I would like to concur with TWoods on this.

Ur younger sister had a good track record before her more than 4 month sabbatical in the US which resulted in her overstay. Am guessing the overstay had no defendable story or exemption behind it and it was done out of breach as am sure she knew of the repercussions.

Be that as it may, she is already on an automatic ban for a US visa hence the second denial, hence the VO's statement during that interview.

The good news is she has a Canadian PR, she should run with that. Let her school there if possible, they have good universities as good and acceptable in the US. She can try to finish her remote studies in the US college if that's possible but if not, she can switch to a Canadian one. She will get her passport after 3 years on continuous stay and can fly back to her US in no time which by this time, her ban would have been lifted. She can also wait to get a TN visa which would allow her work in the US for a period 3 yrs intials and then extend her stay from there if she's so particular about the US.

If she already has a Canadian permanent residency, why doesn't she just go to school there? Why punish herself by staying on a temporary visa, with all the restrictions that come with it? Once she gets a Canadian passport, she can go back and forth to the US as much as she wants. Going to school in the US will simply prolong how quickly she can apply for a Canadian passport as it does come with residency requirements.

Hi everyone,

I hardly come to this thread, but in the little time I slide here, I learn a lot from the intelligent contributors on this US thread. Well done, guys.
I have a quick question, and I welcome answers and suggestions from anyone. Ethier DrStrangelove or any other person. I am open to different ideas and views.

My younger sister got a US visit visa ( before that, she had extensive travel history to the USA and Dubai) and travelled to the USA last year for vacation. Her permit in the US was about six months at the point of entry, but she made the mistake of spending too long, up 4.5 months. When I got aware that she had been in the US for that long, I had to instruct her to plan to leave the country immediately and travel back to Nigeria because I was aware of the risk, but it was too late; she had already spent 4.5 months.


She returned from the USA in November last year and then applied for a student visa in December because she got a full funding scholarship. The VO immediately denied her and, according to her, kept shouting, 4 months! 4 months!! 4 months!!! Who did you stay with? And all that etc. Without my knowledge, my sister went to try her luck again in January this year, and VO immediately denied her again, making 2nd refusal in a row. In the VO words, the second time, “you are not eligible.”

My question is, she has now just gotten her passport stamped for Canadian permanent residency, and she has already completed a semester In the United States studying remotely with excellent grades while still retaining the scholarship. Few thoughts came to my mind:

• Should she try reapplying for the student visa now from Nigeria since it is now seven months from the date of 2nd denial (which was January)? Then document on the DS 160 that she commenced studies and has achieved these grades so far but needs to be on campus because she needs to be physically present with her fellow cohorts regarding group projects they would be taking in the new semester.?

• Should she come to Canada first, spend some time in Canada, complete her first year online, and then apply from Canada?
She is currently working with a company as a manager, and her online programme is MBA.

You guys know better how USA immigration works, and any other helpful suggestion you think best is welcomed.

In my province they accept cash too. They have options for cash or card payment. I am sure it should be the same for Toronto.

I started my application October.
I am not sure what is causing processing delays on your application as I don't know your profile, but I would implore you to try to relax. You might need to weigh your options; if the travel intent is not urgent, I will encourage you to apply via the new IRCC portal. At the same time, these guys can come up with a decision anytime, so one can't tell since we do not know their internal workings.

Before applying on the new portal, can you apply for your GCMS notes to see where they are now or have you already done so? While you await the feedback on your GCMS notes, can you keep sending them emails and web forms as your application is passed standard processing times?

Don't limit the emails to Nairobi alone, including London, Lagos and Abuja. Some MPs don't do much, so I would advise you not to put all your hopes on them. But you can still try to follow up with them since they are yet to get back to you.

Finally, I would advise when you send MP mails or IRCC, let the tone of your mail not depict desperation, but a true intent or need to visit or make it a little compassionate.

So while the application was taking forever we sent a couple of webforms and also contacted an MP. We just got a response from the MP after the application was refused and the following were sent to the MP as reasons for the refusal:
1. Applicant failed to provide proof to prove the mother and daughter relationship to (name of daughter)
2. Applicant's reason to visit is to attend the ex-husband's wedding, however, applicant did not provide any evidence to prove that she is legally separated or divorced with the ex-husband.
3. Applicant stated on her application that she is in retail / Security verification: wholesale business, however, she is not able to provide any income proof or personal fund for the visit.

