BluntCrazeMan: The tribunal and the appeal court didn't cross-examine the documents which Uzodimma presented, neither did they dwell much on determining the authenticity of the figures contained within. .. The Supreme Court took the figures like that after establishing that INEC erred. A document whose figures are not confirmed in the lower courts, and yet the Supreme Court didn't make efforts to determine the correctness of the figures?? Who does that? .. That INEC made a mistake is one thing. That Uzodimma presented some documents (through the Police) which contained some data about the election is another thing altogether. Then, that the Judges became the ones who went home (away from the court proceedings) and started pressing calculators and trying to determine the value of the votes scored by the Candidates is another thing altogether. .. Like I always maintained.. The Supreme Court would have ordered a re-count or a re-collation.. Uzodimma would have still won. No problem about that. But let the right thing be done by the Judges. .. Look at these conditions below. They are the conditions a contesting candidate must fulfill before he is declared winner. .. .. 1. The sum of all the votes won by all the contesting parties should be equal to the Total Valid Votes Cast.
2. The sum of the Valid Votes Cast and the Total Rejected (or Voided) Votes should be equal to the Total Votes Cast.
3. The Total Votes Cast should not be more than the Total Accreditated Voters.
4. To be declared winner, in addition to the governorship candidate winning the highest number of votes, he must also win at least ONE-QUARTER of the Total Votes Cast in TWO-THIRDS of all the local government areas in the state.
The figures which the Supreme Court presented, did the judges bother to cross-check the figures to know whether they passed the third and the fourth conditions?? They definitely didn't check the conditions.. (If INEC did a re-count or a re-collation, they must check all the conditions all over again). .. This had been my argument. The Supreme Court Judges did the work of INEC, and they ended up making a mess of the job because they don't know the rudiments of Collation of Election Results. .. Like now, at this very moment, which data would somebody who is doing a research on the results of the Imo State Governorship Election of 2019 work with?? .. Is it the INEC Figure? Or the Supreme Court Figure? Lol! I see you are not willing to give up the argument anytime soon. What I need you to understand is that even if the Imo judgment was flawed, it doesn’t render Justice Tanko incapable of good deeds. And reprimanding errant judges is a good deed that’s worth all the commendation. |

BluntCrazeMan: The scope and the powers of the Election Tribunal is not limitless either. It has limits. The tribunal shouldn't assume powers that they don't have. Also, they shouldn't assume premises that are not yet proven to be true. .. Nothing is wrong with declaring an entirely new winner, but the figures that made the new winner to emerge must be well established and ironed out in the proceedings. Admitted that the powers of the the Election Tribunal is not limitless; but it surely includes declaring a new winner which has happened many times before in our judicial system. Uzodimma’s votes in more may have been fraudulently gotten but his handlers and strategists were intelligent. |

BluntCrazeMan: In announcing a new winner, shouldn't the new figures be established in the court? The only thing that was established was the error of INEC, which should void the Election, or cause a rerun. .. The new vote-counts were not determined in the court. The judges after establishing that INEC erred, now went ahead do the tallying.. And what's more?? The tallying they did was wrongly done. There were lawyers in court with these numbers and the evidence to back it up that they represent the right figure that was denied Hope Uzodimma through INEC’s flawed action. Since the court only works with evidence(s) before it, would you blame the learned Justices for working with the evidence(even if flawed but unproven to be so by defense counsels) before it to now add the contested numbers to the existing votes which skyrocketed Uzodimma from 3rd to 1st. What happened at the Supreme Court in Imo case might be emotionally torturous but it is logically and legally sound. |

