PoliticsThe Owners Of The Ship Arrested By NNPC Revealed. by Penguin2(op): 10:27am On Jul 12, 2023
NNPC was quick to tell us that they arrested a vessel with about 800,000 barrels of stolen crude oil, but despite revealing that the company that owns the ship is a Nigerian registered coy, they were silent on the owner(s) of the company.

Well, here you have them.

WHO OWNS THE VESSEL WITH 800,000 LITERS OF STOLEN CRUDE?
Nigeria's state-owned oil firm, NNPC Ltd announced on Monday that 800,000-litre (211,338-U.S. gallon) vessel carrying stolen crude had been intercepted offshore while heading to Cameroon.
Holab Maritime Services Limited with Henry Herbert Coker, James Nataniel Coker, Linda Aniekpette Coker and Abie Coker, as Directors, own the Vessel and the company registered in Nigeria with an address in Nigeria.
Authorities have been loud about intercepting and destroying the vessel but have been quiet about who owns the vessel.
My findings indicate that the listed owners are cronies of bigger oil thieves who are in Nigeria. Their identities would be unveiled soon!

Guys let's say the truth, the way politics is played here in Nigeria, expenses and other things that involves, 90 percent of our leaders are not saint, some are criminals, drug pushers, thieves e t c. Hardly can one put his or hard earn money after many years of struggling in to politics that's not sure of winning. I know of a business man in my state that was pushed into politics by some friends that want to chop his money, the man fainted and nearly have stroke after losing primaries, since then the man done lay low. Nigeria politics is not for the poor or legitimately made money. Politics is too expensive and that's why we will hardly have true leaders and keep getting looters cos their money will always be questionable. Imagine burning hard earn money in millions or even billion on politics and lose huh Omo na die now
Have you now seen why it is imperative that the way politics is played in Nigeria is changed?

Have you seen why some of us are dedicating our time pushing for a New Nigeria where politics won’t be excessively monetized and left for only those with illicit wealth who have no intention of going into office to do the right thing but to loot?

Couldn’t stop laughing while reading the part in bold. Why not just come out and call fergie001 a closet Batist. Or are you scared to tell the entire world that you’ve found Agbado in fergie001’s pocket? 🤣🤣🤣

Come fergie001, why did you ignore the part in bold in your response to this comment? You know I’m your friend, tell me how much Tinubu paid you to push this Tinubu 🌽 agenda?

On a more serious note, I think reasonable Nigerians can now see how vile, unreasonable, emotionally charged and logically deficient most of these noisy Obidients are. These are the set of people we’ve been dealing with across all platforms since last year. Will they stop by September like fergie001 said, I don’t know but I don’t think so.

Being an obedient is a disease. It makes people dead to logic and common sense. It makes them deny the obvious. They need healing after the court case.
Well, I’m not going to call Fergie a Batist until he professes so himself even though all his arguments so far points to the fact that he wants Tinubu to remain in power for whatever reasons best known to him.

About logicality and illogicality….

I want you to answer few questions:

Is it illogical to state the fact that INEC disobeyed the Electoral Act and INEC guidelines said that in collation of votes, form EC8A should be snapped and uploaded to the IREV so the public can follow the collation process in order to eliminate electoral fraud?

Is it illogical to state that in instances where INEC made pretenses of uploading results, what were uploaded were blurred in some occasions?

Is it illogical to state that after we had voted and results carefully and neatly entered in form EC8As, we later saw mutilated versions of these forms with tipex on them and the figures viciously mutilated?

Is it illogical to state and reinforce that INEC failed to show transparency in collation of votes (the most critical component of the entire electoral process) after the promised Nigerians and the world that they would do that?

If Obidients are being illogical for stating these things, is European Union Observers Mission, American Observers, Civil Society Organizations, etc, illogical too?

If your answer to the above is yes, pray, what is logic?

fergie001:
But it is these same forms that will be scanned and uploaded?
These same forms will still remain with your agents and the Police right?

You have been quoting guidelines and all of a sudden I quote one, it is infallibility.

September is not far, what I see is just a reason to tie up the Judges as biased.
The question is why would INEC choose which of its guidelines to obey and which to disobey?

