Lagos State runs an agbero government. No where is this more apparent than in the build industry. They have multiple agencies in the building space. Each of these agencies milk you to the highest level. Planning approval, safety commission approval, labscal approval and stage certification, area boys money, omo onile money, LGA approval. Plus several officials in these agencies that you have to give money for them to do their work after you have paid official fees. I built in FCT without paying anybody kobo aside approved fees.

Yes, another agency came and put a stop work mark on the fence and wall.. Didn't pay though because the official I already engaged said he was going to handle it.

Those Government Agency, are fighting for their own pocket, I doubt if they remit all those crazy bill to government account.

Is this brand different from Senwei? Used Senwei without issues, even transferred it to one of my project sites. Very good brand.

This is the assumption that Lagos state use to bully people building in Lagos State. When I had to get planning approval last year in Lagos, I was billed 1.5m after presenting my 3 year tax clearance from FCT. I was told to write to the chairman of LIRS but I know it will be a long route. I contacted someone close to the governor who got in touch with chair of LIRS. Of course they changed the assessment and agreed that my FCT tax clearance was sufficient. This shouldn't have to be, what of if i don't know any one I would have been double taxed. Mind you my monthly tax before i voluntarily retired last year December is enough to pay a senior civil servant monthly. Now they still do 5% withholding tax on all my consultancy fees and I am expected to file to pay more by year end on other sources of income.

Those who pay tax in this country are often over taxed. You pay PAYE, land use charges, VAT on every purchase, all sorts of levies by LGA people, pay tax on even on interest from savings you have in your account. Efforts should be to expand the tax dragnet and not over taxed the few that pay tax

Was also told to write the LIRS chairman.

This country gives you more reason to just pack up and leave for good.

The same Nigerians are complaining when this got done.

No offence meant but these are part of the reasons that we can't really have growth in the country. Income tax is different from property tax.

The government is simple not making enough money, tax based wise, to really build/rebuild infrastructures in the country.

Here is the assumption, and it is a valid one. If you are a salary earner who earns 100k monthly but has #100M in your account for building , they would assume you have other source of income.
Money does not grow on trees. There are only two ways to acquire money; either by earning it or by inheritance.
For both, the law is that you must pay taxes from the money. That tax is what they are using the opportunity to ask and collect. Another assumption is that the money was earned in Lagos. If not, prove it.


However, it wouldn’t be fair for those with full verifiable taxed income to pay additional when building . But that has been the unhealthy, unlawful double taxation practice in Lagos.

The question is, based on salary structure, how many PAYE workers have cumulative salary of #100M through the life of their career?
Remember, the FIRS has the power to audit any entity and most people might not want that.
Invariably, this audit is what they do during this process.

Just what I was trying to explain.

Except you can prove that it was the 100k salary earned within the tax period you're building the structure with, they will surely want to tax the rest not covered by tax.

I think we are making an assumption that there is an amount of tax that should be paid for a type of house. That is not the law. There is no law that values the tax to be paid as a function of the house being built. They might use this for business owners to imply you are not declaring all of your income but for PAYE it is clear unless there is no paper trail of the salaries and allowances the worker earns. I trust my union, anyone tries this nonsense will hear it.

A tax officer told me that the building tax in Lagos is dependent on the location and structure just as I said before.

Confirmed from 2 other officers from different tax offices in Lagos, afterall they had nothing to gain from me, so why would they say something not true?

I will stop here though and let others that went through similar situation share their experience.

At the risk of sounding like a broken record, I believe this thinking is an illegality. What if I had that money saved up since 10 years ago. So far as I paid appropriate taxes on my verifiable income from last year, especially PAYE, it is no one’s business to look at the house I want to build.

I made an example earlier on.

Can the tax of a salary earner earning ₦100k monthly for like 3 to even 5 years be enough to clear a building project of like ₦50m-₦70m?

