I wasn't referring to your wedding certificate; instead, I was highlighting instances where visa officers might give reasons unrelated to your application during a refusal. This underscores the variability among officers, some may overlook certain aspects, while others scrutinize more, and errors can occur in the process.
Some officers may overlook a certificate while some will probe further.

Regarding the guy whose marriage certificate is in question.

It's crucial to ensure legal accuracy in the presented information. However, the suggestion of obtaining a court sworn affidavit declaring divorce seems a plausible approach, as it aligns with the current circumstances. Balancing legal accuracy with practicality is essential, and legal guidance with appropriate persons will help him make informed decisions. That way there’s no misrepresentation of facts.

I was looking for the advice in all this turenchi... lawyers sha! grin

Hi everyone.
I really need your advice as I believe this community has been so helpful to a lot, wish I knew so many things earlier.

Just finished my MSc in Data Science here in UK, awaiting my result in November. However, there is and has been a knowledge gap and intuitively I thought to register for a data analytics boot camp, that starts in November and runs for 8-10 weeks (Primary modules completed by December ending) in hopes that I am able to better my knowledge and eventually get a visa that sponsors my stay back in the UK

My dilemma is my current visa expires in Feb 15 2024 and We are a family of 4. I am at a crossroads as to the best step to take given the timeframe

I live in Cardiff and have even sought the most commonly switched-to-visa to no avail

I know you must have come across situations similar to mine, what do you advise I do pls?

Thanks so much

Why is it a dilemma? that you have 4 months on your visa? You are in the UK legally and there's a pathway to continue to stay legally. Don't let the pressure of skilled worker visa stress you out unnecessarily. I know the concern is about countdown to ILR, but trust me, there's a world of opportunities in this Youkay, and if what I hear about the data job market generally is correct, then I think you're on the right path. There's so much you can do - ILR or not, as long as you're in here legally.

As per the "commonly switched to visa", my advice is DON'T DO IT because you're going to be restricted to working primarily for the sponsor and you will need to switch again when you find the role you want. It'll be even more frustrating if you don't enjoy doing it.

I would advice you go ahead with your training, start/continue applying for your professional roles and see what happens until February.

In my opinion, you are better off switching to your graduate visa in February than actively looking to switch to a care visa now. Trust me, the graduate visa is a gem! It allows you work unrestricted, you can even do multiple jobs and switch as many times as you like until you find your niche. (Employers in my experience even feel more comfortable employing someone on a graduate visa than someone on a skilled visa)

Stay hopeful that you will get a professional job soon, in the meantime, keep doing what you've said here, you're on the right track!

There was no need to drag the church or someone's service to God over a simple matter.

Why not address the issue and the person?

What did quoting scripture or carrying church on the head have to do with the topic?

Being careful is not equal to spreading fear.

I hope the day police takes away that lady's child, we will dig up this chat.

The bold part says it all. Just imagine this!!! What a wicked thing to say!! "The greatest single cause of atheism in the world today is "Christians"..."

You left the chat because I called out your hypocrisy using the bible you claim to follow. My message to you is to stop scaremongering and my angst is that you're painting me as the bad guy for trying to prevent someone from taking a rash decision based on "people said".

Without fear, religion will cease to exist but people willingly give out tithe for reasons best known to them. I mean there's a UK Pastor wearing £30K LVs and £300K Patek wristwatches but people will still give the tithe.

I think everyone needs to watch this cartoon "Sausage Party". It's a subtle dig at religion and very funny grin -https://www.imdb.com/title/tt1700841/

Make I ask you

Na you be the police officer wey talk to the pikin without the mama ?

You know wetin dem discuss?

You never see when officer they reassure you meanwhile case dey happen for back

Na why home office dey always ask for more documents when people they apply for only dem and their child without the second parent to avoid cases like this especially if the person dey study.

