For now, it seems that Nigeria does not have a government.

Nigeria is now on auto pilot. The President is nowhere to be found. Nothing seems to be working anymore. By the way, where is Fashola? Is he not supposed the Minister of Power,etc? What is he doing about this darkness that pervades the entire nation. The other day, it was the Enugu State Assembly giving EEDC quit notice out of the State. Today, it is another State protesting the ineptitude of BEDC. And so it is all over the country. Is Nigeria a failed State?

Ajax vs. Lyon

It is great to see Ajax, a true European heavyweight in the latter stages of European club competition but they face a stern test in Lyon, the French side that tends to underachieve although it has great potential. Ajax captain, Davy Klaassen might have a key role to play in this fixture as he generally tends to be the pivot for all that is good about the Dutch giants. The same can also be said of Alexandre Lacazette for Lyon with his impressive goal scoring form.

This is likely to be a high-scoring fixture but I suspect Lyon have a lot more experience playing in a stronger French league and this might just prove pivotal.

I tip Lyon to go into the final.

Celta Vigo vs. Manchester United

I am sure Manchester United fans expect to win this competition even with Zlatan Ibrahimovich set to be out for months. However, any team from the Spanish Primera Liga that gets to this stage of European competition is usually difficult to beat. They are usually good on the ball and technically sound with gifted players. Iago Aspas and Manchester United old boy, Giuseppe Rossi should prove a handful for a Manchester United team that has proven wasteful in recent weeks.

However, ultimately with Jose Mourinho at the helm as Manager and a squad that still has talent like Paul Pogba, Marcus Rashford, Mkhitaryan and co. I expected United to be in the final.

So, I am looking forward to a Manchester United vs. Lyon final.

Where the EFCC Act is inconsistent with the Constitution, the law is that the Constitution will prevail to the extent of that inconsistency. The Senators should take a chill pill and allow the matter to rest. EFCC Act is inferior to the Constitution of Nigeria. But how can a legislator be dumb to the extent of not knowing that views expressed by Prof. Osinbajo on the issue is the position of the Presidency? Or is Osinbajo no longer the Vice President of Nigeria? And an active one at that? These Senators sef! A bunch of jokers!

Prof. Osinbajo (SAN) position is a probable constitutional authority. If they are not satisfied they should approach the supreme court for interpretation as the burden of proof is on them.

Section 171(1) of the 1999 constitution as amended has bring to nullity the EFCC act they are sole relying upon to the extent of its inconsistent.

You are right. Even Section 60 of the Constitution refered to by that Senator has no bearing or relevance to the issue under discourse. And yet, he is a Senator of the Federal Republic, making laws for the country.

The Vice President may be right when he stated that the appointment of Magu by the President does not need legislative approval. According to Sec. 171(1) and (2) of the Constitution, legislative approval is not required for the appointment of EFCC Chairman.

The President of Brazil was impeached for corruption. Another President was recently impeached and detained on the same score. She may likely face corruption-related charges. These were serving Presidents. So, why should former President Jonathan not answer questions on his corruption-stricken government? GEJ, Obasanjo, Abubakar, Babangida and others must all answer questions on how they ran the country aground during their time in government.

The Nigerian National Petroleum Corporation (NNPC) on Thursday confirmed the disengagement of officials linked with missing 130 million liters of petrol.

A high ranking source in the ministry, who did not wish to be named, made the confirmation to the News Agency of Nigeria (NAN) on Thursday in Abuja.

The source said: ”a committee has submitted it’s report and NNPC has recommended their disengagement”.

The officials were linked to the missing petrol stored at private depots through a thoroughput arrangement.

NAN recalls that Mr Henry Ikem-Obih, a Chief Operating Officer (Downstream) in NNPC, had on March 17, revealed that about 130 million litres stored at the Capital Oil & Gas depot and over 30 million litres in MRS Limited depot, all in Apapa area of Lagos, were not found when needed.

Ikem-Obih had said the infraction by the two downstream companies was a clear violation of existing contract which prohibited the firms from tampering with the volumes in their custody without express permission of the corporation.

He said the companies were called to explain and given two options to either return the full volume of what was stored in their depots litre-for-litre or pay the full value of the products taken without approval.

He had also mentioned that NNPC alerted the Directorate of State Service (DSS), the Economic Financial Crime Commission (EFCC) and relevant committees of National Assembly with oversight function on the corporation’s downstream operation to help recover the assets.

The officials were reported to have been sacked and later advised to resign, but are now officially disengaged from the services of the corporation. (NAN)

Ademola is not a Justice of the supreme court. You know that you are ignorant of the subject matter.

A typographical error. Justice Adeniyi Ademola is or was a Judge of the Federal High court, Abuja Division prior to his being docked on corruption charges. Right thinking members of the public still perceive him as very corrupt despite the temporary respite granted him by a fellow Judge of FHC.

