Back to my question, should I abandon the visa renewal then since you opined that this true life story is not convincing. I need to be in the US soon to take care of business and some regulatory issues pertaining to my business. I have never stayed in the US for more than 14 days and do not intend to live there.
You can put in your application and be mindful not to misrepresent material fact!

Thanks for your candid opinion. I am not aware and did not think it necessary that I should report officially to the US Dept of State. I am not a lawyer. I just wanted to forget about her and move on as well. I wonder what will be the objective of reporting to the US Dept of State when I cannot take custody of the children. I have had a bad year too traumatic to complicate my life further and for the sake of the children I ignored many things.
sad

Dear Visa Officer. I have a B1B2 Visa which expired in February 2016. Its my 3rd 2 years B1B2.

I did not want to renew it for the following reason. My wife went to the US for summer vacation in 2015 July (exactly 1 year ago) with 4 of our kids all below 10 years old. Though the marriage had been shaking for 3 years prior to her vacation. When it was time to come back she refused. I threatened divorce and to my greatest surprise, she accepted it. I later learnt she was having an affair. We got divorced shortly and surprisingly its already 1 year now I saw my kids and I am alone. I did not want to go to the US again in order to get off the trauma. Worse part is I learnt she is now married in the US and has moved on with my kids. 2 of the kids are American Citizens while the other 2 are Nigerian citizens.

I have a lucrative business in the USA and I pay my US taxes in the last 3 years. I have an ITIN (Individual Tax Identification Number) I have business Licenses too from the US authorities and I am actively running my office online and physically in the US.

My dilemma now is I have tried to get of my trauma and want to renew my US Visa (B1B2) through dropbox but when I got to a point in the DS160 form that asks if I do have family in the USA, I answered yes (trying to be honest) but now it further asks their status in the US. Now the truth is that I really do not know what kind of status my wife and 2 kids have. The options are Citizen, Greencard and I do not know. They left with B1B2 but it may be they changed status. The right answer is I really do not know. What is the appropriate answer to give here? The only circumstances that has changed in my application status since my last visa issuance are more money (income) grin and divorce cry. Will my divorce be a ground for denial particularly now that I do not have family ties to Nigeria? But I have a very good job with a fat Salary and a business empire in Nigeria which I cannot leave. I need to get to the US ASAP to sort out some Federal issues with some Government agencies as it relates to my business and there should be no room for denial at this stage.
Being frank with you, story doesn't sound convincing. Why did you not write officially to the U.S. Dept of State when your wife absconded with your kids to the States?

OmoBendel24:
@TzeTzeFly, greetings. That which seyewest is yet hoarding, any lessons for us from your end?
It depends on the mistake made:

1. For men over 16 years old, if you made a mistake answering the question about GENDER OR PURPOSE OF TRAVEL, you need to fill out a new DS 160 form and print the new confirmation page.

2. For all applicants: if you made a mistake answering the question about biographical data such as: Passport Number, Names, Addresses, or Phone Numbers, you can correct the information yourself in the form.

If you cannot make the correction in the form, on the day of the interview you should inform the person receiving your documents about the mistake.

3. For all applicants: if you made a mistake answering the questions about your Family, Education, Travel, or any Security-related question, you must complete a new DS-160 form and print a new confirmation page.

ALSO

According to the information contained in the U.S. Dept of State bulletin:

Once an Applicant has submitted the DS 160 online application, the application cannot be accessed to make changes.

In order to make the required changes, a new DS 160 must be filled out and submitted so that a new bar code will be generated, which must be taken to the interview at the U.S. Consulate/Embassy as the case may be.

If the Applicant realizes that there are errors in the submitted information after being scheduled for an interview appointment, the Applicant should cancel the interview, fill out a new DS 160 and schedule a new interview appointment with a new confirmation sheet and barcode.

However, in case of a minor spelling error, the Applicant may attend the scheduled interview and inform the Consular Officer of the error without completing a new form.

Applicants should know that incorrect information on the DS 160 will impact the information printed on the visa and may result in the U.S. Consulate/Embassy requesting a new DS 160 before completing the visa interview.

While it is not possible to change information on a DS-160 after it has been submitted, there are two easy options for creating a new DS-160.

FIRST:
If it is within 30 days from when the original application was submitted, the first option is to log into the CEAC system and select “Retrieve an Application” using the application ID number. Next, you will be asked whether you want to go to the confirmation page or create a new application. Select create a new application, and the entire application will appear, except for travel plans to the U.S. Then, you will need to edit and update the information and submit again.