Tho I made a silly mistake, I felt they should have requested for those documents especially because it's stated on the portal that if they needed more documents they will request for them. Also the 3rd reason they gave is not true because I submitted my statement of account with the application.

Meanwhile the reasons for refusal that was sent to the MP is different from the ones listed in the refusal letter. These are the reasons listed in the refusal letter:

• You do not have significant family ties outside Canada.
• The purpose of your visit to Canada is not consistent with a temporary stay given the
details you have provided in your application.
• Your assets and financial situation are insufficient to support the stated purpose of travel
for yourself (and any accompanying family member(s), if applicable).

My hosts stated in the Invitation letter that they will be paying for my flight, feeding and also accommodate me and bank statements were attached to support their claim, I also submitted my bank statements. So that last reason is a bit confusing

I am wondering if the reasons sent to the MP is what is in my GCMS note since it's more detailed. I have not requested for my GCMS notes, I don't know if I should still do that.

I think you should still request your GCMS notes so you can be assured that you are not leaving anything out. You would need to address the visa officer's concerns in your next application.

1. I think their first point is straightforward. You can attach the birth certificates of your daughter and yourself, and you can also attach two samples of old pictures you took with your daughter.

2. As stated in my earlier response to you, try to be silent as much as possible about your ex-husband in your purpose of visit to Canada and focus more on your visit to your daughter. However, make sure you work on the concerns of the immigration officer regarding documentary proof of separation or divorce, then attach that to your next application. You can still declare him in your form and then tick (divorced or separation) as applicable because what you filled in your first application regarding your bio details must be consistent with what you would fill in the re-application.

3. They are expecting you to attach evidence of your claim in the retail business. Are you an employee, they would expect to see a reference letter from your organization to the embassy and perhaps you are the owner of the business, you can plan to attach your incorporation documents and evidence of last tax returns filed.

4. Proof of Funds – My suggestions as earlier mention is you give sometime and build your proof of funds but please avoid lumpsum deposits as you build.

I can sense you are really in a hurry to apply again but I would suggest you wait for your GCMS note and take your time to build a strong application so you can get it right the next time but regardless, its your call.

No rule says you can't apply for a visit visa outside your home county, but you need to be careful about 1: home ties and 2. Duration of time you would be away from Nigeria You would have to consider the combined period you intend to spend in the United States and the period you plan to stay in Canada. Both countries share information, and they would be able to track that you are currently in the United States on a visit visa. Let's look at it from different scenarios.

1. For someone who has extensive travel history to the United States without any record of an overstay, the immigration status won't be an issue if the person decides to apply for a visa to Canada. However, the applicant would still have to prove that he. or she has something doing in Nigeria that would compel the person to return home. E.g. if you have a leave approval from your job that covers the period of absence from your work and away from Nigeria, that might fly with the immigration officer.

2. The person does not have extensive travel history but is in the United States on a first-time US visa. Applying to Canada for a visit visa from the United States might be seen as a high risk by the immigration officer. Their thought would be this applicant's period of stay is almost expiring, and the person is trying to use Canada as an escape route. It might even be riskier if they don't assign higher positive weighting scores on the home ties.

Overall, it is better to apply for your visa from Nigeria and then attach your US visit visa as evidence that you have a USA Non-Immigrant visa. This document would improve your chances. This process might take time, but your chances are higher. Those who have applied for a visit visa to Canada from the USA can also share their experiences and add their input.

Yes, you guys can send your passport to the Canada visa application centre (CVAC) in the United States. Dont forget to have your biometric slip handy (which was given to you when you went for biometrics).

The VFS in the United States has a slightly different style on the documentation you need to gather, so you would have to send them an e-mail at info.canny@vfshelpline.com. They would respond to you with full details on what you need to do.

United States has two states where you can send your passport to CVAC for stamping. New York and Los Angeles. I strongly advise you to plan to send your passport to Los Angeles; and it is faster and takes less than two weeks. New York is busy and might not be as fast as that of Los Angeles.

