Should it be safe to wait for the Judgement to be read, so that you realize that what Obi is seeking for is far beyond (in scope and in cause) what the APC sought for in Osun??

When the Osun SC-Judgement was delivered, the Obi’s legal team studied the judgement, and made lots of amendments in their demands, and in the types of documents they were earlier demanding for.

Tinubu BSc is not in contention but the F gender is from South West College, an institution that aided his admission to CSU.

Now the witness, Eba, I understand also filed a suit against Tinubu, then Candidiate of the APC in November last year with the same allegations. Eba also claimed that the logo in Tinubu's Certificate was different from the original one, etc. He claimed that his friend, an Attorney who is based in Chicago, a Mr. Kowals sent him the transcripts.

Mr Kowals doesn't work in CSU but is based in Chicago (Eba affirmed in his affidavit). YOU DON'T NEED TO BE A LAWYER TO KNOW THERE IS NO PROBATIVE VALUE IN THIS 'EVIDENCE'. As long as CSU has confirmed that the man in our alumni calendar graduated here, that settles everything.


Let me buttress further, many years ago when my younger sis was to write UME, those were the days of Afribank. The pattern then was when afribank closes sales of forms, you have to go to the UME office at Ikoyi to get it, then fill and submit (this you can do even 2 days to the exam).

I left almost Badagry to Hawkworth Street 4 days to the exam, with the docs of about 5 persons (all males excepting my sis) to buy, fill and submit on the spot 4 days to the exam. I had unintentionally entered Male for her. It became a problem for her when she eventually got admitted at FUNAAB.

You seem to be missing my point….

The crux of my back and forth argument with you from my thread to this one is that I have been trying to tell you that there could be exceptions when the maker of the document is not required to appear in court. But you seem to have insisted that the maker of the document must appear in court at all times as far as anything regarding the certificate is dispute.

That’s why I tried to separate some facts for you.

1) A certificate can be authentic and valid but they are not yours.

What this means is that if we go to start verifying the documents, they would be authenticated and verified in the archives and records of the maker.

Now, if I were challenging the authenticity and validity of the document, that’s when I need to bring the maker to come say that even though this document bears your name in the right order, they can’t find it in their records; meaning it didn’t originate from them. That’s what you are seeing Mbah going through in Enugu right now. The document bears his correct name but didn’t originate from NYSC. Hence, it’s “inauthentic” and “invalid”.

2) I am not challenging the authenticity of the result. Meaning I accept that the result or document is valid and can be found on the archives of the issuer. But I’m asking the court to see that the name on the document is different from your own name or that while you are [b]man
, the document (as certified by the issuer) belongs to a woman.

Now you are telling me that I still need the maker of the document to come tell the court that the name on the document varies from the name you have used all along elsewhere?

Or that they should also come to tell the court that the gender they are seeing boldly indicated as F truly originates from them or was a clerical mistake?

If it was a mistake, can the supposed owner show the step he has taken since 1979 towards correcting the appearance of female on his certificate even though he is male either in the form of affidavit or a letter written to the awarding institution to correct the “error?

Service is mandatory for any graduate under the age of 30 years. Failure of which is renders your degree invalid. Again, claiming you served and at the same time working in your state is a constitutional breach tantamount to you collecting double salaries.

Just a reminder, Obi submitted BVAS accreditation data for all the states he’s contesting.

I have not seen that judgement though but I will reference you to two judgements:

1. The Court of Appeal in Isa Wabu v Mohammed Gololo

Lead Judgement: Bolokuromo Moses Ugo JCA

Background:
After losing the House of Reps election for Gamawa Federal Constituency in Bauchi State. Wabu approached the tribunal challenging Gololo's BSc, NYSC and MBA Certificates tendered. Gololo claimed he acquired his BSc and MBA from LASU.

Wabu called LASU & NYSC as witnesses, and the University testified they didn't issue that doc to Gololo and they also did not offer MBA within that period.

The tribunal ruled that as long as Gololo satisfied S65 by having his fslc and ssce, he had the basic constitutional requirements and cannot be disqualified. They cited the very controversial Agi v PDP. They, therefore, dismissed same for lacking in merit.

Wabu appealed, and the Court of Appeal sacked Gololo. They argued that S65 cannot overrun S66 (a disqualifying factor). That the appellant incontrovertibly proved that the documents were forged and was enough.

2. Supreme Court in Ibrahim Modibbo v Mustapha Usman.

Modibbo was supposed to be discharged on Oct 18, 2018 but he adjusted his Date of discharge to be Oct 03rd I think, so as to justify his winning the APC Primary on Oct 7.

The SC frowned at that and upheld the FHC judgement sacking him.

In Saleh v Abba: He was sacked because of a forged ND Certificate from Fed Poly, Mubi.
He already obtained his SSCE which was not disputed.

So, I believe what is indeed needed is unvarnished proof of forgery, but this Supreme Court.....


The only thing I will believe is that LP lawyers did not add "IN AID OF HIS QUALIFICATION" if they did well well ....

The furore over the forgery allegation against Mmesoma Ejikeme has been laid to rest after the committee set up by Anambra Government confirmed that the girl indeed forged her result.

With that, everyone has come to accept whatever punishment that JAMB dims necessary for Miss Mmesoma .

Furthermore, JAMB has proven its integrity and the integrity of its technology.

