EXTRA TIPS FOR BUYING A PLOT OF LAND IN OGOMBO THAT YOU SHOULDNT IGNORE:

1. Everyone buying must definitely meet the representatives of the family owners to verify proof of the ownership of the land but if it’s a direct individual seller you also have to meet the person alone. Never buy a land without knowing who is Selling. Never!

2. Everyone buying is entitled to view the general layout of the areas for sale to confirm its authencity. I will not encourage anybody to buy without any physical inspection by you or a representative you trust and will never buy a property for someone on your behalf anymore. Always ask for the copy of the layout of the place and if it has no layout ask for the individual survey plan. If there is none, walk away. Something funny is cooking.

3. All payment must be done in the presence of the family representatives and me if you choose to contact me as your Solicitor or your lawyer. No hidden hanky panky games. Any agreement that payment should be done secretly without any form of acknowledgement is a prelude to a scam. Its also more advisable to pay via a cheque rather than cash to aid you in respect of documentation so if something goes wrong it can serve as proof of payment or it can be easily cancelled by your bank.

4. Everyone is entitled to a copy of the global c/o, 4 copies of the deed of assignment signed by the families,1 copy of the deed of assignment covering the  portion of land owned by the family,  a covering letter from the family to alausa, purchase receipt and duly signed form 1c. This is what the legal fees takes care of (That's if you follow the proper channel to get them or using me). wink

5. Most importantly you will be linked to other people who have bought plots there (more especially Nairalanders for you to have your own mini estates) for you to do your own independent verification to see if there is any funny deal or issue. Your free to carry out your own independent investigations and Mr Tony flez stays in the Ogombo town so its very easy for him to show you the sights , sounds and people of Ogombo anytime. Ogombo is one of the most organized and transparent families in AJAH and their documents speak for themselves.

6. You can come with your own surveyor and do your own research and negotiate the price with him at your own cost. If you dont have one i can recommend a couple but you deal with the surveyor independently of me or MR TONY FLEZ because we dont share their money and they are also professionals to do their own jobs independently of ours.

7. If you see a plot for sale in Ogombo with a foundation ask for the building plan  to compare. Never buy a land in Ogombo when you see a foundation without knowing the owner and the building plan to support such claims. Also ask for the survey plan to compliment your search.

8. If you see a land with existing beacons there, ask the agent to bring the survey plan for you to compare whether it corresponds with what is on the survey plan. If they dont provide none, walk away. It belongs to someone else.

9. Fenced lands are very difficult to prove ownership because you dont need a building plan to fence your land so tread with caution and ask all reasonable questions to verify ownership.

10. When a family member says he is the owner of a particular plot, venture to ask him what family in Ogombo he comes from and he is representing, because with that its easier for you to relate it back to me to investigate.   

11. All secondary sellers from ogombo must have a deed of assignment signed by the ogombo families. Always ask for the deeds, survey plan and original reciept to confirm ownership.

12. When you buy a land in Ogombo always attempt to show sign of development there by either trying to fence it or put materials on it or clear it constantly. Try to get friendly with the sellers to assist you in looking after your lands too.

13. Finally be aware that there is no property in lagos that is 100% free from wahala that a person should know in advance. We all try our best to be as transparent as possible and put the omonile's in check but we should also be on our guard too as individuals to shine your eyes and protect what ends up being yours.



Now for those that have deeper pockets and want a more serene area in Ogombo there are also lands that start from N5Million upwards such as Golden Park. It really boils down to your choice and you will be shown every where for you to decide on your own. Because of the popularity of Ogombo that has been in existence for years, the price for a plot of land there goes for N1.8 Million Naira and above for A plot [/b]depending on the availability of the land and the level of development there, [b]in fact getting one at that price should be considered a steal but you should press your local agent to scout for the best deal and land for you and that's minus other expenses such as legal fees, agency fees, survey fees and Signing fees and above because of the constant demand for lands there but I should know the prices vary depending on the area, the family selling, the documents they have and proximity to amenities.

For the families to sign their documents it will cost you N100,000 +, Also Survey fees costs between N70,000 to N150,000 Depending on the surveyor  you employ, Agency and legal fees range between 10% each and you or your lawyer must have a link directly to the family to get your FORM 1C Signed and the letter of approval directly from the family unless it will be difficult for you to process your governors consent without them.  Its also necessary to say most plots there are standard plots of land ranging from 600sq to 648square meters.


Already a few number of Nairalanders have purchased lands there since the beginning of the year and are creating their own mini Nairaland estate there but I waited this long to see if any problem whatsoever would crop up that would make me not expose it to people but so far so good, the buyers are happy and I pray it stays this way and allow others that need the lands to benefit.  It must be stated though that some of the lands are not dry land during the rainy season but like every other land in lekki ajah you must do a raft whether it’s a dry land or not due to the proximity of the lagoon but getting a cheap dry land in lekki where there are so many amenities and developments and mansions is a rarity, so you cant eat your cake and have it.