Not only is he a judge of a federal high court, justice ademola comes from a family of Jurists, his grand father was ounce a chief Justice of Nigeria, his own father was ounce a justice of the court of Appeal and he himself is a justice too. This case was lost purely because of poor investigation and FG & EFCC should be held accountable. Media trial is very different from judicial trial, seems FG relishes in media trial while failing in her responsibility to do a detailed investigation that will allow them get a successful trial.
How do you jail somebody just because he got a "gift" and couldn't link the gift to a crime? It's not for the judge to help FG/EFCC, they must prove their case beyond reasonable doubt. There are more cases to be lost ahead if this lazy investigation approach continues

The fact that the judge dismissed the case without even allowing a trial says it all. The anti corruption war is doomed if every arm of government keeps protecting their own from punishment.

The executive protected Babachir Lawal and Abba Kyari from prosecution even when weighty allegations were made against them. The National assembly rallied round Saraki and Dino despite the serious corruption and certificate forgery allegations against them. Now, the judiciary has also joined the fray by protecting one of their own.

The federal government should not waste time and resources appealing the high court judgement. They will get the same outcome at the appellate court. The president should start by taking action against those accused of corruption in the executive. That is the only way to send a strong signal that he's serious about the war on corruption.

In saner climes, that judgment will be seen as travesty. It defies all logic.

Federal Government Thursday appealed the judgment of Justice Jude Okeke that nullified the corruption charges against Justice Adeniyi Ademola, Mrs. Olabowale Ademola and Mr. Joe Agi (SAN).

Also, the government through the federal Ministry of Justice has filed a fresh case in the Code of Conduct Tribunal, CCT against Justice Ademola and his wife for living above their income and failure to declare their assets.
It will be recalled that Justice Okeke of the High Court of the Federal Capital Territory, Wednesday April 5, 2017, upheld a no case submission by the Defence in the corruption case against Justice Ademola, Mrs. Ademola and Mr. Agi.

The judge also struck out the 18-count charge proffered against the Defendants after holding that the Prosecution failed to prove any of the allegations despite the provisions of sections 53 and 60 of the Independent Corrupt Practices and Other Related Offences Act (ICPC Act).

However, sources in the Presidency informed State House Correspondents that the government had been advised to appeal against what is described as “a very strange outcome indeed considering the underlying facts.
“It is even stranger that the trial was not allowed to continue considering the applicable statutory provisions.

“Section 53 (1) of the ICPC Act raises a presumption that any gratification accepted or obtained by an accused person must have been corruptly accepted or obtained until the contrary is proved. Section 60 of the Act does not apply to the case.

“Of interest is the decision of the learned trial judge that the offence of giving and receiving gratification was not made out by the prosecution against the defendants in the face of the evidence held in court.

“Prosecution witnesses gave testimony of the payment of N30 Million in three tranches by Mr Joe Agi (SAN), into the account of Mrs Olabowale Ademola, the wife of Justice Ademola. Agi was a legal practitioner who actually had cases in the court of Justice Ademola.

“The defendants, however, claimed that the money was a gift from common friends for the benefit of Justice Ademola and Mrs Ademola to support the wedding of their daughter’’, the source narrated.

The source added that the evidence of the defence suggesting that the source of the money was not Agi, was unclear at best and ought not to have formed the basis of the learned trial judge’s conclusion at this stage of the proceedings.

“What was clear was that the last tranche was paid shortly before Justice Ademola granted a garnishee order in favour of Agi’s client to the tune of about $637 million.
“Prior to this, it was also not disputed that Justice Ademola’s son had received a BMW vehicle worth about N8,500,000 from Agi.’’
The presidency source continued: “One of the charges dismissed relates to the possession of firearms by Justice Ademola without a valid licence.

“On this, Honourable Justice Okeke held that the Firearms Act made provision for a time lag, that is, for Justice Ademola to continue to hold on to his firearms and ammunition even after the expiration of his licence.
“In this case, a new licence was tendered in a situation where Justice Ademola ought to have tendered a renewal of his old licence. Being in possession of two licences in respect of the same firearm ought to have raised some questions for the defendants to resolve.’’

According to sources, within the prosecution, the ruling suggests that the learned trial judge proceeded to ascribe probative value to the evidence of prosecution witnesses at the stage of a no case submission when he ought only to have considered whether a prima facie case had been made out by the prosecution against the defendants.

“The learned trial Judge had held that there was no link between the gratification received by Justice Ademola and the judgment he delivered in favour of Agi.’’

The source maintained that the ruling failed to address the relevance of section 53 of the ICPC Act which raised a presumption of corruption in respect of the gratification in question.

The source said this and other troubling questions must be addressed in an appeal against the ruling.

When contacted for official comments of the presidency, the Senior Special Assistant to the President on Media and Publicity, Garba Shehu denied the existence of a rift between the Executive and Judicial arms of government over this issue and other recent judicial decisions posing a challenge to the war against corruption.

According to him, the relationship between the two arms of government has been very cordial, adding that nothing has happened to change the nature of the relationship.

Nigeria is a failed State. In saner climes, an ex-convict like Ibori who stole his State blind will not dare show his face in public but not in this country where anything goes. Do not be surprised to see him tomorrow angling for an elective office or even rewarded with a government appointment because in Nigeria, anything goes. Read somewhere that he is friendly with some powerful members of Buhari's kitchen cabinet.

This Saraki must be a very corrupt individual. PMB should summarily sack all the corrupt elements in his government if he wants to be taken seriously on his fight against corruption.
