Any survyeor can do change of name once you present the original survey plan and thats if it has been lodged i.e the red copy. You only pay the fees for change of name and re-lodgement and the deed has to be re drafted to effect the changes.

Holatunjiii has been banned permanently for posting more than 3 topics or reposting available or bump in 3 in more than 3 topics in the main property forum. From today i will be exposing all the people trying to violate this rule after the have been banned so agents if you like think we are not monitoring you and your posts, you will be next and my friendship with you offline will have no bearing with the rules on Nairaland that has to be obeyed.

Haba you people are funny o! angry It takes me approximately 3 days to write an aticle on it and if you check the property library thread you will see everything needed in respect of documents needed before and after you procure a property. I have even gone out of my way many times to pick an environment, scan all the documents physically to see what it looks like ranging from a survey plan to a deed of assignment to a gazette to a certificate of occupancy to a governor's consent to a deed of ratification to a signed Form 1C to a Government letter of allocation etc. Wetin remain again I even exposed the guidlines and calculations on how to calculate your governor's consent and C/O and this topic is coming up again?


You people want to give me extra work today! Abeg the sun is too much. I can't shout! Go to the property library thread  on Real Estate Topic Library (Must Read Before You Buy Any Land Or Property) https://www.nairaland.com/nigeria/topic-290735.0.html and spend 1 week digesting all the free information about the documents you need and see examples physically. Ok if your patient enough i will do another one on Eleko Free trade zone soon and this time present it as if your in primary school with pictograms to explain everything all over again grin


P.S: I have been receiving reports that newspapers, property magazines and some property websites have been stealing my articles and publishing them free of charge and plagiarizing them word for word without recourse to seeking permission from me or Seun. Its not good o! undecided

I am not stopping anybody from publishing them because the aim is to spread the gospel of eliminating omoniles and fraudsters from cheating Nigerians off their hard earned money when purchasing land but haba try to give small credit to whom credit is due. I am not asking for anything and i don't need any financial inducement or popularity because i am doing it based on my conscience and i love what i do and not to seek fame. Just email me or call and i will give you my blessing or contact the Nairaland owner or moderators. I sleep better at night knowing someone somewhere has become wiser for not falling prey to these fraudsters. Thats all i ask unless i will stop wriing them since i know the will be stolen and my efforts wont be appreciated.

Lawyer dont lie rather they follow the rules of court and rules of evidence that guides them on what to say and what to do. Thats why you hear this slang 'The burden of Proof is on the other party'. If the other party cannot prove his case beyond reasonable grounds within the confines of the evidence act or rules of law in force at that moment then its not the duty of the other lawyer to assist to help prove it. In fact it is even a punishable offence for a lawyer to incriminate his client willfully.

Not disclosing a fact that has not been requested is not lying

Not speaking up or maintaining silence is not lying

Fabricating a new story that cannot be dispelled or disproved by the other party is not lying

Presenting false evidence that was not objected to and was later admitted to be admissible is not lying

If a lawyer lies and the other lawyer objects to the statement or fact and the judge does not overule the 'so called lie' then it isnt lying

Bottom line present a better evidence when the time arrives for you to win your case

P.S: If a lawyer has been found out to have coached his client or lied to gain an unfair advantage he could be charged for perjury or disbarred

Yes it includes old adverts that people reply to themselves. Thats why the bulk forum is there for posters to post a million posts and reply themselves without any recriminations. What posters do is pick up 10 of their old posters and type available or bump continuously to attract attention and it ends up spamming the property forum. Once i say a post by the same poster that does it 3 or more times, such a poster WILL BE BANNED. The rules will never be compromised and thats why i appreciate what blank is doing by helping me point them out and once i trace their last posts and see its true the poster will be banned.

Dont get so worked up blank, they will all be banned. There are procedures to be taken before a poster is banned. Thats why i asked you to report them to me and we take appropriate actions. Am not online 24hours a day and i also need your input to know which and which posters are violating it. The property section used to be clustered and you dont know the work i do underneath for you to enjoy the property forum. Anyway thanks for the update. They will all be banned.

Silly law in my own opinion. angry What about pregnancy entrapment? A girl sees a guy she likes within 2 weeks of dating she gets her self pregnant either by piercing the condom secretly, claiming she is on her period whilst she is not on her period  or in the heat of the moment demand that she hates condoms but she is safe or the condom bursts and she refuses to take her anti pregnancy pills or lies she is using a female condom but alters it that ends up leading to an escape of semen, what in this instant should a guy do? Accept an unwanted pregnancy obtained through deciet, entrapment or falsehood?

