A prosecution witness in the ongoing trial of Patrick Akpobolokemi, a former Director-General of the Nigerian Maritime Administration and Safety Agency (NIMASA) and others Thursday told a federal court that one of the defendants bought a land in Lekki, Lagos, at N70 million. Eboigbe Etiosa, an estate valuer and agent, said Ezekiel Agaba, a former director at NIMASA, paid for the land in two installments of N40 million and N30 million. Messrs Agaba, Akpobolokemi, Ekene Nwakuche, Governor Juan, Blockz and Stonz Limited and Al-Kenzo Logistics Limited are facing trial for allegedly diverting N2.6 billion, a fund meant for the implementation of International Ship and Port Security code at NIMASA. The ISPS Code enables NIMASA to carry out security checks on vessels entering into the country. The EFCC arraigned the defendants on a 22-count of advanced fee fraud and money laundering before Justice Ibrahim Buba of the Federal High Court, Lagos, on December 4, last year. Mr. Etiosa was the prosecution’s 11th witness. Led in evidence by Rotimi Oyedepo, the EFCC prosecutor, he said a friend introduced him to Mr. Agaba, former Execituve Director, Maritime Safety and Shipping Development at NIMASA. The witness said he sold a piece of land to Mr. Agaba at Northern Foreshore Estate, Lekki for N70 million, adding that he received the payment in installments – N40 million on January 15, 2014, and N30 million five days later. Mr. Etiosa said the monies were paid into his Zenith Bank account. “On January 15, 2014, I received N40m from Ace Prosthesis Limited,” he said. “On January 20, 2014, I received the balance of N30m from Aker Integrated Services Limited. “Actually, I do not know these two companies. After negotiation of price by the parties, I forwarded my account number to Capt. Agaba and my account was credited. And it was the money that I used to purchase the property.” The witness said the N70 million was for the purchase of a land by the NIMASA director, and not for a contract he executed for the agency. Earlier, a prosecution witness, Rita Ifeadi, told the court how NIMASA staff operated bank accounts with different names. Mrs. Ifeadi, the branch manager of Zenith Bank, Bar Beach, said Messrs Juan and Nwakuche operated an account for Aruward Consulting Services opened in the names of Philip Enuesike and Ima Udo. Mrs. Ifeadi said a bank account could be operated by an individual other than the person who appears on the bank forms. “In KYC (Know Your Customer), if you know the people coming to pick the money, you can confirm it,” Mrs. Ifeadi said during cross examination. “For some of those accounts, I knew who was coming to pick up the money, so I counter-signed the counter-cheques. Once I counter-signed, the teller could go ahead and pay.” The witness said since she “personally marketed” the accounts for NIMASA, she knew who was coming to withdraw money from the various accounts. She also said an exception was made in the case of Messrs Juan and Nwakuche because the account opening forms were incomplete – the spaces meant for referees, for instance, were blank. “It’s a failing on the bank’s part not to regularise the forms,” Mrs. Ifeadi said. “Such errors do occur. United Nations Information Centre in Nigeria has said women have a poorer representation in President Muhammadu Buhari-led government than in past administrations.
UNIC Lagos Director, Mr. Ronald Kayanja said this yesterday at the United Nations International Women’s Day celebration, organised by a coalition of non-governmental organisations in Lagos. He attributed the situation to huge funding required for election campaign and traditional perception of women, saying economic and gender-based violence also increased the risk of young women contracting Human immunodeficiency virus (HIV).
He said, “In Nigeria today, women represent 58 per cent of all the people living with HIV. The power inequalities that underline gender-based violence, including physical, sexual, psychological and economic violence, expose young women to HIV. “I hasten to add that even though women are disproportionately affected by the HIV epidemic, more men than women die of AIDS every year in Nigeria. “Of particular concern to the UN is the political will to implement the Nigeria National Gender Policy, which commits to affirmative action and requires that women fill 35 per cent of appointed positions. “Regrettably, we are far from the target presently. THE Nigerian Army Unit Commander stationed at Ovre-Eku community, Ethiope East Local Government Area, Delta State, Lt. E. D. Oworobo, has told a police source that the reason he ordered his men to flog the women who had embarked on a peaceful protest over a disputed land claimed by PRESCO Oil Company, was because they attempted to disarm his men.