One of its guidelines says, use form EC8A and EC60E as primary sources of collation (obeyed).

Another of its regulations says scan completed form EC8A with the BVAS machine and upload to INEC Result Viewing Portal (IREV) (disobeyed, in some cases where it was obeyed, they results were blurry).

Now, this is the most important and most critical aspect of the entire election - transperancy; but it was maliciously and illegally disregarded.

Now, how do INEC assure us that what they counted reflected what we voted since they shut us out of the collation process against the provisions of the law?

What is the need of elections if votes won’t count and be seen to have counted? Why don’t we switch to monarchy and do away with elections then?

And now after all these obvious infractions, visible to blind and audible to the deaf; attested to by generality of the Nigerian people, Civil Societies, Local and International Observers, you are telling me if the judiciary upholds it, I should not see them as biased.

Anything apart of declaration of the rightful winner of the election or annulment of the entire process, would be testament to the judiciary having sold her soul to devourers and we might as well do away with laws and regulations in Nigeria cuz they would be useless.

I don't know what's difficult to understand?
What are you scanning using the BVAS, isn't it Form EC8A?
What will you upload, isn't it a scanned copy of Form EC8A on BVAS?

It is self-explanatory!
You want a cancellation of the Presidential Election which to me should and will never happen.
It’s becoming increasingly apparent that you are an institutionalist who would rather the status quo is maintained than disrupting the system.

Look at you highlighting one aspect of the regulations which states what INEC should do within the four walls of their collation room while leaving out the aspect of the regulations that stipulated what they should do to bring the public into the process and ensure transparency.

You are assuming that INEC is made up of infallible agents who are so sincere that they always compute the right figures as contained in forms EC8A and EC60E without manipulations. Or they are free to manipulate (while shutting the public out) and whoever is disgruntled with the process should go to court?

The bolded is where it's always at.

I have asked you one question to even point out one place where I have said the INEC guidelines is not justiciable in law...I say these things for reference so that you can quote me rightly.
I don’t wanna seem like I’m insisting on things you didn’t say, but on what basis have you been arguing that the election will be upheld if you have not been dismissive of INEC Guidelines?

Was it on the bases of pre-2022 Electoral Act precedents? Because the only precedent set by the highest court of the land after the 2022 Electoral Act became law, makes allusions to INEC Guidelines including the transmission of results which is one of the things you have been dismissing.

So, while you may not have been as dismissive of INEC Guidelines like Lotanna2 (Garfield1), your arguments so far suggest that that’s what you imply (unstated assumption).

I am happy that you have not reacted to copious words from the INEC guidelines itself, that means we are making progress.
How can you say I’ve not reacted to the copious words of INEC Guidelines since that is even more indicting of INEC than even the Electoral Act.

Let’s take Regulation 38 that was referred to by the Supreme Court in the Osun Judgment, the regulation even helped banish the ambiguity that is seen in the word transfer and transmit.

Recall that APC wanted to hide under semantics to try to exploit the technicalities of language by suggesting that what is in the Electoral Act is “Transfer”, not “Transmit”. Now, Regulation 38 solves that confusion by using these two words interchangeably.

If we were to examine the entire copious of the guidelines, you would see that INEC did not confirm to almost 50% of what were stated in the guidelines which formed the basis of the trust that the Nigerian people, political parties, candidates and international community, had going into the elections.

My point therefore, is that INEC even has better chance of escaping the atrocities they committed on February 25, 2023 if their own guidelines were to be discarded than if its copious is examined and applied in judging the conduct and outcome of the election.

PoliticsRevealed: APC Deputy Governorship Candidate Is A Murderer Who Escaped From Jail. by Penguin2(op):
The deputy governorship candidate of the APC in the forthcoming Bayelsa governorship election has been accused of being a murder and manslaughter convict who escaped from jail and now trying to surreptitiously sneak his name into the list of beneficiaries of Presidential Pardon through Amnesty Program but has hit a brick wall after the Director General of the Presidential Amnesty Program, Major General Ndiomu (rtd), refused to “play ball.” This is said to have thrown the APC governorship candidate in the state, Timipre Sylvia, into confusion as time for substitution of candidates has elapsed.