SegZ24: Happy Sunday to us all..
Doctors in the house, abeg make una educate me more..
When it comes to your health or diet, doctors and researchers advise/encourage us to drink lot and lot of water because of the health benefit it gives, rather than in take of coke and sugary substance...
I tried putting this advice into practice so many times. First thing in the morning after devotion or before stepping out for work, I make sure I drink at least 2 glass cup of water..
But one thing I have come to notice is that, after drinking enough water before stepping out, the rate at which I use the gent (urinate) is quiet higher than when I don't even drink water in the morning.. Within 1hr, I would have make use of the gent like 3-4 times, till like 12pm before I return back to norm..
So I began to wonder, is something wrong with my system or do I need to go for any check up or that's how it suppose to be
I tried making some findings on google, but I could not lay my hands on something convincing enough.
So Please doctors in the house, educate me more, Am I in good shape or I still need a medical check up??
I know se some fellaz go still yab me, it is allow.. Very funny. It’s normal thing. Try to be taking one cup or even half cup. That way, the rate at which u use the gent will be reduced. What’s important is that the acidity in ur stomach is diluted with water early in the morning before meal. The quantity of water doesn’t really matter. Note: I’m not a medical doctor, just telling you from personal experience. |
Romance › Re: Could She Be Carrying My Child? by Penguin2: 1:16pm On Sep 13, 2021 |
Princecanada: Hi Nairalanders,
This issue has been bothering for a while now. I am not the promiscuous type. I was a virgin all through my university until I started working in one of the states. She was my first and has been the only one. I have been having relationship problems in the sense that I it's just so difficult for me to get emotionally attached to a lady. I am straight so don't think the other way round. I tried to see if I could work this out with her, but along the line, I lost interest again. So just before my relocation, she said she wants to see me one last time before I travel, I tried to lie to her that I am unavailable, but then she made it seemed like I didn't want to see her, I felt sorry and said no problem that she can come around. I have only had sex with her once but with protection, on this her second visit, she said she wouldn't want protection anymore as she doesn't enjoy sex with condom, and that she wants to enjoy sex before I leave. I told her I am not comfortable with the idea as I don't want her to get pregnant as she is still a student in one of the universities. She said she can only get pregnant if she wants to, and that as a student, she doesn't want that yet. When she came over, the did happened but even then I still used a condom, condom broke on 3 occasions, then I decided to raw, and when I felt I was about to release, I pulled out. Even though I pulled out, I was uncomfortable because I have heard that precum can also get a lady pregnant. I was scared about any possibility of infection too. Took her to the hospital the next day, did HIV and other STD tests which came out negative. We went together to see the doctor for post pills, but she declined taking any that since I didn't release in her, she will be fine. And that she has pills she can take too. I was furious at her, but had to respect her decision as it is her body.
Three weeks after, she called that she thinks she's pregnant, that she missed her period which is very unusual. I was so mad at her and told her, I didn't want to hear any of that as I made it clear to her from the beginning. She started crying and got emotional, that got to me and I told her not to worry, that I will pay her bride price and marry her. I earn about half a million monthly, so I believe I can take care of her and the kid. She paused and said she needs to think about it. Regarding abortion, I already told her, my tradition forbids me from giving any form of material and financial assistance to her to do that, if at all she wants to do it, it has to be her sole decision. I made it clear to her that I won't be involved in the decision to abort the pregnancy. She called back after a couple of minutes that she is not comfortable with my decision to marry her, that I want to do that because of the pregnancy. She asked if there was no pregnancy, would I have chosen to marry her, I told her, I don't know. She said then that she is going to abort it, I pleaded with her not to abort seeing the possibility of me becoming a dad soon, she said she will go ahead to abort, that her friend have gotten her some meds already. She called few days later that she just got the drugs, and have taken them, and that she is experiencing blood flow and stomach ache, that I shouldn't abandon her in this difficult time. I said no problem, so I kept calling to check on her very often. After a week, I stopped calling as usual, and that became a problem. I wanted her to move on with her life.
I kept in touch with her and supported her financially when the need arose. When I told her, I am back to the same city with her, she said she wanted to see me that it's very important, I said what's so important that we can't discuss over the phone, she said when I see her I will know. Well, when the day came for her to see me, I told her I was unavailable, then she coded I was avoiding her. We chatted, and she told me the pregnancy is still there. I told her to stop messing with me as I am currently trying to move on and build a new relationship. She insisted, then I said well, if you are, deliver the child, I will take responsibility. She said is that all I have to say, that I want to make her my Baby Mama? I then asked her, what more does she want? I offered marriage before, but now, that's no longer on the table. When the baby is borne I will take responsibility. Well, long story short, at the end of our chat, she said, she was never pregnant, and that she will only get pregnant if she wants to. I then told her, I am not going to forgive her in a hurry.
Since then, we stopped communicating. Recently,I saw her WhatsApp status with her visibly pregnant in the picture. I have been seeing most of her status update on Facebook and WhatsApp, I feel so sorry for her most of the time. She has done nothing wrong but love me. The problem is me, I can't seem to be able to really love back the way I ought to. Feelings die after few weeks and months. This happened to all the 6 ladies I have dated.
My worry right now is, could she be carrying my child? I didn't release in her, but there could be a possibility of precum. One of her friends once called me that she noticed she is pregnant, and I am the only one she has known to be dating her. She claimed to have called me without her knowledge and consent and ask if she told me she was pregnant.
I was a good boy and should have remained a virgin till marriage if I had known. Now look how complicated my life just got. I never wanted to have kids with different women. I haven't really been myself since. If you are a young single guy, please learn from my experience.
For the mature minds in the house, what do you advise I do about my present predicament? What’s complicated about your life when you are still single? All you need do is work on ur brain and psychology to accept and marry her if DNA confirms the child is urs. It’s on you to have children with different women |

