Properties2011 Land & Property Scams Or Swindles Nairalanders Encountered To Avoid In 2012 by lawyer(op): 6:16am On Jan 31, 2012
Happy New year people or should i say Happy Subsidy tongue: It has been a poor start of the year due to the Fuel Increase fiasco and i haven't been in the right frame of mind for the last 3 months to write property articles, give property advice or go about doing proper search work due to my car getting burnt while on the job, personal issues and commitments i had to sort out but i am now fully recharged to continue where i stopped and i thank the thousands of Nairalanders who called or mailed me this past year in their various capacities. You have all endeared yourself to me and i will continue to use my God given talent to freely assist you within my own human capacity to do right by you in an Honest way and may God make this 2012 a year filled with blessing and favour for you and your pockets will never be subsidized so that you achieve all your aims for you and your family.

Anyway despite my brief foray into property searches last year, i am still baffled that Omoniles and Fraudulent Land Owners and Agents still device means to scam people that even amazes me. Its as if These people go to one Scamming school every year to perfect new scamming tricks and it means i have to enroll into their school to keep abreast of these Scams to steal people's hard earned money when it comes to property transactions. So what i have decided to do this year as time goes on and permits is to collate some of your questions you have called to ask me about or emailed me to advice you on this past year and give you real life examples i encountered so that you too can be careful or weary of them before you part with your money and learn from other people's mistakes and not fall victim to these greedy idiots.

I know for the past 3 or 4 years that i started doing this property search for people i have tried to deflect the attention from me when it comes to having property for sale as an Agent or promoting my self to call me to do the search, but i think to an extent i am beginning to know the major players in this land scamming business and my name or prescence is acting as a sort of deterent whenever they hear i am involved in any search or transaction so they will shield their scamming plans and do whats proper so that i dont expose them. SO START CALLING ME NOW! I AM NO LONGER HIDING BEHIND THE SCENES ANYMORE. AS LONG AS YOU CAN TAKE CARE OF MY MOBILIZATION TO AND FRO THE PLACE I WILL GO THERE TO CONFIRM (Dont blame me for asking for mobilization NOW ooo! Jonathan have removed subsidy from me to move around anyhow o! (LOL)!!! grin BUT ON A MORE SERIOUS NOTE THERE IS A LAND OR PROPERTY SCAMMING CABAL OUT THERE DEFRAUDING PEOPLE DAILY AND BANKRUPTING FAMILIES AND THEY MUST BE STOPPED. I CANT DO IT ALONE AND WE ALL NEED TO JOIN HANDS TO EXPOSE THESE PEOPLE THIS YEAR AND SHOW WE ARE BEGINNING TO GET WISER TO THEIR RIP-OFFS OR SCAMS

So i am going to show you some Cons, Swindles and Fraudulent tricks Omoniles, Bad Agents and Greedy Owners tried to Pull on some Nairalanders in 2011 and all of them are True stories And please feel free to write your own experience as this thread expands. I can't know it all and we need loads of people to be aware of this thread.

Dear All,

How much is the cost of land survey plan for a plot of land at Awoyaya area of ibeju lekki ?
Between N100,000-N130,000 Depending on the surveyor. Most survey plans in AJAH Are usually the same price so it shouldnt matter whether its in Elegushi or Ibeju Lekki

Cheers

This Okonjo-Iweala is just on auto repeat saying the same thing she said on Al-Jazeera tv, Channels, NtA etc and repeating the manifesto of SURE Without addressing the real issues realistically. The truth is that there is a major disconnect between these ministers and the Masses. The way they communicate with the masses is so emotionless and filled with sadism. Listening to sanusi shows yes the subsidy issue is a problem that must be addressed someday but the way they address things is so academic like that no one is ready to accept what they are saying. The problem is really a major disconnect between the executive and the Masses due to their arrogance and mode of communicating these issues.

Our company abandoned a project in Bayelsa because of similar circumstance. I thought its a SW thing. Its all over the place.
I dont know why lawyer (the mod who only stickies threads he favors) lets this remain in the front page. Shows his disgusting hatred for the Yorubas. The same people whose properties he keeps making millions from weekly through a forum created by a SW guy. Man, abeg this are divisive threads you should delete. Not intelligent and educational ones that are posted my building professionals and real estate veterans. Mschewest!
lol@ yemi313

This guy must really hate my guts! Haaaaaaa! Am sure you go to bed with me at the back of your mind on how to eliminate me from the property forum as a Mod. Please continue scheming, someday your prayers might come true, but its not going to happen today.