Most of the girls that do these things are the ones that think they have seen a single well to do guy that they think can take care of them financially and they do everything to hook the guy emotionally via a pregnancy or baby hoping the guy will be sympathetic to accept the child. Alot of guys have experienced these issues and have been left devasted because of this. Sex is consensual amongst adults whether married or single and having a baby when it isnt planned shouldnt be taken lightly and such burden should not befall both parties.

The other scenario is what if a woman gets preganant and she doesnt want to have the baby with the man? She has the option of not either telling him and aborting the baby secretly or still telling the man and aborting the baby because she thinks she is not ready. What remedy does the guy have? Absolutely none because its her body. She can choose to or not to get pregnant and the man is helpless. So to me its a very bad law if it ever exists and will be repealed once the powers that be feel the heat of this repugnant law and i can assure you the number of family law cases will triple with respect to this matter. Adults will be adults and will continue to have sex but if the man isnt responsible enough to use a condom why cant the woman be responsible too to take her contraceptive pill or use her female condom?

So if a man gets an Ashawo pregnant after she has slept with 6 guys that night, he should accept the baby after it was discovered that out of the 6 guys he was the unfortunate one that got her preganant? undecided SMH Daft law!

I think most of you are missing the point why i stated that the thread should focus on this topic of building a luxury blocks of flat. Brabus didnt beg me to make it a sticky, i did because i saw the importance of it and how it will educate others but adverts are strictly not allowed as sticky topics. Most of the sticky topics are educational topics and property awareness topics. My concern is not based on  has been whether it has been derailed but the fact that the last 5-7 pages have not contributed any thing meaningful apart from paddy paddy gist and marking present. I am not witchhunting anybody and i dont intend to unsticky it BECAUSE I expect to see more info about the hows and whys, pros and cons of building apartments not advertising doors and lights or a property company. All i want and all forum readers want is to learn more and the first few pages of this thread did just that and i will encourage more but i wont just allow a topic to be a sticky if its just a chat blog or advert without pics. Please lets conform and lay this issue to rest. Your all my friends and while i try to educate you with the little i know in  land matters legally i also would love to know the nitty gritty of building a house from the scratch.

I accept and understand why it might have gone to sleep but you can also share your experience with PAST projects that has been successful not future ones that your still hoping to implement. Its your thread and our job is to follow us where you lead us to but dont make it convoluted and scattered.

This thread is getting Derailed. Oga Brabus the reason i made this a sticky is for us to learn from your experience in building a luxury block of flats but what am reading now is getting disjointed and issues that have nothing to do with your project are taking centre stage. I will appreciate if you get back to the project at hand or else it will be reversed to an ordinary thread that can accomodate every other topic and not get the exposure it requires.

But i still need to clarify this. My fiance bought a Plot of land at Aboru, Iyana-Ipaja Lagos State 2 years ago. It was said to be government acquisation but the agent that sold it to him gave him a court judgment and it state on it that the family has cleared the case in court with the government and can go ahead and sell the land has the court has ruled that the land is for d family.
He has erected a 3 bedroom bungalow on it and also done foundation for another building with the consent of the baale of the land who also said the land is now free from govt acquisation.
Sir, How can we still verify if this land is free from acquisation and if its eventually a govt acquisation land, do we fall under those the committee are deciding on,
Am really worried about this issue and await your prompt reply

These are the issues i have with your post:

1. An agent brings a court order that the family has been cleared. Which court order? Every court order of the high court almost in all case will be appealed on. Have you checked the court of appeal or seen the supreme court order of that matter?

2. Also when a gov loses a case, it either pays compensation to the family, publishes a white paper to the effect to give notice or issue a gazette to that community. Did you see one or have you heard of any of the above?

3. How can a baale claim to know a land is free from Government acquisition? Is he a registered surveyor? I myself can never tell you a land is free from government acquisition unless a registered surveyor attached with the surveyor general's office attests to it. A baale is a baale. His job is to rule his subjects in his community not become a surveyor or judge or commissioner of lands to start stating things he cannot back up.

What i can advise is for you to contact a surveyor to go to the site and pick the coordinates directly to take it to alausa to cross check and afterwards you will know whether it is free or not before we know whether it falls under the regularization lands.

Am sorry i cannot advise you through the internet to buy or not to a buy from a company i havent come across before. There are thousands of real estate companies in lagos and with my little resources based on mobility i can only cover a little distance to know them all. So am sorry i cant say they are good or bad because i havent met them before.

An Update to the above topic: This rule applies for the whole of Lagos not only Lekki/Ajah. The only disadvantage so far from what i can gather is that it might cost more to regularize a land that is under Government Acquisition compared to getting a C/O or Governor's Consent. In order words its just as if your buying the land all over again but this time from the Government. So its still advisable to still search for lands that a not Government Acquisition because the resultant penalty to regularize it might be too steep for you to bear.

