at surveyprof at fxking2012 and others. there is a big difference between witch-hunting and scam investigation. even the esteemed Nigerian police will investigate first before declaring a person wanted or divulging details of their investigation. the time honored principles of hearing the other side and not being a judge in your own court has to be adhered to. if omowunmi wakes up now to sue both nairaland and both of you for slander and libel(defamation) what will be the defense? personally i support the refusal of the MODS and Seun in refusing to put this thread on the front page until the 21 days ultimatum had elapsed . but at the same time they need to put disclaimers up! furthermore everyone has labelled her a scammer without a court declaring same> ps a criminal is not a criminal until proven guilty. please in as much as we want to rid our dear nairaland of scam(i have been a victim) we should not stoop low as to be declared unprofessional in our doing so. at the poster, there are time honored means of debt collection as well as dispute resolution not tarnishing a person's image all over the web. the grace we have in this country is our internet laws are not that strong. ps if she repays you and countersues you for defamation what are you going to do? maybe she has tendencies to be fraudulent but are we a court to declare that? next time report all fraudulent activities to the police, they have the power to investigate, all we are doing is just giving her powers to protect herself if she wants to. at shopclue, me i dont know you neither are you my client but i will advise you for free: a good name is better than gold. i have said my piece. ps if anybody tries insulting me etc... Madam Aigboma! The wives get as much as 50 even 60% or as low as nothing in Nigeria! It depends on the circumtances of the case as well as the Judges discretion. I can say awards I have seen in court that make no sense. |
Madam baby! The question asked by the op was if the laws where there, yes the laws are there but the issue of enforcement of the said laws na another matter! When the politicians continue to steal money meant for proper Data management of Nigerians how can the Law be enforced? However it should be noted that in the african Society(ps before western influence) one doesn't marry an individual but his/her family! If you want child support a wife should pressurize her in-laws(ex). That is where society will aid in the enforcement of the Law! |
Do people just post without asking some basic questions? 1. The law for Divorce Settlement and child support in Nigeria is well provided for in the Matrimonial Causes Act sections 71 to 73. Covers ancilliary releifs in a divorce petition. Furthermore there is the Child Rights Act that provides for Children Born outside a marriage done Under the Marriage act(customary marriages and children born out of wedlock). If people are not aware of the Laws doesn't mean they do not exist! Pre-nuptial agreements are illegal in nigeria becuase Parties cannot use agreements to oust or fetter the jurisdiction and discretion of the judge. |

sometimes i hear stories that make me laugh? what grounds will the court give him a divorce? he wont get it... seriously, all he is saying is nonsense. tell your sis to have no worries, she should call family memebers to resolve it, but if it fails, she can always get a lawyer to protect her and prevent the divorce if she so wishes. but if she wants the divorce both of them can go to court to get it, but if na only him.... he wont get the divorce |

A party to a proceeding cannot before going †☺ court make any agreement that will i̶̲̥̅̊n̶̲̥̅̊ any manner fetter the jurisdiction, judgement or discretion of the Court. aℓℓ agreements †☺ such are null, void aπϑ of no effect whatsoever. $☺ no prenups in Nigeria. But it favors ɑ̤̈̊ woman becuase she can get as low as 1/3 of marital assets aπϑ as much as 2/3 of the assets depending on the circumstances of each case.. Ciao. |