I have chosen to ignore you for a very long time and you have been trying to get my attention but i think your latest tirade and rambling deserves a response. Anyway let me clarify some things for you before you continue on a worthless campaign to get rid of me for no reason.

1. I never delete posts. No moderator has the ability to delete a post foolishly. If your post is not showing then it must have been marked out by the spam bot. I only tackle people that post more than 3 posts per day to move their posts to the recycle bin or posters to try to cause rancour or division. I have no business with you and i don't think i have remotely bothered to even check any your post talk less of deleting them, so please don't flatter yourself that i delete your posts when i don't even know what you post or care to be honest .

2.  Why would you say i hate Yoruba people when am technically a Yoruba person because i was born and bred in lagos and surrounded myself around the SW culture all my life despite the fact that am not Yoruba and i owe my upbringing to them? Also have you ever seen me on Nairaland ever ever engage in any tribalism debate with anybody or belittle anyone based on tribe? I am beginning to think your hatred for me is personal. Have i slept with any body you know personally that is ticking you off so badly? If yes am sorry o! grin

3. This topic on the property forum wasn't sticked by me but  by the Super moderator. I didn't even know about this topic was on the Nairaland homepage until 3 days later before i made my own contribution in the midst of other contributors who posted in favour of or against the omonile syndrome and it is here because it was selected by the Super mod as a contributing topic from the property section so stop spreading falsity that i was the one who made it remain on the property section as a sticked topic. Maybe you should also go as far as saying Mukina is a tribalist since you now know who sticked this topic. Besides what has Omonile got to do with Yoruba people as a group? Omoniles in lagos are bad and dangerous people who also cheat alot of hard working and honest Yoruba people who pay so much to acquire lands and have to still settle these jobless riff raffs, so what has my hatred for yoruba people got to do with Omonile? Am sorry to say but its seems Muscle Pull is infecting your brain for trying to turn omonile syndrome into an ' I HATE YORUBA' Campaign. Please carry such nonsense to the tribalism section and leave such idiocy away from the property forum.

4. Finally dont get jealous that your posts are not made sticky because if you have a post that is intelligent and contributes to the up liftment of the property section i wont hesitate to put it there because i have done it for so many people to give them the required exposure needed. Besides any topic i put as a sticky topic has been thoroughly investigated by me and i dont put it there for fun whether it belongs to me or not.

5. Finally i have been trying to put a picture to your name and i think am beginning to remember you. Are you not the guy that i came to investigate some where in ogun state that wanted to sell a piece of land to a Nairalander and the documents you showed me were Suspect, dodgy and forged by one person and the so called owners even looked dodgier and i refused to endorse the transaction and you were angry that i didnt play ball with you and you spent the whole time calling me names and trying to convince the buyer that i had a special agenda towards you when prior to that moment i didnt know who you were? Oga that was 2 years ago. If thats the reason you carry a hardon everywhere against me, please feel free to continue hating me because if it was to happen again i will NEVER BE YOUR FRIEND OR SUPPORT YOU to sell dodgy lands. I still have a copy of that dodgy agreement with me and i can post it on Nairaland so that the resident forgery experts can also confirm it.

So please feel free to cal me a tyrant or dictator or whatever as a property mod. If others say it i will check my actions, apologize and conform to their standards but if its only you, i won't bat an eyelid and continue to be dictatorial to you so that you dont Sell another dodgy property to a Nairalander with dodgy documents. Money does not rule my life and would never do so.

Now that you have finally gotten my attention, i will be looking forward to engaging you in anyway you want from now on! angry

Mr. Lawyer,

Let me first really appreciate all your efforts in helping people like us from getting defrauded by the omoniles and dubious agents. Actually there was a land around Awoyaya town off Eputu old road, Ibeju-Lekki LGA that I would have blindly purchased last month safe for the knowledge that had been instilled into me by your posts. I took the copy of survey plan I collected to the surveyor's generals office in Alausa for confirmation only to be told the land is GA. I was really shocked  shocked going by all the assurance I've gotten from my agent & omonile.

Now I really need your help & proffessional service. Please kindly do let me know how best to reach you.

