The question Nigerians now have to ask themselves is whether they value subsidized petrol over the road repairs, bridge building and other infrastructural upgrades that the same funds could have been spent on - it's either going to be one or the other, as the same small sum of money can't be spent twice (and I say "small" because the extra annual revenue Nigeria is earning from higher oil prices is less than a company like Google or Microsoft makes every 3 months, but is expected to fund all sorts of spending for over 180 million people).

I believe a point of contention people who want the govt. to provide amenities and yet not increase pump price are those who believe that if there is extra cash with the govt, 'they' will chop it and let's be sincere, I am yet to see any seriousness in fighting waste and corruption in govt quarters and so it is quite easy to understand people's fears/bias.

The price of crude has risen to the $70/barrel range and some would rather want the nation to reflect that as well. The main thing is the govt willing to bear the higher subsidy costs or pass it on to the end user? Whatever the decision, it had better be reached sooner than later so everyone knows how to make effective plans for the future.

Let's be sincere with ourselves on the matter. If you watched the movie series BILLIONS, there was this episode where some investors colluded to short the naira so as to make a killing from our dwindling economy thereby the naira would lose value fast within a short period. Funny also that our president at that recession period also said the same thing of speculators bringing down the naira value. This is purely business. On why the naira did not reach N600/$ then was a work of politics play which saved us losing more.

Politics will always affect investments and as long as nigeria is at the mercy of these super powers, their investors can affect our economy as they wish and we would be left with having to name blame whoever is at the helm of the nation's affairs. I expect more of such negative effects an if I were you I would cushion my businesses from feeling the drawbacks of what is coming.

Sometimes for the sake of peace, status quo needs to be maintained. The decision by the US removed it as an unbiased peacekeeper in the negotiations between Israel and Palestine. The aftermath of that decision has polarized people of faith all the more all over the world. Conflicts and semi conflicts have taken place since that decision and who knows what else. Afterall, they both have a claim to the land but the question is who gets which part?

I hope Israel and Palestine would learn to resolve their issues more quickly to avoid more bloodshed near and far. With Russia testing out SATAN1&2 and several other major and minor skirmishes happening all over, we don't need another straw batch that could ignite WWIV.

Common Law:

Essentially, where a tenant holds over at the end of his contractual tenancy; by virtue of an agreement between the tenant and the landlord, under common law, he becomes either a tenant at will or a tenant at sufferance.

A Tenant at Will:

A tenancy at will arises whenever a tenant with the consent of his landlord occupies land as tenant on terms that either party may determine the tenancy at any time. In the context of holding over after the end of a prior tenancy agreement, a tenancy at will could ensue where a tenant for a fixed term whose lease has expired continues in possession of the premises with the landlord’s consent/permission[1].

A Tenant at Sufferance:

A tenancy at sufferance would suffice where a tenant refuses at the expiration of his tenancy to vacate possession and wrongfully, that is, without the consent of the landlord, continues in possession. A tenancy at sufferance arises where a tenant, having valid tenancy, holds over without the landlord's assent or dissent.

Statutory Tenants under the Tenancy Law:

Under Nigerian Law by virtue of various tenancy laws, the law recognises only two classes of tenants.

(i) Contractual tenancy and

(ii) Statutory tenancy.[2]

Contractual Tenant:

A contractual tenancy is based on an agreement between the landlord and tenant. A tenant who enters upon premises by reason of a contract with the landlord is a contractual tenant.[3]

Statutory Tenant:

A Statutory tenant is one who when his contractual tenancy expires, holds over and continues in possession. His status as a statutory tenant is by virtue of various Tenancy Laws which defines a tenant to include all persons in lawful occupation of premises.[4] What this means, essentially, is that under Nigerian Law, the distinction between a tenancy at will or a tenancy at sufferance, for the purposes of defining a tenant who is to be protected by statutory law, is discarded. You are either a contractual tenant or a statutory tenant.

