I don't understand the noise about this discovery.

Is there any law in Nigeria that limits the amount of money in cash a Nigerian can hold?

So far, until the EFCC proves he stole the money, it is the money belonging to Andrew Yakubu. It is for the EFCC to prove a case against his where he stated the money is gift from friends. Is there any law that limits what a Nigerian can receive as gifts from friends?

The case of the Delta State Government against the FG in the 15m USD bribery money. James Ibori was never an appointee of the FG but a Former Governor of Delta State. It was a logical conclusion that the 15m USD belonged to Delta State. The government of Dr. Uduaghan went to court to retrieve that money back to Delta State. But the court ruled in favour of the FG, claiming that the Delta State government has not proved that Ibori took any money from Delta State. So, logically and from the law point of view, it remains a property of Ibori with which he tried to bribe a Federal Officer and the money was returned by a Federal Officer and it belongs to the FG. Technically, Ibori has full right over the 15m USD which he dispensed when he offered it as bribe to Nuhu Ribadu.

The money still is Andrew Yakubu's ...it is gonna be a long fight. No need to glory. for the EFCC, the glory is only in the immediate media attention. Nothing else.

I totally disagree WITH Saraki. If anything it is the government that is more clueless!! We started building power plants with limited gas supply, we have no alternative to the ND issue where our gas is, we have no political will to get MDA's to settle outstanding bill running into billions, and we are not courageous enough to find a commercially viable way for NLNG supply more gas to the domestic market.

Saraki did not even mention the key issue here which: the cost of gas. The cost of gas is not attractive for any investor to expand by way of pumping in money.

Saraki is just trying to use this opportunity to turn the tide of public outcry against his party.

You shouldn't allow the big fancy figures you read in the titles push you into irrational delusions as it is doing presently to you and several others on this thread who have been asking why govt can't use these 'massive' funds to finance the budget deficit. The real question you should ask yourself is, where do you think the govt raises the almost N4 trillion it uses for recurrent expenses?

The revenue made so far in 2016 by FIRS still falls within the exact same range that has always been generated at least in the last 4 to 5 years; same goes for Customs, nothing signifantly more has been realised when compared to previous years and most of these moneys still end up servicing just the massive recurrent component of the budget.

The only reason why these figures are news worthy is because despite the massive dip in revenue from oil (oil company tax previously brings more than half of the FIRS revenue) and the reduction in import volume into the country, the FIRS and Customs have somehow been able to still maintain the same level of revenue generation as previous years, possibly due to improved efficiency.

You make sense! Sometimes you are objective and when you are, it is your finest moment. When you speak 'politicos'....

At that time, the Presidential Spokesman, Femi Adesina, said PMB was treated here in Nigeria and was only going for further "checkup" or "evaluation" and rest.

The truth before us is: PMB actually spent 20M NGN for just "check-up'' or "evaluation".

Yet 'they' will come and tell me that PMB is frugal and a man of integrity.

Joeprince...I lived in Bonny for 10 years and only left last year. I heard that the economy of Bonny has deteriorated and there is serious hunger in town.

Electricity in some part of Hospital Road is supplied by Shell from Roundabout to Macauley. Wheile from Macauley to Akiama is NLNG. So, you mean there is electricity challenge now? What of the water scheme is it now running or Bonny still depend on BUC water along Hospital Road?

The Economic and Financial Crimes Commission (EFCC) has called on the presidency to set up a high-powered inquiry to verify the claims of an exclusive report published by THISDAY revealing that the Department of State Services (DSS) had arrested a member of the Presidential Investigative Committee on Arms Procurement, Air Commodore Umar Mohammed (rtd), for allegedly fronting for officials of the commission and the Office of the National Security Adviser (ONSA).

Mohammed was arrested on Sunday over allegations that he might have fronted for and received large sums of money from certain individuals and companies on behalf of members of the committee believed to be linked to the EFCC and ONSA.

The individuals and companies, THISDAY gathered, were purported to have paid massive amounts of money to the committee members through Mohammed in order to evade prosecution.

