This woman is the only one that has put tribe aside in order to promote this government...She will have a great influence in this country, and comes out as a likeable and charismatic person. PMB should utilize her in diplomatic relations within the country. Maybe find someone else for minister of environment.

I think Faleke would not win the case with his current approach. He should get political and call in favours.

Faleke should convince the former pdp candidate and other parties to go to court not him in person. The argument tendered should be that since the constitution calls for substitution of candidate due to death before the election commences, the substitution done by inec was void as the election had commenced. The prayer should be that late Audu is made to be the candidate for the inconclusive polls.

Section 36 (1) of the Electoral Act states “If after the time for the delivery of nomination paper and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner or the Resident Electoral Commissioner shall, being satisfied of the fact of the death, countermand the poll in which the deceased candidate was to participate and the Commission shall appoint some other convenient date for the election within 14 days.”
The elections commenced and he can't be substituted legally.


When late audu wins, Faleke can now be sworn in as the deputy citing Section 181 which states that (1) If a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of the House of Assembly of the State;


I believe the supreme court will grant these arguments even if the lower courts fail to.

I didn't study law, but here's my take.

Faleke would not win the case with this approach. He should convince the former pdp candidate to go to court. The argument should be that since a letter was not forwarded to inec on the demise of And I, the election should have been concluded with audu as the candidate.


When audu wins, faleke can now be sworn in citing the death of a candidate elect clause.

At the rate this is going, we might be in for some serious wahala soon.