The Major  attractions after my search  for me to endorse Ogombo comes in various forms such [/b]as:

1. [b]Compared to many areas in Ajah, Ogombo town is very developed with a lot of houses and amenities surrounding the area with a lot of people living around
there compared to areas in ibeju lekki where it’s a virgin environment and you have to wait for years to build slowly till the population quietly picks up. It’s a place where you can buy and build without waiting for the next person. It is a very popular place in Ajah.

2. Ogombo as an entity is being controlled by 7 families ( used to be 9) and all the members of the ruling houses must consent to the sale of a land unless the sale won’t go through. This helps to eliminate fraudsters selling lands without the consent of the owners because they keep their records,

Ogombo has a global c/o registered as No. 73 at Page 73 in Volume 1996 AD dated 18th  of June 1996 at the Lands Registry Office Alausa, Ikeja Lagos State and the survey plan coordinates fall under the Ogombo gazette that can be verified at the Surveyor Generals office at  Alausa so the documents are top notch.

4. Its very close to these popular areas such as Abraham Adesanya Estate, Lekki Scheme 2 and Okun Ajah . In fact its far more developed than Okun ajah with a functional 24/7 police patrol and a recognizable police station in Ogombo that also covers the Abraham adesanya estate, okunajah and lekki scheme 2 axis.

5. The major roads leading into Ogombo town is developed and tarred and a lot of expansion and developments have being proposed there.

6. There are so many proposed estates that are in the planning stage that is going to make that place explode and there are some estates already functional that are being habited by lekki top shots.

A lot of people have been asking me to recommend a place for them to buy that is affordable, free from omonile wahala, fraudulent land scammers and the documents are very good.  I refrained from hastily endorsing any land for sale for a long time because before I recommend a place I must know the ins and out of that particular area, the owners and do my own independent search at my own cost to know its validity. For the past 4 years i have been criss-crossing the 4 corners of lekki/ajah and everyday i am learning about new towns and new places that so many people don't know about and i try to share my experiences good or bad with people and ask people to verify for themselves. I have done alot of searches for people in eleko in respects of lands they wanted to buy and i have combed the areas thoroughly and even met some of the original settlers who have told me their stories and complains of neglect and what they want the government to do for them. I will never come out to say anything i am not conversant about talkless of relying on you tube like you to criticize people when you don't even know what the name of the petrol station leading to eleko is called.  

To say that people living in lekki/ajah/ epe expressway are not suffering is to be unkind to the occupants there. The traffic is killing them there and all they need are more roads and channels to make their homes and offices get closer to them. To move from Abraham adesanya to Badore junction at a very bad hour could make you sit down there for almost 20 to 30 minutes because of the traffic grid lock and your still probably going to the mainland. What is more important to those in those areas? An airport or link roads to ease communication? Even the toll gate hasn't solved the so called traffic and in my own opinion has even made it worse with all the traffic lights and stop gaps And your telling me i dont know about the developments of economics. It has nothing to do with who is in power or who i voted for or not. The priority of the people must be taken care of firstly before huge projects that would only worsen the situation.

You went to LFT 2 weeks ago and you saw nothing? You even asserted that people in the area don't know anything about the project, but the state is talking about it everyday, there are hard working state officials including the LFT empress (Shola Oworu) working on the project 24/7, the governor campaigned in the are just weak ago shouting about the projects to the same constituents in the area and promising to prioritize the project.

When did i attack the rational of the free trade zone?  This was exactly what i wrote and dont misquote me:


Talking about the FTZ When last did you visit it? I was there 2 weeks ago and i can assure you that half of the population in the lekki/ajah epe axis don't even know where the place is and apart from AMEN Estate there and  Eleko Beach  what other development is there surrounding the ftz that the populace there can lay claim to that they have benefited from apart from land speculators buying up lands in the last 15 years waiting for something concrete to happen but it only occurs in Newspapers and LTV 8? The eleko road was built almost 20 years ago so it isn't a TINUBU/FASHOLA thing.


1. Can you describe the exact location of the free trade zone starting from Eko akete to tell us where  the exact place it is without you using google or you tube as your guide? The road leading to eleko beach is one long straight road and it gets to a T-JUNCTION Where you can either go straight on to eleko beach or choose to go right or left. From your you tube video can you tell me how long from the T-Junction it will take to the ftz and tell me what exactly is opposite the free trade zone towards the beach? Do you think the roads your talking about was created today? It has been in existence for years and those who used to party around eleko beach in the 90s will tell you that. 

2. I asked what are the developments that are there apart from the free trade zone that the populace have benefited from? Can you tell us the schools, hospitals and other amenities commissioned in the communities adjacent to the free trade zone?  Mention one since the ftz was created? At least your commissioner should tell you the names of the infrastructures provided or do we have to go to you tube to find that one too? How far have you gone to tour the communities? Apart from eleko beach there, what other beach is there and what is the living condition of the inhabitants there?  Apart from AMEN Estate can you tell me of an other known estate there and why is sales is so slow for the owners of AMEN Estate that they have to slow down work because of the lack of infrastructure or awareness of the area. Do you know the number of people still living in mud houses and no light within the adjoining community close to the beach? Have you seen them personally to ask them what they have benefited from the ftz

3. Before the free trade zone, eleko beach has always been in existence as a tourism hot spot and all the roads had been tarred for years back, so whats the significant difference in that area apart from the free trade zone hidden in one corner for the past 15 years or so?

