Thanks. That is why I never agree with people on this forum who always tried to give a reason of a visa denial on the basis of a posted transcript.
The transcript is only one of many other factors that visa officers take into account to make a decision.
The transcript doesn't reveal if there is a red flag on the applicant's file nor a ban.

2. You need to leave the village a bit more. Several countries per year. International travel is cheap nowadays including accomodations.

In addition to that most of the presidents in third world countries end up by moving in western countries along with their families

And how do you know if she shares the same faith as you? She could be an atheist. Why do Christians always come up with bible verses even when there is no indication that the person they are talking to is a Christian?

You forget the first two years of Obamas presidency was democrats controlling both houses! Obama promised immigration reform with a possible pathway to citizenship for undocumenteds. It was passed in the senate, did not even make it to the floor in the house because the republicans took over at the end of year 2. Full immigration legislation was upended in priority by the affordable care act in his first 2 years.
Also, note that DACA was a compromise executive action after Obama was pressured by his base to fulfill his promise. He couldn't provide a pathway to citizenship because that would have been unconstitutional. Had to come from congress.
Mark my words, it will happen. Trump may only be a one term president. Chickens are beginning to come home to roost !

I highly doubt that her case will be referred to an immigration judge...

It will certainly be rejected for failure to file within one year of entering the United States, the law is very clear on that...

Whether an immigration attorney can exploit any loophole in the Asylum Law I won’t really know except she speaks to one...

Most immigration lawyers usually charge about $100 for an hour of consultation...

Op can afford to spend such amount to make inquiries regarding the possibility...

I always thought whenever an asylum case is rejected it get send to the judge automatically.

I am fully aware that she has 2 kids. It may not be easy, but it's not impossible. I know, I have personally witnessed it more than twice. In one case, the woman's kids were in their teens. She met a guy who wanted a family but did not want the stress of raising babies. Win win situation right? They are still happily married after 5 years. Word on the street then was that she will never find a man with that kind of baggage she had.

But all this may be in vain. He kids father is still around. I suspect they are still married so not an option at this point .

Yes, if only if she is detained by ICE & presented before an immigration judge for the commencement of a Deportation Proceeding...

The judge will ask if she has a fear for her life if the government decides to return her to Nigeria all she needs to do is say YES & then the immigration judge will give her an Asylum Application Form to file with the court.

Under this scenario the Immigration Judge will decide her fate during court proceedings rather than USCIS.

This is called Application for Asylum with an immigration Court under deportation proceeding.

What if she applied for refugee via normal process to be denied given that she has been in the States for more than 1 year. My understanding is that her case will be directed to an immigration judge. Can the judge grant op refugee status in the US?

Op options is limited right now.

Op has two options to regularize her stay:

A) Marriage:

It could be broken into two

i) Genuine Marriage

ii) Arrangee Marriage

We both know the pros & cons so no need to discuss that

A) Asylum

It could be broken into three

i) Asylum before an immigration court

ii) Withholding of removal

iii) Protection against the UN Convention of torture

These three will only come up if God forbid Op is apprehended & presented before an immigration Judge

Dangerous Advice:

i) Asking Op to return back to Nigeria without regularizing her stay.

So, can op still qualify for asylum in the US?

We were all suggesting marriage because that is the only available option based on a presumed attempt to stay and regularize her status. I am not proposing she pay for an arranged marriage. Far from it. I believe she can find true love quite easily here in the States . There are lots of people looking for love and companionship,it may just not be in her age bracket. Having said that, is marriage for love not a recent Western development? As far as I know, marriage as recently as the last century was mostly arranged. Each party expected clearly defined benefits going into the marriage. Thus, marriage is defined as a contract between two people. I wonder why the government frowns on marriage for immigration benefits? Perhaps it's wrong if it's solely for immigration benefits and if it's paid for, but if it's just one of the accompanying benefits, then so be it. This is what marriage in antiquity was all about. Both sides gaining some defined benefit .

I will do some research on this as I'm not conversant with the Canadian asylum system. However, I don't think it's a given that an illegal immigrant with kids can simply cross to border into Canada and be granted asylum. If the illegal immigrant is fleeing from abuse, it then begs the question as to why asylum hasn't been requested for in the US.

There could be a thousand reasons why she didn't request asylum in the US.
That is the reason why the refugee board holds hearing to weigh legitimacy of each case.
OP hasn't said much here with respect to her personal life. Therefore, we can just make assumptions as to why this or why that. But if she ever apply for refugee status in Canada, she will have to answer the question as to why she never made refugee claim in the US

The OP isn't a refugee. A lot of Africans have abused this ''refugee route'' by claiming to be refugees when they are not. This has ruined the chances of genuine refugees fleeing war torn countries. If the OP chooses to get married in the US for papers, she will most likely end up in an abusive relationship because whoever she is marrying will know he is doing her a massive favour. The best option is for her to save her earnings and return home. She says she has savings of $3000, that's almost N1 million and should be enough to tide her over for a few months whilst she gets settled in Nigeria.

Did she say she wasn't a refugee or you are assuming she isn't a refugee.
She hasn't been answering questions about the father of her kids. How do you know if he is the reason she had fled with the kids?
Don't you know that abused women can apply for refugee status in Canada?
Anyway, it is up to the refugee board in Canada to determine if op is a refugee

Before somebody can come openly don't U know she has tried all her possible best to change her status .

Some are advising to help as if they are mayor.

Some are even advising from their village.

She hasn't tried the Canadian route
I guess she is afraid to embrace the unknown
It isn't easy to leave a familiar territory for an unfamiliar one.
It may require a lot of courage. And once in Canada she will be asking herself why she had spent so much time in the US without papers.
"If I knew then what I know" has been a familiar tune of many people who had crossed from US to Canada.

OP, as I do understand the situation, the only option to fix your status in the US is via marriage.

On the other end, should you decide to move to Canada , you may end up becoming a Canadian resident through the following routes:

1- Refugee Status

2- If the refugee route fail, you can appeal the decision.

3- You can apply for Canadian residence through Humanitarian and compassionate ground any time even when waiting on your refugee application. The fact that you have 2 kids living with you will help in this process as the Canadian government will take into account the best interest of your kids. Been involved in the community such as a church helps as well.

4- If the appeal of your refugee application fails, you have one more chance via a process called "pre-removal risk assessment" . In the process you have a chance to explain to the Canadian government in writing why you think they shouldn't send you back to Nigeria. Once again, the Canadian government takes the best interest of the children very seriously. The fact you have 2 kids will increase your chances

5. You can get married.

On a different note, should you decide to cross into Canada, dont worry about your living arrangement in Canada given that you and the kids will be provided with free room and board by the Canadian government.

Single mother with 2 kids and 3k USD under her name. She wouldn't qualify under any program to move to another develop country, talk less have the funds. Furthermore, these countries share information and her over-stay in the U.S would definitely be known. If she leaves America, she'll most likely never step foot in another developed nation again .

Years ago I rented a room to a lady in her 70 who used to own 2 houses. Lost the first one through bankrupcy . Second one due to sickness and she couldn't pay .

False. ICE has arrested 37, 000 non criminals, a 145% increase from 2016. Trump has given ICE far greater power under his administration than Obama did. ICE has stopped prioritizing catching and deporting violent criminals over non criminals. It's now fair game for anyone. This is common knowledge. Furthermore, with the South Americans attempting to cross into the U.S, Trump has given border officers/soldiers permission to use lethal force if they have too to prevent them from entering. I suggest you do some research and stop passing out false information yourself. This administration is not one to play with when it comes to being illegal. I agree she should enter Canada during the summer, but will she have time ?
