Also the Rules of Professional Conduct 2007 that guides the conducts of Lawyers in Rules 24 has made it mandatory for a lawyer to accept all briefs (clients) that come to him. Narrow minded and myopic reasoning. Section 36(5) of the 1999 Constitution provides that "everyone charged with a criminal offense shall be presumed innocent until proven guilty by a competent court of law." You don't even appreciate the purpose of a defense lawyer in a criminal trial. His purpose is to make sure that justice is done in the trial and that in punishing an accused, the law is not thrown to the dogs. His purpose is to ensure that the laid down rules as regards criminal trial are fulfilled by the prosecuting. A renown jurist once said that "it is better for 99 criminals to go scot free than for 1 just & innocent man to be punished. |
