Chapter 38

Obtaining Property by false pretences; Cheating

418.         Any representation made by words, writing, or conduct, of a matter of fact, either past or present, which representation is false in fact, and which the person making it knows to be false or does not believe to be true, is a false pretence.



419.         Any person who by any false pretence, and with intent to defraud, obtains from any other person anything capable of being stolen, or induces any other person to deliver to any person anything capable of being stolen, is guilty of a felony, and is liable to imprisonment for three years.


                If the thing is of the value of one thousand naira or upwards, he is liable to imprisonment for seven years.



                It is immaterial that the thing is obtained or its delivery is induced through the medium of a contract induced by the false pretence.



                The offender cannot be arrested without warrant unless found committing the offence.



419A.  (1)          Any person who by any false pretence or by means of any other fraud obtains credit for himself or any other person-



(a)            in incurring any debt or liability; or



(b)            by means of an entry in a debtor and creditor account between the person giving and the person receiving credit,



                 is guilty of a felony and is liable to imprisonment for three years.



  (2)           The offender cannot be arrested without warrant unless found committing the offence.



419B.       Where in any proceedings for an -offence under section 419 or 419A it is proved that the accused-



(a)            obtained or induced the delivery of anything capable of being stolen; or



(b)           obtained credit for himself or any other person, by means of a cheque that, when presented for payment within a reasonable time, was dishonoured on the ground that no funds or insufficient funds were standing to the credit of the drawer of the cheque in the bank on which the cheque was drawn, the thing or its delivery shall be deemed to have been obtained or induced, or the credit shall he deemed to have been obtained, by a false pretence unless the court is satisfied by evidence that when the accused issued the cheque he had reasonable grounds for believing, and did in fact believe, that it would be honoured if presented for payment within a reasonable time after its issue by him.

As far as the process of becoming the Chief Justice of Nigeria CJN, is by seniority, why the shout over North - South palava?
that is my point, southern lawyers stayed in the bar, while northerners go to bench, the likes of FRA, Gani, Awolowo, Sofola, Afe Babalola, Bola Ige and many others could have made CJN, if they did not choose money making over power.

North knows what they want and they stategised for it, in the South its always crying foul even when laid sown rules are being followed.

This was the same way Awolowo was treated by Gowon, he was even appointed as vice chairman of the council. If she is up to the task, good for us. Others should just work for the good of the country. The presidency is that of G E J, he has the responsibility for failure or success they should obey him or leave his government.

@afam,na Federal Character, this is one thing that is killing the country. Competent hands will not be allowed 2 run the affairs of this country. They will go 2 chad or niger republic and bring one 'MALU' rearer and give him an appointment in the name of FEDERAL CHARACTER.
Judiciary is not Federal Character but seniority. You join the line when you become federal judge.
Southerners dont like to become judges, they stay as lawyers making money.

Sometimes I wonder about the significance of the south lead in western education if it cannot be used strategically to its advantage. In the succession list I posted above, one would think that there are no southerner supreme court justices. There are but supreme court justices are categorised as the chief justice and all others are associate justices. They are ranked by seniority on bench and must retire by age of 70. If you clock 70 as associate justice when you have a chief justice who is younger than you, you will never become a chief. North always take this into calculation since 1980s in presenting judges for promotion to supreme court and court of appeal even federal high court.

how many peaople know that the past 3, the current and the next 3 presidents of court of appeal are northerners. Even Ayo Salami is a northerner from kwara state.
Southerners dont like to become judges, they stay as lawyers making money. FRA, Sofola, Gani, Odje, Babalola, kasumu and many others stayed at the bar when their Northern counterparts moved to the bench. You cant eat your cake and have it.

Salami is not bigger than Nigeria.The ACN and CPC did not appoint him as the President of the Appeal Court the in the First place and so should not be responsible for the agitation for his continue stay in office to cover up their shady pacts with him.

We all worked in Corporate organization and we are sometime moved around to other units.He has behave in such in an unprofessional manner by refusing promotion to the Supreme Court .This is unheard of in history .An act of Insubordination.His Sins are many.To hell with ACN,
It is unprecedented too for Appeal court president to move to Supreme court and become a junior member, they always retire as President of Appeal Court. Law profession as rule.
Appointment in Judiciary is mostly based on seniority not so much a political arrangement. If you ask, the line up for CJN up next 10 may have been complied by now.

The "mad man" led a country that has highest GDP in Africa, owing nobody a dime. has hospitals that work, refineries that produce enough for his people, creates work and housing for all his people, but forgot to recognise that there is life after power.

If our own "sane men" could achieve at least one of his achievements most university graduates driving taxis in US, washing plates in London, prostituting in Italy, carrying drugs in Singapore etc etc, would not have left shore of their countries.

It is purely by seniority from the date you join Federal High Court.

^^^ they are really trying, that is what Nigerdock should do. get refurbished and upgraded to be able to handlle those PMs in Nigeria. That will create a lot of business for artisans and material suppliers just as they have in places like Limbe, Port gentile, Shahaja and other places these MODUs go for repairs.

^^^ it may be on transit awaiting custom papers, TIP (temporary import permit. It can also be maintenance. Most maintenance other that dry dock can be done in Lagos.

lol, yes, it is an oil drilling rig. They are at the dock to carry out PM preventive maintenance on the rig itself All heavy equipment do that on schedule. They used to go to Limbe in Cameron or Port Gentle in Garbon but Nigerian content is making sure they stay in Nigeria as much as possible now.

A father should be blamed for how his son turns out. He was his responsibility and he failed him, that is probably why he turned out the way he did. I would have agreed with you if it were the other way around. I will not want to go into the psychology of how he became a terrorist, but I am sure his father is not totally free of any blame.
