Another similar scenario played out when Yahaya Bello emerged as the winner of the Kogi elections following the death of Audu who was the APC candidate but died on the day of elections. Faleke who was running mate to Audu had claimed he must be sworn in but the court rather ruled that the ticket was APC property and that since APC won the election, the next in line should be the candidate that emerged second in the APC primaries.

If Datti contests and wins the LP ticket and he decides to step down, it is the LP candidate that came second in the primaries that will emerge on the ballot and Datti has no right to give what wasn't his in the first place to anyone and especially not some one who was never in the Party or engaged in the primaries.
