But if you have been following their bulletin, you would see that they advice visa seekers to make their applications early enough to allow them plenty of time to access and process their applications: the 14 working days is for those with straight-forward and easy-to-access applications, some could even take lesser days. I'm only suggesting my opinions to prepare your heart for a likely scenario, i really do hope my opinions do not come true. dancewith: This is the correct advice. If you are refused, it won't be because the time you proposed to use the visa has lapsed. Afterall they issue it for 6months minimum
Best of luck If a Visa Officer observe that the purpose of a visa application has expired, or has become invalid, or that there is a change of circumstance whether it is due to their delay or it is due to the applicant's pace, the Visa Officer would have no choice but to refuse the application; this is a protocol: in no circumstance would a visa be issued once the original purpose of the application has become invalid even though the visa would be valid for 6 months |

Unfortunately, this sort of thing does happen, and as harsh is this may sound, your visa application is highly likely to be refused for reason of "Change Of Circumstance", and the explanation would be that the visa sought is for a given period which has likely become invalid as your circumstances have changed. Next time, it is advisable to apply about 3 months prior to your intended use of the visa. |

First of, you know I told you ealier on here on my post that I have two waec results. The first waec result is having an error with just a letter word with my middle name and the second result is having the date of birth error. So I am heading to the waec office tomorrow to get the certificate of the first waec result, the one wth the name error, then I will also complain to them about the second waec result wth the date of birth error. The greatest fear I'm having now is dt I don't know how long it would take the waec officials to rectify the error on the result because some people say it takes 3-6 months to amend the error. Well, given that you're due to make your visa application, you do not have enough time to worry about how long it would take the WAEC officials to rectify the information; what matters now is the efforts that you have made to rectify the discrepancies. Meet the WAEC official and request for the corrections, also, request that they write a letter to this effect: TO WHOM IT MAY CONCERN [i]This letter serves to confirm that **** ****** ******* has brought the data errors in his WAEC certificates to our attention, and we have observed the following (two) errors. 1) His middle name was wrongly spelt as OSAYAMEH as supposed to OSAYAMEN 2) The month of birth was wrongly entered as JANUARY as supposed to MAY; ie 23/05/1991. We would like to use this opportunity to apologise for any inconveniences that this may have caused and we are making efforts to rectify and update his WAEC documents. Should you need further assistance, please contact us on: 01888888888[/I] With this kind of declaration, you won't need to go for the Affidavit: Ensure that the letter is written in a WAEC official letter-head paper, (Trust Nigerians, you might have to pay some unofficial fee for this  ). It was just an error by the man who registered me for the waec exam. He mistakenly made the error. Maybe my handwriting was too tiny so he couldn't see it clearly then he wrote something else when filling my waec registration form for the exam. Actually, my Birth certificate was issued by the federal republic of Nigeria national population commission. It has the stamp and signature on it by the issuer of the birth certificate. The Date of birth on my passport corresponds and matches with the date of birth on my international passport. All my documents bear the same date of birth of my international passport and my birth certificate. They bear 23 of may 1991. Which is correct. My Transcripts of result bears the same date of birth correctly with my international passport and birth certificate, my school leaving certificate testimonial also corresponds correctly too. But it is only the waec result which I told you about bears it wrongly with all my documents. My waec result is stating it wrongly as 23 of january 1991 which is wrong. With the comprehensive analysis that you have made, i think you won't have much of a problem in rectifying this discrepancies. But first of all, what effort have you made to rectify this issue prior to this present visa application situation? If you haven't yet made any attempt to correct it, you may have to answer why to the visa officer, and i'm afraid it is enough reason to refuse your application (that is, if you applied for the visa in your current circumstance). You need to at least, make documented effort to have the date corrected, and then, apply for your visa. But if the correction seems to be taking too much time to come through, then you can go for affidavit to support your efforts. Applying for a visa with DOB discrepancies is serious enough to result in visa refusal. |

Before i can really give you an answer, i'd like to know these: *What nature of Birth Certificate do you have? *Does the DOB in your passport match the DOB in your birth certificate? *Is there any other document that bears your DOB? *If so, what document(s) and what DOB do they bear? |

Mr. Swagger, observing the nature of the error, and expecting that every other document that you are presenting to support your application bears the correct version of your middle name, and considering that it is just the last letter of the name that has this issue, you should have not much of a problem to worry about. However, if you are concerned that the spelling might raise an issue, then, (like Justwise had recommended,) i'll suggest you go for affidavit. But if i were you, i won't be bothered by that, i'd go to the part of the application form that says: "Do you have any other information to give to support your application" and tick "YES" and then fill this note in: "Though, i have requested the WAEC authority to correct the error, but i wish to declare that the H that is misplaced for the N in my middle-name was an error on the side of the WAEC officials: the correct spelling is OSAYAMEN as my other documents suggest; therefore, i expect the letter error would be overlooked".
If the ECO deems that you merit an Entry Clearance, s/he is not going to refuse you the visa for reason of that single letter error, but if s/he has other reasons to refuse you the visa, then that's when other unnecessary reasons (like a coma instead of a full-stop) would be mentioned. |

First of all, under the Data Protection Acts, no "family member" has the privilege to demand or request for any information belonging to another person, how much more to request that a Date Of Birth belonging to another Passport holder in a West African computer database be altered. During the passport creating process, you had consciously provided the Passport Officer with every information required, and you were given the opportunity to verify that the information entered into their computer was correct, and you had confirmed their accuracy and have therefore given the Passport Officer the permission to proceed and create the Passport. Now, you have realised that you entered a wrong Date Of Birth (a familiar story with Nigerians); Now, if the E-Passport truly represent what they say it is, ECOWAS Identification Passport, then, i'm afraid changing anything genuinely and legitimately would be impossible: or, maybe you can put your thumb or the palm of your hand on Sulphuric Acid solution to melt away their original lines so that you can apply for a new passport with a born-again finger/thumb prints  . How about that? |

