[size=18pt]Jonathan needs Yar’Adua’s letter to become president, says court[/size]
The Federal High Court in Abuja ruled today that the Vice President, Goodluck Jonathan, does not require an enhanced authorisation to function as president. Justice Dan Abutu said this today in his ruling, adding that on the basis of his delegated or assigned powers by the president before he travelled, the vice president could be said to be performing the functions of the president. Justice Abutu held that the vice president has been discharging the functions of the president as were assigned/delegated to him by the president before his trip on November 23rd, 2009.
The judge also said [size=14pt]the only way[/size] Mr. Jonathan could become acting president is if sections 145 (1) of the 1999 Constitution was complied with. Section 145 reads: “Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President.”
Mr. Abutu was delivering judgment in a suit filed by Christopher Onwuekwe, that the present scenario, where the president has travelled out of the country because of his failing health and is unable to return is an indication that there is no head of government and that the situation has led to major crisis capable of threatening the stability of the Federal Republic of Nigeria.
Specifically, the suit was filed against the Attorney General of the Federation (AGF) and the Federal Executive Council, asking it to order Mr. Jonathan to begin exercising the powers of President Umaru Musa Yar’Adua in his absence.

Kobojunkie: UUmm. . . The BBC report states he 'has full powers' in Yar'Adua absence. That in essence means there is no power vacuum because the VP can continue doing the job the President would have been doing if he were in Abuja. Does that mean Jonathan has the power to sign the budget and NAS bills in to law, swear in the chief justices of d federation and fire any minister he doesn't need? |

Nigeria's vice-president has the right to perform all duties on behalf of sick President Umaru Yar'Adua without any formal transfer, a judge has ruled. It is the first of four cases aiming to clarify who rules Nigeria during Mr Yar'Adua's absence. He has been in a Saudi Arabia hospital since November. Ministers and the lawyer who brought the case said they were satisfied.
But some critics want to see Vice-President Goodluck Jonathan become official head of state.
Correspondents say the issue is so sensitive because of the ruling party's system of alternating power between north and south. While Mr Yar'Adua is a northerner, Mr Jonathan hails from the south. Northern powerbrokers may be reluctant to see a southerner take over officially before the next scheduled presidential election in 2011.
'No power vacuum' Justice Daniel Abutu said Mr Jonathan would only be legally regarded as "acting president" if he had received written instructions to do so.
Christopher Onwuekwe, the lawyer who brought the suit against the government, said he felt the judge had upheld his case. He said he went to court only to confirm that the vice-president had the power to carry out the functions of the president. Justice Minister Michael Aondoakka welcomed the ruling, saying it showed there was no power vacuum and would allow ministers to get on with the business of governing. He said there was now no justification for the other three cases - due before court on Thursday - to go ahead. In one of the cases, rights lawyer and activist Femi Falana wants all decisions taken by the cabinet during the president's absence to be annulled. In another, the Nigerian Bar Association is demanding that he hand over power formally to Mr Jonathan. And a rights group wants Mr Yar'Adua declared "missing".
In his first public remarks since falling ill, Mr Yar'Adua told the BBC on Tuesday he was in constant contact with his deputy. He said he was recovering and hoped to be able to return to Nigeria to resume his duties. Doctors say the president is suffering from acute pericarditis - inflammation of the lining of the heart. He also has a long-standing kidney complaint.

DR CROSS: illusion2, please dont call Goodluck a bloody vice president,the guy is trying his best because is not in his position to declare himself as president,we should all blem the federal council or what ever the call themself.But i only blem Goodluck for not confroting U.S vice president about Naija being black list as terrorist country Nobody is asking him to declare himself the president. But let him at least exercise his power as Vice president especially now that the president is not around. He has been too quiet, dull and inactive for my liking. The best time for him to shine is now. He should be on the side of the people. Even if it means losing his face b4 some few disgruntle political sycophants, he will always be on the good side of history and People will always remember him for being on the side of the truth/majority. real4life: When Saminu Turaki was governor, all his commissioners and top government officials used to live in Kano because Jigawa was totally inhabitable for them. I think one of the first things Sule Lamido did was to order all top government officials to either live in Dutse or resign from office. That is impressive as well
