A lawyer Malcolm Omirhobo has dressed in a traditional outfit for appearance at the Supreme Court.

He told reporters his dressing was in protest of last Friday's judgment by the court, overruling Lagos's ban of hijab by Muslim female students in public schools.

According to him since the Supreme Court already made the pronouncement, adherents of other religions, including Ogun and Sapoona worshippers, should feel free to adorn their dresses that depict their religious beliefs.

CASES PROFESSOR OSINBAJO WON FOR THE LAGOS STATE GOVERNMENT AS ATTORNEY-GENERAL AND COMMISSIONER OF JUSTICE (1999 – 2000)

Professor Oluyemi Osinbajo became the face of law in Lagos where, during his tenure as the Attorney-General and Justice Commissioner (1999-2007), he introduced major reforms that catapulted the state’s Judiciary to its current enviable height that it now serves as a reference point in judicial efficiency in the country.

Prof. Osinbajo’s appointment as Attorney-General was informed by his reform-minded contributions to the justice sector while he served in 1999, as a member and Secretary of a Think-Tank and Transition Work Group, a body set up by then newly elected Governor Tinubu, to deliberate on strategies for transition from military to democratic government in Lagos State.

During Prof Osinbajo’s years as Lagos Attorney General (1999-2007), the state engaged in many legal battles with the Federal Government then headed by Chief Olusegun Obasanjo. To Prof Osinbajo’s credit, Lagos state won most of the cases. Some of the cases are highlighted below

Urban And Regional Planning (2001-2003)

One of such was the suit marked: SC.353/2001 between the AG, Lagos (Professor Osinbajo) and AG of the Federation. It was instituted in 2001 by the Lagos State Government to, among others, challenge the constitutionality or otherwise of the Urban and Regional Planning Act, 1992.

Prof. Yemi Osinbajo won the case for Lagos state where in its judgment on May 13, 2003, the Supreme Court held that the state government possessed control over the physical planning and developmental control within their territory. It also held that all development permits issued by the Federal Government to the buyers of its properties in Lagos from 1999 to that date subsisted, but henceforth, owners of such properties must obtain relevant permits from the state government.

State Control Of Natural Resources (2001-2002)

Prof Yemi Osinbajo also led the Lagos team in the celebrated case over control of natural resources located within the Continental Shelf of the country. The dispute was between the Federal Government and the eight littoral states of Akwa Ibom, Bayelsa, Cross-River, Delta, Lagos, Ogun, Ondo and Rivers States in relation to the southern (or seaward) boundary of each of these states.

In the suit marked: SC28/2001 initiated by the Federal Government at the Supreme Court in 2001, the FG argued that the southern (or seaward) boundary of each of the states is the low-water mark of the land surface of such state of the seaward limit of inland waters within the state, as the case so requires. It contended that natural resources located within the Continental Shelf of Nigeria are not derivable from any state of the Federation, a position countered by the eight littoral states.

Prof. Osinbajo-led team won the case for Lagos State where Justice Michael Ogundare, who read the lead judgment on April 5, 2002, held that “the seaward boundary of a littoral state within the Federal Republic of Nigeria for the purpose of calculating the amount of revenue accruing to the Federation Account directly from any natural resources derived from that state pursuant to Section 162(2) of the Constitution of the Federal Republic of Nigeria 1999 is the low-water mark of the land surface thereof or (if the case so requires as in the Cross River State with an archipelago of islands) the seaward limits of inland waters within the state. And this shall be my judgment in respect of the plaintiff's case.”

On Statutory Allocation To States (2004)
Prof. Osinbajo also led the Lagos team in the suit marked: S.C. 70/2004 between the AG, Lagos State and AG of the Federation instituted in 2004 by the state government to challenge the directive by then President Obasanjo to the effect that statutory allocation to states that created local governments, be withheld by the Finance Minister.

Dissatisfied with these directives, the Lagos State Government sued the Federal Government at the Supreme Court. While Prof. Osinbajo conducted the case on behalf of his state, Chief Afe Babalola (SAN) led the Federal Government’s team.

In its judgment on December 10, 2004, the Supreme Court ruled in favour of Lagos State led by Prof. Osinbajo. The Supreme Court held among others, that it was wrong for the Federal Government to withhold statutory allocations due to the states under any guise.

On Criminal Offences During The Military Era
Prof Osinbajo led the prosecuting team when the state decided to prosecute former Chief of Army Staff, General Ishaya Bamaiyi; former Chief Security Officer to the late General Sani Abacha, Major Hamza Al-Mustapha; his son, Mohammed Abacha; Chief Superintendent of Police (CSP) Rabo Lawal among others for alleged criminal offences during the military era.