Ikorodu has a lot of places under government acquisition and thats where omonile has operated successfully for years hoodwinking people to buy lands that are not free from Government acquisition, so this is probably cheering news for a lot of people that have been victims of these omoniles. Also i want to correct one misconception
The omo onile and surveyors stamped the survey plan as free of any government acquisition
. No omonile has the right to prepare any survey plan what so ever and stamp anything on it because they are not registered surveyors, secondly a surveyor that stamps a property that is free from acquisition and in fact its not should be reported and arrested for misrepresentation. That assurance can make you lose millions of Naira to these omoniles and you should be very careful with the surveyors you bring because there are many greedy quacks out there. I myself have been a vicitim of dodgy surveyors so i should know.

Just heard from a very very reliable source in the Surveyor General's Office that Governor Fashola is setting up a committee to look into this issue of Lands that  that are under Government acquisition in Lekki/Ajah should be released to the buyers and given the opportunity to regularize their documents.

The plan is that only lands in lekki that do not fall under proposed schemes or for pet projects such as bridges, airports, pipelines, easements etc that one way or the other is a must that the government must use the land should be released to people so that they can regularize their papers. Alot of buyers in the lekki/Ajah environs have suffered immensely in the hands of Omonile and some dodgy Agents or surveyors selling them lands that are not free from government acquisition and the buyers are stuck in that they cannot process either their C/O or Governor's consent after they discover that they have bought wrong properties but with this new committee being set up to look into this issue, it will go a long way to assist the thousands of people that are already victims of this issue.

I learnt the procedure will come in this mode: Once the coordinates of the site has been taken by a surveyor and it has been found to be under Lagos state government acquisition, the survey plan will have stamped on it ( LAND UNDER ACQUISITION BUT FIT FOR REGULARIZATION). It will replace the frightening stamp ( LAND NOT FREE FROM GOVERNMENT ACQUISITION).  cry Regularization means perfecting your documents as if your perfecting your governor's consent.

But once again remember its still in the setting up committee stage and we pray they act on it fast to give succour to alot of people that are desirous of perfecting their documents who have been victims of this  LAND NOT FREE FROM GOVERNMENT ACQUISITION palavar and we also hope the government continues to grant more gazettes to more communities in Eti-Osa and Ibeju Lekki.

WARNING: Once again this only applies to lands that are under Lekki Acquisition and not lands that have been acquired by the government for specific purposes such as SCHEMES OR PUBLIC INFRASTRUCTURES. If your own falls under these ones, am sorry your on your own and the consccession will not be granted to you.

Also this is not a license for those who haven't bought lands that intend to do so tomorrow to start buying ( LANDS NOT FREE FROM GOVERNMENT ACQUISITION) Just because Lawyer said so. Its just a useful information i heard that i have decided to share with you guys and probably give hope to those affected to keep their fingers crossed that there is light at the end of the tunnel. If your buying afresh please do your due diligence and search properly o! Government can rescind policies as fast as they hurry to implement them.

So Good luck and lets continue to pray the committee delivers!

Am not a fan of ACN, TINUBU OR FASHOLA By any stretch of Imagination what so ever but atimes we have to put our politicial bias aside when it comes to issues like this. I dont think Fashola is Mediocre, rather i think he is being weighed down by the expectations of the millions of lagosians that want lagos to turn in to Manhattan Overnight. The problems of lagos are just too much for one person to handle so at times it gets distracting to focus on one thing.

One minute he is talking about developing the roads, next thing floods come, next thing pipeline blows up, next thing civil servants strike, so its hard to focus on one thing when these problems manifest its self everyday and money needs to be spent to accomodate every ministry and local government. The real enemies of Fashola are the ACN Local government Chairmen and Civil Servants in Alausa who are so corrupt and non chalant in performing their duties. If money is voted to Bariga local government for them to clear the gutters and patch the roads and instead the local government chairman uses it to celebrate the coronation of OBA Bariga the 29th, Rebury his grandmother who died in 1809 and send the area boys to tax all the okadas, market women and stores to give returns to tinubu and to fund the UP ROAD UP UNION ELECTIONS, how do you expect development to come to bariga?

To me Fashola isnt Medicore, he is just hampered by bad workmen surrounding his government and his God father that is just a ********  angry (Insert your own Expletive here) I Strongly believe if he had no GODFATHER Looking over his shoulders to divert Lagos state funds into funding special interest pockets and ACN in the whole Nigeria, he will do better but as long as that GODFATHER IS STILL IN CONTROL OF LAGOS and its area boys, Expect nothing meaniful and Just thank God for the crumbs coming out from Fashola's table to Lagosians
