What exactly is your definition of fundamental human rights? Cos it appears you are all too willing to talk about limitless freedom of expression even when it encroaches on the rights of the majority.
Well this is my understanding of the fundamental human rights:
These are rights naturally accruable to every person by virtue of his/her existence as a human being.
The Nigerian Constitution under Chapter IV enumerates the following as fundamental rights.
* Right to life.
* Right to dignity of human persons.
* Right to personal liberty.
* Right to fair hearing.
* Right to compensation for property compulsorily acquired.
* Right to private and family life.
* Right to freedom of thought, conscience and religion.
* Right to freedom of expression.
* Right to peaceful assembly and association.
* Right to freedom of movement.
* Right to freedom from discrimination on the grounds of ethnic group, place of origin, circumstance of birth, sex, religion or political opinion.
The above rights are classified under Chapter IV of the Constitution as Fundamental Rights.
Now let's not forget that these rights are not limitless in practise; it will be folly for anyone to assert that he or she is entitled to freedom of expression and as such decides to walk down the street nude, that will be encroaching on others people rights as you will be trampling on other people's right to human dignity. Fact ism your rights end where another person's begin, we can continue to argue about the technicalities of these rights and laws all day, it will all still boil down to what is generally accepted, a society's natural reactions to alien acts that assault their own sense of morals, decency, culture and standards. The whole argument can't be wholly premised on the dictates of fundamental human rights cos in practice, these rights are subjects of ambguity and technicalities that render them almost impracticable. For instance, in the west, Polygamay and bigamy are criminal offences, yet it does not hurt anyone, it is between consenting adults and is a private afair. Does it mean this group that want to practice polygamy and bigamy do not have rights? How come the UN is not championing their rights to freedom of expression, liberty and association. What makes the ho'mosexualism cause any better and more important than polygamy cause.
Are you trying to tell me their decision to outlaw polygamy and bigamy in their society is not borne out of a combination of their moral standards, belief systems, societal idiosyncrasies and culture? Don't you see the double standards here??

I'm particularly disappointed with David Mark on this issue. He has always portrayed himself as a sensible, level-headed person who takes his job seriously. Although there have been some worrying signs in the past (ammending the constitution to protect jumbo salaries, turning off the mic when senators say things he doesn't like), I've always had some respect for him. Until now. It is unthinkable that a four term senator like Mr. Mark is ignorant of all the problems with this bill. That means he knows it goes against the letter and spirit of the constitution and he doesn't care. That, coupled with the powerful office he holds makes him extremely dangerous to Nigeria's democratic future. I've decided based on his utterances on this bill to use all my little power and influence to make sure he never holds public office again. I'll vote against him, campaign against him, put insulting photoshops of him all over the internet and do whatever I can to end his political career for the good of the country. Typical of the g'ay people movements to hit below the belts just to get you forcfully in line with their nonsense. This exactly what is happening in the west; coming out to openly disagree with h'omosexualism is almost tantamount to political suicide cos these deviants have infiltrated virtually every sphere of influence and power- the media, politics, education, social strata and so on. There is also the cultural argument. The bill aims at protecting taditional values and beliefs. Members of the senate claim that hömösexuality is imported from the west and is alien to african culture. This is of course completely false as a simple google search will show, but if even if it were true the question is "so what?" As we all learned in primary school social studies, culture is not constant, not fixed and is completely non-binding. No one has the right to enforce their cultural beliefs on others. My parents cannot legally force me to have a traditional wedding if I just want to go to registry. Then there is the completely stûpid idea that our local traditions are inherently good while western ones are bad. There are plently of traditional practices that are now considered pure evil, for example female circumcision, killing of twins, the treatment of widows in parts of the east, burying obas with human heads in the SW, the osu caste system, etc. Then there is the fact that christianity, islam and our entire system of government is imported.

Whether you choose to believe it or not, there is no part of the African culture that supports or encourage H'omosexualism, nobody is saying it does not exist in Africa but the fact is, it is an alien phenomenon and there is no part of the African culture-Nigeria culture in particular- that has h'omosexualism and its likes as an integral part. The examples you have given of the failings of our own culture does not make the practice of h'omosexualism any more apealing or better than those examples you gave; can you honestly claim that the majority of the Nigerian populace still practise them??
Finally, nobody is saying our culture is superior to the west, the fact is, if we are going to change certain aspect of our culture and imbibe news ones it must be the ones that have positve effect, promote our well being, preserve and enhancr our way of life not the nonsense you so adamantly wanr us to copy.