On Tobacco Targeting Young And Underage Persons In Their Advertising And Marketing
Prof. Osinbajo was instrumental in the prosecution of the suit brought against British -American Tobacco Nigeria Ltd (BAT), International Tobacco Limited and four others on the ground that they were allegedly targeting young and underage persons in their advertising and marketing in spite of the obvious knowledge of the adverse effect and severe health implications of their products.

Black US Teen Cleared Of Murder, 91 Years After His Execution.
An African-American teen executed in 1931 for the murder of a white woman was exonerated by a Pennsylvania court this week, after decades of lobbying by his only surviving sister.Alexander McClay Williams, age 16, was convicted by a white jury in just four hours, and remains the youngest person ever put to death in the eastern US state.
But 91 years later, a county judge dismissed the case and declared Williams was innocent.
“I’m just happy that it finally turned out the way it should have in the beginning,” Williams’ sister, Susie Williams-Carter, was quoted by the Philadelphia Inquirer as saying on Thursday.
“We just wanted it overturned because we knew he was innocent, and now we want everyone else to know it, too,” the 92-year-old said.Delaware County District Attorney Jack Stollsteimer said in a statement that the case was dismissed on Monday, after years of litigation.
The decision “is an acknowledgement that the charges against him should never have been brought,” the statement said.
The case is the latest recognition of historic racial injustices in the US legal system, which convicted and in several cases executed innocent Americans, many of them Black, in the century following the 1861-1865 Civil War.
On October 3, 1930, the estranged ex-husband of Vida Robare, a white matron at the Glen Mills School for Boys, a detention center for young offenders, found Robare’s body.She had been “brutally murdered” in her cottage, which was on the school’s grounds, the district attorney’s statement said. The ex-husband, Fred Robare, also worked at the school.
Williams, who was serving an indefinite term at Glenn Mills, was charged with the crime.
Interrogated five times without the presence of a lawyer or a parent, he signed three confessions — “despite the lack of eyewitnesses or direct evidence implicating him,” the statement continued.
When he was finally appointed a lawyer, it was William H. Ridley, the first African-American member of the county bar.
“Ridley was given $10 by the Court for expenses (approximately $173 today), and had only 74 days to establish a defense, without the assistance of investigators, experts, or resources,” the statement said.
“The Commonwealth had assembled a 15-member team to handle the trial, which lasted less than two days. The defendant faced an all-white jury, which found him guilty in less than four hours. No appeal was ever filed.
”Stollsteimer paid tribute to the Williams’ sister and Ridley’s great-grandson, who “worked tirelessly for years to demonstrate the inconsistencies in the evidence as well as the unscrupulous manner in which the case was handled.
”There was “substantial” evidence that was either ignored or unexamined, he said.
That included the bloody handprint of an adult male found near the door of the crime scene, photographed by police but never mentioned at trial — and the fact Vida Robare divorced her husband for “extreme cruelty,” but he was never examined as a suspect.
“We believe that this young man’s constitutional protections were violated in an irreparable way,” said Stollsteimer.

Arabic Teacher Arraigned for Allegedly Defiling Nine Female Pupils In Lagos.

Seven of the survivors said that the defendant, who is their Arabic teacher, on several occasions, inserted his fingers into their vaginas.

Arabic teacher, identified only as Farouk, has been charged to an Ikeja Domestic Violence and Sexual Offences Court in Lagos State over a nine-count charge involving sexual assault. The teacher was alleged to have contravened Section 261 of the Criminal Laws of Lagos State, (2015) for fingering his nine Islamic pupils, ages seven to 13 years.According to Vanguard, a witness, named Mrs Oluchi Nwoke-okoi, a registered nurse and midwife, while being led in evidence by the state prosecutor, Mrs Olufunke Adegoke, said she was a staff of Women At Risk Foundation (WARIF) and had 15 years’ experience in midwifery.

She testified before the court that she attended to the nine survivors and conducted vagina examination on seven of them after their mothers brought them to WARIF centre on February 20, 2019.

She said, “The survivors and their mothers were brought to the centre by police officers. We took time to question each of the survivors and also conducted vagina examination on them.

“Seven of the survivors said that the defendant, who is their Arabic teacher, on several occasions, inserted his fingers into their vaginas. The 8th survivor said the defendant only touched her breast while the 9th survivor told us that she was afraid to attend the lslamic class after her sister told her that the defendant inserted his fingers into her vagina.