However, reacting to THISDAY’s story yesterday, the EFCC distanced itself and its chairman, Ibrahim Magu, from any illicit activities and resorted to the over-flogged refrain: “corruption is fighting back”.

A statement by its spokesman, Mr. Wilson Uwajaren, said: “The attention of the Economic and Financial Crimes Commission has been drawn to a report entitled, ‘DSS Nabs Member of Presidential Cttee on Arms Procurement over Alleged Fraud’, which appeared on page 10 of THISDAY newspaper of June 21, 2016, regarding the arrest of Air Commodore Umar Muhammed (rtd), for alleged fraud.

“The report, quoting anonymous sources, alleged that Muhammed who is a member of the arms procurement committee is ‘fronting for some members of the committee’, including ‘high ranking officials in the EFCC and ONSA’.

“Though the report falls short of naming the so-called officials that Mohammed is allegedly fronting for, it is common knowledge that the acting Chairman of the EFCC, Mr. Ibrahim Magu, is the only member of the Arms Procurement Committee from the commission.”

The EFCC went on to express grave concern over “this spirited attempt to create doubts in the minds of less discerning Nigerians and members of the international community regarding the integrity of its acting chairman”.

“To all intent and purpose, this devious report is another avenue of corruption fighting back as some people have been uncomfortable with the uncompromising stance of the acting EFCC chairman in the fight against corruption,” it stated.

The commission was categorical that no official of the agency that is directly or remotely connected with the work of the Arms Procurement Committee has had any dealings that verge on fraud with Air Commodore Mohammed or any other member of the committee.

It went further to challenge anybody with contrary information to come forward with the evidence.

“The EFCC as a body upholds zero tolerance for corruption and will not condone any act that amount to corruption. If Mohammed is established to have engaged in any illegal activity, he should be held liable.

“In view of the gravity of the issues, the EFCC calls on the presidency to set up a high-powered inquiry to verify the claims of the report and those who have made it their sole business to impugn the integrity of others and cast doubt on the credibility of the anti-corruption war.

“No matter the distraction and attempt by dark forces to derail its work through negative propaganda, the commission will continue to discharge the mandate freely given to it by the Nigerian people to hold all public officers accountable,” it stated.

However, THISDAY gathered from high level sources in the DSS that Air Commodore Mohammed was still in the custody of the security agency, which had expanded its investigation by carting away documents from his residence at No. 4 Lundi Close, off Mississippi Street, Maitama, Abuja.

During the raid on his residence, the DSS discovered $1.5 million cash and 18 luxury cars.

The DSS was also said to have carted away his state-of-the-art cars, including a Rolls Royce, Ferrari and Buggati, among others, and raided his Kaduna residence.

Mohammed, revealed a DSS source, has been very cooperative and has made major revelations that would enable the agency to invite the persons on whose behalf he acted when he received bribes from the individuals and companies that were being probed by the Arms Procurement Committee.

Exactly the point. If Ize-Iyamu becomes governor, he can actually appoint a bright gentleman as his Economic Think Thank Manager. Afterall, the Willie Obiano just appointed a young man of 30 to head his Economic Strategy Group....

EFCC freezes his account...then what next? You can't prosecute him because he has immunity. So, why freeze his account since you cannot charge him to court to prosecute him for any financial wrongdoing.

For goodness sake, he has immunity till 2018.

In my mind, I think the law is when you freeze account, you charge to court.