SECONDLY:
If you saved the DAT file from the original application, you can access and amend the information at any time from an already submitted application. Once the changes have been made, save and submit the new application.

For either option, if the original DS-160 was used to book the visa appointment or pay the MRV fee, the applicant MUST present at the interview the confirmation pages from the new AND original DS-160, as each submission creates a different barcode.

Thnks for ur response but I don't have any divorce papers it's not common here in the north all I have is her birth certificate
I am the mother
Just as @LadyG stated and in addition, it is not uncommon to see situations such as yourself. When filing your DS-160, in the column regarding marital status, select "separated".

And when going for your interview, go along with a consent letter from your spouse (Stating his express permission for you to travel with the child) as well as his identification document.

Do not forget to take the child's birth certificate along with you and letter from her/his school that the travel is known to the school authorities. It shows that there has been a prior responsibility from parent to child.

All these are necessary to stem child trafficking. Not any ones' fault

Hello Guys. Its been a while I came here:last time was when I filling DS160 form and scheduling appointment ,when lady Guinivere gave me a very insightful suggestion. I need inputs from all and anybody that's had experience in the case I am about to highlight. I applied to renew my visa,my wife and my sons visa last year october,I couldn't do drop box because the visa had expired more than 2yrs ago.I also want to state that the first time the visa was issued in 2010 we didn't make d trip. Now,fast forward to 2015 we applied and when we were with consular. The consular asked if visited the US before and we said No,she asked again and again. And we said no as we did not visit. This after all the regular questions and all.She went in a couple of times and finally came back asked us to wait that a senior officer would come to attend to us.I also want to point out again that on this said day we didn't go with expired Visa's and passports, just went with copies of the visa's. After about 3 hrs wait an officer emerged in a seperate cubicle and I was called into that cubicle while my wife and son stayed outside. Its was a male officer(as I later got to find out he was an investigator, but an American).I explained why I we cldn't use the visa the first time and why I choose to bring the copies instead of the originals. He took his notes and asked me to bring the unused visa's.I brought it back some weeks after and he observed the visa's and passports and returned them to me.After looking at the passports he now revealed to me that a group of people( two of them) used my company:obviously my company name was and in DS160 form then and in this current application. It own and run the company so technically I had to fill in my comapny name as my current and past employments. He said this guys got the visas and were not allowed to get into the US,he didn't tell me why.He then asked me to provide all the proofs that I own the company and any other documents that I might think would help or proove I own the company.I went back and came back In another couple of days gave him my CAC certicates,MoU,Tax clearance,Tin and Vat certificate, personal bank statements and company statements( even tho I didn't have much in them at the time). He took them and asked me to return in a weeks time.I went back in a weeks time and he brought a piece of paper that had the letter head sworn statement on it.He asked me to write what my company does and gave me two names and asked me write what I knew about them.I told him I didn't know them and he asked me to state so.I eventually found out later that the two guys were the two guys that used my company name to secure visa's.He told me afterwards! I wrote what my company does ( even tho this was in my DS160 form and I also verbally explained to to them) and I also wrote that I have never met known this individuals.Since them he told me that a decision would be taken by the consulars and that he is not a consular but the emabssies investigator:I later found out he was the regional cordinator of security for the united states envoy in Naija.I concern here is,how can I clear myself of this kind of wahala oo cos really I don't understand.Ever since my passports and that of my family is still with them and all the documents. The investigator told me the embassy would get back to me in a couple of days time, but this is 3weeks running now.In my head I am trying to figure out how this happened,I think back and I don't know if it was my agent cos I gave him my details to fill in my DS160 form back then in 2010 when I first applied, but I didn't hand him any of my documents.Again the Investigator personally told that it only looking very suspicious cos this individuals in question came and secured there visa's almost immediately I got mine visa, that is shortly after I got mine maybe after some months I got mine.He went ahead to tell me that it actually doesn't look good that people could use my comapny to commit this kind of fraud. He also decided to give heads up about what the consulars with decide:he told me it might be what I expect cos according to him they have some overwhelming info which only me can give to the applicants.Well that all ooo.Pls I need advice on what to do,I have not been contacted yet tho.But I am thinking maybe there is something else I need to do that I have not done and may be somebody out there might just have some clue of what to do next cos I can always walk into the embassy anytime to see the investigator if I so choose.
Sorry, I had to highlight the entire message so the questioner can know he is the one referred.

Just so you should know, the onus of proof rest solely on you. This case against you is a very serious allegation. I repeat, it is not something you would want to take with kid gloves.