Oworobo and his men of the 4th Brigade Command, Benin-City, Edo State, had last Wednesday, flogged and kicked hundreds of women protesting at Ovre-Eku (Iwevbo) community over a land which had been in dispute for years between Edo and Delta states. The source who spoke on condition of anonymity, said that Oworobo had contacted the District Officer, DO, of Eku Police station, Mr. Andrew Efejedia, in an attempt to exonerate himself and his men of any wrong doing in the incident, where he claimed that he had no option than to order his men to use minimal force to disperse the protesters who had tried to disarm his men. According to the source, Oworobo had asked the DO, “Don’t you know it is a crime to carry a charm according to the Criminal Code of Nigeria?”
Meanwhile, Lt. Oworobo has also threatened to deal with the Warri correspondents of The Authority and The Nation newspapers, Theophilus Onojeghen and Bolaji Ogundele, both of whom had contacted him to know what actually transpired between his men and the protesting women. The offence of the journalists was their temerity to contact him for the military’s side of the incident. In separate reactions to the journalists, an angry Lt Oworobo had described them as idiots and madmen, allegedly saying: “You’re an idiot. You’re a mad man. Why are you calling me? So I should report to you abi? Who are you to call me? A Nigerian national who claimed he swallowed capsules containing "precious stones" escaped the gallows today, for drug trafficking but was jailed and ordered to be whipped for possession of drugs. A Court of Appeal three-man panel led by Justice Datuk Tengku Maimun Tuan Mat sentenced Abuchi Ngwoke, 31, to 20 years jail and 10 strokes of whipping after convicting him for possession of 251.66 grammes of methamphetamine. The court unanimously allowed Ngwoke's appeal to set aside a Melaka High Court's decision to convict and sentence him to death for trafficking in the drugs at the Melaka General Hospital between 5am on May 23, 2012 and 2.50pm on May 25, 2012. Tengku Maimun said the court found there were merits on the issue raised by Ngwoke's counsel, Hisyam Teh Poh Teik relating to the chemist's evidence. The panel which also included Court of Appeal judge Datuk Ahmadi Asnawi and High Court judge Datuk Kamardin Hashim ordered Ngwoke to serve his jail sentence from the date of his arrest on May 23, 2012. According to the facts of the case, Ngwoke was arrested by the police after he was found breaking into Batik Selat House MITC in Melaka and drank a bottle of ink. He was brought to the General Hospital where 27 capsules allegedly containing methamphetamine were removed from his stomach. In his defence, Ngwoke claimed that he swallowed "precious stones" which were wrapped, with soup after a man named Chibike told him that it contained precious stone gold dust which was used in jewellery-making in Malaysia. He claimed he was drunk when he followed Chibike's instructions to swallow the capsules which he believed contained precious stones, before leaving for Malaysia. In the appeal today, Teh submitted there were infirmities in the chemist's evidence with regard to her analysis of the drugs because there was no evidence she had read her written statement on her analysis in open court under oath. He also argued that Rozieyati Abdullah's written statement was inadmissible because there was no notation that she had identified her written statement and also no record that her statement was marked by the court. He also said the High Court judge erred when he descended into the arena of conflict and crossed-examined Ngwoke relating to the issue of his consciousness which was prejudicial to his client. Deputy Public Prosecutor Nurshafini Mustafha said there were no infirmities in the chemist evidence, adding that her evidence on the analysis of the drugs was sufficient. She also said the judge had asked Ngwoke questions for purpose of clarification relating to his consciousness when he reached the KL International Airport (KLIA) from Lagos, Nigeria and to Melaka. A 27-year-old man, Mfon Obot Essien, was Wednesday sentenced to and half years imprisonment for tricking an American family to pay $3,000 for a fake kidnap of their daughter. Essien, from Akwa Ibom State and goes by the pseudonyms: David Morris and Femi James, was arrested in 2013 following a petition written to the Economic and Financial Crimes Commission, EFCC by the United States (US) Department of Homeland Security. They had written the petition, urging the Commission to investigate a criminal organization involved in drug smuggling, money laundering and fraud.
