The truth Lawyers of today would shy away from as they self conceitedly shirk their responsibilities to society as social engineers and officers of truth, equity and justice.
There is no hard and fast rule....that once judgement is entered in a suit, the victor is ordinarily entitled to reap the benefits of such judgment.
However, the adverse party aggrieved is entitled to present an appeal if he so desires on valid grounds so as to have the said judgment reviewed on appeal within the prescribed time frame for the he presentation of a valid appeal.
The filing of an appeal without more ordinarily does not act as a stay of the execution of a judgment, the appellant is expected to file an application seeking orders of the trial court for the stay of the execution of the judgment pending the determination of his appeal.
Upon filing of his appeal he is expected to serve same upon the beneficiary of the judgment, the Sheriff of the Court as well as other necessary agencies and persons who may have been directed to take certain steps in giving effect to the said judgment (in deserving circumstances).
Upon service of all these processes, the court is expected to hear and determine the application for stay by either granting same (on condition) or refusing same.
All the parties are expected to maintain the status quo and not take any step that would foist a situation of fiat accompli on the appellate court.
Any party that decides to take any action having seised of these facts and steps taken by the party appealing does so at his own peril.....as such actions stand the risk of being reversed by the appellate court should its attention be drawn to same.
These processes and procedures are hallowed, basic and elementary.......

Furthermore, the provisions of Section 143 (1) of the Electoral Act, 2010, as amended, provides thus:

"If the Election Tribunal or the Court, as the case maybe, determines that a candidate returned as elected was not validly elected, then if notice of appeal against that decision is given within 21days from the date of the decision, the candidate returned as elected shall, notwithstanding the contrary decision of the Election Tribunal or the Court, remain in office pending the determination of the appeal. "

These are strange times indeed in our motherland as well as in the application of ethics in the legal profession......
It is high time, the stern disciplinary measures get applied to both lawyers and the teeming litigants to whom they now fully pledge their allegiance rather than to the higher dictates of justice and the law.....

A Federal High Court in Abuja has ordered the Governor of Abia State, Okezie Ikpeazu, to vacate office immediately for submitting false information to his party, the Peoples Democratic Party, for the party’s governorship primary in December 2014.

Justice Okon Abang in a judgment on Monday ordered the Independent National Electoral Commission to immediately issue a certificate of return to the plaintiff, Uche Ogah, who polled the second highest number of votes in the primary.

Uchechukwu S. Ogah is a Nigerian oil magnate, entrepreneur, investor and philanthropist. Ogah is the President of Master Energy Group, a conglomerate with over 15 subsidiaries and interests across a variety of industries.


In 2014, Dr. Uche Ogah, rejected the outcome of the Abia State Peoples Democratic Party (PDP) governorship primary held in Umuahia.

Ogah, who came second in the contest with 103 votes, claimed that the exercise was fraught with fraud.

Ogah said there was no credible and proper accreditiation of the delegates who participated in the primary, giving way to admission of non-delegates to vote in the exercise.

“I know there was no formal accreditation and people were given tags just to go and vote. Everything in Abia is fraud; why? Everything, from beginning to the end,” he said.

Any one asserting that corrupt practices thrived in Nigeria under Ex-PGEJ watch is simply either ignorant or being paid to do a hatchetman's job.....
The records show domestically that more cases were filed in court and more convictions were elicited during his 5 year watch than during the tenure of both his two predecessors OBJ & Yar'adua using year 2000 as a baseline.....this facts are verifiable from the websites of the two frontline anti-corruption agencies, the ICPC and EFCC, respectively.....Paid advertorials were taken out by these agencies annually.
On the international front, Nigeria's ratings in the Transparency International Corruption Perception Index showed that our ratings equally improved in this barometer used to measure the standing of nations.....this information too is verifiable from the Transparency International website....
Folks should save the repetition of these warped lines....they are boring and monotonous.....
Curiously, discerning folks should query why the recently released List of recoveries do not have names attached to them.....
Is it that these recoveries being presented span way beyond 29/5/16?

Where in the world would an individual be granted lifetime injuction from investigation let alone prosecution for corruption as is Peter Odili's case with EFCC... Having a supreme court judge as a wife is a "blessing".. cool
Do posterity a favour and ask yourself why it has taken the EFCC ages to initiate appeal proceedings since 2008 to set aside an adverse judgement of a Federal High Court........

What they don't tell you is that loosening foreign exchange controls works....for a while. If we are not earning enough forex to replace the forex lost by the loosening of the controls.....we could enter a state where our savings account is drained down to zero....and we are left with no option but to take a big fat IMF loan that would take decades to clear off again.

And we should also not forget the massive devaluation of the naira that would result...leading to marked increase in prices....and inflation.

