Hi everyone,

Thank you for all the help everyone brings in here. I am a product of the wealth of information stocked up here on nairaland. Coincidentally, May 27 2021 was the day I got my share of hot breakfast of study visa denial served steaming hott! Omo! But the faith and positive energy I got from here pulled me through. Went for JR (my timeline is on my profile) and came out victorious! Today, 1 year after, it's my 8th month in CA and just this week my family visa application was approved - SOWP, 2 SV, 1VV! THIS IS GOD! It only ends in praise when we persevere. I wish you nothing less than victory.


So, today I have a problem; VFS rejected the passports sent to their abuja office today o! The DHL customer care said that ''a certain document was missing''.

Abeg, what could be missing? Anyone in this position? N3800 transmission fee was paid for a family of 4 for a 2way courier. All other document was there - colored photocopies of passport datapage, PPR letters, yellow strip, consent form - my wife signed on behalf of the kids, and a paper bearing all the names of the family members.

I count on you for a feedback.

And i'm open to help anyone needing help and add my quota to your success story as well. Private chat me.

After the case was re-opened for redetermination by another VO, what were the updated documents that you were asked to submit?
1. Proof of fund
2. Letter of Acceptance
and any other documentation that has changed since the last submission..
for eg, birth of a new baby, tuition receipt in case if you have paid extra tuition..etc

TIMELINE; 1ST APPLICATION
. Online submission - Jan 22 2021
. Biometrics - Jan 25
. Background check - began almost immediately
. IELTS request letter - Feb 10 2021 with deadline Mar 13
. IELTS Submitted: Mar 13
. Upfront Medical - Mar 13
. Medical updated to pass - Mar 15
. GCMS notes requested - May 3
. Refusal letter - May 27

REASONS FOR REFUSAL:
1. Personal assets and financial status. 2. Purpose of visit

. GCMS notes received - Jun 3;
When notes came in, these were my observations:
1. My 2 children ages were wrongly captured
2. That I had lump sum whereas I didn’t have any.
3. Referred to my sponsor who was my Brother In-law as ‘’Uncle’’ instead of Brother In-law. I also had my Dad as Co-sponsor.
4. There was no Senior Visa Officer's comment.
And it was during the JR process, when Rule 9 notes were requested that I got to know what the SVO's comments were. The SVO ‘‘accused me’’ of
5. not having career progression, no correlated employment history, no established relationship with my brother in-law and that even if there was a relationship, that there is ‘’no obligation’’ on him to pay for my studies!

Meanwhile, my detailed 8 paged SOP was very clear on Career progression; Mine was a career switch – from Biochemistry to Administration, With 8 years work experience cutting across Marketing, Public Administration, & currently as P.A..
My SOP was one of a story telling as I knew I had to convince the VO why the career switch.

On ‘’no obligation to pay’’; I submitted notarized gift deed, sworn affidavit of sponsorship signed by both sponsors.
I made sure I covered everywhere cover-able..yet, breakfast was served! Check out the detailed TOC attached.

So, with all the errors and wrong conclusions i saw in the GCMS notes, I was convinced that the VO was being negligent with my application. I felt I had a strong application. I decided to go for JR straight. My mind was convinced and made up!

I reached out to a Canadian law firm.
They were very professional.
And 1st things 1st; they had to re-assess my application to be sure that my application was strong enough to go for JR.
Their best hands went through it and in their own words - ''The refusal was unreasonable''. They saw that i had a good case.

A 10-paged document was prepared in my defense countering IRCC's reasons for refusal. If you see citations from previous Supreme court cases, flying around everywhere in my defense eh, omo, me ma, i was feeling good freading the whole paper work!

And yes, God's favor was all over it.

And today, 7 weeks after the application for JR/RE-determination was submitted,
It has ended in praise.


