It is a sign of the problems we face that some of us are more interested in the style of the interview triumphing over the substance.

Most Nigerians like Goodluck for some of the things his critics hate such as humility, likeability and the absence of gra gra.

He will continue to confound his critics. Remember a few weeks ago some of you said he was mugu/mumu - he has since shown you otherwise. Now it is his accent.

Get used to the accent - you will be hearing more of it as president beyond 2011.

Fayemi vs Oni: Violence, as tribunal reserves judgment

The Action Congress governorship candidate in Ekiti State, Dr. Kayode Fayemi, on Tuesday asked the Election Petitions Tribunal hearing his petition against Governor Segun Oni to declare him as the validly elected governor of the state.

Fayemi said this as he adopted his written address before the panel headed by Justice Hamma Barka.

Elsewhere in Ekiti, the state capital, violence broke out between some people suspected to be thugs loyal to both the AC and the Peoples Democratic Party.

The petitioner, who was represented by a team made up of Mr.Yusuf Ali, SAN; Niyi Akintola, SAN; Bayo Adelodun, SAN; Anthony Adeniyi, Femi Falana and other lawyers, told the panel that he had been able to prove that the election held in the six wards under dispute was not known to the law.

Ali said, “I urge your lordship to hold that any election with massive violence and disenfranchisement is not an election known to law. We have discharged the burden of proof placed on us. If there was anything in Ifaki and other disputed areas, it was not an election known to the law.

“The law today is that where there is an allegation by the petitioner that there is no election, the burden of proof is shifted on the respondents to prove that there was an election. They should produce results to show that an election was held.”

He said that the petitioners took all legitimate steps to demand for the result but the respondents failed to produce them.

Citing the case of Joy Emordi, Ali said, “The burden of proof is now on the respondents and having failed, they must bear the consequences of it with equanimity.”

But Oni’s counsel, Mr. Adebayo Adenipekun, SAN, while adopting his written addresses, urged the tribunal to dismiss the petition of Fayemi and confirm Oni as the lawfully elected governor of the state.

He argued that since the petitioner alleged that the election held in the disputed areas was not known to the law and that the results were falsified, the petitioners must produce two results – the fake and the authentic – with which to declare him the governor.

Adenipekun said, “I submit that the petitioners have failed to discharge the burden of proof placed on them. The petitioners have the election materials in their custody but they refused to produce them.”

The PDP counsel, Obafemi Adewale, in his submission, also urged the panel to dismiss the petition filed by Fayemi, saying that he had failed woefully to prove the case of substantial non-compliance with the Electoral Act, 2006.

The counsel for the Independent National Electoral Commission and Resident Electoral Commissioner, Mr. Roland Otaru, SAN, also urged the panel to dismiss Fayemi’s petition.

The counsel for electoral officers, Ido-Osi and Ijero Local Governments, Mr. Tayo Oyetibo, SAN, also urged the panel to dismiss the petition. The police counsel, Mr. Paul Owovboriole, SAN, also aligned with other respondents in urging the tribunal to dismiss the petition.

The chairman of the tribunal thanked the parties and said that the date of the judgment would be communicated to them soon.

Meanwhile, Fayemi escaped unhurt as armed thugs reportedly opened fire on his vehicle while returning from the state High Court, Ado-Ekiti, the venue of the tribunal.

Our correspondent gathered that Fayemi, who was chauffeur-driven in a black sport utility vehicle, was ambushed almost in front of Tantalizers very close to the entrance of the Governor’s Office in Ado-Ekiti, the state capital.

A source said that the attack, which occurred at about1pm, was led by a popular thug.

The source close to the AC governorship candidate said, “As Fayemi’s car got to that place (in front of Tantalizers) they (name withheld) started shooting at his jeep. But thank God the jeep is a bullet-proof one so he was not injured. But they started throwing stones at the jeep also but it did not do any damage to it.”

However, about 11 supporters of the AC were brutalised following the clash which ensued after the failed attack on Fayemi.

A journalist with Channels Television, Felix Vincent, while attempting to film the clash was attacked and he sustained a deep cut on his head. Also, a cameraman with Africa Independent Television, Richard Akinbode, was injured in the clash.

Fayemi, while replying to an enquiry sent to him, confirmed the attack on his vehicle. He said, “Yes, I was attacked but thank God, the car is bullet-proof.”