You guys can go ahead with your travel plans but plan to start the process once you settle in the United States so you can have your passport back early.

Hello everyone, If someone travels to the UK for vacation and while on vacation, gets PPR. How will the passport be sent for stamping?
You can send your passport to any Canada Visa Application Centre (CVAC). You just need to send to that of the UK office an e-mail to understand their requirements for you to send across your passport. My parents had the same issue when they were in the United States and I had to support them to process theirs through Los Angeles. They have their own style which is different from that of Lagos and Abuja. You just need to find out that of UK.

I submitted a visit application in May and till date I am yet to get the biometrics instruction letter. I have not applied to Canada before, and I have been through my application form again and again, I stated that I have not done biometrics in the past. I have sent email to the Nairobi office and filled webform to no avail.

Keep sending them webforms and e-mails. You can do a screenshot or snip tool of the section of your portal where you should see the biometric instruction letter. Let your screenshot show the dates column. Attach this screen shot to your mails and also paste on the body of the e-mail so when the officer sees it, they understand the problem immediately.

Tag your mail "Urgent" and you can also address Abuja office - ABUJA-IM-Enquiry@international.gc.ca

You should get a resolution soon.

Are you referring to the application time when you say super visa may take time? "You may not be able to apply for it so soon" can you shed more light on that. I have gone throught the link you sent, nothing suggests the reason i might not be able to apply soon except that my child is a minor.
Hi,
Your child might need time to settle in and get used to the system. It also allows you to build your funds in your account. The minimum amount for proof of funds for a super visa for a family of one person (assuming you and your daughter ) is $25,921 based on the published IRCC guidelines, but the higher the amount, the better.

My suggestion on not applying so soon is to give some time to build your proof of funds and plan towards getting the Canadian medical insurance coverage with a minimum insurable coverage of $100,000. I am unsure of the premium you will pay, but the insurance company should be able to advise.

But, don’t forget that despite being a super visa, you would still need to prove ties to your home country. The same probability of return test on a regular visit visa also applies to a super visa. I would still suggest you wait for your GCMS note to arrive before applying if you think you are ready to file your application.

I understand the anxiety regarding your child being alone but she would be fine.

This should be your budgeted amount for your trip, and you can then submit a bank statement with a balance over the budgeted amount which makes sense. It shows you have cash surplus. The officer won’t expect you to empty your account on your trip

The minimum requirement for proof of funds for a student visa is not the same as that of a visit visa. The student visa has its standard minimum requirement of $10,000 for living expenses and additional cash available for at least the first year of tuition or more.

But for a visit visa, the officer wants to have some comfort that the applicant would be able to sustain themselves on living expenses, accommodation, and transport during the period of stay; this would depend on the period of stay and the province. For instance, the amount an applicant would show as proof of fund for a visit to Vancouver would be different from that of New Brunswick or Newfound land for the same period.

The applicant would have to research the cost of living in the intended province but much better if the person has a host willing to invite him/her, that person can help with those information.

Super visa may take time but it is much better if you can wait. Although, a super visa has a little different dynamics from a normal visit or tourist visa. You may not be able to apply for it so soon. You can read more on this on the link below:

But the passport expires in November this year. Now, I got to these thread to read several stories of people who there applications stayed closed to 5 months b4 they got a response from the canadian embassy. Now ,my question is this; We intend to renew the passport now b4 there will be any call from the canadian embassy for passport request as I heard the passport must
has 6 months validity and someone also said it doesn't need ,that the visa duration on the passport won't exceed the duration on the passport . Now What would you suggest we do boss. Should we apply for a new passport or we maintain the status quo . This is my question. Thanks boss
I know sometimes officers do request for an updated passport from applicants if the intended date of issuance is beyond the validity of the passport while others go ahead and affix the visa counterfoil up to the validity of the passport, but this is at the discretion of the visa officer.

The best approach would have been for your brother to have his passport renewed before applying. I think he should go ahead and have his passport renewed when he can, and he can notify IRCC when the new passport is issued via webform so they are aware of the new development.