JR TIMELINE
. Submission of a 10-page document countering reasons for refusal prepared by lawyers – July 21
. Settlement offer agreed/reached – July 30
. Case open for re-determination/request for updated documents – Aug 11
. Updated documents submitted – Aug 16
. Raised web form & email informing them that I have uploaded requested docs – Aug 18
. Confirmation from IRCC that docs have been received – Aug 20
. PPR – Sep 8

Hello everyone, thank you for your kind words and congrats to all who have gotten their PPR thus far. As promised, I'll try to share my story with you guys, even though it's incomplete as of yet.


Family of 5
Study permit for me and 3 children, visitor's visa for hubby
Submitted June 10, 2020.
Biometrics request June 11
Biometrics done August 24 (a day after VFS reopened)
GCMS requested August 28
Refusal September 24
GCMS came back Sept 28

Now, from the GCMS notes, I noticed the following:
1. The decision to refuse was taken as at July 11! Guys try to order your GCMS as early as 6 weeks into your application.
2. There was an error in reaching one of the reasons for my refusal. I had done an MBA in Nigeria, going for a Masters of Finance, but the VO interpreted it that I had done an MFin previously and so there's no career progression.

Immediately i received the GCMS, I torn between reapplying and seeking a Judicial Review (JR). The reason I considered the JR in the first place was because I felt the refusal simply unfair and baseless. Yes, a visa is not my right, however, as long as an individual meets the guidelines set in place, it is only fair that they receive a positive outcome.

Another reason I considered it is because, it's an opportunity people rarely use and this has given VOs the leeway to keep refusing people on a whim. If more people contest their refusal and win, it will likely lead to an overhaul of the current system going on in Nairobi.

October 2, I contacted an Immigration Consultant on Instagram about the possibility of reapplying. After reviewing all my documents, he insisted I go for JR, but hubby was not convinced. 1 because he didn't want to "fight" the Canadian immigration system and 2, he wasn't sure if the outcome would be successful especially considering the cost difference between paying a lawyer and reapplying.
Well, Consultant introduces us to an Immigration Lawyer. He reviews my documents again and said that I had a "Perfect" application, and so there's no reason for a refusal. Then he went ahead and offered to go ahead without a DIME being paid! If he loses, he goes away empty handed, but if he succeeds, then we pay a certain amount above the initial base amount. Hubby was more confortable with this arrangement.

October 29th after many back and forth, we submitted our application for JR. We were meant to get a response exactly 30 days which was to lapse on November 29th.

November 29th, Lawyer receives an email from the IRCC lawyers asking for additional 3 days to file their response.

And then silence, no further communication or even the expected response.

December 19th, I received an email saying there was a notification on my GCKey.

I logged on, and saw that the portion that usually shows "refused" had changed to "submitted". Every other member of my family's own still remained "refused". We called lawyer, he said he hasn't heard from them. Now, "success" with regards to our agreement with the Lawyer is when IRCC asks for "settlement". So at this point, it seemed like my application had been reopened without any agreement between my Lawyer and that of IRCC.

The wait was unimaginable!

January 12 I ordered GCMS and it came back February 12, and in it, it was stated that my application has been reopened because of a JR and my Lawyer has accepted the terms of the settlement!

Immediately, we sent the GCMS to him, still he maintained he hadn't heard anything from them. February finished, nothing!

March 3rd, Lawyer receives a letter requesting for a settlement on the case and the terms of the settlement. This was the exact same letter in my GCMS notes posted to my portal AS AT DECEMBER 2020! Anyway, we felt at least things are moving small small.

March 11, I received a request for additional documents. Really, what was important were new LOA and Financial statements.

March 24 uploaded the requested documents.

April 10 did up-front medical

April 29 Up-front medical passed

May 3, review for uploaded documents started.

June 16, Correspondence letter and PPR, 2 minutes apart.

Hubby and the children's applications were not reopened, we're currently in a dilemma as to whether to reapply for them or right a letter to IRCC. Your kind suggestions would be highly appreciated.

