Am a Lawyer, the Judgement for a fine of N5m to Daddy Freeze is in order, This is based on the locus classicus case as elaborated below.

[/b]Damages for Adultery[b]
Adultery is a criminal offence under the Penal Code of Northern Nigeria. Section 387 and 388 stipulate imprisonment for two years, and/or with a fine for adultery. It is not prosecuted under the Criminal Code of the Lagos State of Nigeria. However, it provides for redress if a spouse can prove that adultery occurred.

For instance, section 15(2)(b) of the Matrimonial Causes Act states that: “ The court hearing a petition for a decree of dissolution of a marriage shall hold the marriage to have broken down irretrievably if the respondent has committed adultery and the petitioner finds it intolerable to live with the respondent”

Adultery will only be a ground for divorce if the spouse finds it intolerable. Where the spouse condones the act, the court will not terminate the marriage, as held in Alabi v. Alabi.

Section 31 of the Matrimonial Causes Act further provides that a party to a marriage can claim damages for adultery if such an act is not condoned and was not perpetrated for up to three years before such a claim is made.

Damages for adultery are compensatory. In awarding damages for adultery, the court considers the following:

The loss suffered by the petitioner
Injury to petitioner’s honor and feelings.
Hurt to family life.
Value of the adulterous spouse to the claimant

2 YEAR OLD FEMALE KINDERGARTEN STUDENT FALL OFF INTO A STREAM ON HER WAY TO SCHOOL DUE TO COLLAPSED CULVERT.


A 2 year old female kindergarten student fall off into a stream early hours of today on her way to school due to collapsed culvert in the heart of Makurdi town at Chen Kibou St. Owners Occupier Estate Makurdi Benue State Capital, close to Government House.

It was not clear if she was rescued as different people gave conflicting report of the incident, as most eye witness are children.

The culvert is only link between 3 schools in the area but collapsed due to sub standard materials forcing hundreds of children to stop going to school.

Although, some children are rarely lucky to have some adults carry them across the collapsed culvert. Some defiant children while enthusiastic to get an education fell off into the stream and sustained various degrees of injuries.

This story is still developing.

This is to inform Government Collage Makurdi the class of '95 of the tragic & untimely death of our classmates PRINCEWELL TERHEMBA IYO who serves with the Nigerian Army, 82 Div Enugu but deployed to Maiduguri as a special force to combat the insurgents, Boko Haram in Borno State.

Until his death, TERHEMBA IYO came home (Benue) on a two weeks pass (break) inorder to continue work on his personal building and relocate his mother & make her more comfortable.

PRINCEWELL TERHEMBA IYO left on the 8th of September, 2019 with the hope to return & complete the building, he was killed in a fierce attack in Borno State on the 12th of September, 2019 & his decaying remains found 5 days later on the 17th September, 2019.

According to reports, his colleagues retreated & whispered to him to do same tactically, of course due to insufficient armoury to sustain the long engagement at the war front with the Boko Haram.

As a soldier that he is, you have to obey the last command even without ammunitions.
He is survived by his wife with Two kids & an aged mother. LATE PRINCEWELL TERHEMBA IYO was the only son.