BluntCrazeMan: It is not, Okay...!! It is not. Counting of Votes, or Collation of Votes is not Supreme Court’s Duty., And it can never be .. Research further on this. Why are you limiting the scope and powers of election Tribunal? Because an election tribunal has powers to void elections, declare rerun or announce an entirely new winner. Now if an election tribunal has these powers, why shouldn’t Supreme Court have it since it is the final place where the actions of the Election Tribunal will be tested. |

BluntCrazeMan: That is still not my argument. .. My argument is... “Going by the Nigerian Constitution, and by the same Electoral Act which you mentioned, is it the duty of the Supreme Court Judges to do the Addition and Subtraction of the votes without the consent of INEC??” (Even though INEC erred, it is still the constitutional duty of INEC to correct the mistakes they made, and not the supreme court judges.) .. So, I am saying that they committed the foul in their judgement by doing the job which is the constitutional rights, and duties, and obligations of INEC. .. You can continue to misunderstand me though. But what I am saying is the truth. If it was established that Hope’s votes were unjustly canceled, isn’t it Supreme Court’s duty to correct injustice rather than subject such a person to another round of torturous process for an election he has duly won but his victory was erroneously impeded? |

BluntCrazeMan: You're wrong.. You're very very wrong about your conclusion on my take on this.. .. I hate double-standards.. .. My stance is that the Judgement of Imo State Governorship is so bad and tasteless. And as far as that judgement is established as very wrong and fraudulent, then all those Judges that supported him in that judgement should face a thorough sanction. .. But No. Everybody overlooked it, and everybody remained silent. And that made him to think that the Judgement was actually just and upright?? Imagine that a case for review was filed, and he himself sat at the head of the panel again, instead of another judge. .. And now, he is sanitising the system and forgot that the sanitising should start from him and those Judges that sat with him on that case?? .. Or are you saying that there was absolutely nothing wrong in that Imo State Judgement? Then you let me know, so that I will stop quoting you henceforth.. (Don't come with the “Supreme Court had ruled it” jargon.. The Judiciary is corrupt as already established by the same Tanko; and it can also be a statement of fact that he himself had been a beneficiary of the corrupt judicial system, of which the Imo State Judgement stands out overwhelmingly) .. Nevertheless, if you think that there is something wrong with that Imo State Judgement, then why is he sanitising and sanctioning others, and leaving himself and those other six Judges to remain standing as saints? .. I hate double-standards.. This your Tanko, he should start the sanitisation from himself first... SIMPLE AND SHORT. INEC took action that is antithetical to the electoral act. If you had taken time to read all sides to the story, you would have understood this. If you do a background check on me here on Nairaland, you would find out I’m a PDP apologist and has never supported Buhari nor APC. So, like you, I was very vexed when Supreme Court made that pronouncement. But rather than remain emotional about the whole thing, I wore my thinking cap and I started trying to find out why Supreme Court did what it did. What did I find out? I found out that the Electoral Act states that cancellation of election votes(if found to be fraudulent) must be done at the polling unit by the Returning Officer at the polling unit. Now what happened in Imo? INEC Local Govt returning officer cancelled the votes from over 155 polling units totaling about 330,000 after Polling Unit Returning Officers had certified these votes as valid and party agents duly signed to certify they were the reflection of the numbers truly gotten from these Polling Units(even if the whole thing was flawed). You see what I mean when I say INEC gave Imo governorship to Uzodimma? Because what justification does a Local Government Returning Officer have to cancel election results that has already been certified as authentic by on-field officers? Can he claim to have evidence of electoral fraud more than those who organized those elections? |

BluntCrazeMan: Do we have to go through this again? So, who made TANKO And the Six Other Judges the Collation Officers?? If INEC made a mistake, does it now mean that the job of INEC now belongs to the Supreme Court Judges?? Even if the mistakes were properly and adequately established at the court by the petitioner, but then the new supposed values were NOT also established and proven to be very correct in the court right in front of everyone, and such newly established values accepted by INEC, Is it now the work of the Supreme Court Judges to go back to their Chambers and start the Re-collation process by themselves, even without the notice of the INEC?? And the Judges even went ahead to announce their Supreme Court Results which INEC was not even aware of. Is that supposed to be the right judgement? .. Is the best judgement not supposed to be “A Recount of the Votes” or “A Re-collation”?? If cancellation of validly counted votes was erroneously done by INEC and the Supreme Court identifies the anomaly, wouldn’t it be justified to add what was erroneously denied the rightful owner? |