Thanks in advance
Thanks for your kind words sir. You can call me on 07036681104 or 08077943514 or mail me via nairalandlawyer@yahoo.com

Cheers and good to hear you were safe from the omonile
PropertiesRe: Stubborn Tenants Refuse To Leave And Don't Pay Rent! by lawyer(m): 6:16pm On Oct 29, 2011
Absolute rubbish from your lawyer sorry to say! Once the quit notice has been filed validly for 6 months, any day over that 6 months notice means the tenant is holding over that property illegally and he no longer becomes a tenant but a tenant at sufferance and from there onwards you dont need to issue him a quit notice again but an OWNERS INTENTION TO RECOVER PREMISES in 7 DAYS And from there onwards the tenant practically has no defence legally when the matter will be filed at the rent tribunal nearest to you. Tops with all the adjournment within 3 to 5 months the  court balliffs will personally come to serve them to eject them of the premises compulsorily. So its a no brainner for a lawyer with half a brain in litigation!
BusinessRe: Lekki Free Zone Is A White-elephant And Failed Project? by lawyer(m): 11:03am On Oct 21, 2011
The FTZ is neither a white elephant project or a failed project as opined by the writer of the article. There may be some truths in his complains and i strongly believe this article was based on what he saw last year. I was also a vivid critic of the place last year when there was little developments to show that the FTZ was coming up but this year i have gone there twice and toured the whole place and the results are very very encouraging compared to last year or early this year. Maybe the pace of work is still slow compared to all the hype around the place and the definate lack of information to carry people along is definately another flaw there but make no mistake about it, in the next 10 years, the LFTZ AND ELEKO environs is going to be the most expensive place to purchase lands in the whole of Africa if things go according to plan. There is no where you will have a proposed Sea Port, Air port and ftz and not experience a major boom in the economic development of the area. I was very impressed with the pace of work i have seen this year compared to last year and i believe if more efforts on the part of the government is in place the writer will have a change of mind too like me. What i think is required is to drive more awareness for people to own residential plots there more because the village surroundings makes it look as if there is nothing going on there, but on a deeper cusory look i realised most of those lands have been bought by investors at a very cheap rate like N100,000 per plot like some 3 or 4 years ago to resell at a higher premium when full activities commence and i expect them to make the largest profits ever in Lagos when full business resumes there. Its just a bloody Gold mine!!

When am free i will put up some pictures of this place to buttress my arguments! Cheers
PropertiesRe: Omo-Onile Syndrome: Cancer Ravaging South-West Nigeria by lawyer(m): 2:30pm On Oct 17, 2011
I would really like Eko Ile to talk about this since he seems to defend the actions of everything done under an AC Governed state is good. tongue

Lagos state is definately the worst in this regard and its from lagos other states copy this bad habit and there is no step to control it one bit; infact its being '. For example signing of Form 1c before you do your governors consent is another way to legalize omonile to pay N50,000 to N1Million depending on the area because without that Form 1c and the signature of the Omonile, you cannot process your documents. Before Tinubu came into power processing your Governor's consent wasn't that difficult and recourse to Omoniles was almost non existent. Yes the occassional N10,000 or N20,000 to the youths to be welcomed into the community was the norm but under Tinubu now passed to Fashola's government, Omonile is now a hydra headed Monster more especially in Lekki/Ajah today.

Virtually every indigene whether he came as a settler or a visitor to that area is now an Omonile to extort money for building and nobody can stop them. It emanated from the free hand given to Area boys to tackle lagosians without any form of repercussion because Tinubu needed the area boys for his political firm grip of lagos, gradually to make it more official and make them leave the streets,they switched to being emperors over landed matters to build. You have no idea how horrible this thing is.

You buy a land lets say 1Million, you pay omonile separately for the receipt e.g N50,000, You pay for fencing separately lets say N50,000 (Something that should be your legal right to protect your property), you pay for Foundation ranging from N100,000 and above, You pay for decking ranging from N100,000 and above, you pay for roofing again ranging from N100,000 and above, your forced to use their own community people to supply the building materials, supply the workers and still pay constant homage to the baale of the place by bringing him brown envelopes and that doesnt stop them from still conniving to re-sale your land and the whole process starts agains with another buyer. How much then did you buy the land and how much have you paid to Omonile and you havent sorted out legal fees, agency fees, survey plan, building plan approval, C/O or Governor's consent fees? How can anybody tell me that Lagos is working when it comes to landed matters and every Nigerian's right to own land peacefully?

The whole aim to keep the so called lagosians bloody rich and hold the political force intact. There are so many millionaires made in Lagos for no reason apart from waking up in the morning to collect omonile fees and drive big SUVs and worst of most of them are stark illiterates and its not fair whether you are an AC Supporter or Not. It started from that Tinubu war cry the ' LAND IS OUR OIL IN LAGOS' and that awoke the greed in land owners and the omoniles to skim people dry and they are exporting a very very very bad thing and precedent to the rest of Nigeria.

For example a lot of people decided to go outside Lagos such as Agbara, Ibafo, Mowe etc to buy lands so that they may be free of the scourage of Omoniles that is rampant in Lagos, not when you meet an Omonile in those places they are now competiting with Lagos Omoniles and they always make reference to the Omoniles in Lagos that they learnt it from there and hereto before you wouldnt pay anything more than N10,000 OR N20,000 to appease the community.