The most obvious problem with this bill is that it is completely unconstitutional. In fact, it violates the 1999 constitution is so many ways that it's shocking to me that it even survived its first reading talk less of being passed. It has provisions to prevent gäys from forming associations, gathering together, protesting or petitioning the government. It makes witnessing, publicising or promoting gäy marriage a crime. By doing this, it tramples on freedom of expression, freedom of association, freedom of assembly, the right of the people to petition the government to redress greivances and limits open political discourse. It is important to note that this affects the rights of not only gäys, but all Nigerians. If this becomes law, anyone who forms an HIV/AIDS advocacy group that targets hömösexuals will be liable to a long prison sentence. Even posting on this thread will make you a criminal. This cannot be allowed to happen in a democracy.

While it is easy for supporters of g'ay movements to quickly quote the sections of the constitution that talks about equal human rights; they so conveniently forget that these laws were made on the presumption that the people it deals with were heterosexuals, there is no provision in the constitution that gives any right to people based on their sexual orientation or even allows the kind of association, union or legal standing to h'omosexuals. No section of the constitution gives provision to allow or give support through rights to such an act. Show us in clear terms and let us debate it, not some vague and ambiguous claims that is open to debate.

1. Persons who entered into a same-sex marriage contract or civil union commit an offence and are each liable on conviction to a term of 14 years in prison.2. Any person who registers, operates or participates in gay clubs, societies and organisations or directly or indirectly makes public show of same-sex amorous relationship in Nigeria commits an offence and shall each be liable on conviction to a term of 10 years in prison.

I want to address this whole good and evil issue because this conversation came up in my office last week. Everyone was expressing how evil and disgusting they thought homosexuals were. Me, being the adherent of libertarianism that I am, went completely against the grain (as I always seem to do) and started to spoil their little parade. Should have seen the looks on the faces of these forty and fifty something year olds when me their boss (twenty something), started defending said homosexuals. "How can you condone evil"; I was asked. Problem with this hollywood/biblical good and evil thing is that it doesn't really exist in the real world. Everyone is a little sociopathic, some more than most, for example: I couldn't steal money and then sleep at night knowing I've stolen, hence why I don't steal. There are many who can, and then sleep well. There are those who could happily kill another human being, and sleep well. They are not evil in the biblical sense, they are sociopathic to the extreme with psychopathic tendencies. People commit as much sin as their prepared to live with, it's not that the devils in them, it's just that they can live with themselves. Now having explained this to my office, I started getting all these bemused looks. I'm guessing they thought I was some closet Same-sex. I'm almost certain there are senators on this bill who are in fact bisexuals. The biggest problem I have with this bill and those who blindly support it and pontificate to those that don't, is that they remind me of the William Lynch's of this world, trying to convince you why those that are different may well be demonic etc. Terrified that if they support the rights of homosexuals people may think that they too are man-lover. Horrified by that fact. Forgetful that it was intolerance, pseudo science and fear that led to almost four hundred years of slavery.  

I also will like to address an aspect of your post that I think many at times people who indulge in it mistake it for individuality or an independent mind. Just because you are in the habit of going against popular opinions or according to you, "go against the grain" does not neccessarily mean your opinion is better, superior a proof of a sound independent mind, it is just your opinion, that is it.
And now let me come to some of the erronuos beliefs on whose basis your arguments stand. First, there is nothing wrong if because of my religious, cultural and moral values I agree with the NA that a law should be passed that bans same-sex union and any other means of promoting homosexualism.
Every society is governed by laws, there is no such thing as limitless freedom thus the saying; "your rights ends where another person's right begins". It should be understood that laws are made in the context of what is generally accepted( or seen to be the majority) and societal idiosyncrasies. Even in a country, there are still local laws perculiar to a locality in the country; these local laws are informed by the people's cultural beliefs, generally accepted values and norms, religion and tradition, you can't take away these factors from the law making process. Hence it is folly for anyone to pretend like the much touted fundanental human rights are not borne out of a belief system, truth is, some latent human notions informed these human rights, so it can be argued that while it is ok to protect the right of everyone both majority and minority, it must be seen in the context of basic rights and not social issues as complicated and very complex as the issue of rights practise sodomy. To what ends do one's right encroach another person's right is the big question here nobody ask these pro-g'ay activists and g'ay people themselves. instead reducing the argument to a redundancy by resorting to the overlaboured fundamental humam right blabla, you should be more concerned with whether it is a majority view or opinion amongst Nigerians( the main people concerned) that same-sex union be outlawed. If it is the case, then respect and move on instead of trying to browbeat into acceptance.

