They spoke in hausa language which I understand very well, apart from what the video makers were saying nothing else suggests that the military vehicles and other vehicles were fleeing from something or someone. barcanista: My Brother, I can roll out countless number of High profile Murder cases that was heard at the Magistrate Court. The Constitution does not bar Magistrates from hearing murder case. At least ALL the Prosecutors, Attorney Generals, Prosecutor Generals, Defense Lawyers etal can't be that ignorant. Maybe he was quoting from an oLD law.Thanks again, I think my friend is ignorant or quoting from an old law like you said. I've seen Magistrate Court hearing a murder Case myself, only that I was confused by his statement cos he is lawyer. |
GANDALF1: Not a lawyer, but its true that magistrate court has no jurisdiction over murder cases. Though they can hear manslaughter charges. I think it basically has to do with grave criminal cases like robbery, murder, etc that carries the death penalty.But I've witnessed a Magistrate Court hearing a murder Case. |

Magistrate Court Hears Murder case. eg Senator Teslim Folarin in 2011 was charged for Murder by the police for the Daylight killing of Lateef Salako, aka "Eleweomo", the factional leader of the National Union of Road Transport workers in Ibadan, Oyo state. He was arraigned at Magistrate Court in Ibadan.Thanks, my friend is a lawyer and he said constitutionally; Magistrate Courts can not hear Murder cases but I know I've witnessed a Magistrate Court hearing a murder case. Is it that they know the provisions of the Constitution and still operate in illegality? |

I am not a lawyer but I have great interest in law and The Judiciary. Yesterday I was having a debate with a friend and he said that in Nigeria all Criminal Cases must go straight to the High court.... that Magistrate Courts and Area Courts do not have jurisdiction to hear Criminal Cases especially Murder Cases. I did not believe him cos, the police normally takes Armed Robbers who are charged with murder to Magistrate Courts and not High Court. He said; The police normally will do that in order for the 48 hours allowed by law to hold a suspect not to expire, that is a time wasting tactics by prosecuting police Officers.......... he said they will call it WITHHOLDING CHARGE which is not even known by law. I will like another opinion on this, I've search Google but didn't find the subject. |