In my own opinion, the best way to check mate this thing is to first cancel the Form 1c that gives the omonile the mandatory power to sign as a seller. If a seller decides to resell his land to another person and the new seller sells it to another person, there should be no reason to go back to the omoniles to sign over and over again the deeds and Form 1c. This avenue of siphoning money is killing the land buyers in lagos and the government is encouraging this this so that the omonile gets money and Alausa taxes them. Its so strange that Ogun state Next door never had a Form 1c style to process their documents years back now they have copied Lagos hook line and sinker and Omonile problems are rising tremendously and i expect this complains to be rife through out the south west anytime soon.

Also deeds of assignments could also act as the official reciept. The fact that omoniles know lagosians reduce the cost of the price the land in their deeds to avoid excess billing during the assesment of their Consent or C/O is giving the Omoniles another free hand to fleece the buyer. Government knows about it, the staffs in Alausa and NTDA know about this. So there is no denying that this is an official conspiracy despite one commissioner or Government official paying lip service that this shouldnt be done and is illegal.

Also paying Omonile for foundation, roofing etc is very very illegal and its borderline tresspass where the police has a right to step in when someone violently prevents another from going about his daily business. Here i have spoken to so many cops about this and they tell me the reason they cant stop them is because of order from above to leave Omoniles because Government has accepted its the culture of the community for you to pay them. (What rubbish Talk!!!! angry) Omoniles were virtually hiding under ground during the Military era. Who revived them from their slumber and gave them a new breathe of life to milk people blind and go unpunished? I remember vividly how Raji rasaki dealt with the so called Omonile in Maroko then and they went extinct now before you attempt to buy land in Lagos save at least N500,000 TO SETTLE OMONILE, MONEY THEY DID NOT WORK FOR OR DESERVE BUT JUST BECAUSE THE STATE GOVERNMENT HAS ACCEPTED AND HAS GIVEN THEM THE FULLY BACKING TO RIP PEOPLE OFF.

If truely the Lagos State Government wants to stop Omonile activities, do you think it will cost them anything to do so and do you think they wont crush this menace under 1 week if they really want to do so? But because they are also benefitting from it thats why its rampant and am sorry to say to future buyers this scourge is here to stay until Tinubu who encouraged it and his cohorts have a change of heart to reverse this evil fleecing of Nigerians who have chosen to call Lagos their home

Good day Nairalanders. Pls i want to clear something up. I know Badagry won and i will keep my promise to go there and do my investigations but it will be done at my own pace and taking into consideration the geographical distance from my office to these areas. So many factors go into doing a search i.e getting the surveyor to be ready and not encroaching on his time, having the time to meet the owners and inspecting the location and making further trips back and forth till am satisfied. To be honest Badagry is way off my location and going there is a whole days job thats if the traffic from mile 2 down to alaba and ajangbadi will be free to make it easier for me. So please bear with me so that i find a reasonable weekend to even book a hotel that will give me the opportunity to sit down that weekend and do my job thoroughly because traffic and the rains won't make it any easier for me now. Badagry is a great place but those that know the terrain there know is not a place where you mismanage your time via traffic. In the mean time i will still look at the other ones based on convience of movement for now while i plan the badagry trip properly.

Thanks everyone. From the above it shows Badagry came out tops with Sangotedo/Lakowe 2nd and Eleko/ Agbara coming joint third. I will endeavour to go to all these places as chosen by you guys to meet the agents and show you the lands if they satisfy the criteria of being habitable now. Once again thanks for your assistance, transparency and civility so far and its time to get the ball rolling to see what you voted for.

To the agents of the winning areas, congrats and its time for the hard work now. I want you to now send me the plots of land you have in these areas, the prices and location so i can start in earnest with the investigation. Please i beg you, dont waste my time and yours showing me bush alone with the nearest sign of development some kilometers away. I will not endorse it and it wont be fair to me because your harming me health wise and adding extra pressure to my car, so please lets be reasonable.

Once again congrats to everyone who participated and watch this space for your chosen Nairaland Estate

I watched some clips of it and there is nothing to suggest that it was a ruse and even if it was stage managed, those 5 boys should be dealt with because thats unlawful carnal knowledge that our society frowns on. What is the legal or moral background for 5 guys sleeping with one girl violently? Did the commissioner not hear her begging that she will pay any ransome money so that they let her go? Point noted! Will rectify it! That shouldn't stop you from voting! I don't know any of these agents that have posted these lands and I don't intend to favour anyone because the results have been made open and its a 1 man one Vote system so that I won't be able to influence anything except through you guys!