Please don't use video evidence from the comfort of your room to show me what i used my eyes to see 2 weeks ago and will probably go there again this week or next week and take pictures to satisfy your curiosity. You have no verified anything independently but your basing your arguments on hear say! Where is the logic in that?

I see you just rely on what people say for you to base your own opinion and insult people along the way because that's the only way for you to gain attention and attract people t read your posts. If your looking for a neutral person to verify what i have just said, ask johnie who writes alot about the lekki/ajah axis to go there and verify independently with pictures to know whether i am lying or in your words stating alot of ignorant mumbo jumbo.

Besides if the ftz has been so good as you say and has impacted seriously on the economic benefit of the host communities and lekki/ajah as a whole why is it the least demanded area for people who want to buy lands? Why isn't it on their top priority list? Who today can build a house there and live there immediately apart from the host community who have been living there for donkey years? Do you know how many Nairalanders have gone there to purchase lands via inspections with me and disappeared never to return there and rather buy in mainland ajah because they don't see the viability of that area or the ftz for now?  I don't need any commissioner or govt official to tell me what i can verify with my own eyes. Please other people that are familiar with the ftz or have gone to Eleko should also say their piece and not rely on you tube to buttress their point so that we know who the real ignorant person is.

The government can not do all the things you listed and no government on the face of the earth is doing such, the only way to open up any area for rapid development is to creat the necessary atmosphere for private entities to move in and crate jobs and from there, down stream activities like schools, clinics, hospitals, accommodation, restaurants and many more moves in to cater to the new development, that's how it's done.

You can not survive or sustain anything in any area without viable business and economic activities to help the place germinate and remain  prosperous.

I was thinking this was a forum where we are to learn from each other and back our arguments with evidences and not insults. I hardly post anything in the politics section because people like you degrade it to insults for no reason and i only contributed to this topic because it deals with environments i know very well and its left for people to prove me wrong rather than transform it into insults. In fact your the first person in 6 pages to actually take it personal and stir up an insult contest. I won't come down to your level because after going through all your other posts i have seen why alot of Nairalanders in the politics section always square up to you and insult you.

I used to wonder why people abuse you alot now i know better and unfortunately i would not be one of those you derive joy in from to derail a thread into a personal insult fest.  It Is a forum to learn and proffer arguments and counter arguments. My answers might not go well with you and am not a die hard fanatic of a political party or governor. All i want is the best for myself and my neighbors and if you have a better argument to prove me wrong go ahead but Your response neither provided any meaningful argument to buttress your claim and show why i am so ignorant. Actually you seem misinformed. In your last paragraph you said they need schools, roads, hospitals etc to accommodate for the large influx of people to the lekki axis. If you didn't know the lagos state government has already created a lekki masterplan. Like all masterplans the lekki masterplan shows a planned development scheme of the entire axis from victoria island to epe and the FTZ. Fashola and the lagos state government are already using the masterplan to develop road, schools, bridge, water, sewage and electric layout for the lekki axis. They are using the masterplan to tell developers the best places for their residential, commercial or  industrial businesses. Developments such as the lekki-ikoyi bridge and the lekki airport are all part of the lekki masterplan. As time goes on you'll see more projects from the masterplan come to reality.

In addition the FTZ is still under construction. and the primary objective for the airport id to serve the lekki masterplan, the lekki free trade zone, eko atlantic, lagos state and "to complement and support Murtala Mohammed International Airport (“MMIA”), the only functional international Airport in Western Nigeria. Additionally, it is the state’s desire for the airport to develop into a new hub for business and travel in the west African region, creating an environment of excellence for national, regional and international companies."

The difference between me and a majority of posters here is that i dont base my own opinions on what other people write and deal with false propaganda. I make sure i have concrete facts before i post anything or say anything. The last paragraph of mine that you said my demands for transportation, roads, schools, hospitals etc in the lekki ajah express way shows my lack of knowledge of the masterplan done by fashola is totally wrong.

Fashola did not create the lagos master plan neither did tinubu create it. It has always been in the master plan since Jakande's era and expanded by other governors. In fact it was raji rasaki that put more effort in creating the masterplan to the lekki ajah axis and nobody expected such a population explosion in that area from 1999 till date. When your talking about a master plan without good roads how do you achieve it? Isnt it one long 40km dual highway from Ozumba Mbadiwe till you get to the julius berger bridge in the Epe township that divides it? How do you expect people to cope when the cabinet office confirms a small town in its gazette every 3 months and bring more people to buy their lands without infrastructures.