Notice to Quit

A landlord seeking to recover possession of his premises before the expiration of the tenancy (effluxion of time) is obliged to issue a notice to quit. The notice stipulates a period within which the tenant must quit possession of the premises. The period of notice given will usually depend on the agreement between the parties. In the absence of any agreement, the period of notice will be determined by statute. For instance, Section 8 of Recovery of Premises Act, Cap 544, LFN (Abuja) 1990, provides that in the absence of express agreement to the contrary, the period of notice to be given by either party shall be as follows:

Tenancy at will or weekly tenancy – a week’s notice
Monthly tenancy- a month’s notice
Quarterly tenancy- a quarter’s notice
Yearly tenancy- half a year’s notice.
Tenancy exceeding one year is regarded as a yearly tenancy and 6 months notice is sufficient. The nature of tenancy shall in the absence of any evidence to the contrary be determined by reference to the mode of payment and demand for rents.

The notice to quit must be issued by the landlord himself or by an authorized agent or Solicitor. Such agent or Solicitor must be authorized in writing. The following may be regarded as essentials of a valid notice to quit:

The name of the landlord or his agent
The name of the tenant
The nature of the tenancy.
The date the tenant should quit and deliver up possession. This may be an exact date or some ascertainable date from the date of service of the notice. It should be noted that it is the date of service and not the date on the notice that is material. Thus, the statutory length of the notice must be complete between service and the expected date of expiry. Also, where the situation requires a month’s notice, it must be one calendar month and if it is a yearly tenancy, it must be six calendar months and no less.

A lot of Nigerians have misconceptions about some of the principles and laws regarding tenancy law. Having received quite a number of emails over some of these areas of tenancy law, this topic will in no small way help shed light on questions regarding tenancy laws and practice which a number of readers might have. Here are five misconceptions about Tenancy Law in Nigeria;


1. Notice to Quit is to be served after rent has expired
The first misconception many tenants have, is that a Notice to Quit should be served after the expiration of the tenancy, thus allowing them appropriate notice to vacate the premises. Most who may have received a Notice to Quit during the term of the tenancy are thus surprised and often wonder if this is the right practice.

The Court in Akpokiniovo v. Air Liquide Nigeria Plc. (2012) LPELR-9582(CA) held that -

“In order to be effective a notice to quit should terminate the tenancy at the end of the current term of the tenancy. Thus any notice given and due to end at the middle of the term of the tenancy will be invalid.”


The above decision in essence means that a Notice to Quit can be served at any time, the only condition stipulated by the law is that the length of notice must terminate at the expiry of the tenancy and not a even day before. Therefore, a Notice to Quit served within the duration of tenancy but stated to expire after the date the tenancy is proper and in line with the provisions of the law.
2. Tenant is not supposed to pay rent during the period within Notice
Another misconception is that a tenant is not meant to pay rent within the period of Notice given to handover possession of the property. This is not true but is generally believed to be true by many. A property owner is entitled to collect rent when due for the occupation of his premises and this right is also recognized by the courts.
3. Landlord can recover possession by self help
Many Landlords or property owners often result to self-help in evicting tenants which is a wrong procedure as a Landlord may be liable to the tenant for payment of damages. Even where a tenancy has come to an end, the landlord is not entitled to go out into the premises and physically throw out the tenant but must give the statutory notice required to the person in possession. Neither can such landlord try to frustrate the tenant out the premises by actions such a removing the roof, disconnecting water and power supply e.t.c.

4. It is the Sheriff’s Department of the High Court that decides tenancy issues.
The Sheriff’s department is not a court of law and therefore cannot adjudicate over legal matters. They are however empowered to carry out and institute court orders.


5. A Notice to Quit can be back dated
Many tenants have often complained of being served a backdated Notice to Quit by their landlords or agents. It should be noted that a Notice to Quit cannot be backdated and it begins to count on the date the tenant was served.

All tenants and landlords must note to always get professional advice from a lawyer as it concerns their tenancy agreements.

Furthermore, it is quite possible to give some exact reversal points (bigbasho can attest to this) once in a while. People with coinciding double trading systems have a better chance of doing this. Yes.

