Edeoga of LP won enugu, but rotation doesn't favour him.
Stop it.

By rotation, it is the turn of Enugu East, and Edeoga is from Isiuzo in Enugu East.

The only argument people have against him is that Isiuzo people are Nsukka people. So some people are arguing that another Nsukka person should not succeed Ugwuanyi who is from Nsukka. But by political geography, Edeoga is on his right.

It is like arguing that Chibuike Amaechi in Southsouth should not be president because a Peter Obi in Southeast has been president.

Even though these two men are Igbos, they are geographically in different political places.

As Chijioke @chijioke_edeoga closes his case against Peter @PNMbah and PDP today at the GEPT in Enugu, I just want to use this one example of Over voting to tell you guys how Mabh and his PDP thugs in collaboration with @inecnigeria rigged the Governorship election. Follow the red marks.

In Mbaguzo village square polling unit PU 14-11-14-007 the total accredited voters was 354 but PDP and INEC allocated 954 votes to Mbah/PDP. That’s a difference of 600 votes. This is just in one polling unit and they did this in several polling units in Nkanu East LG most especially Owo, the hometown of Peter Mbah.

I’m hopeful the tribunal will give Chijioke Edeoga and Labour Party justice and declare Edeoga the rightful winner of Enugu Governorship election. Anything short of that will be miscarriage of justice and would be challenged.

NB: The documents attached were CTC obtained from INEC.

Again, do you realize that when the drafters of the 1999 constitution were working, it was presumed that Nigeria had no law and they were to give her laws?

What I’m saying is that if they wanted to make Abuja a state, they had the powers to do it and a simple Abdulsalami Abubakar’s signature would have brought it to fruition.

But they rather chose to act with the report of the committee on FCT which recommended that the territory be given a special status.

Right?
If you understand the constitution providing that a candidate must score 25% in the FCT to win presidential election as FCT being placed above a state, then I’m not responsible for you choosing to make such cognition of it.

But how would the seat of power of the president be lower than a state?

And was it impossible for the framers of the 1999 constitution to simply call Abuja a state and just make it the 37th state of the Federation? Why take the extra pain of having to refer to 36 states AND the FCT throughout the constitution if it was not intended for FCT to have a special status?

Obi's lawyers did not even contest a single vote be deducted from that of Tinubu's vote because they did not show any cause for that. They never tendered or defended any form EC8A which is the basis for such exercise, neither did they present any BVAS to challenge accreditation of result. Can you help me interpret this judgement of the SC in Bakare v Ogundipe (2021):

By virtue of the provisions of section 299 of the Constitution, it is so clear that Abuja, the Federal Capital Territory of Nigeria, has the status of a State. It is as if it is one of the States of the Federation.

(It can be found in (Pages 36-37, paragraphs E-A))

I have explained this to him before. That the FCT is below a State hence some of these Court decisions were to bring them to the status of a State.
Instead bringing these judgments in isolation, why not also state the the matter in contention when the judgment was made?

Section 299 likened Abuja to a state strictly as it regards the administration of the territory. The section even started with a clause, “accordingly”, and then went on to enumerate what it was referring to when it said that the FCT should be treated as a state. There are 3 subsections to that section and none referred to matter of election. Now in law, what is not mentioned is not stated; you can’t add to the constitution what it did not say.

This goes to say that Section 299 likening Abuja to a State in terms of its administration does not preclude its place as part of electoral criteria that MUST be satisfied before one is validly elected president. That is to either win it or score at least 25%.

If we interpret the constitution the way you folks have been doing, then every successive section of the constitution will nullify the previous section when it regards same matter or subject.

Twitter and cruise...... There is something we call context. Osun had no issue with two-thirds or 25%.

In the history of our democracy, we have only had this situation in the Awo v Shagari time.

At the time, we had 19 States with Shagari winning 12. Awo argued that two-thirds of 19 is not 12, but should be 13.

The SC affirmed Shagari in a 6-1 verdict. The only dissent was Justice Kayode Eso (of Blessed memory)
I knew the reference was about the FCT argument.

But these are the facts…

In 1979, the FCT was Lagos.

In 1979, the constitution in use was 1979 constitution.

But in 2023, the FCT is Abuja.

And the constitution in use is 1999 constitution which gave a special status to Abuja following the recommendation of the Committee on the FCT; this special status was not enjoyed by Lagos as FCT.

Again, the argument is not about satisfying “2/3” but about satisfying a quasi-independent provision of “25% in the FCT”.

You see why citing that Awolowo vs Shagari case is near useless to the case at hand?

Those supporting Tinubu are happy with the excellent job Wole Olanipekun is doing. His final address to the court shredded every single issue raised in Peter Obi’s watery petition. The robustness of the defense is why the legal team confidently released the final address to the media even before adopting it in court. Constitution was brought in to cure the defects.

Reading through the written address of Tinubu and Shettima lawyers at the ongoing election petition tribunal led by supposed respected senior lawyer Wole Olanipekun, one can’t help but giggle at the hollowness and shallowness of their defense.

In the address, Mr Olanipekun was busy citing the case of Shagari vs Awolowo that happened as far back as 1979 under the 1979 Constitution and in election conducted by FEDECO, as our electoral commission was called then.