And judging from what you stated above, you have not been able to prove your case or satisfy the investigator that you had no prior knowledge regarding the two(2) individuals who were able to access your company details in securing entry visas.

Be that as it may, you may be looking at a lengthy ban or worse case scenario, regarded as an accomplice to a crime (if these individuals were suspected to have been involved in identity theft in the past, or such related immigration crime previously). You see what I mean?

It is best you consult an immigration lawyer to advise you on the way forward, and not leave this very serious situation as it is (nonchalantly). Your reputation and that of your company is at stake!

This is the reason why it is always advised that people stay as far away as possible from using agents to fill out their U.S. visa application. Using these so called unverified agents, exposes their confidential information to fraudsters.

I sincerely hope you are innocent in all these.

Hello house,
I have a problem here. I need some suggestions on how to go about this. I want to go back for my second visa interview this march or first week april by grace of God. I changed school now from University of Houston, now to schiller international university, FL. I have my new I-20 but something came up. I am planning on going with my girlfriend but by 2017 i might marry her though but the problem is she is not a nigerian. She is rwandese whom i met during my time in china. I contacted the school and i told them i want an I-20 reprint because i want to add a dependent, although in my statement there i said she is my wife they have asked for a new bank letter, which i plan meeting my fathers account officer to get it and as well pay for express mail and reproduction fee. She has been to the US twice and still has a valid us visa i think, my first question is would it be okay to bring her to Us embassy in nigeria as she is not legally my wife/nigerian citizen/Nigerian resident? . Question 2: though it is my 2nd degree i want to go for my sponsor remains my father but my fear is my parents because i know they hate her because she is not 9ja, so i don't want to go to the embassy to mention my father as part of the person sponsoring including her but i have my own money that is enough to cover her expenses for as long as she is in the USA with me,is it possible for me to be her sponsor while my father is my own sponsor?. My fear is let her not make them dash me 214(b) because of her nationality. Because this time if i don't get it, i am heading to canada
You have been refused twice on reasons we do not have prior knowledge of.

And now you're already looking at a third refusal even before you apply.

REASON:

A student who is expected to take his studies as a priority, is asking to go on a US trip with a lady friend (not spouse).

I don't need to mention that she is not even qualified to visit the embassy with you (she is not resident in Nigeria)

Your additional discrepancy states that she already has a US valid visa. So why do you need to add her in your travel itinerary? embarassed

vo: what course?

me: okay, is that all?
vo: yes
Me: okay...and i left...no document was checked and no slip was given

So experienced guys in the house, can you tell me what to expect and what kind of review they will do, how long does it take...anyone with similar experience?...btw, a little bit of background I was refused a back to back application in 2013, i wanted to attend a conference. then i was only a year in germany. currently, i live in Munich, the same city as the embassy, and graduating in few months from one of the best university in germany. I was in uk recently, visa still valid...i have also been to other 6 EU countries
Your Administrative Process centers on:
What you do in Germany (Part Time)
Where you work in Germany (Part Time)
How you pay for your numerous expenses in Germany on a "Part Time Income"
How you fund your trips to these so mentioned EU countries undecided "Part Time"

And since you applied previously and refused, maybe some discrepancies needed to be clarified. Assuming you are clean through it all, you're good to get the entry visa

We intend spending 7 days of our honeymoon at an inn in New york city after our wedding sometime in April 2016. Wifey is a frequent traveler while am a first timer.

I choose others in my application entry since there is no space for fiancee.

hope this suffices.

What are your views ?
Why not wait till after your wedding before applying?

OR

Alternatively, apply alone and visit the States.

Assume if i were a CO, i would doubt it that you really are going for a honeymoon. And I would think that you only want to get this entry permit for an early arrival into NY.

Good morning everyone, Please how long does it take the french consulate in lagos to process tourist visas (on behalf of netherlands) ? Last time I applied it took over two weeks and I had to go collect my passport without the visa to enable me travel to uk. WHen i returned from UK I took my passport back to the embassy and got a text from them three days later asking me to come collect my passport. The visa was issued but didnt need it anymore at that point in time. I ended up using the visa to travel to spain and portugal two months after. Dont even know if that will be a problem
No problem at all!

The visa was issued to you and used as stipulated within the ambit of Schengen Laws right?

If so, just go apply again and expect a return of your passport in 15days or less.

Enjoy your evening!

I will like to knw our chances this time around ?
You had/have a good profile to get issued an entry visa, but at those times, barring any issues regarding misrepresentation on your part, must have come down to a lack of a solid tie (when you were in Nigeria, during your M.sc. Program in the UK and a sophomore at your job).