What is the last school constructed in the lekki/ajah environment and what town is it located to accommodate how many people? Where was the last hospital or maternity clinic constructed in that axis by the government? Do you know the distances people travel to get free health care for those who cant afford private hospitals? From Green spring school around lakowe can you tell me of any hospital, bank, school or any other lagos state government presence there? I shuttle those places weekly when i go for property searches and i have seen things and heard complains from ordinary folks that live there and  Apart from the controversy of the toll gate expansion that is not received too favorably by the populace, what other road or outlet are they constructing? The only roads i know are the ones that have large government estates that costs over N15Million to get a plot that they are constructing link roads such as the Lekki scheme 2, the abijo estates, eko akete housing scheme etc. I dont see any tarred road construction in areas like sangotedo, lakowe, eputu, odaragunshin etc where average people like us that dont have money to buy N10Million lands can connect the road.

Even the so called coastal road that is supposed to be the alternative road for toll gate people hasn't been constructed because they know they won't gain any revenue from it and its even in the  so called master plan that provides for 3 more coastal roads to assist road users but the govt forgot to place priority on the roads that deserve the populace attention rather its the one they can collect toll fees from they are concentrating on. Since Tinubu's era we have been hearing 4th mainland bridge, 4th mainland bridge and till date we haven't seen one stone , mortar or brick to commence work. Which is more important to people working on the Island, a 4th mainland bridge that will cost half of that amount budgeted for the airport or an Airport that i might only use probably 7times in a year?

There is a big difference between the master plan on paper and the plan they finally carry out at the end of the day, thats why i will still stand my ground that the amount of money to be spent on the airport can do wonders in opening up the lekki/ajah, epe express way if that money is invested wisely to create more roads and more immediate amenities. There are countries that have only 1 airport and they haven't disappeared from the planet. Up till date using MM hasn't killed anybody. People from Ibadan, abeokuta, Ife, akure etc still drive all the way down to Muritala in Ikeja to fly to their different destinations so there isnt any thing new the airport will do that will change that.

Talking about the FTZ When last did you visit it? I was there 2 weeks ago and i can assure you that half of the population in the lekki/ajah epe axis don't even know where the place is and apart from AMEN Estate there and Eleko Beach  what other development is there surrounding the ftz that the populace there can lay claim to that they have benefited from apart from land speculators buying up lands in the last 15 years waiting for something concrete to happen but it only occurs in Newspapers and LTV 8? The eleko road was built almost 20 years ago so it isn't a TINUBU/FASHOLA thing.

So Oga am not misinformed. I get my information directly from the surveyor general's office, ministry of waterfront, the cabinet office, town planning and land bureau and i go there myself to see things one on one. Master plans are paper plans until it has been realized in a feasible and realistic manner. Do you know how many times the master plan has been altered to accommodate different new towns created or the ones judgment has been given in their favour? Do you know how many people have bought lands in places tha has been acquired by government but because of the large population there they ignored the master plan to focus on the well being of people? Look at Badore for example, the 4th mainland bridge is supposed to pass there but the number of houses there are so many from the spot the 4th mainland bridge is supposed to pass through that they will have to demolish thousands of houses to achieve it. Do you think any right thinking government will demolish 1000s of homes and the owners of the houses will walk quietly into the night without any fight back? Wont the master plan be altered to accommodate where things haven't gone on smoothly?

Priorities first and be prudent with tax payers money. That's all i ask  from the Fashola Government. Nobody is antagonizing them, just do the right thing and the right time.

I don't know whether you live in lagos right now or better still you reside or shuttle the lekki/ajah/epe axis frequently. I should know because i give alot of information about those areas on Nairaland alot. It simply cannot fit into the schedule. Have you see the proposed free trade zone and all the propaganda about how its going to change the face of lagos and its hidden in one secluded part of eleko and all construction has been abandoned? Do you know how long it takes to go to Epe from Ajah? Approximately 45minutes without traffic. Have you seen where the proposed airport will be before the oke orisun housing scheme and link bridge? Do you know about the infighting going on between the omoniles and the settlers of the land and the lagos state government over the proposed location of the airport? How do you even get to the airport when the area hasnt been opened up and the amenities are non existent?

Before i said its not true i looked at all the mitigating factors that will hamper the immediate construction of that airport because its an environment i know very well like the back of my palm. Its all Politicians talk and i stand on it just the same way the FTZ or Mega City has been mooted only in the pages of Punch newspaper. I am on the ground here and not speaking based on opinions and reports from people that don't know the next community before and after Epe!      

Lekki/Ajah/ Epe needs roads, roads and more roads to accommodate the large influx of people migrating to that area in droves. They need water to counterbalance the salty lagoon waters, they need more schools, hospitals and better transportation systems to cope with the population there. An airport now is just putting the cart before the horse because it will not reduce the congestion but overload it especially when there are no roads to accommodate it.

This airport is not a priority now to be honest. I shuttle the lekki/ajah/epe axis weekly and i realise there are more pressing things like good roads and amenities needed there before an airport. Remember its only one long dual road that is serving the populace of lekki down to epe. How can fashola be create all these white elephant projects without embarking on the most pressing one which is more roads and accessible transportation. With the mad traffic on that single road, it will take a person a far shorter time to leave lekki and get to MM1 than for the same person to leave lekki 1 to get to epe within the same time. Let them face the most pressing issues in lekki/ajah/epe first and the airport can come later. It must not necessarily be during Fashola's administration that the airport must come. Its already in the lagos state master plan so its bound to be built by one governor one way or the other.