Even if the Sangotedo/Lakowe own wins, i cant alter the voting system now because i dont know the voters and i doubt if i can recall them to revote again but i promise to search the one that comes second due to this error only if sangotedo/lakowe comes first, so i might be searching 3 places. The error is regretted. Pls remember its the first time we are doing this and some errors might crop up but with constructive criticisms like this, future voting patterns will be better.

At this rate i think i have to write an article about this new tenancy law today to solve this problem once and for all. The truth is that this new tenancy law protects the tenant heavily and all your need to do is activate it by going to the rent tribunal. A violation is a violation. 6months rent for a sitting tenant is what the law says not 1 year and if you pay 1 year your also liable for violating the law.

Anyway will be back soon with a complete analysis of the law legally!

For 2 weeks now i have been running a competition for agents to  Locate hidden lands and future Nairaland Estates for our Esteemed Nairaland Audience who are interested in buying lands in Lagos but they dont have the time to do the running around to locate lands in areas they havent heard of and also the fear of purchasing lands from fraudulent people and finally buying lands that have good titles and documents to back it up which can be seen here https://www.nairaland.com/nigeria/topic-752036.0.html#msg9080166 and Nairalanders will have the opportunity to vote for the lands they want me to investigate and endorse based on my search report.

Alot of Agents have taken up that challenge to post some properties that fall within some rules i created which includes the following:

1. Should not exceed N3Million per plot

2. The lands must have either an existing C/O, Gazette or authentic family receipt and the owners must be transparent

3. Must have some level of development and amenities surrounding the land in question.

So far Agents have restricted their adverts to these areas below and i will place a link per agent under each area so you can peruse their offers and choose the one you desire:

Your correct. Its 16th friday. Its a regrettable error. Thanks for helping me clarify this.

De Law,

As the first few days was filled with distraction i beg give the agents one week extension; personally i don't think we have enough options to choose from.
@olubuffet

Thanks for your recommendations but i want us to be uniform to be sticklers for time. This is the first experiment we are carrying out and i promise other ones will follow. There will be mistakes and achievements to be learnt from this process, so the earlier we start the better. If this one is successful then other agents will see the viability of the next one we do. If we even see 2 agents am okay with it. Its the first time we are carrying out this experiment so lets see the outcome.

Cheers

@Agents

Thanks for all your responses. Keep it coming. This competition ends on Friday 14th of September 2011 and Nairalanders will now be given the opportunity to vote for their preferred choice for me to investigate and give you my reports and endorse if need be.

Cheers

@ All

Anything that has nothing to do with this thread will be deleted. Its strictly for agents to advertise their properties and for Nairalanders to vote for them and comment on the properties alone. Any outstanding beef with anybody should be opened in another thread and discussed extensively unless it gets too nasty. I owe no apology to anybody who intends to derail this thread and not give the Agents the opportunity to shine but rather based on their selfishness choose to turn this thread to a battle ground for a war that has no head or tail. This is a competition amongst agents and not individuals, so take your war outside and leave Nairalanders in peace to interact with agents and select who they want to do business with.

@gestapo and tigerpaws

Pls ignore damogul and lets  concentrate on the topic. Its obvious he wants to wind everybody up so that the thread gets derailed and i have to lock it up. It wont be fair to other agents who have properties to advertise. We appreciate your efforts.

Cheers

@damogul

Carry go! When your tired of castigating me let us know so that we go back to the aim of the thread

Cheers

@agents awaiting your properties and pls advertise them in full details and dont forget the cheaper the price the better!

@damogul

Thanks for your kind comments! Its truely appreciated!

@all the aim is for you to choose the lands you want me to investigate! Its not a competition with anybody! If the agent is acceptable to you and the price is convienient and also the location, then all you have to do is be convinced that it might be a viable project for you for me to investigate it and report my findings back to you free of charge! So you have to be vigilant and scrutinize the agents thoroughly before you vote for them and their lands! This is their opportunity to shine and I wish them goodluck!

Cheers

5 Acres of Land @ Oko-Ado
Land Tittle: C/O

There are more,contact me, Real and good documentation,
@femzone

Thanks for setting the ball rolling but i have a problem with the price. I am advocating for plots going for a maximum of N3Million per plot and it will also be preferred if you talk more about individual plots and their prices rather than the total amount for the plots like N320Million. It sounds a bit scary and people might not take you serious. Anyway i appreciate the effort. Looking forward to seeing you as one of the winners if your chosen by Nairalanders