But while the AC alleged that the PDP attacked its members and journalists, the governor, in a statement issued on his behalf by his Chief Press Secretary, Mr. Wale Ojo-Lanre, blamed the attack on journalists on AC thugs.

He also alleged that some PDP members were attacked and injured by AC thugs.

The Police Public Relations Officer for Ekiti State, Mr. Mohammed Jimoh, when contacted, said that he would confirm and get back to our correspondent.

However, a police source who was at the scene, said that the violence was a clash between the PDP supporters and AC supporters. He said that Fayemi was not attacked.

THE conclusion of sitting of the Ekiti State Election Petition Tribunal, led by Justice Hamma Barka, was marked by violence in the state capital, Ado-Ekiti, on Tuesday.

Though yesterday’s last proceedings of the tribunal, at which all the parties to the dispute adopted their written addresses, went without rancor, apart from occasional exchange of verbal attacks between loyalists of both camps, there were reports of attacks on party members and journalists in Ado-Ekiti, shortly after the panel ended its sitting with the Peoples Democratic Party (PDP)-led government accusing the opposition Action Congress (AC) of being behind the violence.

A Channels Television reporter, Mr. Felix Vincent, was attacked and inflicted with machete cuts, while his camera and that of a staff of the African Independent Television (AIT) were broken.

However,that there were accusations and counter accusations by both the PDP and AC, as members of both parties traded words blaming the cause of the violence on each other.

According to the Chief Press Secretary (CPS) to Governor Segun Oni, Mr. Wale Ojo-Lanre, members of AC were responsible for the unrest, noting that PDP had no hand in it. “Now, they have machetted a journalists simply because they used to see him in the Government House. AC thugs, on the orders of their leader, damaged many journalists’ cameras,” he alleged.

An aide of Dr. Kayode Fayemi, the AC governorship candidate, Mr. Yemi Adaramodu, also alleged that thugs loyal to the PDP attacked his boss’s convoy and fired shots at him outside the state High Court premises.

“Towards the end of the adoption of the written addresses, PDP thugs within the tribunal premises led by Bunmi Ojo, the Personal Assistant to Mr. Segun Oni and Ijakoko started chanting war songs threatening to deal with Dr. Kayode Fayemi who was at the tribunal.”

The Ekiti State government condemned the alleged attack on journalists and some members of the PDP, calling on the residents of the state to remain calm, as the whole situation would be brought under control.

Meanwhile, the state governor, Mr. Oni; the PDP, the Independent National Electoral Commission (INEC) and others have described the petition filed by Dr. Fayemi against Oni’s declaration as winner of the April 25 rerun governorship election as lacking in merit and inconsistent, urging the tribunal to dismiss it.

Addressing the tribunal, counsel to Governor Segun Oni, Mr. Adenipekun, SAN, noted that the petitioners were inconsistent in their pleadings and in their written submission. Adenipekun pointed out that the petitioner, in Paragraph 44 of the petition, pleaded that no election known to law were conducted in Ifaki I, Ifaki II, Orin/Ora Ward, Usi Ward in Ido/Osi Local Government Area and Ipoti Wards A and B in Ijero Local Government Area. However, in their written address, he said, they pleaded that there was no election at all.

“That is their entire case before Your Lordships. And it says that there was no election known to law. That is different from a case of ‘there was no election at all.’ In the case they brought that there was no election known to law, that presupposes that there was election but that it was not in conformity with the law.

“In their evidence, any place that they argue that there was no election, I urged Your Lordship to ignore their plea that there was no election. This is very important because of the burden of proof. Where they are alleging that there was an election, but not the one known to law, they have to prove that there was an election, but it was unknown to law. Therefore sir, they must bring all the electoral materials used for the election before Your Lordships. In addition sir, where they are alleging falsification, manipulation and so on, they must produce two results, one that is fake and the authentic.”

Sources told Peoples Daily that the suspect was boyfriend Miss Oge Enekwechi, (an elder sister to the deceased) with whom he was staying after completing National Youth Service Programme. He only recently secured employment as a teacher with the state ministry of education


It was gathered that on the evening of Easter Sunday, a row had ensued between the suspect and his girlfriend, which attracted the attention of neighbours, including the mother of the lady, who immediately asked someone to call Emmanuel (the deceased) to come and rescue the sister.