When I was going to start my project in 2020, they assessed a tax of about 2.5 million because for 2018 and 2019, my tax state was Delta State due to my work location. All I did was send them my Delta State tax clearance for those years and that settled it. I joke with my colleagues that with the amount of tax I pay to Lagos State, they should be calling me every morning to ask what they can do for me. This is not bragging before brag-police come for me o, just to show that my PAYE is enough to sort all tax issues with LASG without paying a dime more.

That's why I said some salary earners should be able to clear that hurdle if what they paid as taxes correspond with what they're building.

The truth is that most businesses in Nigeria don’t get their taxes right because of so many informal ( not illegal) transactions. A certified tax person or firm can help you get it straightened out and no one would challenge it when presented anywhere, even for building approval.
But Nigeria factor would still play out before anything is approved.

The town planner official told me in plain English that even if I pay 3m in taxes before then, they'll still send me a letter asking for more and claiming it wasn't enough.

My wife's boss faced the same, he was able to scale through because of more than 30 years of tax payment both as an employee and employer..

A man like that was supposed to get a tax cut, but they denied him that.. Meaning they still indirectly got something from him.

The people (both public and private sector workers) in this country have turned the country into a product they have vowed to make profit from whichever way.

You are supposed to show evidence of tax payment on every penny you earn, or inherited. That is why you must pay tax on the difference between your reported and verifiable income and the total cost of building the house.

But I see your point. If you have a projection to build the house in stages, that is while you earn, it then seems that you would be taxed double. This is because they have already collected that tax based on previous assessment. Then your employer would still deduct the PAYE.

I being a business owner trading intangible products (services) for money, it becomes difficult for the Govt to task such.

So I most times use my discretion to pay, yet I was told what I paid for 3 years wasn't enough just because the project is on the island. (The tax boss in one of their mainland offices said so).

I still am not comfortable with this though. Taxes should not be at the whims of those guys especially in the case of PAYE. I stand to be corrected but I don’t think there’s any law backing up such. If it is self-assessed tax for say a business owner then fine but an employee in a corporate organization should not be made to pay more tax because he’s building a house.

Don't know if it's just in Lagos, all I know is that you can't get building approval without paying tax. They issue receipts with specific codes for such taxes. (Most banks in Lagos have the tax teller).

Building tax is calculated based on the value of what you're building and also the location.

Imagine an ₦100k salary earner that has worked for about 5 years building a house in Lekki phase 1 worth ₦150m, without you thinking so deep, do you think his or her tax for that 5 years should cover for such build?

If you don't mind how did you finally resolve the tax issue. This is one issue everyone building in Lagos would have to face especially if you need to obtain planning approval.

If you're a salary earner, try getting your tax clearance certificate for submission. If not enough, they will get intouch with you.

If you're a business owner and have been paying your taxes, get your tax cert submitted to them too as stated above.

If you have never paid tax before, just wait for them to send you a letter or employ a tax expert to help you handle that aspect.

That's what normal leagues does.

Questions you should ask are:

(1) Did the referee signal the added time before the goal?
(2) What was the added time?

If that's what truly led to that massive extra time then it is negligence of duty on the part of LMC. If the LMC officials were alarmed and concerned as they ought to be, they should have put an emergency call through to its match officials who are live on the pitch for information to enable them clear the air on the Sunday evening. Clearing the air several days after the incident is rather poor.

Moreover, all the negative publicity generated by that extraordinary extra time should have been avoided if the Twitter handles of either Katsina United or Remo Stars tweeted about that pitch invasion and the fact that the match was held up.


Going forward, LMC officials should as matter of duty keep tabs on all live matches on every match day for any unsavory incidents like violence, medical emergency and pitch invasion, etc. in order to stay on top of such issues. Even the match officials on the pitch should file emergency report to designated LMC WhatsApp account when an unsavory incidents occurs.

Read the report again.

When a field of play is enthroached by fans, the referee stops his watch till normalcy is restored but media houses and social media don't have such luxury.

The normalcy must have taken up to 30mins before the restart of play but the public only sees the delay if not watching the live match or in the stadium.

In summary, there was no 36 mins extra time.
