The National Assembly has put measures in place to ensure that its jumbo allowances are not slashed by the Executive.

Investigation by our correspondent revealed that the legislators had, through the amended 1999 Constitution, removed their budget from the Federal Government’s overheads and made it part of the annual statutory transfers that must be released directly to beneficiaries.

It was learnt that with this move, the National Assembly’s budget could not be altered even if the national budget must be cut to tackle the effects of an unexpected revenue shortfall as long as it had been signed into law by the President.

Other bodies receiving funds from statutory transfers include the Niger Delta Development Commission, Independent National Electoral Commission, National Judicial Council and Universal Basic Education Commission.

A top government official, who confirmed this, said it was clear that the Constitution was amended without public debate to guard against the kind of public outcry against legislators’ jumbo pay, which began in November 2010.

The source, who asked not to be named because of the sensitive nature of the matter, said, “Contrary to public view that the National Assembly has reviewed recurrent expenditure downward, the reduction is a make-believe, because of the transfer of the lawmakers’ budget, which used to be under the Federal Government overheads, to statutory transfers.

“Now, if the President signs the bill into law, if they (the legislators) decide that they want their entire allocation now, since it is under statutory transfers, they will get it. The implication also is that if the government can’t achieve its revenue target, and there is going to be any budget cut, the government will give them that money statutorily.”

According to the amended 1999 Constitution, Section 81 of the Principal Act is altered by substituting for the existing subsection (3), a new subsection “(3).”

The new subsection “(3)” states, “The amount standing to the credit of the (a) Independent National Electoral Commission (b) National Assembly and (c) Judiciary, in the Consolidated Revenue Fund of the Federation shall be paid directly to the said bodies respectively. In the case of the Judiciary, such amount shall be paid to the National Judicial Council for disbursement to the heads of the courts established for the Federation and the states under Section 6 of this constitution.”

Before the amendment, the Constitution simply said, “Any amount standing to the credit of the Judiciary in the Consolidated Revenue Fund of the Federation shall be paid directly to the National Judicial Council for disbursement to the heads of the courts established for the Federation and the states under section 6 of this Constitution.” No mention was made of the National Assembly.

However, another top government official close to the budget process said, “Recurrent expenditure is made up of four main items – statutory transfers, debt servicing, overheads and personnel costs. Items that go into statutory transfers are defined by the law and are usually formula-driven. They are prioritised and so you must allocate them first. You can’t reduce them.

“The National Assembly’s budget was formerly under personnel and overheads. Now that they (the legislators) have put their budget under statutory transfers, you can’t touch it. They (the legislators) have increased their allocation by N121bn. But because they have moved their budget to statutory transfers, the Executive cannot challenge it. When it was under overheads, if it was N100bn, for instance, the Executive could say, ‘no, you can only get N50bn.’”

However, a Lagos-based lawyer, Mr. Femi Falana, said, though the amended Constitution provided that the legislators would no longer need to go through the Executive to access their funds, it did not mean that they would not account for the money spent.

He said, “The so-called statutory transfer is nothing new within the context of our constitution. What it means is that the National Assembly is now self-accounting. Under Section 85 of the Constitution, the Auditor-General shall audit all the accounts of all the departments of the government, including the National Assembly.”

With the addition of the National Assembly’s budget, statutory transfers have increased from about N183bn in the 2010 budget to N496.62bn in 2011.

Of the N496.62bn statutory transfers approved by the assembly, NDDC got N54.32bn; Judiciary, N95bn; UBEC, N62.38bn; INEC, N52.18bn; while the National Assembly got the largest share of N232.74bn.

Sochan, this road was supposed to be fixed by an Edo PDP godfather by name Tony Anenih. The contract amount was 350 billion naira. He turned around and donated half of that amount to OBJ's campaign. He actually produced a proof of that donation to OBJ during some hearing. That's why that whole issue about that road was swept under the carpet. Point blank, GEJ would probably give the contract back to Anenih again, and the same circle of events will repeat itself. The bottom line is that no airports are gonna be built, no roads are gonna get fixed. Quality of life will continue to go south. To sum it up, VOTE BB

I have been living here for 2 years now (after living in the US since 1991), and I fought issues like this all this whlie. I have given up, and I am now part of the system (trust me you no fit change the system. You can only join or move back to yanky or wherever you come from.

