leadership must mentor the young, and provide them with hope about their future as part of a process of inter-generational conversation.

“Nigeria is a country where some governors have become sole administrators, acting like emperors. These governors have rendered public institutions irrelevant and useless.

“Is there development work going on in the 774 constitutionally recognised local government councils, which have been merely appropriated as private estates of some governors?

“Some governors have hijacked the resources of the local governments and this has crippled the developments of the local government councils in the country. The National Assembly must also open its budgets to public scrutiny.”

The former president said drastic fall in the price of oil in the international market had exposed the weakness of governance in Nigeria, while also saying that Nigeria was racing towards becoming a nation of debt with its attendant burden on the citizens.

“The drastic fall in the price of oil in the international market has unraveled the weakness of governance in Nigeria. The Minister of Finance has recently announced that the 2016 budget deficit may be increased from the current N2.2 trillion in the draft document before the National Assembly, to N3 trillion due to decline in the price of crude oil.

“If the current fiscal challenge is not creatively addressed, Nigeria may be on its way to another episode of debt overhang which may not be good for the country,” Obasanjo said.

On the establishment of ISGPP in Ibadan, Obasanjo said there was clearly a need for schools of its kind that would focus research and teaching on implementing policy and making the government work well in Africa.

“I hope it will generate ideas that will lead us from thinking to doing. It must not only generate ideas, it must foster a willingness to use those ideas within government and non-government sectors,” he said.

At the two day-conference, themed, ‘Getting government to work for development and democracy in Nigeria: agenda for change’, Chairman, Board of Governors of the ISGPP, who is a former foreign Affairs Minister, Chief Emeka Anyaoku, and professor of international history and politics, John Evans, also delivered addresses among other speakers