I got response July 13 2022.
Eligibility started Dec 9 2021.
I did biometric in 2019.
I was first refused canada visa in 2019
Travel history ( African countries and USA)
On my second visit to US embassy I was denied visa.I was given US visa the first time.
My child had his PR in January 2022, I reapplied for super visa on the new portal again.( eligibility for that has not started)
I updated IRCC via webform on my November application that I was entitled to super visa too submitting Travel insurance and letter of financial support from child.
My child reached out to their MP on d November application. MP was really helpful. She helped us contact immigration and they responded in a week.
I see God hand through out this process.

After over 5 months of submitting my application, I got a refusal letter this morning with the following listed has reasons for the refusal.

(I submitted my business registration certificate with tax documents and also mentioned I have aged parents who are dependent on me)

• The purpose of your visit to Canada is not consistent with a temporary stay given the
details you have provided in your application.
( I really don't understand this part, is there another visa I should have applied for instead of visiting visa?, i was also invited to my ex husbands wedding by his wife, I felt I needed a visiting visa for that and since I was staying for about 2 months in order to help my daughter adjust to her new environment)

• Your assets and financial situation are insufficient to support the stated purpose of travel
for yourself (and any accompanying family member(s), if applicable).

(I submitted my personal account which had about 2M in it, in the Invitation letter it was stated that my ex husband and his wife were sponsoring my flight, feeding and accommodation)

Here is a quick rundown of my situation: I applied for a visiting visa in order to accompany my child (she is a minor) to canada, she just got her PR approved. I felt it was very important that i accompany her on this trip because she is travelling a very long distance, interacting with a very different culture and reconnecting with her father in person after 7 years apart and that my support will be integral to this major change and transition in her life.
All these reasons were stated in my application but I still got refused. I am really confused on what next to do, should I apply again? Will family reunification work in my case?
I am so sorry about the delay in your application. Please order your GCMS notes to reconcile the wordings on your notes to this stated on IRCC refusal letter.

• The VO might be looking at your application more like a family reunion with a lesser probability of return. Going with your daughter and connecting with her dad might have been a red flag for the VO. In your next application, try to be silent as much as possible on her dad and focus more on your intention to pay your daughter a short visit. You can reduce the next application to one month or three weeks instead of two.

• The advantage of applying for a shorter stay would help with your proof of funds. Proof of funds for a visit visa is dependent on your planned duration of stay in Canada, and you need to estimate the period's living expenses, accommodation and transport.

• When submitting proof of funds, don't give the VO the impression that you would be using total balances in your account. For instance, you have 2 million naira in your account, and proof of funds for your stay adds up to 1.5 million, and thus would make presenting a 2 million cash balance that you are fully established in your home country.


• Reducing your planned duration of stay might be too short for you guys for now, but you will gain it later. The most important thing is getting approval. You would most likely be given multiple visas for at least more than a year when approved, then you can plan for a proper visit in subsequent travels

• Lastly, don't be in a rush to apply again. Allow your daughter to travel. You guys can re-plan on how she can settle in and the necessary support she would need. Most provinces have a Nigerian community that is welcoming. She can connect to the Nigerian community in her province, and they can guide her on the necessary onboarding process. You can also google the African store in her province. Call the person (Hopefully a Nigerian) and connect your daughter to the person. But since your husband is there, she might not have issues.

• The VO comment has nothing to do with your business back home. it focuses more on your ties to Canada and proof of funds.

These notes is to give you some ideas behind the thinking of the visa officer pending when your GCMS notes arrive.

Very Long Post Alert!!

I got admission December 2020 for Fall 2021 in University of New Brunswick but could not apply immediately because I was due to give birth in January 2021. I planned to submit my application in March but thanks to our immigration service, it took over 3 months before I could get passport for my baby despite paying through my nose for expedited processing. I ended up submitting our application on the 9th of June 2021 due to this delay. I was advised to put in mine while waiting for the passport but going without my children was not an option. We applied as a family, Myself, husband and 3 children. My husband applied for SOWP and visiting visa for my children because they're not up to school age.