Nigerian police officers are underpaid, and as a consiquence of that, we the innocent citizens are bound to make up the underpayment. That's why we are constantly extorted. You are lucky they did not whip your backside sef. In most cases they would brutalize you, and nothing will happen. They are very indisciplined and uneducated.

OK here is a picture of a 9ja police officer on duty (hillarious as hell, but sad). I hope this makes you laugh (Mind you he is on duty sipping on some Star Lagar beer and smoking on a cig)

It depends on how old you were when you obtained your first degree. Sky is the limit if at the time of your graduation you were less than 30 years old. For instance, if your current age is 60 years old, and at the time you graduated with your first degree, you were not up to 30 years, then you must do the NYSC. However, if you were >=30 at the time of your graduation, then you are exempt

I am currently doing my NYSC in Lagos. I was born in Tuskegee Al to both 9ja parents, I have a Nigerian passport. "YES AS A FOREIGN GRAD, YOU CHOOSE YOUR STATE TO SERVE IN" (UNFORTUNATELY). I am currently doing Batch B, I went to Abuja with my credential, so I believe that you must go to Abuja to present your credentials. The whole stuff is so easy, do not go out there spending your dough on something you can easily take care of yourself. Depending on your age, you might have lots of fun in camp. I am a little bit older, so I did not stay in camp ,I tipped my way outta camp grin  . Good luck

This is one heck of an alliance Buhari/Bakare (classic alliance to be precise). However, how da heck are they gonna sell this to the average south south and Igbo man that hasn't had the opportunity to see one of their's run this country.

Regardless I am voting Buhari all the way, because I believe that he is the one that will go retroactive on all the corrupt politicians including OBJ and IBB. To hell with the GEJ's "lets move forward and forget the past" sh-t. We definitely need someone that can go back and probe these corrupt folks, and I believe that Buhari or Ribadu can effectively do that. I know people do not expect GEJ to probe his father (OBJ) or even proba anybody that has anything to do with PDP. Here is some background info: Her child is 4 years old, she is 24, and I am 30. I knew that she has a child all along, but we are getting really serious these days and the family pressure is on (on me). The dude that knocked her up simply bounced because her child turned out to be a female ( He never came back, not even a mere phone call).
I know in the US, where I lived for over 15 years, stuff like this flies easily, but here in 9ja, society still frowns on that.

Thus, if you were in my shoes, what will you do?

I didn't regret moving abroad in 1991, and I don't regret moving back to 9ja in 2009. As a matter of fact, my living in the USA enabled me to see the various opportunities here in 9ja. However though, 9ja is still a sh-t hole, quality of life is extremely low. For instance I had to travel 30 minutes to go get my work out on in Festac this morning, NEPA hasn't given me electricity since 3 days. But I gotto say this, all you folks in diaspora need to come back, yall aint never gonna regrete it. Word up

Policemen In Show Of Shame In Lagos

POLICEMEN are out in every society to keep the peace, and maintain law and order.

But the story was different in Lagos yesterday, as three policemen engaged in a brawl at Ajegunle, along the Lagos-Abeokuta Expressway, endangering the lives of hundreds of road users with their AK 47 rifles held carelessly as they exchanged blows.

People were seen scampering for safety, and nobody could tell what caused the fight, which got so messy that the policemen wrestled and dragged themselves on the ground.

The fight caused a heavy traffic build up that lasted for hours on both sides of the road.

The three fighters are corporals serving in the elite Mobile Police Force.

Some motorists and hawkers, who could have intervened, were afraid of the guns they were wielding while the fight was going on.

One of them said: “We don’t really know the cause of the fight. We just saw them fighting. Some of us tried to move in to know the cause of the fight but because of the way they they were holding their guns while still fighting, we were afraid of a case of accidental discharge.

“It would have been better if they had handled the matter more maturely than to engage in a street fight.”