A 22–year-old man, Mr. Uzochukwu Nnabike Okoli, plumber, has passed through the valley of the shadow of death. He escaped death by whiskers in the hands of masquerades for allegedly refusing to be initiated into the masquerades’ secret cult at Umudara, Umunuko Ukpor in Nnewi South Local Government Area, Anambra State.

Okoli narrated his ordeal to Daily Sun at the emergency unit of a private hospital, Ukpor, where he is being treated after almost losing his left arm to masquerades during the alleged attack.
Precisely on Good Friday, April 2, the victim said he was going to worship at a Catholic church on his motorbike when he saw his younger sister: “I saw my younger sister as I was going to worship then I stopped and parked my motorbike to discuss with her. Suddenly I saw the masquerades and their followers who pursued me and I ran into the bush because they had earlier told my father in January that they will deal with me if I fail to be initiated into the masquerade cult.

“When they caught me they said we should go to the masquerade house (shrine). I refused but they insisted telling me that elders were there and would like to see me. I yielded to that but when we got to the masquerade house they insisted that I must be initiated into the cult, which I resisted. Then at the command of the cult members the masquerades started cutting my left arm with a cutlass to chop it off and perhaps kill me thereafter.” Okoli said that the masquerades so severed his left arm in that it was dangling as if it will fall out “and they cut my bones.” He said that the incident was happening in the presence of the elders who are also members of the cult and could not hush the masquerades to stop their murder mission.

Okoli said it was one man he called Nzu that rescued him and rushed him to the Nnamdi Azikiwe University Teaching Hospital (NAUTH), Nnewi, from where he was moved to General Hospital, Ukpor, because of high bill his people feared might be charged at NAUTH.
Not satisfied with the level of treatment at the general hospital, according to the elder brother to Okoli, Chidozie the victim was further moved to a private hospital in Ukpor where he is currently receiving doctor’s attention.

Chidozie told Daily Sun that the matter had been reported to the Ukpor Police Station and that a police officer had taken his brother’s statement even though, according to him, the cult members are still threatening to regroup and launch a fresh attack on his family. He said one of the cult members came in his absence and issued a threat to his mother without any remorse on their earlier attack on Okoli.
Chidozie, a marketer and a part-time student of the Enugu State University of Technology (ESUT), is crying for justice so that his younger brother would not be forced to belong to an organization he does not like: “Don’t we have freedom of religion again in this country? We want justice and nothing but justice.

“My daddy went to the elders to discuss the matter with them but they refused to give him audience saying that it was not a matter between them and him but a matter that will be discussed with the masquerades”.
Contacted, the Police Public Relations Officer (PPRO), Awka Mr. Emeka Chukwuemeka, (ASP), said the incident had not been reported to his office but promised to confirm the story with the Divisional Police Officer (DPO) in charge of Ukpor and get back to the correspondent, although he did not get back to him. All efforts to contact the elders of the masquerades cult members proved abortive

The chill in the relations between the Nigerian Bar Association (NBA) and the Supreme Court worsened on Monday in the chambers of the apex court as the body of lawyers threatened to boycott the ceremony for the conferment of the rank of Senior Advocate of Nigeria (SAN) on some of their colleagues.

A drama played out shortly after when the Chief Registrar of the apex court, Alhaji Usman Musale announced that the court would not take speeches from anybody other than the Chief Justice of the Federation (CJN) and the leader of the new lawyers being conferred with the rank of Senior Advocate. Irked by the announcement, President of the NBA, Chief Rotimi Akeredolu (SAN) sprang to his feet and demanded to know if he had the right to make his speech.

Responding to the question, Justice Dahiru Musdapha said the ceremony was for the conferment of the rank of SAN and not the beginning of a legal year where the NBA and others were allowed to make speeches.
According to Justice Musdapha, “we have said today’s ceremony is for the conferment of the rank of senior advocate. It is not the beginning of another legal year where the association and others are allowed to make speeches.
“Only the leader of the new senior advocates and the CJN will speak. All other persons present here are invitees. If anybody does not want to stay, the person is at liberty to go out.”

