RealityKings1: ✓ A constitution is a set of CODIFIED fundamental rules that define how a country or state is governed. It simply means they are written down clearly in a specific document. But that does not mean the most influential person in the state can't employ state tools to effect your immediate removal if necessary if the codified fundamental rule does not bestow on this most influential person the power you describe then he cannot, using whatever imagined state tools to do what you claim.  Based on the constitution the President DOES NOT have power to institute the removal of any elected official from office. He can remove those whom he employed but none other. Only the electorates, and the Senate have power to vote any elected official out of office.  |

Mr Soludo and the gentleman in Abia are wasting their time rushing to pass new laws to effectively preserve the status quo. The role of the Supreme Court, in any democracy, is not to violate or override the Constitution but to correctly interpret it as is written. The Supreme Court decision stands in direct violation of the Constitution.  2. As I already pointed out earlier, Nigeria and Nigerians have no regard for their laws. Any business entity is allowed to gave multiple accounts for its business purposes.  2. The current constitution clearly indicates that the State Government is to create and maintain(not directly access for its own purpose) only one account for FG to drop the LG-related funds into, after which, the State is then to distribute the funds in that account directly to the LGS based on sharing formulae/decision made by the National and State assembly.  3. LGS fund decisions are equally made by the National Assembly. So, it isn't just the state senate but also the National Senate as well.  4. Here's the problem. The state assembly should not have the power to do any of you insist that Anambra State has done. In much the same way that the National Assembly is not able to demand the States deposit a percentage of the funds, it receives into an FG-owned account, so also, the State Assembly has no right to demand that LGs place a percentage of the funds they receive from the LG into any State-owned account. Everything you described here violates the current constitution. But because this is Nigeria and Nigerians don't particularly care, these things are allowed to happen.  |