Properties / Land Fraudsters Tricks I Learnt In 2010 And Tips On How To Avoid Them This 2011 by lawyer(m): 1:45am On Jan 31, 2011
Quite a while i have written an article on Nairaland relating to property issues and to be honest i learnt more tricks from land fraudsters in 2010 than i could ever imagine. I thought i knew every trick in the book and how to deal with them but they kept on coming at me like a heavy downpour and i couldn’t catch my breath in most situations. In fact it was so bad that i almost gave up handling property matters and questioned my competence in some instances. I have taken a long time to soul search and ponder how to make 2011 more successful and also let people know the tricks and inherent dangers in not doing a thorough search for a property and also lowering your guard in trusting people when it comes to property matters because once they see that slight opportunity that you trust them, they will hit you hard.

Make no mistake about it, no matter how we pray about it or wish it wasn’t true, 419 is rampant in Nigeria and its extremely prevalent when it comes to buying landed property in Lagos. These people are tough and cold hearted and they take no prisoners when it comes to making you part with your money. So below are some rules and tips when buying property this 2011 and please learn from them because i also was a victim when i of all people let my guard down.

1. Rule number one and the most important rule: TRUST NO SELLER OR AGENT NO MATTER WHAT TILL YOU HAVE GOTTEN YOUR DOCUMENTS SIGNED, SEALED AND DELIVERED.


2. Don’t believe all the Marketing Bullshit adverts from Sellers or Agents till you have done your own personal search to confirm. The more they tell you they have a good track record for sales done properly, the more you should be prepared that you might be the first person where things will go wrong and your money will disappear.

3. Every land you are interested in, always and i mean always ask for these documents:

a. The Survey Plan

b. The deed of Assignment and how the property was transferred from time immemorial to the present day Seller:

c. Copy of the Original receipt the Seller used to purchase the land and from whom he bought it from

d. Copy of either the gazette, C/O or governors consent of the land.

e. If possible visit the property personally or send a representative you trust. Never buy a property directly from a property magazine or website without you seeing it personally or sending your representative to see it and comment on it.

If a seller tells you he is not ready to release a document because it’s a private document, please walk away. Every landed document is a Public document of record that can be investigated and searched. The more they tell you they can’t release it, the more suspicious you should be and after demanding it strenuously and its still rejected please walk away fast.

Sweet Talking by a Seller or Agent will only put you in more trouble. If the Seller or Agent says it will take him time before he gets the document but you should fast track the transaction till he gets the document because other people are interested in the land, let him go and eat the land. Without these documents for search,  your only falling victim to these fraudsters.

CASE STUDY NO 1 IN OKOTA:

A Nairalander contracted me to do a search for him in respect of a land he wanted to buy. He contacted an Estate Agent who introduced him to the owners of the land and they claimed to be family members of the Okota Ruling family. When i got to the Omonile's place of residence, i asked them to identify themselves and they brought out everything including driver’s licences, Nepa bills showing their names and addresses, bank account statements, letters and certificates showing they are affilated with the Okota Ruling families. In short everything i asked from them in terms of identification scaled through.

On a further Personal inspection of the land i noticed it was a fenced land and had a small gate man's house there. I asked the Omonile when he bought the land he said in 1978 and showed me an old receipt of the purchase with these old 5kobo stamps attached to it and he told me to take it to the Okota palace to verify it and even gave me a name to meet there to cross check which i did and the person he directed me to brought out a book showing all the transactions since the 1970s till date and confirmed that the original Okota family sold it to the omonile.

I asked the Omonile why he was just selling it after 20 something years and why didnt he build on it since Okota was a prime place, he told me he was short of money when he fenced the land and built the gate mans house 5 years ago and abandoned it but he was now ready to sell the land for N6 million. I asked him where he was living now and he said he lives in Igando and i traced his address to the place he gave me as his official address and i couldn’t help but try to compare the Okota property he said he was building and owned and the igando squalor home he is living in presently to see the differences. I had serious doubts about the seller but i couldn’t find any fault so far.I now decided to up my game by demanding for the documents of the property and he gave me a registered deed of assignment registered in Alausa in the 1980s and upon search it was found to be duly registered in their name and i finally encouraged the Nairalander to do a survey plan search which finally checked out.

After all said and done, i had nothing else to search and had to endorse the sale for the buyer and the property was going for N6.5Million but my spirit still wasn’t convinced that all was right but i couldn’t point out precisely what the problem was and how to detect it. The Agents kept on adding pressure on the Buyer that he should buy the land because other buyers were also interested and in return the Buyer added more pressure on me to endorse it quickly because he didn’t want to lose the land because to him it was a steal. On the eve of the night of paying the sum, i felt very uneasy and i took the receipt and deed of assignment and kept on going through it over and over to see if i could pick any faults but i couldn’t.