And one can’t help but ask why APC is always attractive to criminals.
TIMIPRE SYLVA’S RUNNING MATE IS A CONVICTED MURDERER, TERRORIST ESCAPED FROM PRISON
Joshua Maciver, the Niger Delta militant who was picked by the All Progressive Congress, APC, Governorship candidate, Timipre Sylva, as running mate escaped from Kaduna Prison in 2006 after being convicted for murder and terrorism.
No record exists to show he was granted a Presidential Pardon or enlisted into the Presidential Amnesty Program, PAP.
He is alleged to have forged a PAP Identity card as no record in the Amnesty office indicates he is part of the program.
In 2006, Maciver told Prison officials he needed an urgent medical attention for a life threatening ailment. On his way to the hospital, Maciver, with the help of some Niger Delta Militants who stormed Kaduna, escaped.
He returned to Bayelsa, cleaned himself up and has been involved in politics using ally, Government Oweizide Ekpemupolo aka Tompolo, while authorities looked away.
Stunned by the discovery of his conviction, Timipre Sylva has been running around seeking help. Sylva allegedly sought the help of the Presidential Amnesty office to request that Maciver’s name be included in the PAP program. His request was rebuffed by the PAP Coordinator, General Ndiomu, who insisted they cannot add his name since he was never known to have embraced the late President Yar’Adua’s initiated Amnesty program.
Sylva can no longer substitute his running mate according to the electoral Act except Maciver dies.

This is the simple truth, nothing but the truth.

INEC failed to follow its own election guidelines which gave many candidates and even voters the boldness and assurance that their vote would count and made many risked their lives to ensure they cast their votes.

If Nigerians and many candidates of the last election knew that INEC wouldn't follow their guidelines, especially the upload of result in realtime, believe me, many candidates wouldn't have contested and those that did wouldn't have put in much effort, and millions of Nigerians wouldn't have bothered going out to vote cos Nigeria's election is usually rigged during result collation.

So the introduction of the result upload direct from polling units as the election was going on gave Nigerians the confidence that their vote would count in 2023 Presidential and Governorship elections.
One thing I’ve discovered in Nigeria is that a lot of us have lost the sense of right and wrong. They are Machiavellian that they rationalize evil and expect everyone to move on.

But no, we don’t all have dead conscience. Some of us still know what is right and we will continue to insist on it no matter what the sophistry and rhetorics of evil rationalizers.

fergie001:
I don't know where you read I said the INEC Guidelines had no legal backing.

Please calm down.

Now let me react ...
The INEC guidelines is a subsidiary legislation. What I mean is that it is a delegated legislation, backed by law but will bow to the Electoral Act or Constitution, if there is some inconsistency or ambiguity. The reason is simple, the Electoral Act is a product of the National Assembly whilst the guidelines are regulations set out by the Commission even though they are empowered by the S149 of the EA.

This judgement I have read since last month over and over again have not said anything differently from what we all know.

After voting, results are counted and entered into Form EC8A. The PO signs and stamps the Form EC series. The results are scanned by the same BVAS machine that was used for the accreditation and expectedly transmitted.

Duplicate Copies are given to PU agents and the Police, if I am right. Where during collation, there is inconsistency in results, the IReV results prevail.

See, the Primary copy is the form EC8A. That is the unshakeable hardcopy evidence.

INEC Regulations 48. (a) An election result shall only be collated if the Collation Officer ascertains that the number of accredited voters agrees with the number recorded in the BVAS and votes scored by Political Parties on the result sheet is correct and agrees with the result electronically transmitted or transferred directly from the Polling Unit as prescribed in these Regulations and Guidelines.

(b)If a Collation or Returning Officer determines that a result from a lower level of collation is not correct, he/ she shall use the result electronically transmitted or transferred directly from that lower level to collate and announce the result.

(c)if no result has been directly transmitted electronically for a polling unit or any level of collation, the provision of Clause 93 of these Regulations shall be applied.

(92) At every level of collation, where the INEC copy of collated results from the immediate lower level of collation exists, it shall be adopted for collation.