Aside from the wahala of having to convince the VO and the fact that we are close to our mid 40s, two things stood against us. We had applied to visit Canada in 2019, but were denied, reason given was that we will not come back and false information in my husband's application, he didn't disclose his denial for US visa. We had applied for US visa a month earlier but the consular officer decided to give myself and my son but refused my husband. When we asked for the reason, she said she had none but was making a split decision. It was an oversight on my part because I filled our forms, I did mine first and just edited same form for my Husband and son. I forgot to change that part.
The second issue was my husband had a health condition and no information on how it was handled by IRCC. He didn't want to apply with us because he was scared he would ruin our chances but it was a no no for me. How will I manage with 3 small boys while studying.
We decided to use agents to help with our application but when I heard the price, I ran away quickly, not in this Buhari's economy.

I used same SoP I used to get my admission because I had no time to start afresh, I just edited it and in addition explained why I was doing a second masters (I have an MBA, same with my husband), how it would be beneficial in Nigeria and course not available in my country. I also addressed the issue of the denial in 2019 stating we never planned to break any visa rule and pointed them to our travel history to show that we have never overstayed in the countries we have visited. I also had to explain the false information in my husband's SoP stating it was an oversight. Reason given for going with my children is that they were too young to be left behind and I need my husband to take care of them. He runs his business and will take time off to support me in my career advancement. Reason given for him applying for work permit is that he wants work part time to gain experience that he would apply to his business back home and also support his family while in Canada.

Application was submitted 9th of June and the wait started, UNB gave us ultimatum of 13th of September to get our study permit or defer. We would not be allowed to even start online without it. I had no choice but to defer to September 2022. I wrote to IRCC but got generic responses. I got Nairobi email address from this forum and sent several mails. At some point, they stopped responding. I decided to fast and pray first week in February, a friend gave me Abuja email address, I sent a mail to them on the 7th and got a response on the 9th to go for medicals. I was so excited that finally, we have made progress. My husband and I did ours first. We had to disclose his condition and he was asked to go for further test, the tension of waiting was not easy especially on his part, mine was updated on the 19th while his was updated on the 22nd. We finally crossed that hurdle. Then our kids were asked to go for theirs a month later. Theirs was updated on the 23rd of March. I was asked to submit an updated application letter from the school and I also had to send a new passport because of the expiry date on the one I submitted. My hope was that within a month we should be done with this whole process. Then another wait started. I started writing to IRCC every other week from April but they didn't respond to any of my mails. I saw a format on nairaland 3 weeks ago to use to send email reminders but still no response. I decided to chill until the one year anniversary of our submission. At this point I was tensed because so many things were hanging, cost of ticket was rising, I needed to give enough notice to my boss to get my replacement before leaving. I entered another fasting and prayer last week, I had no other option. On the 10th of June, that's last Friday, someone posted the email address of different Visa Offices. I started sending mails to all of them. I also sent message to IRCC's twitter account and was about to send to London VO when I saw 7 donotreply emails. I first of all panicked and was afraid to open the mail. It was like a miracle, finally after one year of waiting, this came through. I also pray for those waiting patiently to get yours quickly in Jesus name, Amen!

Yes, sir, processing time applies to both outside and inside Canada. You can view the link below for the IRCC guidelines for different categories of applications as it relates to in and out of Canada. Your SOWP would have a shorter processing time if filed from Canada, but the actual processing time and finalization of your application are up to the immigration authorities.

Currently, some applications recently filed inside Canada are taking longer than usual, like Post Graduate Work Permit (PGWP), which used to be very fast. PGWP processing now is running into months due to the backlogs of applications IRCC is dealing with and support they are rendering to wartorn countries like Ukraine. You just have to be patient for the MP to get back to you. It is not something that can be rushed. You can follow up with the MP if you have not heard from them in 2 weeks from the date they asked you for those personal details.

Hi everyone, please I’m a novice here and need some information.

My mum would like to visit my sister who just put to bed. We are planning to apply for visitors visa using an invitation letter from my sister.

Please how much would be required to show as Proof of fund. We don’t intend to submit my mom’s account statement as she’s a trader and doesn’t have much inflow in the account. My sister would be using her own account.

Also please where can I get the format for invitation letter or letter of explanation.