Driving home that night i suddenly had that urge to park along the road to review all the documents properly and that’s when God decided to open my eyes. The Deed of Assignment registered in Alausa in the 1980s was a perfect clone from the one i was reviewing. Everything was properly typed out and stamped exactly and dated exactly[b] except one very tiny mistake[/b]. The person who drafted the clone Deed of Assignment was an expert forger but he slept off at the end of the drafting and in one small corner he forgot to proof read his work thoroughly. In a particular line of the deed of assignment where it was to be dated 16 of April 1983, he ended up typing 16TH OF MAY 2010. That small error was all i needed to cancel the transaction. I took that same cloned deed of assignment to Alausa and gave it to 4 experts there and none of them where able to discover the error until i pointed it out and they were extremely amazed at the level of forgery.

It was’nt discovered due to human power but through God i must confess and when i confronted the Omoniles about the fraud, they simply demanded for their papers and said they weren’t selling again. The next day i came to confirm about the owners, i was told they had disappeared and moved out from the place they were staying. I further learnt that they planted a mole in the Oba's palace in Okota and doctored the log book that recorded all the transactions for people who search to be convinced its real and i finally discovered that the plot of land belonged to professor in The U.S that bought the land in the 80s from a third party seller and was developing his land little by little but didn’t know Omoniles where attempting to sell his property at his back.

So the moral of this story brings out the following tips:

a. Never trust any Omonile who brings out any document for a property that you can see that is quite new but the documents are old looking

b. Always be wary about properties that are fenced. Try to get to the bottom of it why the so called seller fenced the property and he is ready to sell because he might be selling you another man's property

c. Whenever you see foundation on a property, always demand for the building plan approval to confirm unless they might be selling you another man's property

d. Always demand for the survey plan for a fenced property and try and trace the beacon numbers either on the ground or on the wall and compare them with what you have on the survey plan and compare the date the survey plan was made and drawn and the name on the survey plan.

e. Never be in a hurry to buy a land and don’t let the agents or sellers push you till you have completed your search and convinced all is well unless when your pushed, you part with your money and you won’t see both the agent and seller again.

f. Always try and visualize a person selling a multi million naira land and his personality. Someone that looks like a person that hasn’t counted or seen N500,000 EVER CANNOT CLAIM TO BE AN OWNER OF LAND THAT RUNS FOR MILLIONS.

G. Please, Please and Please Investigate the Owner and the documents thoroughly. Don’t skimp on the search fees it could save your bank account and family savings. I get it all the time people shouting they can’t pay N50,000 for search but are ready to throw away N2 Million and above and later come back to cry to me where things went wrong.

This year i won’t even entertain such cries for assistance or help. I will rather force you to pay that money to do the right thing or ignore you because listening to some buyers last year made me cut corners to do a search and take money from my own pocket and i ended up not investigating it thoroughly because i felt sorry for them and wanted to help but when it went wrong in one or 2 situations i felt the brunt of it so its not going to happen this year again. FREE SEARCH LEADS TO FREE PROBLEM AND CHEAP SEARCH LEADS TO EXPENSIVE WAHALA FROM THE BUYER. 2010 thought me that and i have learnt from it. So please dont call me for free search anymore this year. If you pay me your widows mite, its better to hold me responsible for any flaw than hope i do it for you free and that widows mite will make me be more serious and committed to your job


CASE STUDY NO2   (DODGY SURVEYORS)


Everyone knows that i have been a foremost promoter of doing a survey plan search with a surveyor before buying and if possible going to the land with an Alausa Surveyor to confirm whether it is free from acquisition or not. Well i also fell victim of dodgy surveyors i recommended to people that ended up colluding with the omoniles to decieve buyers and me. Such instances occured in Okun Ajah, Mopo Ibeju, Sangotedo, Ikorodu, lafiaji, Eputu, Akowonjo and mowe.

These surveyors have found a way to beat the system because of their greed and its almost next to impossible for a buyer or me to know where they have gone wrong. If it is a familiar place they have been and they have met the owners of the land before and upon their search they have found out that the area is not free from government acquisition, they end up colluding with the omonile and the omonile ends up promising to give them a free land or induce them with money far above what the buyer will give them for surveying the land. So when they are to go to the land to investigate it with their GPS, they will search the coordinates and come back with a favourable report that the land is good. Because they are authorities in this department, you have no choice but to accept their word. You end up giving them the contract to do your survey plan and later on when you bring another surveyor there to investigate the land you realize that the land is committed or not free. Even on the survey plan of the land you have bought, they will be so bold as to stamp FREE FROM ALL KNOWN ACQUISTION but in reality your land could be sitting on a Pipeline or Coastal road for all they care. You confront them and all you hear is SORRY or that the instruments they used then were faulty blah blah blah.

