PoliticsRe: Dasukigate: I’m Not At War With Buhari, EFCC Over Court Orders —CJN by Montaque(m): 8:15am On Jan 14, 2016
Until I hear from the CJN himself.
Even at that, this statement doesn't follow from its topic.
it's misleading.
PoliticsRe: Olisa Metuh Tears EFCC Statement He Made - Premium Times by Montaque(m): 2:09pm On Jan 13, 2016
adadadon:
You can use tape recorders during police investigation, yes you can but it will not be admissible as a statement simply because the evidence act does not make provision noeither does the Acja 2015 dmake provision for the use of tape recorders during investigations and interrogation of suspects. However novel this may be, Nigeria's extant laws do not make sure electronic devices and its output are admissible as statements made by suspects.....
The only state that allows tape recorders or video during interrogations is lagos state and it has been branded by superior courts as not applicable in federal matters or exclusive list matters being adjudicated upon by superior courts.
Since you do not have issues with its relevancy, I think the evidence Act on computer generated evidence is broad to cover this one.
PoliticsRe: Army Secretary Who Couldn't Find Buhari's Certificate Retired - Sahara Reporters by Montaque(m): 12:20pm On Jan 13, 2016
During the election season, I sometimes doubt that he doesn't have a school cert,
but now, am so sure he doesn't have one, judging from the way he handles governance now

PoliticsRe: Chief Judge Bars Magistrates From Granting Remand Orders To EFCC by Montaque(m): 9:38am On Jan 13, 2016
omenka:
Does he have the powers to give such "order"?? A judge has the discretion to grant judgements based on the facts before him and the merits of the applicant's prayers.

If he can do this, what stops him from saying "stop passing a guilty verdict on suspects"??

Ps: funny how these guys still look to "Tinubu's lying propaganda media" to promote their course.

These same guys would rip thenation apart if anything anti PDP is reported.

Such funny sets of people. cheesy
The directives he gave them is in accordance with the law. The apex court has held in many cases that holding charge is unlawful. There are crimes n criminals that you can't Arraign before a magistrate court. He mentioned them in his directives.

anyway. I expected you as you have asserted a position, to prove it.
Computer generates evidence in the evidence Act comes readily to mind.
I know there isn't any law that forbids using a tape recorder during police interrogation since it can be admitted in evidence.

DropShot:
You're not well informed but just pretending to know something.

Upon arrest, a suspect is expected to make statements to investigating authorities irrespective of whatever evidence they have gathered prior to his arrest. Only after making such statements may he then be charged to court.
In Mettuh's case, his failure to make statements and cooperate with EFCC left the agency with no option than to apply for holding order to detain him in the hope he will cooperate. Hence his detention is perfectly in order legally. His continued refusal to write statements will mean an extension to that order to further detain him and NOTHING anybody can do to help him.

Read the ACJ Act and educate yourself further.
Is it mandatory to make a statement while in police custody?

If possible EFCC should hand over the corrupt fool over to SARS By the time they torture him am sure he will open up.
SARS has tortured u before now.
But that's not how to treat a citizen, both in Apostle Paul's time and this 21st century.
Now you accepted the wrongs they did to you and recommend it for another person.
Get civilized.

When at a police custody and they browbeat me into writing a confessional or they wrote it for me despite my protest, at the first sight of having it on my hands, I will tear it into shreds.
People should read thru the lines.

Sometimes i wonder in bewilderment, most people especially lawyers think their position on an issue is final hence sancrosanct. These fellows failed to understand that what they say is only but their personal opinions much like another layman's opinion and nothing else.
Falana ' s opinion on law isn't the same as a layman's opinion on same.
Be humble and learn from him on issues like this.

How many months did it take Femi to say this?
I am waiting for the NBA and the body of benchers. The impunity equals the corruption.
I miss gani.
Many people won't understand what is said now, but it shows that pmb isn't yet free from military ideology. check his media chat and check the press statement of Obama on Ferguson' s court ruling, you will know the gap in civilization between Nigeria n the US.

why should they be happy?
when our now govt runs after a suspect without evidence of any crime, searches ur house illegally like jet Li, incarcerate u in disobedience of court order, and forces you to write a confessional statement while in their dungeon.
Is anti corruption akin to dictatorship?

Am shocked you dont even know the difference between "reading someone"... and "hearing them" speak, with your blocked ears! grin grin

Anyway,
"EFCC is ALLEGED"
"Fayose is ALLEGING"

...and you want me to prove both wrong?
So it is now my own duty to prove what a mentally unstable person like Fayose says, "right or wrong"?

Sorry, l will leave that responsibility to Fayose, he made the allegation, ..let him prove it. undecided undecided

Lastpage!
You haven't legally justified the power of EFCC to force an accused in his custody to make a statement.
I will wait on u for that, and that alone.