A few things to note from my personal experience:

1. The VOs are not as smart or as efficient as we tend to give them credit for.

2. Most times, approvals and refusals are given based more on feelings than clear evidence before them.

3. While I understand that JR is an expensive route, it would be nice if more people do it as it will highlight a lot of the rubbish they do at the embassy.

4. Lastly, let's be considerate to other people about how we boast after getting PPR. Trust me, the things you boast about: perfect SOP, Prayers, Documents etc, there are people who did all that and more and still got refused.

In the course of this journey, I also started to pursue a student visa in tbe UK before things started looking up, and believe me, the system with the British is far more transparent than that of Canada. Once you meet the requirements at submission, you are over 80% sure you'll be awarded the visa. But there's a lot of bias and subjectivity with the Canadian embassy.

I want to thank every single contributor to this Agile forum for the work you do! I submitted a "Perfect Application" ( according to my Lawyer) thanks to the stuff I got from here.

Also, I want to thank @frankrobben for his patience and selflessness here. People drag him all the time, but he never relents in being helpful. I remember the day I wrote about the JR option and his contribution and how he was dragged and insulted. Yet, he and I have never had any direct encounter and the Consultant and Lawyer did not come from him. Well done!

I was thinking that apart from sending emails to all the email addresses and raising web forms, perhaps knowing which particular office is handling ones case will make the efforts more targeted and effective.

So after submitting/uploading my IELTS on March 10th (as per the NSE request that was sent to me), at the stipulated section where it was meant to be uploaded.. i got the notification on my portal saying that ''your document has been successfully uploaded.

So i thought to myself; they have seen it.

Only for me to get an email May 13th (2 months after..) saying that ''We successfully received your document"

So now; is it that all these while, these people have not received the document talk more of ''seeing/reading'' the thing??
Or they are just beginning to look at my ''complete'' application package??
Abi was that just an automated msg??

Abi is it the power of my GCMS note request i sent May 3rd that is working ni..??

After which, a Biometrics Collection Letter would be sent to your GC profile?
It is with this BCL you will use to book online for your biometrics..
Once an appointment date is confirmed, you proceed to the nearest VFS center for capturing.

Over the course of my five (5) years experience in handling complex immigration cases, I have seen on several occurrences, applications being refused by the visa officer after requesting and passing a medical examination. There is no blue print that works for Canada immigration processes and the format is not properly elucidated. A visa officer has absolute right to deny an immigration application if he/she is not satisfied that the applicant is a genuine student. I can tell you free from the wisdom of my experiences that situations like this often occurs when an immigration officer is not able to complete their assessment on a file before transferring the work load to another visa officer for finalization. The new visa officer who then took up the application from where his colleague stopped will review the supporting documents/comments and may have some reservations thus unavoidably leading to refusal. I have seen this happen on several GCMS notes, albeit it's not common. Above all, should you've received a medical request, your application success is 95% close to approval. Keep the faith alive.

Good day people, I applied through the Nigerian student express but I was required to go for my IELTS tests which I did but I could make over band 6 in all aspects which is their requirement. My question is can I submit the results that way since the days given is almost up and it won't be in my favour if I seat for another test now
1. if you have a valid IELTS with a band 6 across all skills, then you can go ahead and upload it.

2. if you are waiting to write a fresh IELTS, then ensure you get the result ready and handy for you to scan and upload before your deadline. Perhaps, CBT (Computer Based Test) will be a better option since it is faster than paper based.

3. it is necessary you submit your IELTS before the ultimatum deadline reaches. Otherwise, your application will be treated the normal route. If you don't have enough time to write and submit, then the normal route will be the option.

My thoughts; your application gets reviewed (R-10)/ checks. And if the Program case analyst notes that you could qualify for the NIGERIAN NSE stream (based on the documents you submitted), you would be sent a REQUEST LETTER ..
In my case; I submitted my application with MBS but not with IELTS. but the request came in for me to submit IELTS under 30 days. I did, and it was instantly updated.

