A mall is private property.... the space is public because it is opened to the public. You can snap pictures or video of anyone in the mall without consent. A house is private property.... one can stay outside of the property and snap photos or video the house without consent.... but inside the property you can be restricted.

People sitting below are on private property.... but that is public space.