According to the petition, “A US family whose daughter travelled to Argentina got a call from her boyfriend claiming that they had both been kidnapped. “The kidnappers demanded a ransom of $7,000, which should be sent through money transfer to their associates in Nigeria with the details “David Morris, 302, Apapa Expressway, Ikeja, Lagos, Nigeria 23401. “Investigation in the US however revealed that the girl was not kidnapped but was under arrest in Argentina for attempting to smuggle cocaine out of that country after being cajoled to do so by her boyfriend of Nigerian descent. “The US authorities then contacted MoneyGram to issue a false money order for $3,000, as against the $7,000 demanded, to enable the arrest of Morris whenever he showed up to receive the money in Lagos,” the petition had divulged.
Following this, Essien’s attempt to withdraw the $3,000 on August 2, 2013 at Chevron Lekki Drive branch of Access Bank failed. He reportedly tried the following day at the Ikota Branch of the bank and then returned again on August 5, not knowing that a query had been lodged concerning his transaction. In his next attempt on September 5, 2013 at the same branch, he was arrested. Essien was unaware that a trap had been set. Operatives of the EFCC burgled him up when he identified himself as David Morris and asked for his $3,000. Following his arrest, items recovered from him included a forged drivers’ license with No. KSF08417AA2 bearing the name: ‘James Femi’ but with Essien’s picture.
According to reports, EFCC investigation also showed that on July 28, 2013, Essien fraudulently received N237, 537.68 from another American, one Mark Mentor, using a forged drivers’ license with No. FFF14411AB6 bearing the name: David Morris but with Essien’s picture as well. He was found to have represented himself to Mentor as David Morris. Subsequently, Essien had also received, on different occasions, $460 and $900 from another US Citizen, Dylan Johnson, through MoneyGram. During his arraignment in 2013, Essien pleaded not guilty to the charges, but when trial began, he asked to change his plea and was re-arraigned. The EFCC Prosecuting Counsel, Mrs Zainab Ettu, in her address on December 9, 2015, had reportedly told the court that investigations by the Commission showed that Essien belonged to “a syndicate of fraudsters.
“These fraudsters use different machinations to fraudulently obtain money from unsuspecting and vulnerable victims,” Ettu had said, noting that the offences contravened sections 8(a)(b) (c), 1(3) of the Advanced Fee Fraud and Other Related Offences Act No. 14 of 2006 and sections 409 and 363 the Criminal Law of Lagos State, 2011 and urged the court to convict him. However, at his arraignment yesterday at a High Court in Igbosere, after he pleaded guilty to a six-count charge of conspiracy, obtaining money by false pretence and forgery, Essien bagged a total of 28-year jail term. The Chief Judge, Justice Ralikat Adebiyi sentenced Essien to a minimum of seven years each on the first three counts, and one and a half year on count four. Nigerian Refugee Who Claimed To Be Gay Jailed For Raping Woman In IrelandA Nigerian asylum seeker who claimed to be gay but then raped a woman has been sentenced to serve five years in prison in the Republic of Ireland. Kenneth Udeh met the woman while she was on a night out and raped her after offering her a lift home. The rape stopped when a passer-by scared him away. Udeh with an address at Coffee House Lane, Waterford, but originally from Nigeria pleaded guilty on the day of his trial at the Central Criminal Court to the rape of the woman in Waterford City on September 14th, 2014. Mr Justice Patrick McCarthy noted the attack had a serious effect on the woman but also had to take into account that Udeh was a foreign national and had entered a guilty plea. He imposed a five year sentence which he backdated to reflect the time Udeh has spent in custody Judge McCarthy noted that the woman did not think Udeh should be allowed to remain in the country but said that was not a matter for the court to decide. Udeh came to Ireland in 2009 and had applied for and been refused asylum twice. He is now appealing his position to the Refugee Appeals Tribunal. Garda Catriona Savage said that the first time Udeh applied for asylum he said he was a Christian coming from a Muslim country. The second time he claimed he was a homosexual coming from a Muslim country. In a victim impact report read to the court the woman, who cannot be named, said Udeh “violated” and took “complete advantage of her” She said she felt like she