It's okay for your husband to invite you and it won't affect your immigration petition. However, it is difficult to overcome the presumption that you're an intending immigrant and be granted a non-immigrant visa when you have a pending immigrant visa petition. It's not impossible, but it's difficult.

However on checking my status it says administrative processing. It went from ready to administrative processing. I was wondering if the passport photographs had anything to do with it. I'm not in the office, so I can't check on this case specifically. You might want to call the collection center before you make the trip out there; or to send us an e-mail at LagosIV@state.gov asking if the visa has been printed yet.

It's up to you. Applying for a non-immigrant visa won't affect your immigrant petition in any way, so whatever you choose, you know you have the immigrant visa waiting for you.

Please I would like to ask you what advice can you give to us newly wed young couple(married at one of the NY city halls in June) in our mid 20s my spouse who is a 24 year old U.S Citizen. We are presently studying in college in Germany with two more years before we graduate. We are both planning to move to the US permanently after when we graduate(in late 2016) by then our marriage will be over two years old. We would like to know what class of immigrant visa would be suitable for me who is not a US. citizen? When is the right time to file for me? Is it possible for her to file for me while still studying outside of US? Also is it possible to sponsor me without haven't paid US taxes since 2009 she's been away from the US and being a student(a tax waiver)? if not what are the alternate ways of doing it the right way please help us.

I'm afraid I don't have any update for you. But making another inquiry won't hurt your case at all.

Sorry another question. My husband is so afraid of me writing to the embassy for this update because our letters state to not contact you until after our 60 days. Will asking for this update now really not affect the process of our AP. I am trying to be patient, but to be honest I have waited for almost 2 years now. We will be celebrating our 2nd Anniversary on Dec 28. This seems so unfair we have done everything the legal way and we don't even know why we were put in AP and receive no information regarding our case. I am just wondering are they doing anything with it all or is there a line that these case go in and sit until they are chosen, as if we are applying for another stage? This process is hell and I am now on antidepressants and antianxiety medication to attempt to get through this process. Honestly, I have never been a patient person and I am trying, but this is hell and I miss my husband every day and he misses me too. Is there any possible chance he could be here by our anniversary or is that not even a possibility so that I can prepare myself to get through yet another Christmas without him. Hello VO... good afternoon. I was supposed to go for the OilComm Conference in Texas so I went for interview on the 21st of October 2014. I was surprised when the person that was supposed to interview didn't do what he was supposed to do and just refused me without no explanations or questions. The only question asked was my ID which I gave him and that was all. I was a bit confused but just got to comply. Why do you think I was refused even when my intentions of going for a conference was very clear?

Also, I will be going for visitation next year with my wife and kids... what chances do I have and what will be the requirement for a family visa? Although I've traveled to South Africa before but as a single man and not with family. I will like to know how to fill forms and what will be the documents that will be attached with my kids passport since they are just 3 and 2 years respectively. I will really appreciate your response.

It depends if it's an F2A for a spouse, or for a minor child. Be prepared to submit such documents as the petitioner's proof of LPR status, birth certificate, and affidavit of financial support, and for the beneficiary, birth / marriage certificates, medical report, police certificate, other documents as advised by USCIS.

It depends what evidence you submitted, but it's closer to success than if you had not responded to the request for evidence at all.

Your visa category is CR1 if you've been married less than two years, IR1 thereafter. In both cases, your spouse should file the I-130 on your behalf. The CR1 will convert automatically to an IR1 when you've been married two years (although you may have to remind the interviewing officer to check that!), so no worries about needing to file a separate petition -- that's not necessary. Technically she should be residing in the U.S. when she files; considering the current USCIS/NVC processing time, if she has any sort of address in the U.S. she can use as a contact address, she could file maybe nine months before you plan to relocate to the U.S. At the time of your interview you'd have to show either that she has already reestablished residence in the U.S., or that she plans to do so with you.

It sounds like you'll need a joint sponsor to provide an affidavit of financial support. That's the I-864 from the joint sponsor, the I-864A if he or she is married, and the most recent three years' worth of tax documents.

In addition, if you were issued a CR1 visa and upon entry into the USA your marriage is above two years your status gets bumped to IR1 and you qualify for a 10yrs permanent. However you get a two years conditional if its the reverse

My wife is a US citizen, we already had a two years old son in the marriage and d boy is living with her In US and she's filing for me via USCIS/NVC. Sir, the issue is that i was in two failed marriages that produced no children. The first marriage was to a lady that won US Visa Lottery, we adjusted our status to accomodate both of us but unfortunate the lady died of ghastly accident before our Visa interview at the US Embassy, so we did not enter for interview at all and i had to remarried a year and two months after losing my first wife and fortunately, My second wife's Brother involved my her in US lotterry before we met and she won alone and we had to adjust our status again to include both of us but unfortunate I caught my wife in the act of fornication at the death hour and she ran away and abandoned me and up till now i never set my eyes on her and based on this i didn't enter embassy with her for interview but i learnt she entered alone on my surname with her other names in the International Passport and she was refused and this was an incident of 2007/2008, there's no children in my two previous marriages and i didn't enter US Embassy at all for any interview and i have never apply for any Visa to any another country not even once except the one i narrated. Sir, so this present one is my third marriage and to a US Citizen, hope my previous marriage ll not affect my forthcoming Immigrant Visa Interview at US Embassy though i have documented Death and Divorce certificates to support my previous marriages. And my interview is fast aproaching, kindly advice me on what to do. Thank you sir.

Yes, your sister can file for you. I haven't heard that the recent executive order will affect sibling petitions, and the order has not yet taken effect. You can track information about the executive order at http://www.uscis.gov/immigrationaction , which begins:

Executive Actions on Immigration

On November 20, 2014, the President announced a series of executive actions to crack down on illegal immigration at the border, prioritize deporting felons not families, and require certain undocumented immigrants to pass a criminal background check and pay taxes in order to temporarily stay in the U.S. without fear of deportation.

These initiatives include:

•Expanding the population eligible for the Deferred Action for Childhood Arrivals (DACA) program to young people who came to this country before turning 16 years old and have been present since January 1, 2010, and extending the period of DACA and work authorization from two years to three years

If I hear anything concrete about this point, I'll let you know right away. But my guess is that any petitions filed before the initiative takes affect will be processed to conclusion.

As you can imagine, we saw many fraudulent Diversity Visa marriages that "ended" in fatal accidents and last-minute divorces because, at the last minute, one or both of the applicants lost courage or had a disagreement with the visa tout. This means that, unfortunately, people who have experienced real tragedies sometimes have to wait while we verify their documents and check their stories. What it boils down to is that even if someone had been involved in Diversity Visa relationships that were not bona fide, what we will be concerned with in future interviews is whether the beneficiary really is married to the present petitioner. If the current marriage is bona fide, eventually a visa will be issued (as long as the beneficiary has no permanent ineligibilities for something unrelated).

Given your history (marriage to two Diversity Visa winners who added you to their cases AFTER they won), it is likely that we will look at the bona fides of your third marriage very carefully. But if it is a bona fide marriage, I wouldn't worry.

Advise on possibility of a US sibling visa application being approved in less than 10 years. A friend told me she knows someone whose case was approved in about 5 years. She did not state if there were any special circumstances that qualified the individual. Just that repeatedly checking the status makes it get processed faster