The article is just a big and unnecessary advert for loosening the controls. While at the same time it pretends that there would be no side effects of loosening the controls. Bad economics...bad article.
Can't the huge recovered funds be deployed to act as a buffer to cover for the doom & hard times been experienced.....
Or are we being led off the pathway of perfidy with misinformation?

The scarcity you've boisterously asserted occurred because of unguarded comments made hypocritically asserting that subsidy payments were a scam....which made the marketers to insist that they get paid all their monies in derogation of existing protocols to verify their claims after the 2012 revelations, which said request the Ex-PGEJ government resisted......
And I stand with the government then for refusing to fall in for that cheap blackmail....

One of the major problems wrong with Nigerians is that we forget easily. This is the reason why hardened criminals and looters in the past can easily come back and contest for public office to the extent of winning. It is so sad that some people, mostly youths who are the leaders of tomorrow are going about with the slogan "#BringBackOurCorruption". They say they want the last administration presided by Good luck Ebele Jonathan back in power cos they can't stand the current fuel scarcity amidst other challenges that I believe the Nation will breeze through in due time.

This brainwashed blind bats who love to view things ethnically are quick to forget that the fuel scarcity experienced towards the end of the last administration's tenure was really unbearable compared to what we are currently facing now. Then, major sectors were shutting down, from telecommunications to the media, from aviation to banking. Nigerians were literally cut off from the rest of the world during that period. A period in which getting a bus to the bank to withdraw money was difficult cos buses had no fuel. When you manage to get to the bank, you are told you arrived late cos they close early due to shortage of diesel. Was the power sector any different?

Take a look at the pictures of fuel scarcity events that took place in the last administration below and tell me that Nigerians didn't make a good choice in voting them out.
The cause of truth would have been better served if the time frame when this induced scarcity was mentioned.....
This happened during the last days of the Ex-PGEJs government after these inciting comments were made by folks who claimed subsidy payments were a scam.....thus sending marketersinto a frenzy insisting that they be paid all of their unverified claim before the new government begins to sale petrol for #40

Also—I am reminded of a similar incident— which occurred around 2002 in Enugu.

Two kids, while playing one hot afternoon entered an old bus which belonged to a panel beater and was no longer in active use. While inside, they shut the hatch and remained stuck for about 2 hours until they suffocated—as a result of inhaling chemicals stored in the bus .

When they were later found, a mob which had formed quickly torched the panel beaters workshop and beat him until he fell into a coma. The bodies; yet to be retrived. People waited for police to come. When they finally arrived, the first policeman who opened the bus was knocked out cleanly by the fumes from the chemicals. The other officers stayed clear until —I think Officials from UNTH—arrived the scene with proper equipment.

Now after proper analysis of the events leading to the deaths. It became clear that the Panel beaters only offence was stocking a controlled substance which he had the right to do. Only then it was too late. Workshop gone, left eye gouged, Clients cars torched. The crowd made a wrong call that day, a call that no collective feeling of remorse can make recompense for. Whether to the bereaved families nor to the Panel beater; whose life changed forever that hot afternoon.



Police will investigate this matter and get to the root. Make no mistake, Nigeria police works.

RIP to the kids....
This equally reminds me of an incident when I guess I was about 5-6 years....we'd gone visiting family friends, the breadwinner was a Refrigerator technician. As kids we were after awhile left to go outside to play hide and seek....And we hid ourselves around every cranny & crevice in the compound, which coincidentally was littered with both no longer serviceable fridges and those under repair....
I'd taken cover inside one of these fridges and shut the door in.....I suddenly found I could not open the door from within and was on the verge of suffocating..... When suddenly one of our peers saddled with the task of seeking us out from where ever we were hiding by dint of luck....decided to pry open the door to this fridge I was already entrapped in......
The rest na story.....after the door was opened....Whilst the guy was boisterously shouting he's found me......I just jejely scamper out of the Refrigerator, dey gulp in fresh air to fill my lungs......
I no come agree to play dat play again that day.....
Till date as an adult....I just wonder wetin people for talk when dem find me dead later.......
Folks need to keep watch over thsse young Nigerians.... As they are basically oblivious to the dangers lurking all around them......

After calling us out as panic buyers who hoard fuel in our homesteads.......
After boisterously asserting that the NNPC has strategic reserves to last between 60-90 days to allay our fears of scarcity and non availability of refined petroleum products to make the rounds......
We have today been confessed to that these were all lies and that for the past 20 years the NNPC has never held any strategic reserve to last between 60 - 90 days as they'd previously asserted......
These guys suffer from a dearth of trust & integrity deficits.....
This ain't no joke......
