The court upturned the judgement of a Lagos High Court.
The Court of Appeal in Lagos has discharged and acquitted Hamza Al-Mustapha from the murder of Kudirat Abiola.
The judgment overturns that of the Lagos High Court which sentenced him to death by hanging.
The presiding judge accused the lower court of being “stroked to secure a conviction by all means.”
Mr. Al-Mustapha was a former chief security officer to the late dictator, Sani Abacha.
He was sentenced to death on January 30 for conspiracy and murder of Mrs. Abiola.
Mrs. Abiola, 45, was shot in Lagos on June 4, 1996, as the lower court ruled, on the orders of Mr. Al-Mustapha.

According to AFP twenty nine students have been killed in an attack on a boarding school in northeastern Nigeria. The attack took place in a school in Yobe state. A confirmed report has it that a teacher was killed as well. Nobody has claimed responsibility. |

It is quite interesting seeing the handiwork of an African and in particular a Nigerian on spotlight. As can be seen in this picture of United States First Lady, Michelle Obama. While on a tour of Africa, United States first lady Michelle Obama wore a shirt by Nigerian designer Maki Oh.
The stylish first lady wore the Adire Tally shirt to a MTV Base Meets African Youth event while she was in South Africa as part of her visit to the continent with her husband Barack Obama. She wore the hand-printed blouse with an a-line skirt, in green with bold prints.
The session saw the mother of two and former lawyer participating in a 'live hangout' called Connecting Continents: A Conversation with U.S First Lady Michelle Obama which saw her chatting to four young people from Africa.
The young Nigerian designer has made a splash since arriving on the fashion scene five years ago, but despite having dressed stars the likes of Solange Knowles and Leelee Sobieski, Obama is certainly the biggest name to have worn her threads.
According to Interview Magazine, Oh "hand-dyes all of her fabrics with natural indigo leaves and paints on prints with a cassava plant paste, a traditional Nigerian practice called adire". This is a result of the designer's environmental and cultural agenda.
Obama is known for wearing eye-catching garments from a range of designers, including a few upstarts who have had their career made by the first lady's fashion choices.
Maki Oh isn't the first African designer to dress Obama, as she has worn dresses by Tunisian born designer Azzedine Alaia to public appearances in the past.