People here say be careful, take the whole case serious, e better that way and it ends up being nothing than to say na tick box exercise when the case dey build for back

I don't have patience for stupid talks like this. The lady clearly narrated her circumstances and what transpired, and how the matter was resolved, but you lot are here creating scenarios in your head!!! No 2 circumstances are the same and hers was resolved in her favour. I have not said she should not be careful, all I have said is that she should not send her child back to Nigeria because social services were called!!!!

I am not responsible for your ignorance. You all have ignored every other thing I said and keep taking this "tick box" thing literally

I repeat again, from my personal experience, once police is called on ANY matter (i.e not only about staying home alone) involving a child, as a matter of practice, a social worker will be called to conduct a risk assessment, which is just a bunch of questions to determine if any further action is required. If no serious cause for concern is found, the matter dies there!!! (except another report is made of course) I was telling the lady not to be scared that a social worker was involved because it is standard practice and she needs not just ship her child off to Nigeria because of this incident, but you're here arguing "case dey build for back" as if you're the police officer or social worker in charge!!!

You people like arguing for the sake of it and refuse to pay attention to context. I don't ever speak on what I don't know, and it is sad that shallow minded, ignorant people like to run people's lives in this Youkay wey we all dey on top "dem say".

It's people like you who call police and social services on people because of a "hunch" - sad, bitter people!!! 🙄

It is not a tick box excercise. Don’t say what you don’t know because you want to seem nice and reassuring.

Let the person be careful and take advice from people with direct knowledge. It’s not a matter of alarming her but of making sure she’s fully aware of how things can pan out, and that she takes the neccessary precautions going forward.

Funny how you know for a fact that I'm saying "what I don't know", or that I don't have direct knowledge. Is it because I'm not dropping "LIVE" anecdotes about "my friend in Bristol"? It's like the only precaution that will satisfy you people is for her to tie her (11yo) daughter to her waist and go around the streets of London with her

You may scream much but it doesn't change the fact. My friends' kids were taken away last month over absolutely nothing, just a "hunch" that the kids were not safe. I have a few other LIVE examples in South Wales and Bristol.

I used to think like you before but after being involved in some cases and speaking to 3 Social Workers, I realized it's neither a joke nor scaremongering.

And yes, "because she born pikin, she must carry the pikin for head everywhere" if she has to. She has to ALWAYS ensure the child is in safe conditions, failure to do so can mean losing the kid. Of course, she should have a social life, but the Government must not deem the child neglected in the process of her social life.

A word is enough for the wise sha.

Pele o, Mr wise, ologbon Sodiki. Abeg rest! I am not even making a case for her social life, in fact, my position is quite the opposite.

The lady went as far as installing cameras to keep an eye on their child while they're away, and you're here repeating safe safe as if a child can only be safe when the parent is there!!!

You can agree or die!!! there is no law or minimum age when a child can be left home alone as long as the child is mature enough and there is no cause for concern (i.e risk)!!! Secondly, a cause of concern must be real to warrant taking a child away, it cannot be over a mere "hunch", you clearly don't know what you're saying... Its either your friend is not telling you the truth about their negligence or you're just here telling lies!!!

Stop scaring people please, and don't be a hypocrite!!! Na una go carry church and bible for head, and na for inside the same bible you carry for head that it is said that "God has not given us the spirit of fear", yet here you are literally doomsplaining on top a matter that has been handled. One of the many reasons why a lot of people don't take you religious people seriously. Hian!!!

"Too much fear" you say

While inphoenix was right that sending back to Nigeria should be well considered being thought as best; (s)he may have said some things that are not entirely correct and make us feel too comfortable.

It's a big offence to leave a child alone if it places them at risk and you can be easily prosecuted for it and the child taken from you. I am speaking from experience of cases I am involved in but can't speak much of because the matter is in court and it's private and confidential.

It's definitely NOT a tick-box exercise that the social services have been involved and could be a big cause of concern. It entirely depends on the officers handling the case. If you know any social worker, they'd tell you better, someone whose wife is a social worker already mentioned how serious this is.