This is my own case scenario sha..

Not in all case necessary. I listed all 7 siblings without adding their birth certificates or passport data page as well as my parents. I only uploaded that of my spouse and children and got approval.

PPR JUST DROPPED!

My application journey is quite interesting, and I promised to share here if I get a PPR. So firstly, I applied using an agent. As a matter of fact, I got admission using one agent, and got the visa using another agent. My application made me come to the conclusion that using an agent is truly not worth it. Imagine that I paid 300k just to get a PGD admission in University of Winnipeg. Bygone, anyways - lucky agent. After my admission, I switched to another agent because my Dad, who previously didn’t show interest, decided to be involved. The second agent came through my dad (he paid the agent 250k or so) - he was recommended by my uncle. I gave him the LOA I paid 300k for, and he requested me to write my LOE. I was able to write a good LOE with the help of Google, and of course, Nairaland. I am sure you are wondering what exactly this agent was paid to do, if both LOA and LOE came from me. Me sef dey wonder lol.

APPLIED - DECEMBER 7
BIOMETRICS - DECEMBER 8

Na where wahala start be this. The whole journey was mentally exhausting. This agent fit make person crase with obvious lies and pretense. Want to make this as short as possible, so let me just drop one example. The agent was supposed to have applied long before the time he did. So we pressured him till he lied and made a fake medical request letter. In his own letter, the medical has to be done in 90 days, instead of the usual 30 days. Note that biometrics had not been done then oh. He also gave us fake biometrics appointment letter one time, and when the day came, he said IRCC has technical issues, and he would have to book another date. Basically, my whole journey with this agent was filled with altercations and mistrust. It got to a point, all we wanted was access to the portal, but this agent was giving stories like he didn’t know the password offhand, and he would find it. Moving on...

ORDERED GCMS - MARCH 27

Fast forward to April ending, I hadn’t heard anything from this agent. Was checking this thread regularly and seeing even January applicants receive PPR. I decided to message this agent to remind him. This was when the agent logged into my portal and saw that I got medical request 8 days before.

MEDICAL REQUEST - APRIL 14

Finally, he was confident about the application, and dropped the login details even without asking him.

MEDICALS DATE - APRIL 27

I was eager to get the PPR, and was checking my portal like every hour after I did the medicals. On the morning of April 29, I opened my portal, GUESS WHAT I SAW? Booooom! Procedural Fairness Letter - I wanted to faint even before opening the PFL.

PROCEDURAL FAIRNESS - April 29

I opened the PFL, and what I saw was that the VO has concerns that my Dad’s statement of account is not genuine. I am to prove that it is genuine in 15 days, or I get 5 years ban. I was destabilized and scared to the bone. A lot ran through my mind in milliseconds.“ Could it be that this guy used a fake SOA, instead of the one we gave him?” “Could it be that he altered some transactions?” Picked up the phone to call this agent, and for like 2 hours, his number was switched off. I started feeling like he already saw the PFL, and was on the run.

Finally, we reached him, and he assured us that he used the SOA we gave him. He told us to go to the bank for MBS, and give IRCC a SOA that shows transactions till the date of the PFL. We did that immediately, but how could I trust someone who once gave us fake medical request and biometrics appointment letter?

I became restless since that minute I saw the PFL, and even after submitting MBS, I couldn’t still sleep or do anything. I was literally checking my portal uncountable times in a day.

MEDICAL PASSED - MAY 1

This should have been an update that would have made me rest assured of finally leaving this Nigeria, but I remained unhappy and restless because of the PFL.

GCMS NOTE RECEIVED - MAY 3

Finally, GCMS note came in yesterday night before I slept. Saw that everything has been passed. I also saw that instructions have been given that I get a study permit till 2023. Lastly, it was in the GCMS note that IRCC had messaged my Dad’s bank to confirm if the SOA is genuine, and they got response from the bank that it is genuine. This happened since the beginning of April.