The Omoniles have learnt to use them thoroughly to their own advantage since they know you might want to do due diligence. The truth is that it’s very rare or let’s say BIG MANISM that will make a Registered Surveyor follow you to the site to do a routine land search. They usually send their boys and whatever coordinates the boy writes for the oga, the oga just stamps it as being okay without even seeing the land sometimes. Some of The Alausa surveyors i trusted last year really messed me up atimes and i had to give up recommending anyone again. Most of the time the buyers end up blaming me for introducing them when in reality i had no idea this was what they were doing to buyers and collecting money plus free lands from the omoniles to distort the truth. This Greed and Fraud extends to all sectors of our country and its getting more difficult to see who you can trust.

When i confronted a past surveyor general of Oyo state on this issue, he told me point blank that such practices will not stop unless they change the procedure of checking land coordinates in Survey General's office and the buyer is ready to pay the right fees for a thorough survey check.


He says the law on survey check states that a survey plan must be done on the site personally and after that a[b] LAND INFORMATION WILL BE DONE WHICH COULD TAKE UP TO A WEEK AND THE SURVEYOR GENERAL WILL SIGN ON IT TO SHOW WHETHER ITS FREE OR NOT AND IF IT ENDS UP NOT BEING FREE BUT IT WAS ERRONEOUSLY SIGNED AS FREE, THE STATE GOVERNMENT WILL COMPENSATE THE BUYER[/b].

But the flaw in this system means that the proposed buyer must shell out almost a[b] N100,000 or more to do a survey plan and register it before the Land Information is drawn up and gotten and if at the end it is found that the land is not free, the buyers money goes into the drain and he performs this process all over again till he gets the right property to buy.[/b]

The Bitter truth is that how many people will be ready to go through this process? Virtually 1% of buyers so we still have to rely on these Surveyors doing their thing and hope for the best that they are competent enough, loyal enough to you first and trust worthy to deliver.

So despite the Ups and Downs of 2010 with some dodgy Surveyors, i promised myself not to introduce anybody to any surveyor personally again again but i have also found out that not helping other people because of a few dodgy surveyors means am not fulfilling Gods work to assist because of my anger of the system and untrustworthy surveyors. I have now found 2 surveyors that i can alternate with to introduce people to help with their various searches. I can only vouch for my own work that its almost perfect and i take blames for my own short comings but not the short comings of other people because i introduced them to you. While i believe they are morally upright people that SHOULD DO YOUR JOBS PERFECTLY, still have it at the back of your mind that they are human beings and can also go hay wire so they must be monitored seriously. Remember RULE NO 1: DONT TRUST ANYBODY.

So the Moral of this story brings the following TIPS:

a. Once i introduce you to the surveyor, whether private or Alausa, make sure you know his office and where he works. Your not paying me money and i dont share their money, so you must know who your giving money to and if your satisfied with him. Its not enough anymore for you to say ' LAWYER INTRODUCED ME TO HIM OR HER'. That excuse died with 2010 and i am no longer taking liability for a surveyors job. I have my own office, my law firm duly registered and my documents to back me up when called upon located in Ikeja. So also get to know where the surveyor works and know what works he or she has done I can only recommend based on previous good works and monitor them for you but your the one paying them.

b. Also when a surveyor is going on a search, make sure you ask him or her about the GPS to take the coordinates. Most of them have computers where the whole coordinates is stored in so once they punch the coordinates in the system, they should have the answer in minutes. Please try to make them show you the coordinates through the system personally or scan it out to you. It replaces the land information to an extent since your coming through the back door to be 100% sure of what you’re buying. If your surveyor can't give you concrete facts to back up his case, please abandon him in a Jiffy. Don’t get sentimental. I was a victim in 2010 because i was sentimental. This 2011, Mr. Sentimental has Died. No Dulling!!! tongue

c. Most surveyors charge exorbitantly but one thing i will advise from now on is this. Never pay a surveyor his full money until he has done the survey plan and has placed the beacons on the land. Also demand for the red copy after the survey has been done and pay that extra money for land information search to cover you. PENNY WISE POUND FOOLISH is the cause of so many landed problems and i vow to be very hard on them on behalf of buyers who can’t have access to them because of distance or work schedule. 2010 Has made me tougher to understand their tricks and i won’t let them get away with it in 2011.

d. Talking of the beacons: Make sure your surveyor places these beacons on the ground after the survey has been drawn. The absence of beacons lead to boundary disputes and gives omonile the opportunity to steal lands because it cannot be identified properly. Don’t let lazy surveyors take advantage of you this 2011.


CASE STUDY NO 3. IKORODU: (How to Detect Land Owned by Another Person that is being offered for sale)

A Friend of mine saw a bungalow he was interested in and decided to buy it in Ikorodu. Upon search we found out that the Seller was the true owner and had all the documents to back it up. In fact he was living in that bungalow for the last 2 years after he just built it and put it up for sale for N7Million. My friend was really interested in it and[b] he had an agreement with the seller that he would pay him N4Million as the first installment and the remaining balance of N3Million for the second balance in 2 months time[/b]. Everything was agreed to and the first N4Million payment was made to the seller in his lawyers office and as an extra security for my friend i said the seller should collect the keys of the bungalow to move in and after he settles the final balance, the original documents such as the survey plan, deed of assignment and original receipts including the building plan will be given to my friend. The seller agreed and handed over the keys and took the N4Million and a contract of sale was drafted and signed in his lawyer’s office and witnessed by a lot of people.