This Is unlike what we saw with INEC during the election who claimed “glitches” for their failure after promising heaven and earth before the election. One now wonders if JAMB server is now stronger than INEC server even though INEC spent billions constructing their own.

But away from JAMB and INEC servers, our concern here is Tinubu and his many forgeries.

Can we all agree, just like we have agreed on Mmesoma case, that same punishment meted on Mmesoma should be meted on Tinubu who is facing similar, and even more, of what Mmesoma did?

Or are we hypocrites that would condemn a young Mmesoma for forgery but defend an old Tinubu, who should be a role model and example for younger generations, on his own forgeries?

Lol, funny enough I was an INEC adhoc staff in a Muslim dominated area. And APC won those places with Atiku coming far behind. Muslims don't have much numbers but Caleb is from mangu, How do you expect his people not to vote him. That was his number one stronghold. Most Muslim in plateau are APC so no way they voted PDP

The Labour Party, LP, on Friday, commenced its evidence against the election of Barr Peter Mbah as the governor of Enugu State.

The case filed by LP and its candidate, Barr Chijioke Edeoga came up for hearing at the Enugu State Governorship Election Petitions Tribunal.

At the resumed hearing, the LP presented the National Youth Service Corps, NYSC, as its first witness.


Among the documents tendered by the NYSC are the alleged forged discharge certificate, as well as the original discharge certificate which Mbah ought to have collected, as well as a letter written by Oma and Partners, an Abuja-based law firm, which had asked the Corps to scrutinise the discharge certificate submitted to the Independent National Electoral Commission, INEC, by the governor.

Awomolo sought to tender the witness’s deposition on oath as evidence before the tribunal.

The third respondent, PDP, counsel, Barr Anthony Ani, SAN, objected to the admissibility of the document and opted to move a motion dated and filed on the 7th day of July 2023, which seeks to pray the tribunal to strike out the written deposition on oath of the PW1 on the ground of incompetence.

The 1st respondent, INEC, as well as the 2nd respondent (Peter Mbah) aligned themselves with the submission of Ani and prayed the court to strike out the written deposition of Mohammed (PW1) for lack of competence.

Relying on the Court of Appeal decision in the case of ANDP & anor V INEC as well as that of Damina & anor V Adamu and ors, the respondents’ counsels asked the court to strike out the written deposition on oath of the PW1 for lack of competence.


In response the petitioners’ lawyers relying on the case of Ararume & anor V INEC, which according to them, is a conflicting decision with the authorities cited by the respondents’ counsel, asked the court to admit the written deposition on oath of the PW1.

In a short ruling, the tribunal admitted the document and reserved ruling on the objections raised by the respondents for final judgement.

The PW1 was then taken in for examination-in-chief.

Mohammed told the tribunal that he acted on a subpoena served on the Director General of the NYSC or any other official to appear before the tribunal for the purposes of giving evidence in order to clear some issues bothering on the certificate purportedly issued by the agency.


The subpoena was admitted in evidence without objection from the respondents and was marked as exhibit PTC/01/06.


Mohammed also tendered his official identity card as a staff of NYSC which was admitted in evidence and marked as exhibit PTC/01/07.

In paragraph three (3) of the Petitioners’ Witness’s deposition on oath, the witness stated that in obedience to the subpoena by the tribunal, he came with the authentic discharge certificate of the governor, as well as the one purportedly given to him.

The respondents’ counsel objected to the admissibility of the documents and reserved their reasons for final written addresses.

The tribunal admitted the documents and marked them as exhibits PTC/ 01/08 a and b.

The Petitioners also fielded another witness, an Abuja-based legal practitioner, Mary Nneoma Elijah, a principal partner in the law firm of Oma and Partners.

She is the Petitioners’ Witness 2.

The Petitioners’ counsel sought to tender her written deposition on oath dated and filed on 22 July, 2023, as evidence, which was objected to by the respondents’ counsel, citing the same grounds raised in the first stage.


The court admitted the document and reserved the ruling during judgement.

She also adopted the subpoena of the tribunal dated 21st day of June, 2023, which was admitted and marked as exhibit PTC/01/09.


The witness’s letter to INEC, as well as the reply given by INEC was sought to be tendered by the petitioners’ counsel amid objections from the respondents’ counsel.

However, the letters, as well as the discharged certificate were admitted and marked as exhibits PTC/01/11 a, b & c respectively.

Also, a letter addressed to the presiding justice of the Federal High Court, Lagos Division, for the production of the appointment letter dated 14 July 2003, appointing Barr. Peter Mbah as the Chief of Staff to the then governor of Enugu state, Dr. Chimaroke Nnamani in the same year he (Mbah) claimed he was serving, also admitted in evidence amidst objections and marked as exhibit PTC/01/13 a&b.


During cross examination, the 1st respondent’s counsel, Mr. Abdul Mohammed, applying for the subpoena, asked “confirm to this tribunal that the subpoena did not ask you about anything at the Federal High court”.

In response, PW2 said ” True”.

Mr. Abdul Mohammed further asked the PW2: “Confirm to this tribunal that you have given to the petitioners the contents of these letters at the time they were preparing this petition”.

In reply, the PW2 said, “It’s false, the letters are public documents which are in the public domain. Anybody can ask for the letters and they will be given to him.


The matter was adjourned to Tuesday, 11 July, 2023 for further hearing.