didn't want to live after the rape and that she had nothing to live for. It put severe pressure on her relationship with her partner and it was only through his patience and understanding that the relationship survived, she wrote. The woman wrote that she felt Udeh has given all black men a bad name and that she was now afraid of black men. She said she won't get into a taxi now if the driver was black. “I feel he shouldn't be allowed remain in the country,” the woman added in her statement. Gda Savage told Tara Burns SC, prosecuting, that the victim, who was in her twenties, was out for the night in the city. In the early hours of the morning she was outside a pub and got chatting to a group of men, including Udeh, who were smoking. She said goodnight to the men and was about to leave when Udeh offered her a lift home. The two then walked to where Udeh said his car was. The woman said later that the next thing she remembered was being on the ground with Udeh on top of her with his trousers down. She shouted “stop it” and “get off me” but Udeh raped her. He did not wear a condom. A local man was leaving work late when he saw Udeh and the woman and heard her shouts. He shouted at them causing Udeh to get up and flee. The man and a taxi driver gave chase but lost Udeh. A female passer-by came to the aid of the victim and gardaí were called. They tracked down Udeh to a hostel near where the men had lost him. In interview he denied any sexual contact with the woman but this was contradicted by the forensic evidence. Defence counsel Mary Rose Gearty SC said that he had written a “short and genuine apology” to the woman. Gda Savage said that she didn't think the victim would accept this. A Nigerian father who was convicted of beating his 12-year-old son to death for not doing homework, has been sentenced to 10 years in jail. ZA, 37, will be deported after serving his sentence. The man rushed his son’s body to hospital one day in April last year telling doctors that he had given his son milk and the boy took ill after that, complaining of stomach pain and vomiting. Meanwhile, the boy’s private tuition teacher, Pakistani, 52-year-old GI, claimed that she had seen bruises on the boy’s face and body several times. She said that the boy first evaded her questions but later revealed that his dad beats him and added that one day the boy pleaded with her to help him in a subject that she did not teach him. The boy claimed that if she did not help him solve the math, his dad would beat him, the teacher testified.
The boy’s situation was discussed at a school meeting and the father was summoned. He, however, told the supervisor that he wanted his son to excel in his studies because he spend all his money on his education. The security guard at the building also testified that he had one day heard screams and on checking found the man pushing his son underwater. When he intervened, the man allegedly dismissed him saying he was teaching his son swimming. CCTV footages revealed the dad taking the boy to swimming pool when no one was there and he had a stick with him. The watchman also recalled seeing bruises on the boy and one day he caught the boy with a swollen forehead. The father confessed to police that he beat up his son with a wooden stick or shoes or punched him. Allegedly on April 18, the father received an email from the school about his son’s low performance. “I punished him and prevented him from going out. I asked him to stay at home and do his homework. He was being careless, so I slapped him in the face, but he continued drawing in his book. I got angry and beat him up and then again asked him to do his homework. Then I gave him milk and asked him to continue doing his homework. However, he started vomiting, and told me that he had stomach pain,” the man told police.
“While I was in the kitchen, I heard a sound. On looking I found my son on the floor. I took him to the bathroom and then asked him to clean up. But again in the bathroom he fell down. So I took him to hospital,” the father added. He said he took the boy to hospital at 10.30pm but records show the boy was in hospital only around midnight. He was declared dead on arrival at hospital.
DNA tests reveal that the boy was not his biological son. Police found blood vomit at home. They also found an iPad that the boy used, through which he had sought help online. A sentence reading, “Help, I got hit on my stomach,” was found on the iPad. Post-mortem revealed that the boy died due to internal bleeding. His intestines were also damaged. The man had denied the charges of pre-meditated murder.