(93)Where the INEC hardcopy of collated results from the immediate lower level of collation does not exist, the Collation Officer shall use electronically transmitted results or results from the IReV portal to continue collation. Where none of these exist, the Collation Officer shall ask for duplicate hardcopies issued by the Commission to the following bodies in the order below: (i) The Nigeria Police Force; and (ii) Agents of Political Parties.

See INEC Regulations (91)The following principles shall guide the collation of election results:

(i)Voting takes place at Polling Units. Therefore, Forms EC8A and EC60E are the building blocks for any collation of results;

All these are products or an extended explanation of S60 of the Electoral Act.

48(c) shows there is a possibility that results might not be uploaded due to network or human/machine error.

A combined reading of 91-93 shows the impenetrability and indomitability of the Form EC8A.

Check the underlined... Where the hardcopy doesn't exist! That shows the Primary status of Form EC8A.

I have seen that the petitioners may panelbeat S64(5) of the Electoral Act:
Subject to subsection (1), a collation officer or returning officer shall use the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act and the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act to collate and announce the result of an election if a collated result at his or a lower level of collation is not correct.

In the interpretation of statutes, words should be given their ordinary and literal construction or meaning.

This section has simply said 'if the collation is not correct'. It is now incumbent on the petitioners to present before the Court, the PUs where this seeming anomaly took place. Places like Lagos, Rivers and so on so that the tribunal will scrutinise their anyhowness. That is, in areas where there is some inconsistency between the accreditation, form EC8A and uploaded results on IReV.

A peer review shows the EA has given more teeth to S47 of the EA concerning accreditation.

Is this enough reason to cancel the Presidential Election?
Is it enough to prove substantial non-compliance?

Not in my honest opinion.

IReV is important for transparency and public viewing of results, I will advocate amendment to give more teeth to IReV, this time a more mandatory and forceful one.

INEC nonetheless needs to be berated for failing in its moral responsibility of uploading results in seeming and brazen malfeasance and furthermore hiding under legal technicalities. It is important that we continue to strengthen our laws to ensure a better and tamper-proof election.
It’s not my intention to drag you into another round of back and forth.

But one thing I need to clarify is that I’m not being emotional about anything. There were obvious infractions during the election; this much has been confirmed by even the European Union 🇪🇺. So I find it abhorrable that you would consider my constant reechoing of this obvious reality as being emotional.

I know you would want to make reference to how it was in 2003, 2007 and 2019. But that infractions were tolerated then and people took it with equanimity doesn’t mean we should continue to walk in that path.

INEC failed to adhere to the Constitution, the Electoral Act and their own Guidelines. This should be punished.

The only reason I called your attention here is because I wanted you to see that INEC guidelines is justiciable in law unlike the narrative that you and Garfield have been pushing; that the court will only look at the constitution and the EA.

See, 2023 presidential election cannot stand, no matter how some of you try to rationalize the criminality that took place that day.

Both constitution and electoral act are superior to the guidelines and will take precedence in the case of confusion, ambiguity or clash.the court only uses guidelines when it is in tandem with the electoral act.
From that portion of the judgment, jsc agim clearly said the guidelines never demanded for real time transmission but transmission after election without specific time frame.the guideline further stated during collation, transmitted and manual copies must be used for collation in case of discrepancies.obi never brought evidence showing transmitted copies were not used during collation and he also called only one adhoc staffs.therefore, this portion of his prayer fails
Even a layman knows that when dispute arises between the constitution, an Act of the National Assembly and any bye laws, that the Constitution takes precedence followed by the Act of the National Assembly.

But I have not seen, or refuse to believe that any of INEC’s Guidelines runs contrary to the provisions of the Electoral Act nor the Constitution.

There’s nothing contradicting the Constitution or the EA about results upload which INEC failed to do.

Again, you can see the Supreme Court making reference to, in dispute, comparing the physical result of form EC8A to the Electronically Transmitted or Transferred Results (those were their words).

Now, with about 18,088 blurred results sheet, plus some thousands others yet to be uploaded, what did INEC compare forms EC8As with at lower level collation centers when dispute arose?