Your sister can file for your mum since since she is the one inviting her. The amount to show as proof of funds depends on the period of time your mum intends to stay in Canada. Your sister would need to demonstrate in her invitation letter that she would be responsible for your mum's stay in Canada with that , she can use her Canadian bank statement.

Another key area the visa officer would be looking out for is home ties to her country, just to be sure your mum would be going back after her planned duration of stay in Canada.

Your sister should remember to submit necessary document to show that your mum has some asset or livelihood that would compel her to return back home like incorporation documents for her business, documents for landed properties in her name or your dad's name.

There is no hard and fast rule to an invitation letter. She just needs to write a formal letter, she can tag the heading "Letter of Invitation". The letter should be addressed to:

I am sorry about the delay in your application from IRCC.

The refusal reasons means IRCC doubts ties to your home country (Nigeria). Refusal reasons based on travel history and immigration status could mean the following;

• You have more ties to another country aside from your home country.
• There is no proof on file with immigration that you have a job or established business back home.
• You have overstayed your visa in another country.
• You currently live in another country and have been there for an extensive period.
• You are currently studying in another country.

This is not saying you are guilty of any of the above because we have not seen your GCMS notes, but to show you a few examples of the meaning of that category of refusal reasons

Once immigration has made a verdict on your application, the only means to appeal this is Judicial review. Judicial review is costly and time-consuming, and it is like taking the Government of Canada to court. This is not to discourage you if you want to tow that part but to let you know that hiring an authorised Canadian Immigration lawyer is not cheap. They can only do their best to defend you in court, but the final verdict lies with the presiding judge or jury.

My candid advice would be that you don’t rush to file another application. The best is to wait for your GCMS notes and give some time to build a more robust profile or strengthen your home ties before filing another visit visa application. You save a lot of money with this approach.

You can liaise with your faculty adviser or program officer to issue you a “letter of invitation” for visa purposes to invite your family. That letter would state the date you are expected to graduate and the name of the person you are inviting, and your faculty would know best. You can also draft a “confirmation of invitation letter” to attest you are inviting your family.

Additionally, what I did in my case was book an Airbnb where my parents are going to stay. The Airbnb would show the check-in, and check-out date, which should settle proof of accommodation aspect, and you note it in your confirmation of invitation letter. The good side of Airbnb is that you can cancel your reservation at a later date and get your full refund ( Make sure you monitor the refund policy) in case of processing delays from immigration.

Finally, Plan to apply on their behalf using your phone number and e-mail address as contact details, so you can follow up in case of processing delays and check the link below for additional documents you need to attach for them for a visiting visa.

Hi Raymond,

The application process is simply the same. A temporary resident in Canada may choose to apply for his/her spouse in Nigeria as their representative. This kind of application would be deemed filed in Canada. This temporary resident can then follow up with IRCC should there be need in case of delay in application processing.

That's just the basic difference.

But had inflow and outflow while the major money was untouched. the second account came in as my arrears. But as a lump sum. I show the proof of where the money came in from. The visa officer's thinking is that you borrowed the money for demonstration purposes in your visa application. The transaction date the lump sum amount was credited to your account is most likely almost very close to the date you printed the statement for submission.

You may need to give it some time, like four months apart, minimum from the date you filed your second application and when you intend to file your re-application to IRCC. Within this window period, you can:

• Maintain the consistency of the inflow into your account, and it would give you time to build the account more.

• Try to avoid lump sum deposits. Lumpsum deposits mean amounts that are infrequent and irregular. E.g. If the range of values that goes into your account is between 4,000 naira and 10,000, a sudden 150,000 naira would be considered a lump sum. So try to ensure the inflows are within range.

• I assume the source of funds is from your business. The VO doubts the source of funds, which means you might need to work more on how you present the support document backing up those payments made to you.

• When filing your application again, after clicking yes to the visa being refused before on the IMM form, don't explain in the comment section of the refusal on the form like you did something wrong. Start by explaining the reasons behind the refusal to your understanding and conclude by stating you have attached sufficient documentary evidence to show the legitimacy and legality of the transaction from your business (mention name of company].

• You can liaise with any forum member of your interest to review your letter of explanation for you, especially the finance section, before submitting again.

In the meantime, keep building the accounts and limit withdrawals.
