Under the Proceeds of Crime Act (“POCA”) the Courts have wide ranging powers to confiscate assets. It allows the process of the Prosecution’s attempt at confiscation of assets.
If you are considered to have a ‘criminal lifestyle’, then any assets, expenditure, and any property given or received over the last 6 years is assumed to have been met or obtained with the proceeds of criminal conduct, unless you can prove the opposite. The burden of proof is upon you, not the Prosecution. This is known as a “reverse burden” and why it is important to have specialist solicitors. You need to be able to prove that your assets (such as your home and car) have not been funded by criminal conduct, such as fraud, tax evasion or even less ‘criminal’ offences such as environmental offences. If a ‘criminal lifestyle’ cannot be shown by the Prosecution, then the confiscation is limited to the amount you actually gained in a criminal case.