This did not go down well with members of the NBA leading to an emergency meeting of the body immediately after the ceremony.
The NBA president said, “we offer ourselves to lead this profession. I say it with all emphasis, I, as the leader of this association, I am prepared to leave that position today if the bar is not prepared to be forthright and be courageous in the face of this assault. I see it as an assault and a calculated and deliberate one.

“The Attorney General of the Federation is here; he was never informed that he would not be making any speech. It will certainly not be right to come here and not allowed to contribute.
“In the invitation sent to me, I was told that I would be making a speech here today. We were told that there was an error in the invitation sent to me. It could not have been an error. We have always been following a procedure here. The NBA president and the AGF usually speak at this occasion. If the procedure is changed, we need to be informed. There was a duty imposed on the CJN to inform us that procedure has changed.”
At the meeting, it was unanimously agreed that Akeredolu should lead some past presidents of the body to protest to the Chief Justice of Nigeria (CJN), Justice Aloysius Katsina-Alu over what they described as an embarrassment.
Earlier, Akeredolu disclosed that while the court session was going on, he had asked his colleagues to stage a walkout but was prevailed upon to stop.

Others who spoke at the meeting were two past presidents of the association, Chief Thompson Okpoko SAN and Chief Wole Olanipekun SAN.
The development almost marred the conferment of the rank of senior advocate of Nigeria (SAN) on 19 lawyers.
Former president of the association, O. C. Okocha minced no words in condemning what he called “this kind of behaviour by the court,” saying there could be no court without lawyers and that a situation whereby lawyers were addressed anyhow would make the profession a laughing stock in the public.

In fact, the lawyers had to shun the food usually provided for the entertainment for guests.
Meanwhile, copies of Akeredolu’s speech had been circulated before the face-off and it was difficult to retrieve them.
In it, the NBA insisted that the involvement of the association in the choice of who wore the silk would help in getting candidates who would be accepted by all stakeholders in the profession.

Akeredolu lamented a letter written by the Secretary to the Legal Practitioners Committee, Usman Alhaji Musale, “as uncouth, insulting and totally at variance with the issue raised in my letter.”
“The letter suggested that the conclusion of the members was that you have jumped the gun by writing to his lordship before presenting the matter before the National Council of the Bar.”

He said Musale’s letter remonstrated him to always exercise due discretion because it considered the “….letter as baseless, unmeritorious and disrespect to the person of the Hon. Chief Justice of Nigeria ”.
Meanwhile, the CJN, Justice Aloysius Katsina-Alu fired a salvo in his speech, though inaudibly presented, which lamented the indiscipline of some lawyers who preferred to argue their cases in front of the media.

“Those who make allegations of corruption or other misconduct against serving justifiable reason, I would like to remind them that all freedom of expression has limits and that they are walking a dangerous road. I say no more at this time.”
Nineteen lawyers including Mr. George Oguntade and Mike Ozekhome who were sworn in yesterday were appointed by the Legal Pratitioners Privileges Committee, the body charged with the responsibility of appointing senior lawyers into the inner bar on February 1, 2010.
The announcement was made by the Chief Registrar of the Supreme Court, Alhaji Musale who said the committee led by the Chief Justice of Nigeria (CJN), Jusice Aloysious Katsina-alu considered all the applications submitted by applicants.

A total of 126 legal practitioners and academics, he said, applied for the rank and only 19 were lecturers and 107 practising lawyers.
The committee, he said, accepted the applications of 19 in line with the guidelines and the list of other new senior advocates are as folows: Nella Andem-Ewa, Joseph Nwobika, Offiong Bassey, Dorothy Ufot Francis Dike, Chukwuma Ekomaru, Obi Okafor and Sylvia Shinaba.
Others are; Etigwe Owa, Adebanjo Badejo Ishola Layonu, Babatunde Ogunba, Toyin Pinhero, Olusina Sofola Samuel Mosugu, Andrew Chuckwumerije and Fabian Ajogwu.

Musale said the swearing-in ceremony would be conducted by the CJN on the new silk on April 12, 2010. He disclosed that application forms for this year’s applicants would be available from next week and were due for submission in March.
He said the guidelines for the appointment into the rank of the senior advocates had been streamlined by the privileges committee.
Responding on behalf of others, Dr. Samuel Efurosibina Mosugu said the honour was a crown to all of them and they would continue to cherish it and use the title for the benefit of the common man.