My friend immediately took possession of the bungalow and moved some of his things in to show intent / immediate ownership and hoped that before the end of the 2 months he would balance up the remaining amount owned. Due to the nature of his job off shore, he was away for about a month and a half and when he got back to his bungalow; he noticed the bungalow has been over taken by another person who had moved into the bungalow.

The place was repainted and totally newly furnished and all my friend's loads and properties had disappeared as if they never existed . The new owner claimed that he bought the same property from the Seller 2 weeks before my friend came back for N10 Million Naira and he paid at once and in exchange he was given the survey plan, deed of assignment and receipt by the Seller and when he moved in he did not see any property in the house to make him realize that it was being inhabited by anyone previously. All attempts to locate the Seller till date has proved abortive to either arrest him for fraud or sue him for fraud and breach of contract. The lawyer and Agent kept on denying that they haven’t seen the Seller but because of the pressure on the Seller's family, the N4Million was refunded but my friend lost a lot in terms of other fees he paid to get the property i.e survey fess, legal fees, agency fees, miscellaneous etc and all his belongings he left in the house but at least he was fortunate to get his original capital paid.

The Moral of this Case study provides the following Tips to learn from:

a. Be very careful before you attempt to enter into any installment payment. Look at the people your dealing with. Investigate them properly. Cover all your lose ends. More especially if you can pay at once to get the property please follow that route. There are so many bad people in the property business that are ready to exploit that loop hole especially since if a second buyer comes forth they can resell that same property to him for a higher price and refund your money  if they are kind enough or deduct from it and tell you stories.

b. Also if you’re buying a land, always try and look out for signs to show that land doesn’t belong to the omonile. Once you see it has been newly cut as if they want to start construction work, immediately know its a stolen land because nobody will cut his land today and sell tomorrow.

c. Also learn to know how to identify fenced lands and the blocks used. If a seller is telling you that he just fenced the land but the fence looks very old with the blocks as if it has being molded in the last 10 years, know the seller is trying to trick you to buy another person’s land.

d. If the fenced walls looks new, ask him why he wants to sell so soon after spending so much to fence it and try to get the architect who fenced it for him to confirm. Use that trick that you need the same architect to assist you in constructing a structure on the land and when the seller begins to dilly dally about the whereabouts of the same architect that built his own fence then you know he is a scammer.

d. Also when you get to a land and you see beacons around the land; ask immediately for the survey plan to compare the name on the survey plan with the sellers name and the beacon coordinates with the ones on the ground. Also check the date the survey plan was made and the surveyors address on the Survey plan to confirm and cross check whether it was the same surveyor that did it. If the seller is playing games with providing the survey plan for the same land that has beacons then you should just walk away.


To be honest there are so many stories and tricks i learnt last year that i can fill the property forum for days with, but i have to stop here for now and learn too from these tricks to become a better and smarter Property Transactional Lawyer. Also please i implore you to learn from these tips too to perfect your property transactions. Before you part away with your money perform these searches or contact me. I have become very very good at this in spotting fraudulent landed deals, although not perfect and still learning new scams everyday but this year i hope to save people millions and millions of Naira especially those living abroad that do not have access to know what is going on here and how to go about it and pray these land fraudsters change their ways and learn to get a job instead of scheming on how to steal and defraud people's money.


Next time i would add more tricks i learnt when people want to sell Government Schemes, Omoniles who resell other people's lands bought and how to protect your land from being resold and why its necessary to document your papers in Alausa after you have bought it to prevent land scammers from playing on your intelligence.

I have been offered a plot at Badore (withing the gates of Silverpoint estate) , on the search the land is GA. a call to the chairman reveals the estate was gazetted but the school and a few plots at the front were not included for some reason.
Now is it possibel to release the plot by paying the goverment the xN per meter to gain a secure ownership.

I have sited the DOA and it tallies with the local family etc the lawyer is happy on that subject, a survey we had done revealed the problem.

Any advise on how to proceed, the plot is reasonable price if you included the 1500n/meter costs to the LSG as i suspect we would have to pay to release the land.

Any Agent or seller that is asking you for a dime to produce landed documents for you to go and search to confirm its authencity is a thief and crook and has something to hide. Landed documents despite its private nature end up becoming public documents for search. E.g a survey plan is a public document registered and lodged in the office of the surveyor General, a deed of assignment ought to be lodged and registered at the Land registry for search and confirmation, a Certificate of occupancy is a document of public record, same thing with a gazette lodged in the cabinet office.

So what are they charging you for again. The only people that can charge you for anything is the lawyer doing the search for you on your behalf and the government that prescribes fees for search. Any other person or body is just trying to play on your intelligence and its best you watch out for them.

You register an Incorporated Trustee also known locally as an NGO. It will accomodate all your plans. Rotary Club, Jaycee Clubs, Old Boys reunion associations are all examples of Incorporated Trustees