THEN WHY ON EARTH DID IRCC GIVE ME PFL ON APRIL 29huhhuhhuh Shaey IRCC dey whyne me nihuh

The more I thought about the whole issue, the more it becomes obscure. I search Google tire to see if anybody don face the same issue before, but I no see anything.

To God be the glory sha, I opened my portal 12pm today, and I saw ORIGINAL PASSPORT REQUEST! Booomshakalaka!!!!

Till now, I can’t explain what happened concerning that PFL thing, but I just thank God. I no even wan understand again sef lol. Thanks to everyone doing a good job here. You all will be forever appreciated.

''your application is under active review'' were the terms used in the email IRCC sent me after i had sent emails and web forms to them telling them that my application has exceeded standard processing time (after NSE request requirement was met).

It seems to me it's the same thing..

I am also going for an MBA in UCW this summer but then I am yet to get a decision. I applied March 16 with NSE documents and did biometrics on March 19. I have been waiting for medical request, however, I have booked for an upfront medical for May 11.

Same here too; MBA at UCW this summer. Applied Jan 22. NSE submitted March 10. Upfront medical March 10. UFM updated to pass March 15. Sent web form & emails as per exceeded standard processing time, and they replied me with the ''your application is under active review..'' msg.
Thinking of requesting for my GCMS. And if July 5th is going to be realistic for UCW prospectives, then we need a feedback before June 15 if we have to make it in & finish the 14days quarantine before orientation begins.. (my calculation)

This too will end in praise.

You need to contact IRCC via webform to inquire about the current status of your application and ask if they need any documents from you to expedite the processing of your application. Sometimes, if you don't follow up with the immigration authorities, you may not get a faster processing from them. Be proactive by contacting IRCC via this medium.

once it gets to the point of clicking on ''NEXT'' where it takes you
to where to upload the eMedical information sheet, the thing will just hang!

Now that you av done your Upfront medicals, it expected of you to send your e-medical SHEET (a long slip given to you at IOM) via Webform & Mail to CIC Nairobi immigration and also send to E-mail address of other Immigration offices.

3) No fixed duration like I said initially, but it shouldn't be more than a Month if its gonna take long

Every submitted documents go through R10 checks where the documents are resorted to make the work easy for the VO.

Not all folks that went through the NSE Stream are successful. Some has been refused whilst majority got positive decision.

The requirement for the POF under NSE is for the account to have a minimum of 30k with transactional history of 12 months.

With the available 75%, I don't think you are likely to face any issues. Most people going through NSE don't even show close to the 30k and besides, the VOs seem not to be abiding to the rules guiding NSE during processing.

To my understanding, numerous of those applications with NSE request were still being processed despite the 30 days pending warning.

Now i have some thoughts & questions;

1. for ircc to be requesting for additional document, does this mean they have gone through ALL my documents (POF, CLIENT INFORMATION) and the whole bunch..? Otherwise how will they know that i did not submit IELTS (I didn't have to because my school didn't require it as criteria for admission and i was not interested on the NSE route). Also, i noted from the thread that it seems like once you do the NSE request, folks seem to end up with positive visa approval (i stand to be corrected). am i alone on this though?lol

2. Also, one requirement for the NSE, is that the funds should have been in the account for 3months..
my issue is that only about 75% of my funds in that account have been there untouched for 3 months..the remaining 25% did not meet the 3months stipulation. If i decide to do this NSE request thing, i hope this will not end up bringing wahala to me.

LOE explaining why i won't be able to submit IELTS, indicating my preferred interest to have my application processed using the normal route? Is there any harm doing this?

This is what I will do:

Write a concise LOE thoroughly explaining why the NSE request couldn't be responded to.

Remind the VO that the deadline has elapsed and that the commencement of the academic window is already at sight.

Then entreat earnestly for the resumption of the application processing to begin. You can use either or both email and CSE to achieve this means.