Since 1979, we’ve have had many reformations to our electoral laws and have even changed our constitution.

If anything, the most relevant case as far as election cases are concerned in Nigeria today, is the Supreme Court ruling in Osun in case of Oyetola vs Adeleke. This case is the most relevant because it is the only Supreme Court decision since the Electoral Act 2022 came into force.

Ironically, Mr Olanipekun surreptitiously ignored the Osun case which has a lot of similarities with the case at PEPT as they both bother on the place of technology in our election and to what degree INEC can choose to apply or ignore technology in our elections.

It is pertinent to state these things for the world to hear, read and see, so that we all keep an eye on the judiciary and see what comes out it.

Remember that it is not enough to do justice, justice must also be seen to have been done.

I think it’s just a policy.

Seems the management decided that new posts should start moving to front page as from 8am rather than the previous 4am, 5am, 6am, in the past.

Or maybe the crop of MODs in charge now are less passionate about the job and treat Nairaland moderation as a job they resume at 8am unlike when Lalasticlala was here who doesn’t mind staying awake till 3am and waking up at 6am to move posts to FP.

In my experience managing staffs, there’s nothing as bad as having employees who cannot move an inch beyond their job description. Their employment contract says they will be closing work at 4pm, a minute after 4pm there are already at the gate no matter the loads of work left in the office.

Seun needs to recruit moderators who will treat Nairaland like a passion rather than a job they are employed to do.

PoliticsAfter Ignoring Amosun’s 1000 AK-47 Rifles, DSS Charges Emefiele For A Handgun. by Penguin2(op):
Every Nigerian would remember how the DSS clandestinely sought to obtain a black market court order to arrest Mr Godwin Emefiele in the middle of the election and at the heat of Naira Redesign Policy; accusing him of corruption and terrorism financing including the financing of IPOB and diverting the vehicles that were previously acquired for his presidential ambition to Unknown Gun Men in the Southeast.

It was therefore near hilarious to find out that at long last the secret police could only charge Emefiele for one Handgun and about 123 live ammunitions.

One now wonders what happened to the corruption accusations and the claim of terrorism financing?

Why was Emefiele accused of sponsoring IPOB only for it to not make it into part of his charges?

Could it be that the DSS lied? If yes, who knows how many other lies has been told with the name of IPOB?

And if it’s a crime for Emefiele to possess a supposedly unlicensed handgun, why has a character like Asari Dokubo who openly brandish different sorts of assault rifles in public not been arrested and charged as well?

Now below is a report of the former governor of Ogun State, Ibikunle Amosun, who was found with 1000 AK-47 rifles and has not been charged.

Is there a selective administration of justice depending on where one comes from in Nigeria?

Godwin Emefiele has been slammed with two counts of illegal possession of a firearm, as the Tinubu administration continues to find ways to nail the former central bank chief after multiple courts found him unanswerable to previously filed charges of terrorism and corruption.

Federal authorities said they found an unlicensed shotgun that operates on a magnum cartridge, apparently the 44 calibre variety, according to court filings in Lagos. The charges, which said Mr Emefiele also had 123 bullets in his possession for the unlicensed firearm, were brought by the State Security Service, the same repressive national intelligence agency that successive Nigerian administrations have weaponised against political adversaries and everyday citizens.

The charges said the weapons were recovered from Mr Emefiele’s home in Ikoyi, on June 15, 2023, even though Mr Emefiele was arrested on June 9, 2023, and has been locked up in Abuja ever since. A spokesman for the SSS did not immediately return a request seeking comments about the discrepancy between the date Mr Emefiele was arrested and how arms were found in his possession a week later in Lagos.

While serving as the central bank governor, Mr Emefiele sought unsuccessfully to rescue the ruling All Progressives Congress’ presidential ticket from Bola Tinubu. Mr Tinubu, who was declared winner of the controversial 2023 presidential election in February, immediately fired Mr Emefiele upon his assumption of presidential duties in May and kept him in illegal custody.

Several courts have ruled for Mr Emefiele to be freed on the account that his arrest and continued incarceration were baseless and extra-constitutional. The rulings followed calls for Mr Emefiele’s release from rights activists, who said his detention was untidy even as they acknowledged his alleged corruption and recklessness while in office.

In an information sheet dated July 13, 2023, the SSS said Mr Emefiele’s possession of a firearm and bullets in contravention of the 2004 Firearms Act — a criminal statute that carries a jail sentence.

The charges against Mr Emefiele came as the SSS continued to ignore Ibikunle Amosun, a former governor of Ogun who was exposed for illegally stockpiling firearms and ammunition during his rein as the governor of Ogun state.

Mr Amosun, who served a two-term of eight years as Ogun governor, was caught with 1,000 AK-47 rifles and four million rounds of live ammunition during a period of rampant armed banditry, abductions and political assassinations.

A spokesman for the SSS did not return a request seeking comments about when Mr Amosun would be charged, four years after he left office as governor and lost his constitutional immunity from prosecution. Mr Amosun, a member of the APC, stepped down for Mr Tinubu at the ruling party’s national convention in June 2022.