From what you state here, you seem to have a good financial turnover, travel experience and possibly a friend or family residing legally in Canada which fits a reasonable profile for issuance of a Canadian visa.

Try applying once more and I can assure you that if you know exactly what your mission to the States is going to be, you are eighty percent (80%) certain of being issued a visa save any past misrepresentation on your head.

Wish you the best this season!

Hello Fello Nairanders, Please I'm impressed with the great Knowledge being revealed here but a friend has a serious issue and he's very devastated, Please I need an Advice that I can pass down to him.

He applied for a group conference , 30 in number and all got the VISA including him. They asked him few questions and then congratulated him, took his passport , gave him a white paper and told him to pick it up in one week ( Lagos)

After four days, He was called by the consulate on phone to come back for another interview..( He told the caller sorry he has bought he's flight ticket already ) when He got back to the embassy, they told him , they noticed he has two International Passports

1. Ghanaian Passport with Darko Issac

2. Nigerian Passport with Uche Isaac Agu

and they asked him what's up with that, as they waited for him to explain, they issued him a Blue paper and told him he has been refused.

The truth is he has previously applied for a US Visa a year ago in Ghana with he's Ghanaian passport which he was refused a Visa. Now he came to Nigeria and applied with a Nigerian Passport.. ( He has both nationality as mother is a Ghanaian and father Nigerian).

He also told me, he did not mention about the Ghana passport in the Visa app. Form.

1. Now please what Can he do to clarify this and re- apply again??

2. What are the chances of him getting the Visa Again??

3. How can he prove to the Embassy ? Note: all information in the Data page where the same both date of birth etc.

Please I will appreciate your advice as he is due to apply for the same conference in 2 months.

Many thanks
He need not bother re-applying as he just got seriously banned. What he did howbeit ignorantly or otherwise, is called misrepresentation and he signed that Ds-160 accepting whatever consequences/outcome of his application.

He should have just mentioned his dual nationality saving himself from his present predicament. However, he can also request to know his status from the consulate or embassy as the case may be.

All the best!

2. ds-160 print out
3. passports
4. letter of employment
5. leave approval letter
6. court affidavit ( letter of consent from both parent)
7. bank statement.
8. pay slip
9. our introduction pictures because am choosing COMMON LAW MARRIAGE
10.hotel reservation print out for the duration of 10days

Please kindly advice. Thanks

@ LagosNIV
It is always advisable to apply for a visa ahead of your travel dates. It gives you ample time to prepare.

You need to make a convincing claim as to why a visa should be issued to you. The process has litttle to do with documents presented.

The document(s) only helps to sway in your favour if there is a need to be extra certain about your claims.

If i may ask, what is she travelling for?
All you need to show as evidence of your connection, is either of or all of these:
1.Your birth certificate with her name indicated as your mother.
2. Pictures of the family in the past showing every one or just you and her.
3. If you pay her little stipends weekly or monthly, asterik this on her bank statement and write a little note stapled to this document as a proof.
4. Any other thing you feel can connect two of you is acceptable to this application.

You can also support her by adding your financial documents to her applications since she is your mother.
And being a retiree, your assistant helps her to show that there is a tie to Nigeria.
Hope she has previous travel experience?
Attach evidence to her application to show relationship between you two.
All the best!

Please my mum wants to apply schengen visa through France but she is a retired civil servant.what document will she present in lieu of employment and leave letter. Also, when does the date start to count, is it from the issue date of the visa or the date you enter a schengen state.
Your prompt response is highly appreciated.

Her retirement letter is sufficient.
Is France her first point of entry into the Schengen region?
She will be issued visa according to the number of days she intends to spend in the territory or given a three months visa. The number of days she will reside depends on the immigration officer at the point of entry. Get the visa first.

@Omooloriredade Many thanks in taking out time to detail these intent, but fortunately my intents are not in the above mentioned. My intent to travel is tourism and so I know I do not qualify for an expedited appointment, which brings me back to my question: Do I retrieve form ds-160 and fill in my new intended travel date, this will surely generate a new DS 160 confirmation number?

What if u get married to a citizen before the expiration of your visit?
It is possible to get married to a U.S. citizen before an expiration of your visit but in such a situation, USCIS has high suspicions of a sham marriage (a marriage solely to get a GC) , so as an applicant you must be very careful.

You should wait about 60 days to get married after entering on your B1/B2 visa and you should avoid showing that you had a preconceived intent to get married before you entered the U.S. on a visitor visa.

How you prove that fact, is solely your responsibility.