That said, I really hope it doesn't escalate any further but you really need to be cautious going forward. I wish you the best.

Wait, so because she born pikin, she must carry the pikin for head everywhere? Or a single mother must not fend for herself or have life because she get pikin. I wish you people can listen to yourselves sometimes!

If you read what I said, it is a tick box exercise EXCEPT there is a cause for concern!!! You just repeated the same message I passed, but you still had to instill that fear that she is not safe in the poor woman, why??!!!!!!

I hate when you people scare others with all these social worker nonsense!!! You think it's just easy to take away children?

I have only socialized twice in a year for few hours close to my house.
Some people are making it look like i party every Friday. Anyway seems like I gave too much info.

You even had to ask for my age.
The issue of sending her to Nigeria was because the people around me was spreading too much fear

Thank you

Didn't mean to be judgemental, apologies if I came across that way.

Fear mongering is very rampant in our community and can lead people to make mistakes. No 2 situations are exactly the same and every case will be treated on its merit.

I'm just happy you're not sending her to Nigeria. Just try and find a way around not leaving her overnight. You both will be alright, best wishes!

Viruses:

There are different categories of job

1) There are jobs that pays £10/hr, there are jobs that pay £20/hr, there are jobs that pay £25/hr and so on

2) There are jobs that pays little at the start and it increases with experience, while others do not increase with experience.

Meaning if you have a job paying £25/hr for instance, even without packing extra shifts, you will earn more than someone working £10/hr and is parking shift left, right and center.

My advice to immigrants is instead of packing shifts upandan with the intent of having money, look for that job that will pay you more with less work.

In other words; in your situation, rather than asking for a job that will give you opportunity for more shifts or that will have an understanding manager, ask for skills that are in demand that pays well and has good prospects, use the little spare time you have to develop those skills and with the same hours as you are working now, you will earn more.

Don't come for my head that I haven't mentioned any skills, this is my own contribution.

There is no single lie in what you've said. Simply put, to work hard or to work smart? It may sound merely theoretical to some, but it is the correct mindset from which to manifest. This Youkay is indeed the land flowing with milk and honey, but you gasto se kini? you must to je k'ori e pe...

Nigeria is best option now for me. I just want to know if other people passed through this and how they scaled through

Please weigh your options before deciding on what is "best".

From personal and quite similar experience, I'll advice to please keep your child with you.

There is no law against leaving children at home and there is no set minimum age where a child can be left at home by themselves, what is considered is the child's maturity which the officers have been able to establish in your case.

What you will have a problem with is leaving a child alone overnight. The minimum age that will be permitted is 16.

Also, once the police has been called on ANY matter regarding a minor, social services must be involved, its standard procedure that is just usually a tick box exercise, except there really is a cause for concern, which I don't see from what you have explained here. A lot of scare mongering about social services "taking away children", but for that to happen, it must have been quite a bad situation or parents' are annoying or display oversabi attitude. They will escalate it for you for example if you use some "buzz words" or display some body language they look out for that Nigerians tend to use that set alarm bells ringing, so even if there is no real issues in their investigations, such utterances or attitude could land you in hot water.

Now back to you..., you certainly can do without the reason for which you have gone out late at night, can't you? I don't know how old you are, but come on now... there are certainly other ways and times to socialise, innit? 😀

My point is, if the only reason you are considering returning your child to Nigeria is because you want to enjoy the night life (as opposed to you needing to work nights for example, even then sef) then I think you can make that sacrifice for you to watch your child grow with you.

It might also interest you to note that when time comes to attend Uni, you can avoid paying overseas fees by virtue of "long residence" which going back to Nigeria might make a bit more challenging...

Just thought to drop this here

https://www.whatdotheyknow.com/cy/request/588049/response/1408595/attach/5/FOI%20Response%2054681.pdf?cookie_passthrough=1

Summary

Dear Ms Boateng

Thank you for your enquiry of 23 July in which you requested a variety of information
regarding Biometric Residence Permits (BRPs). Your enquiries have been handled
as a request for information under the Freedom of Information Act 2000.