“Vagina examination was carried out on them. Based on their histories and the vagina examination, the result shows absence of hymen. Conclusion is suggestive of sexual assault of minor,” she said.

She disclosed that the youngest of the survivors was seven years while the oldest was 13 years.

Similarly, during cross-examination by defence counsel, Mr A.O. Okonkwo, Nwoke-okoi said she was certified by the Nursing and Midwifery Council of Nigeria (NMCN), revealing that the vagina examination she did on the victims was within her area of practice.

She continued, “I have a license to practice as a registered and certified midwife and the vagina examination I carried out is not outside my practice. Laceration of the vagina means bruises, injuries or scars on the vagina. In some cases, when the vagina is tampered with, there may be laceration or not.

“In the case of sexual assault, laceration can be seen when the survivor struggles or when penis, fingers or object is being forced into the vagina. In the same vein, hymen cannot be intact when the finger, penis or object is inserted into the vagina. It is not in my power to decide whose fingers penetrated the vaginas of the survivors and I disagree that scratching can tamper with hymen."

It was gathered that the prosecuting counsel told the court that the witness was their last witness in the trial and hugged the court to order the defendant to open his defense.

Hence, Justice Abiola Soladoye adjourned the case until October 5 for the defendant to open his defence.

Yesterday I uploaded my education credentials meant to be submitted to INEC Nigeria today as nominations close for Presidential candidates running in the 2023 Presidential Election.

Many have asked why I performed so woefully in my first attempt at the West African Senior School Certificate Examination (WASCE), well, it was how it ended after that first attempt.

I did state that I took a second stab at WASCE at a different high school before securing enough credits to gain admission into the university.

I just couldn't give up until I made it and got admitted into UNILAG in 1989 to study Geography and Planning. In fact, my late dad demoted me by asking that I go back to "Class 4" after that woeful result I posted yesterday. After securing admission into UNILAG I had to combine the two results to get matriculated.

I appreciate the engagement provoked by sharing my not-too-good WASCE/GCE result yesterday.

It should be on record that on the past four to six years, Lagosians are cruelly left at the mercy of ill-equipped, nonchalant Road contractors.
I mean for more than a month year now that structures have been demolished and places to earn livelihood brought down without mercy, some parts of this road have not been with constructed drainage no to talk of the much touted new roads.
As we speak, the old road is 20 times better than the present hell fire.
Doyin Omololu Street, a major artery that receives hundreds of vehicles coming from ikorodu/Mile12 axis has been cut off for months just because a new culvert is to be replaced (earlier, Elebiju another important road was cut off for almost a year). People in their hundreds of thousands are cut off now causing serious discomfort to them.
Places like Adekanmbi Street, oshinteye Street etc have been cut off with no hope of ever accessing their streets again except they trek in.
Around Biola, Glo, St. Patrick Catholic Church, Oshoogun, Iyana School etc are daily in trauma.
Those connecting this important road from Ikorodu via Estate to the Islands to and fro are worse hit.
In dry season, the kind of sickness this is causing the inhabitants and road uses-patients, old people, new born etc in hospitals, motorists, pedestrians shows one thing: The government has no value for people's wellbeing, ministries of environment, works and health with their commissioners are mere caricatures. The governor is the Head-rogues.

About 75 per cent of filling stations across the country are currently out of business due to their inability to purchase diesel required to power their tankers and transport Premium Motor Spirit, popularly called petrol, to their various outlets, oil marketers stated on Tuesday.

Marketers also stated that the cost of diesel would keep increasing and might hit N1,500/litre in the next two weeks if nothing drastic was done to curtail the current challenge faced by importers of the deregulated commodity.

Dealers under the aegis of the Natural Oil and Gas Suppliers Association told journalists in Abuja that this was also the reason why petrol scarcity had failed to abate in Abuja and neighbouring Nasarawa and Niger states, among others.

Speaking on behalf of the marketers, the National President, NOGASA, Bennett Korie, explained that the only solution to the current challenge was for the Federal Government to raise the pump price of petrol a little in order to reduce the huge foreign exchange used in PMS imports.

This, he said, would eventually free up some forex for diesel imports, a development that would impact positively on the rising cost of diesel, stressing that the product was currently sold at N850/litre.

He said, “If you go round now you will see that about 75 per cent of filling stations in Nigeria have gone out of business. There is no diesel to take fuel to their stations. All of them are going down.

“And it is not that the fuel is not there, but the cost of bringing it to the stations is too high. We know that the crisis between Ukraine and Russia has contributed badly, but the government has to do something fast, otherwise we are going to buy diesel in the next two weeks at N1000 to N1500/litre.”
