I would like some advise with regards to the financial requirement evidence, apologies in advance for the length of this wink


I recently got made redundant from a position where I was employed from April 2006-September 2014 (8.5yrs) with a salary of £19300pa

I secured another job immediately to then start on 10th November 2014 and before starting I spent some time in Lagos with my then fiancé. This job was a lower salary of only £17800
Then in December 2014 my former company had an opening for another position with a salary of £18400 which I took, and I re-joined my former company (after getting redundancy pay grin hehe) and employment resumed on 5th January 2015 and I have managed to get my salary increased to £18826pa so finally I am meeting the minimum requirements wink

My question is I have also been doing overtime, does the 6 months’ payslips all have to be minimum of £1550 or can some be lower as long as the average meets the minimum, my gross pay for last few months are as follows: oldest first

1. 28th Jan 2015 £1416.10
2. 28th Feb 2015 £1533.33
3. 28th March 2015 £1431.75 ( Travelled to Lagos again In March which was when our wedding was)
4. 28th April 2015 £1493.33
5. 28th May 2015 £1763.97 (this includes new salary and overtime and incentives)

Forecast based on new salary:

6. 28th June 2015 £1568.88 minimum possible (overtime worked £320.00 to be paid in July)
7. 28th July 2015 £1888.88 minimum (inc overtime worked already in June)

So can I use payslips from February through to July which totals £9680.14 giving me an average over 6 months of £1613.36 per month, can i use this or will i need to wait for another 3 payslips? I have all other documents, photos pre and post wedding, transcripts of all communications, marriage cert and employment contracts and so forth, just this needed and the relevant bank statements and upto date letter from my employers.

Hi Karen,
from what I know you must make the minimum requirement a year before you reply so let say you apply July 2015 with no children dependants, the pay you earned beween July 2014 to July2015 should be at least £18,600 .

ok my P60 states ive earned over £20000 so this is sufficient?

I located this online, so I thought since i have always been in a Salaried job and still I am, and I will have been back at my former company 6 months come 5th July 2015, that I would only need to supply 6 months, and only require 12 months if i have not been in my job for the minimum 6 months

Where the applicant’s partner (and/or the applicant if they are in the UK with permission to work) is in salaried employment at the date of application and has been with the same employer for at least 6 months prior to the date of application,they can count their gross annual salary towards the financial requirement. In doing so they must have been paid throughout the period of 6 months prior to the date of application at a level of gross annual salary which equals or exceeds the level relied upon in the application

what I'm confused on is my overtime pay, since this is not salaried, it is extra on top, plus my salary is made up by the following:

Basic salary: £16426pa
Night rate : £2400pa
total: £18826pa

plus I get commission and overtime every month which differs month to month.

because I always work nights this never changes, as I work for Citibank (US) servicing Australia, UAE, Bahrain and Middle East, however my job is located in the UK shocked confusing I know lol

I have been researching for weeks now and keep getting so many different info - thank you again

I got the following email from sheffield today.

mate if she is not contesting then wait for decree abosulte which is six weeks and 1 day from date of the nisi for you to apply to the court for the absoulte , which takes five working days . also read below from UKBA

DIVORCE IN THE UNITED KINGDOM
The only valid way of divorcing in the United Kingdom and Islands is by obtaining on application a decree from a civil court. A decree nisi is the court's decision to grant a divorce provided that nothing comes to light which may alter that decision within the period of time specified on the certificate. If nothing comes to light, a decree absolute is then issued. A decree absolute is the only acceptable evidence of divorce.
As a foreign embassy, high commission, consulate or other diplomatic premises are for legal purposes regarded as being inside the United Kingdom, a divorce obtained from any such premises in the United Kingdom is not valid here.

Not any longer no as I used it to move house ( as i was living with my elderly father and looking after him) , so I am back to square one on the savings front, so I have restarted to save.

I really don't see you having problem with this, they are looking at your annual earning and not monthly. The fact is that you earn more than £18600 per annual and that is what matters.

Your explanation here is also very good as it gives a clearer picture of the situation, try and do the same in your application form.

Indeed, I'm online researching all the time on immigration issues, I did vote Labour, unfortunately the Tories stayed in so no sign of the minimum requirements changing for the better anytime soon.

I hope my hubby can apply about September so we can make sure we have everything in order, our marriage is very genuine and very lucky i am to have such an amazing man to call my husband...Mr & Mrs B all the way no matter what challenges we face.

I have been reading through this forum for sometime before registering, I will surely return my knowledge to those in the same situation.

I lived in Fratton, Liverpool Road few years back, my apartment is in Havant now a bit further out as its better priced, and bigger than central.

Did you go to Portsmouth Uni?

My next door neighbor, I myself am about to finish a night shift at 11am ...knackered now crazy hours here, back in at 11pm tonight cry been working 4hrs overtime on the end of my normal 8hr nights will be worth it in the end though smiley

Nope not at all, luckily I drive so don't take too long to get home, I will do all that it takes to get my hubby here, Only then I can relax, I have always worked some strange hours though, worked nights for about 9 years now kinda used to it.

I have to prepare to hand over now, so have a blessed day, and good on you for being such a lifeline for all on this forum, amazing things you do.