Information Requested

FOI 54474
A 2016/17, 2017/18 and 2018/19 database on the number of people who were
issued with civil penalties (and the range of fines issued) for failure to return their
old/expired biometric residence permits (BRP)
FOI 54681

As requested, I would like to clarify on what information I am hoping to receive.
Currently entry clearance applications under the Points Based System (PBS) receive
a vignette in their passports and a biometric residence permit (BRP) when they
arrive in the UK.

If they would like to extend or switch into different immigration categories, they would
need to make a Leave to Remain application. If their applications are successful,
they would receive new BRPs (making their expired or old BRP invalid)
The Home Office decision letters (applicants currently receive) states that the
applicant will need to return their expired or old BRP by cutting it up in 4 squares or
face a penalty of up to £1000 if they fail to do this.

Therefore, I am requesting a 2015/16, 2016/17 and 2017/18 data showing the
following:
1) how many people returned their old or expired BRPs?
2) how many people were fined for failing to return their old or expired BRPs?
3) what was the range in fines people received?

Response

Regarding your above enquiries; to provide this information would invoke the FOI
cost limit exemption. Our electronic systems are unable to identify how many people
returned their old or expired BRPs records to UKVI.

In order to answer your enquiries, the Home Office would have to make a manual
trawl of all our records in order to collate your requested data. This would be neither
cost nor resource effective and therefore, under section 12(1) of the Act, the Home
Office is not obliged to comply with an information request where to do so would
exceed the designated cost limit. We believe that to provide the information you are
seeking would breach this cost limit and as such we are unable to supply it to you....

Yes. It works for dependents too.

How it selects people it works for isn’t published. I believe I’ve heard that it doesn’t even work automatically for all main applicants. Ultimately, if it says service not available, you need to go to VAC.

No way around it.

Thank you! I tried it again just now and it has gone through. I think the service was down or busy the previous times I was trying. So glad I don't need to go to a VAC and spend money and waste time on top!!

Chose the option trying to complete dependants application, but it keeps saying service not available. I was hoping not to need to submit dependant's application at a VAC cry

Going through my Visa, I just realised that it will expire in may 2023. The same month my wife finishes her program. Was thinking that there is usually a buffer of two months or so after graduation to sort out PWP or is it just the norm? What shall we do? Engage the school international student dept? Suggestions are welcomed

I had this same issue with my dependent and failed to address it soon enough, needless to say, it was hellish when I was to apply for postgraduate visa.

A shorter visa expiry date is an Home Office error - your dependant visa is supposed to be valid until the same date as the principal applicant's. Get in touch with them asap and they'll correct it.

I think one of the reasons why we're not moving forward as a country, is just because we failed to support and love ourselves.
Over years, I have consistently observing lifestyles of minority communities in UK like Indians, Pakistanis, Bangladesh & few Chinese just to mention few. Most of these communities will bring their brothers from their various countries staying with them assisting them in selling their petty business on high streets.

I visited one of my Pakistani course mates during my undergraduate programs, to my astonished they were visually 6 people living in a single bedroom flat with happiness and show of love. An average Nigerians in UK have competitive mindsets, they always see friends and families as competitors. Let love reigns. Help if you can and say No if you can't.
Nature will always lifts those who are willing to give arms to fellow beings. To those bad wagons you'll all soon be Baba & iya London!
A word is enough for the wise!

You hit the nail in the head! You need to see the twinkle in my host's eyes the day I told them I had saved £6000 towards my tuition. That was the day hostility started. But me? I just pretended I didn't see it and continued to play my part. I didn't even bother to involve anyone. No family member got to know, because I found out that raising concerns about hostile treatment would be termed "being entitled". I just sucked it all up and put all my efforts into maintaining a cordial relationship. It remains the hardest thing I've had to put up with in the decades I've spent on earth, but, na me know wetin I dey find.