Presidency is considering a legal action against a private lawyer, Mr. Nnamdi Nwokocha who it said has by his press interview prejudiced public opinion against President Mohammadu Buhari for alleged lack of school certificate and declared him guilty on the pages of newspapers. A Presidential Media Aide, Malam Garba Shehu, while reacting to Nwokocha’s press interviews, in a statement explained that “it is unfair for a lawyer who is a litigant to a case in court to go out of his way to hijack the power of a Judge by declaring the President guilty of what he is accused of.” According to Malam Shehu, “newspaper pages are not alternative courts where a lawyer can declare anybody guilty of anything when the court has not formally given a definitive judgment on an issue before it.” Major General Muhammadu Buhari (rtd), He stated that “The two-pages interview splashed on pages 56-57 of ThisDay edition of Saturday June 11th breaches a lawyer’s ethical code and we hope that the court and the Bar Association will take notice of this.” The Presidential Media Aide said “any lawyer that sincerely believes in judicial process and the rights of other parties to a case would not have engaged in the inappropriate and unprofessional practice of trial by media, especially a situation where Nwokocha openly declared the President guilty when the court didn’t make that declaration.” Malam Shehu noted that “gag orders emerged in the United States on account of lawyers’ inappropriate conduct on trying and convicting people on the pages of newspapers or the court of public opinion.” The Presidential Media Aide noted that “free speech is not synonymous with recklessness and wanton abuse of the rights other parties to a case in court.” He also said that “The litigant’s unabashed claim that he was a card-carrying member of the opposition PDP which lost power in the last election clearly indicates a scheme that seeks power by circumventing the democratic process of elections.” Malam Garba Shehu said “if Nwokocha has not stopped his unfair and professionally inappropriate abuse of free speech, the President’s competent team of lawyers will seek the instrumentality of the law in dealing with his unethical actions.” He said “you cannot be a litigant and be a Judge at the same time.”

President Muhammadu Buhari has appealed the ruling of Justice Adeniyi Ademola of the Federal High Court in Abuja who on May 26, 2016 dismissed his preliminary objection in a suit filed by an Abuja-based legal practitioner, Mr. Nnamdi Nwokocha-Ahaaiwe.

Nwokocha-Ahaaiwe had alleged that Buhari was unqualified to aspire to the Office of the President of the Federal Republic of Nigeria because he did not sit for the Cambridge West African School Certificate WASC) in 1961 as he claimed.

When the suit came up on May 26, Buhari in his preliminary objection challenged the mode of service of the originating summons on him, insisting that he ought to have been served at an address in Kaduna instead of by substituted means at the national secretariat of the All Progressives Congress (APC) in Abuja.



However, Justice Ademola, in his ruling, had held that it was incompetent and upheld the service of the originating court processes on Buhari.
The judge held that the service of the court’s processes on the president through the secretariat of the APC was proper.

The court was satisfied that if it was served on a senior officer of the APC at the national headquarters, it would be brought to Buhari’s attention.
Dissatisfied with this ruling, Buhari through his legal team filed a notice of appeal at the Court of Appeal, Abuja Judicial Division on seven grounds of appeal.

The president’s legal team, which endorsed the notice of appeal, is led by Chief Wole Olanipekun (SAN).
Others are Mr. Lateef O. Fagbemi (SAN), Chief Akin Olujinmi (SAN), Oluwarotimi O. Akeredolu (SAN), Kola Awodein (SAN), Prof. Taiwo Osipitan (SAN), Charles Edosomwan (SAN), Emeka Ngige (SAN), Femi Atoyebi (SAN), Femi Falana (SAN), Funke Aboyade (SAN), H.O. Afolabi (SAN), Muiz Banire (SAN), and 10 other counsel.

When contacted on the phone, the plaintiff, Nwokocha-Ahaaiwe said the president has the constitutional right of appeal and was within his rights to exercise it particularly since he had not yet submitted a defence to the substantive action and had filed nothing in defence of the merits of the case.

Meanwhile, the Principal Registrar of the Federal High Court, Abuja, Mr. Jane Egbo, has issued a summons to the parties to appear before her on Monday, June 13, 2016 to settle the records of the president’s appeal.
Also, a check at the Registry of the Federal High Court, Abuja confirmed that the plaintiff has filed an application to amend his originating summons to include prayers for the nullification of the election of Buhari, as he was not qualified ab initio to contest the election having contravened the Electoral Act and committed perjury in claiming to have had a WASC when he never even sat for the examination.

The plaintiff also wants to add prayers for the court to order the Independent National Electoral Commission (INEC) to withdraw the certificate of return issued to Buhari and issue a fresh one to Dr. Goodluck Jonathan who came second in the 2015 presidential election.

The plaintiff’s motion on notice for amendment of his originating summons has been served on all the defendants and will come up for hearing on Thursday, June 16, 2016.
