FarahAideed: Exactly that's why we are praying Buhari sieze Bonga so he can go the way of Abacha fast na ... Of course they will not pay 9.6 billion but will end up paying at least 3billion in staggered payments and that's still a huge loss Be serious Nobody is paying any 3 billion USD |
Politics › Re: Presidency Hawks Want FG To Seize Bonga Over $9.6bn Judgment Debt by Myself2(m): 10:20am On Sep 02, 2019*. Modified: 12:47pm On Sep 02, 2019 |
FarahAideed: Clowns ..I pray Buhari listens to those hawks and sieze Bonga Why do you consider them clowns?? You must have forgotten that there was once an organization called British Petroleum in Nigeria. Also during Abacha's time, the U.K. threatened some of Nigeria's assets, Abacha started impounding aircraft belonging to British Airways once they touch Nigeria, In both instances, Nigeria came out tops. I kid you not, the FG can actually seize Bonga or any huge equivalent British/Irish owned assets in Nigeria The end game will be drag in so many weighty third parties who will be forced pull their weights and weigh in for self preservation ad maintenance of their business status quo, ultimately Nigeria will get a reprieve. Actually anybody who thinks Nigeria will just pay that outrageous and dubious $9.6 billion knows nothing about the power of self preservation in international politics |

linearity: If you re-read my comment, I used the word IF; and that is based on the original story and the defense of the worker and the reason for her post. My comment was, if her defense is true; then there is no defamation.
. I remember simply responding that would be a big IF as the entire matter rests on this IFSo we are in agreement here linearity: .
. Police can arrest anyone, and IPOs can charge anyone. A charge brought against anyone is not a proof in itself. We have seen even Nigerian courts striking out EFCC cases. IPO bringing a charge against someone in Nigeria, especially in a circumstance like this, in majority of the cases; might mean either the defendant did not pay 'bail' money or the 'bail' money was not enough or that the claimant have a deep pocket and must have taken care of the Police and is determine to teach the lady a lesson or to intimidate her to back down and back off.
. We are also in agreement here linearity: I don't have to be a Judge to know the law, it is your duty as a citizen to know the law and conduct yourself accordingly and also be able to assert your rights, if the Police or some Boss want to intimidate you. You forgot to mention Or If some mischievous staff wants to lie against you as a boss, or slander/defame you in some form |

9jaRealist: But that's exactly what he has done! Instead of a civil case for defamation, he has apparently used his position to initiate a CRIMINAL process.
Defamation is a TORT (ie, a civil wrong rather than a criminal wrong). Accordingly, while he can seek CIVIL redress, getting the police to arrest the lady is an abuse of the coercive power of the state. > I disagree, he did not need his position to approach the courts. At worst you could say its an abuse of court processes or case was filed wrongly, either way, he did not need his boss position to do this, he should even be pitied as his case could be thrown out for being filed wrongly (if not amended) The arrest of the defendant by the police could still have happened even in a civil suit, it's what follows thereafter that is key |

dicefrost: Truth is a defense against Libel. If the boss actually owes her, then she did not commit a crime by calling him a debtor That's a big IF, which neither you nor any other nairalander here castigating the boss can say for certain whether it happened or not, so why not allow e court to hear he matter and make pronouncement |
Crime › Re: Police Arraign Company’s Secretary For Calling Her Boss ‘Debtor’ On Social Media by Myself2(m): 6:03am On Aug 30, 2019 |
linearity: Go look up the law and meaning of defamation.
It is not defamation if, what is alleged is true!
If the guy is owing salary, then calling him a debtor or publishing online that he is a debtor is not a crime and it is not defamation.
The over zealous police must prove that, what the lady published is false and untrue to get a conviction....all the lady need is a charge and bail lawyer and she will be free, otherwise the IPO will falsely push her into some stupid agreement that, she will sign to put her in silence, therefore making the debtor not to pay her and she not able to talk about it anymore. Are you the judge? So what other legal advice would you have given the claimant since you are against him for taking the legal step of going to court and not resorting to self help. The claimant has gone to court, let the judge give judicial interepretation to that. How are you so sure the boss was even owing her in the first place, are you a witness to their transactions? The IPO must have done some reasonable amount of investigation before having the boldness to charge the matter to court, so let the court hear both sides and determine the case on its merits or otherwise |

9jaRealist: Dude, it is NOT... On the contrary, she precisely asked the ONLY relevant questions.
TRUTH is a complete and unqualified defense to defamation under Nigerian law (as the Supreme Court reaffirmed in Dumbo & Others vs Igbugboe), and that has always been the case under common law. > The judicial process as pertains to common law stipulates that if a party feels defamed by another, they are at liberty to seek redress in the court of law.Rather than vilifying the claimant, he should be applauded for not resorting to self help or using his position as boss to exact vengeance or punishment on the staff |

okokkk:

Uche Ogah's ascendance to power is testament of the efficacious nature of sycophancy and desperation. His innocent and unassuming outlook are obvious mistakes of creation. Don't fall for it!
When he first stepped into the political scene in 2013, he brought hope. He revived the belief in the Abia project. In Aba then, we used to sing, "Ogah fuo ,anyi e fuo" meaning "If Ogah goes missing, we are all doomed". That was the extent of hope he offered. But all that meant nothing to Ogah who only wanted power for power's sake.
His message was of liberation. We wanted our evil godfathers out of the way. He knew this, so, he preached same. We thought Ogah was the new order. We all followed him sheepishly till he led us to Orji Uzor Kalu.
Today, that epic betrayal has been rewarded by the cowliphate, and for the cowliphate. This is truly a man who has the facts on the ground |
