If the man really loves you, he will tell you he is impotent before you get married. Anyway, young people planning to get married should check for STDs, HIV, ability to consumate the marriage, et cetera before getting married.

A lot of problems can be prevented by doing due diligence. People should do their homework before allowing love to 'carry them away!'

This is not divorce; it's annulment. There is a difference between the two. [I]"Annulment is a legal procedure for declaring a marriage null and void. Annulment differs from divorce where the court ends an otherwise legal marriage on a specific date."[/I]

What we are saying is that since the marriage is [I]contracted[/I] based on certain [I]basic expectations[/I] and you know that you are not able to satisfy those [I]basic expectations[/I], and you go ahead and deceive your partner in order to get married, then the marriage [I]contract[/I] can be declared null and void.

This is just like what happens when you get married to someone and the person is discovered to be married to someone else! In that situation, will you say that since you "don't believe in divorce" both of you must remain married to the same man?

If, unknown to you but known to him/herat the time of the marriage:

[li]He or she is suffering from a venereal disease in communicable form[/li]
[li]Your wife is pregnant by another man (remember, we now have DNA analysis).[/li]

... then the marriage can be cancelled (annulled, voided) by a court in Nigeria.

IAH, if the child is living with the man and his mother is alive then it can be really complicated unless both you and the child are able to accept each other.

Then you have to consider the financial status of both of you if he's paying money for child support, then you have to consider the possibility that he will leave you even after you have children in your relationship with him!

So it depends on so many factors. Was he married to the mother of his child? Did she leave him or did he leave her? Was it just a fling that went wrong? WHy was he not able to maintain a relationship with the boy's mother?

Sometimes we are too quick to conclude that someone is perfect for us when we know so little abt the person.

Such a marriage can be declared null and void in court.  Only a wicked man will marry a woman knowing that he is incapable of fathering a child.  The law of Nigeria provides for 'voiding' (annulment) of a marriage under circumstances like the one you've described.

[color=#770000]UPDATE:[/color] There are so many cases of impotence that are due to psychological and similar factors. Those ones are curable, and you cannot annul the marriage unless it's an incurable case. I apologize for ignoring this factor in my post.

Hmmm. Good point.

I just want to say that you should try to be calm about it. Good people sometimes do bad things; people make mistakes. If it's possible for you to ask him in a direct, really calm fashion with the facts, like: "so and so told me you were seen at a club with another woman. Tell me about it". Then listen to what he has to say and watch him intently for signs that he's not being sincere.

Ask "why" questions, and do not use this as an occasion to react. Just listen like a calculating robot and ask questions. Then excuse him and think about the response. Then when you're sure you know exactly what happened, you can react. You can also keep us updated. Hope this helps.

I am a young man and I have dabbled into so many things, but so far the Nairaland Forum seems to be my most successful venture. I am not in love with anyone, and nobody is in love with me.

So, I'll spend my last day on earth furiously typing all my plans and ideas for Nairaland in a document, and I'll direct my parents to give the document to my biological brother to continue the work I have started so at least I'll know I'm leaving something good behind. That's it for me.