But then, the judge that was the lead Judge in the judgement is also the same judge that is now forming saint for us. ... You here, you're now talking from the two sides of your mouth. I hate people like you. Dishonest people like you are the main problem we have in this country. Your problem is that I’m not joining you to be deontological about ur assessment of Justice Tanko. You have condemned him to be bad, and therefore nothing he does will ever be good. That is not how a rational mind reasons. You should be able to separate your biases from your assessment of people’s actions. Tanko’s actions of trying to call erring judges to order is commendable and I must commend it. Doesn’t matter what he has done in the past. His present action is good, recognize that. |

I remember we have always had reservations about how this man became CJN but he’s ending up to do all the things other CJN who have been properly nominated never did.
At least he’s beginning to make Judges understand they are not some super humans that are infallible and unquestionable.
Corruption in the Executive might be tolerated.
Corruption in the Legislature can be managed.
But corruption in the Judiciary should never been imagined but it is there.
So, thank you Tanko for trying to redeem the Judiciary.

It would kill laziness in the stvpid state governors and make people hold their governors more accountable. This is one of the things that can save the unity of Nigeria. Politics › What Do You Think Is The Implications Of VAT Collection By States? by Penguin2(op): 6:51am On Sep 08, 2021 |
Rivers State govt has taken FIRS to court and obtained a favorable judgment that it is states and not the federal govt that should collect VAT.
FIRS has tried to apply for stay of execution of that judgment but their effort has hit a brick wall and going by Nyesom Wike’s antecedents in the courts, I do not see anything changing about the judgment even till the Supreme Court except of course through some obvious political influence.
Rivers State for instance has enacted a law to that effect with Lagos state own law having passed Second Reading in the State Assembly. Now these are the two highest VAT generating entities.
In the event that Rivers and Lagos succeed with these laws and the courts fail to overturn the judgment of the Rivers High Court, we know that it is ite missa est as other states will naturally queue in.
Now, the question is, what are the likely implications that might arise from such scenario?
1) Resource Control: If there’s anything that is pronounced in the agitation for restructuring, it is the question of resource control more technically referred to as ‘fiscal federalism’. Should this judgment stand, it will be the springboard for similar judgments that will likely lead to complete resource control by the federating units. But until then, this is a start and step towards resource control.
2) More Sincerity in the Fight against Insecurity: One thing that we all have agreed is that there seems to be sabotage of the war against insecurity/insurgency by those in the high places in the north. But one thing is clear, northern governors, by virtue of the security reports at their desk, know these saboteurs but give excuses or feign ignorance because even if every business activity grounds to a halt in the north due to insecurity, Lagos, Rivers, Ogun and other southern states, will generate VAT that will be handed to them at every month end. Now add that to oil money and you see why they don’t care.
But should it be to your tents oh Israel, and every state of the federation is meant to survive on what it internally generates, you’d see more sincerity towards the fight against insecurity. Because they would see that there are no businesses that would pay VAT due to the activities of Bandits, ISWAP and Boko Haram. By the time the northern states, especially the worst hit states, see no businesses to tax, they will be forced to go after the sponsors of these monsters and make the monsters are defeated so that businesses can thrive.
3) More Liberalism from the North: A nairalander made a funny comment that “by the time Wike is done, northerners would beg Nigerian Breweries to build a beer tank at the back of the Sultan’s palace”. Well the comment simply captures the grievances of the south against northerners who, through Hisbah, destroy thousands of crates of beer on daily basis because it is haram but would always share from the VAT generated from the sale of alcohol in the south.
It is worthy to note here that aside Oil and Gas, pharmaceuticals and Construction, Alcohol is likely the next highest generator of VAT( this is a personal projection that might be wrong). So by shutting out one of the highest generator of VAT, it is already disadvantaged as oil and gas, pharmaceuticals and construction does not seem to boom in those states either.
Now, when come comes to become, the north would be forced to relax some of “ethically restrictive religious principles”(as Wike chose to put it) and become more receptive and liberal to diverse businesses that could boost IGR.
4) More Ingenuity by Governors and State Governments: When states begin to generate what they consume and this feeding bottle kind of federation is finally murdered and interned, elected governors and states govts would become more ingenious towards revenue generation. They would see to expansion of tax net and that govt revenues are adequately accounted for instead of being pilfered into the pockets of rogue officials in cahoot with governors sometimes.
And do you know what happens when citizens pay more taxes? Demand for accountability would rise. Every citizen would want to know what his/her tax was used for. And with increased demand for accountability comes increased govt responsibility.
Again, governors will start thinking about investing in things that would yield revenue for the states aside tax instead of just sharing what has been generated through tax.
Trust me, a lot would change with the implementation of this new phase of our fiscal existence if political influence can allow it succeed.
Now what’s yours? Do you disagree with any point above or you have more to add?