The sis months is just a allowance to let the tenant find a house that attunes to his schedule of work, convenience and other factors that made him select that house in the first place. That duration enables a PAYING tenant have a smooth transition. An owing tenant loses that right and becomes what is known as a Tenant-At-Will.

One cool thing about the bible is that these are actually stories and verification can always be made by manuscripts (canon and non canon) written around the same time to balance and sometimes detect possible errors like the one below.

And 6

2Ch 36:9 Jehoiachin was eight years old when he began to reign; and he reigned three months and ten days in Jerusalem: and he did that which was evil in the sight of Jehovah.

2Ki 24:8 Jehoiachin was eighteen years old when he began to reign; and he reigned in Jerusalem three months: and his mother's name was Nehushta the daughter of Elnathan of Jerusalem.
2Ki 24:15 And he carried away Jehoiachin to Babylon; and the king's mother, and the king's wives, and his officers, and the chief men of the land, carried he into captivity from Jerusalem to Babylon.

Obviously there was an error in Chronicles with the age being eight instead of eighteen in Kings. He is said to have wives and since precedence does not show israelite kings inheriting the prvious king's wives it would be out of place for a eight year old kid to have wives. Also what kind of grevious sin could an eight year old kid have done for God to totally reject him

Jer 22:24 As I live, saith Jehovah, though Coniah the son of Jehoiakim king of Judah were the signet upon my right hand, yet would I pluck thee thence

In attempting to reconcile these two passages, it must be supposed either that, though he had set out on the seventh, he did not arrive in Jerusalem till the tenth, or that he did not put his orders in execution till that day.

But in 2Ki_25:8, it is said "the seventh day." Nebuzara-dan started from Riblah on the "seventh" day and arrived in Jerusalem on the "tenth" day. Seeming discrepancies, when cleared up, confirm the genuineness of Scripture; for they show there was no collusion between the writers; as in all God's works there is latent harmony under outward varieties.

2Ki 8:16 And in the fifth year of Joram the son of Ahab king of Israel, Jehoshaphat being then king of Judah, Jehoram the son of Jehoshaphat king of Judah began to reign.
2Ki 8:17 Thirty and two years old was he when he began to reign; and he reigned eight years in Jerusalem.
2Ki 8:24 And Joram slept with his fathers, and was buried with his fathers in the city of David; and Ahaziah his son reigned in his stead.

2Ki 8:26 Two and twenty years old was Ahaziah when he began to reign; and he reigned one year in Jerusalem. And his mother's name was Athaliah the daughter of Omri king of Israel.
2Ch 22:2 Forty and two years old was Ahaziah when he began to reign; and he reigned one year in Jerusalem: and his mother's name was Athaliah the daughter of Omri.

From verse 17 above it is evident that Joram father of Ahaziah was forty years when he died and his son could only have been twenty two years old when he took after his father's throne. The 2nd Chronicles part could only have been a wrong typo from the transcribers of the book of Chronicles as the son could not have been two years older than his own father. Pretty lousy I would say for historians of a whole kingdom.

Ans 28

2Sa 21:8 But the king took the two sons of Rizpah the daughter of Aiah, whom she bare unto Saul, Armoni and Mephibosheth; and the five sons of Michal the daughter of Saul, whom she bare to Adriel the son of Barzillai the Meholathite

I would say at this point the original compiler of this writeup is indeed trickish as he/she intentionally left out the ending part of the second verse. Michal had a husband named Adriel with whom she had at least five sons. When she married David afterwards she never had an issue for him. So the sons being used as ransom here were her children from a previous marriage thus she was not barren.

Taking the example OLAADEGBU wrote above about the four gospels, if there was a ploy at fraud , the four books would have been reforged to not make contradictions happen but what we actually see is the report of an incident many years after the event recollected by different witnesses. An authentic manuscript is expected to have these contradictions but on a good look at at harmonizing all four, the point can be gotten and even all four would be seen as true.