I mean if we consider that some African countries already have legislations that protect and encourage the act and their cause, it can't be ruled out that a sizeable number of the viral infection, amongst other things, may have been fuelled by ho'mosexuals-both from closet ho'mosexuals that may have been doing it on the down low and the ones that are openly g'ay. Take RSA for instance, they have the highest incidence of HIV and AIDS infections plus a very very visibly active g'ay community that has succeeded in forcing their government to legalize their acts and peotect them, don't you think h'omosexualism may have fuelled the very high number too?

Let me assist you to a better understanding. The reason why homosexuals are at increased risk for STDs (HIVAIDS especially) isnt because they're more promiscuous. Heterosexuals are JUST as promiscuous. Denial doenst get us anywhere so please, lets drop it for a second. The reason they're at increased risk is because of the stigma that they often experience. They're subjected to the shame of having to hide their love for one another. It is different for them. AND the reason why heterosexuals have less HIVAIDS rate is because they have the benefit of preventative health-care services (anti-HIVAIDS) that are provided to them. Homosexuals often (especially in African countries) lack that benefit. There is NO place for them to go to get taught about how to protect themselves. There is no place to go to gain support. "fuelling" the rapid rise in HIV/AIDS
infections in Asia, according to a recent
report by the Western Pacific Branch of the
World Health Organization (WHO). The WHO
warned today that the HIV/AIDS epidemic
may take a major turn for the worse in Asia.
The central role of male homosexual sex in
the HIV spread has prompted WHO’s
Western Pacific office, in collaboration with
the United Nations Development Program,
UNAIDS and the Hong Kong Department of
Health, to implement AIDS prevention
programs in light of the unique
vulnerability of people with same-sex
attractions.
"Studies show that at present, the
proportion of HIV infections being
transmitted among men who have sex with
men is larger and more significant than we
had originally believed," said Dr Massimo
Ghidinelli, WHO Regional Adviser in HIV/AIDS
and Sexually Transmitted Infections. "Action
needs to be taken now if a major increase
in HIV/AIDS cases is to be averted. We need
to target HIV prevention strategies, together
with better access to health services, for
men who have sex with men (MSM)."
The release cites a 2007 report showing an
increase in AIDS infections across Asia, and
mentions China in particular, where the risk
of infection by active homosexual men is
45 times higher than for men in general.
The WHO noted that Asia is thought to have
the world’s largest number of actively
homosexual men, estimated at 10 million.
China’s official news agency Xinhua also
announced today that AIDS took more
Chinese lives than any other deadly
infectious disease last year. Xinhua said
there were a total of 264,302 HIV/AIDS
cases by the end of September last year.
The United Nations estimates 700,000
Chinese were HIV positive by the end of
2007.
The organizers will meet with HIV/AIDS
specialists from Asian governments,
regional experts and representatives from
nongovernment organizations from 18 to
20 February, when they will consider
strategies to deliver better services to MSM
communities.

guy you are truelly uninformed about the issues you argue. I have looked up the guy in question, he lives in Abuja and not Lagos, and yes, he was at the senate to make a case for G'ay right. His personal stories are full of serious persecution both from family and community. His mate is even yet to come out of the closet cos of course he is prolly in a worse position to do so. They want you to respect their rights yet they dont want to respect other ppl's right to object obscenity, see how they kiss and handle each other in the open, one can imagine what they do in private. Guy you are digressing from the main point of the debate, the Nigerian polity has always been awashed with discussions and deliberations of those issues you have outlined, there is nothing wrong in debating same-sex cohabitation and legislating it so that we know where we stand in the issue especially now that it is increasingly becoming a political issue that cut across boundaries. Even if  the Nigerian senate deliberates on those other issues for the next 20 years, the country's problem wont go away in a jiffy, it is folly for anyone to suggest that until we exhaustively deliberate or legislate on those aforementioned issues that we should not legislate where homosexualism and its like. No country does not have problem, it does not mean other issues(however unimportant you or anyone thinks they are) should not be discussed alongside, it does not preclude the other ones.