If you have red carefully what I wrote you should have realized that I was talking about the importance of “gut feeling” when people have to make major decision in life including immigration and visa issues. It is not always about what the experts think or say. A person can try something unheard of, based on their gut feeling, to achieve his/her goal and it works. And this is irrespective of the person location; Be it Nigeria or abroad.
Poster has an ordeal and came to this forum for help. We are all here to try to help and each person according to his little experience. At the end of the day, it is up to poster to pick what she thinks is best for her. So, am I not a member of the forum to write on this thread? Do I have to live in Nigeria or to be a Nigerian to contribute to this post? Why those constant and unnecessary critics on my posts?
Earlier on, you had slammed me with a critic; I quote what you wrote “I still don't see how this matter is connected with religion” Did you really have to criticize me for that? If you had red carefully the poster original message, you should have seen where the religious aspect came about. But, your urge to fish something negative in my post had made you overlooked what OP wrote.
If we were on the same workforce, I would have accused you of bullysm. But, thanks God that we aren’t. A work bully always sees himself as a take-charge guy and his need for control can make him incredibly overbearing.
I am on Nairaland because of the high regard I have for Nigerians. I can narrate on many pages about the positive experiences I had with Jamaicans and Nigerians in North America. From the time I was a new student in the US to the North American workforce. They are great people who would go out their way to help a fellow black man.
Just one of many examples: During a soccer game when I was a new student in the States, some players from the opposite team were trying to fight me. Out of nowhere this black guy, Nigerian, came to my rescue and started to threaten the people who were attacking me. He was screaming at me “Don’t be afraid of them, they can’t do anything to you; I am an African just like you”. What an experience I will never forget! I have had similar experience with Jamaicans. Adding to that, I have seen Nigerians hosting No-Nigerians strangers into their home and even providing them with pocket money.
You indicate that Nigerians can testify of more extreme cases than the one I narrated. Again, I don’t see the point of this remark. Did I mention that my experience was the most extreme case to narrate? Are we into a contest to see which nationality can narrate the most extreme cases of immigration?
I was facing prison, fine and permanent bar from the United States. Is there anything more extreme than that in the West? Maybe this remark was another subtle way of telling me “We are Nigerians and we have seen it all. You are not a Nigerian, so there is nothing you can tell us.”
Anyway, for the respect of all my Nigerians friends and acquaintances, for the respect of Nairaland, and for the sake of my own sanity, I won’t even attempt to engage into any further unnecessary debate with you. I am here on Nairaland to laugh, relax and feel home. Something similar had happened to me in the United States. I submitted a bogus refugee claim along with my fingerprints. This bogus refugee claim was still pending when I decided to move to Canada. (I had my permanent residence status in Canada through my family).
However, I didn’t want to leave the United States with the full knowledge that the US immigration had my fingerprints on a bogus refugee claim. I knew full well this would definitely come back to bite me at a most unexpected moment. Therefore, I wanted to correct my wrongdoing with the Americans before moving to Canada.
The only way to withdraw my bogus refugee claim was to tell the truth to a United States immigration judge. However, all the lawyers I met strongly discouraged me from doing that and advised me to leave the matter as it was. Because, by law, making false refugee claim in the United States is a criminal offense that would result in fine, prison and permanent bar from receiving any future immigration benefit. I was in deep water.
Nevertheless, I had this strange feeling that I had to come clean regardless of the outcome. I couldn’t be at peace with myself if this matter wasn’t resolved after leaving for Canada. Against all odds and hope, I follow my gut feeling. I went on and told the truth to the United States immigration judge who was assigned my case. To my surprise, after confessing the truth to the judge, the entire episode took a very strange path. (See details in my next post)
My conclusion for this matter is that a forum like Nairaland is a great place to gather useful information in regard to immigration and Visa issues. But, above all, people should not underestimate their gut feeling. Each one of us is a unique individual on the planet, with a very unique destiny, a unique story, a unique chance … what may work out for everyone may never work out for you. Conversely, what may work out for you, may never work out for anyone else. There is only one “you” on the planet.
Just as the say goes, he who follows the crowd will never go further than the crowd. But, he who walks alone may probably end up in a place where no man had ever been before.
To be continued Honestly, i don't see how this case that you explained can be compared to the one (of the OP) of this thread. First of all, you should realise that you were already in the United States and therefore, entitled to their legal system or Justice-Tempering there. Also, know that you are not the only one to have passed through such situation, there are lots and lots of people who sought asylum in Europe with false nationalities, and yet, got their documents converted to Nigerian citizenship: Trust me, more asylum seekers from Nigeria can testify of more extreme cases than the one you narrated. Now, it is very important to know that in many cases, countries like the USA or EU states find complications in getting rid of asylum seekers especially when deportation seems to be a hard task, in such cases, they would rather overlook or pardon all negative odds and grant them the Leave to Remain or Residence Permit; and even if they know that the asylum seekers do not merit the benefit, they can even grant them the Leave to Remain on humanitarian grounds. So, my friend, you case is totally different from the case of a visa applicant who is still in Nigeria, you can't use a solicitor to challenge a visa refusal decision, you just have no ground. |
